K-1 Fiance(e) Visa Process & ProceduresCHECK MADE OUT TO USCIS INSTEAD OF HOMELAND SECURITY

They stamped over USCIS and cashed it 8/3 and it cleared 8/4! Yahoooooo!
Where on the check do I find the case number?

They aren't putting the case numbers on the cheques anymore, you'll have to wait for the NOA1. Should be any day now, though. Congrats on filing!

K-1 Fiance(e) Visa Process & ProceduresNOA 1 did not arrive

hahaha definitely.. :D do you guys know anything about case number to check the status on your visa???? i hope im not mistaking i read somewhere on here that it says it on the check ??? or do i have to wait for NOA#1

They're not on the back of the cheques anymore, now that Texas does the fee intake. Gotta wait for the NOA1. Ours came 2 or 3 days after the cheque cleared so it shouldn't be too long now.

My fiance texted me the case number when he opened it, but he made a typo so of course it didn't work and I was FREAKING OUT until we figured out it was just a typo, haha.

thats awesome :) our check was cashed today :D hahah at least i dont have to check my bank account 100000x a day hahaha ...feels much better :)

Now you'll be checking the USCIS case status site 100000x a day, haha.

Our cheque was cashed!!! I'm waiting for my fiance to text me back and tell me if it was cashed yesterday or today. FINALLY!

For anyone wondering, CSC received the petition the morning of June 28.

Anything yet? It's been two more days and my check still hasn't cleared...it's been nearly six business days.

It's 9 business days for us (including the holiday, so actually 8) and nothing yet.
JlovesAFemaleCanada2010-07-08 14:37:00
K-1 Fiance(e) Visa Process & ProceduresNOA 1 did not arrive

This is frustrating. I thought the check clearing/NOA1 was the quickest part of the process. If even this is taking weeks that's not a good sign for the coming months.

Oh and a random question. How does everyone know their NOA status before getting the receipt number in the mail? Is there a way to check on the application before receiving the NOA1 hard copy?

I agree...this used to be the fastest part of the process. Things have slowed right down.

Before the transfer to the Texas lockbox, the service centres would stamp your case number on the cancelled cheque, which you can check if you use online banking. The Texas intake centre doesn't seem to be doing this, so we'll have to wait for our NOA1. Tough break, it's so annoying.

Well they have been pumping out NOA2 in 30 days and less...try not to get too bent out of shape, not all of us will be so lucky. :P

Our package arrived at CSC on the 28th and the cheque still has not shown up on my fiance's bank account. You're not alone. :P

Also, your tracking information is correct. It only shows the city and zip code where it was supposed to be delivered, not the address. If it further makes you feel better, I've seen that "signed for" name on tons of people's tracking info for CSC.

K-1 Fiance(e) Visa Process & ProceduresHow did you decide on a K1?
Same reason as everyone else...didn't want to be apart for our first year of marriage.

I quit my job to move within a 2 hour drive of my fiance so that we could visit more often. And although it's not necessarily true, I feel more comfortable telling a border guard I'm going to visit my boyfriend rather than saying "husband." I would be more paranoid about being denied.

Also, since the K1 is supposed to be faster, we wanted to be together as soon as possible.

Not to sound too pedantic, but writing voice certainly does have tone: That is how a good author conveys particular emotions in a piece.

Thank you for saying what I wanted to say but couldn't because I probably would have used a harsher "tone" (if such a thing exists).

K-1 Fiance(e) Visa Process & Proceduresundercover agent spams?

that doesnt mean i said im going lie
the original post was about me asking whether or not they will check for paperwork IF i ask them to move the interview date due to him being active military and the possibility of him getting deployed.
i didnt word it,as well as i should have and just did, came out as if i was gonna lie when in fact with deployments its a hit or miss.
thats why i got so scared when i got this message

better yet why would they send me this message about four hours after they made this account?
i just wanted to check, because they mentioned that i will have my interview in ankara, that made me not think about the possibility of this whole thing being a spam or scam

Okay? Then why are you taking a tone with me? I never said whether I thought you were lying, I was just replying to what you said. No need to get defensive.

Having no issues at the border...but I'm also a govt employee...lol
Thanks so much for telling me I can visit....that changes everything!

Yeah no problem. Are you a federal government? I used to be, but alas, I gave it up to move to Sarnia so I could go to Ann Arbor whenever I wanted (I lived in Nunavut before).

I'm sure you're familiar with the do's and don'ts of talking to border guards, but if they ask you if you work, I would definitely say "yes, I work the government." Because at least they know it's not a job you're going to f**k from, you know? haha...like McDonalds or something like that.

K-1 Fiance(e) Visa Process & Proceduresapply for k ? but work in canada
Yes, there is no law preventing you from visiting him. Lots of people waiting on K1 and CR-1 visas visit all the time. You may or may not be asked to show "ties" to Canada. Ties are things such as letters from your employer, copies of bills you pay (rent is a big one), things like that. Things that would make you need to return to Canada, to prove you are not going to stay. I am in the middle of the fiancee visa process and I visit A all the time. The border guards don't bother me. I have a Nexus card which makes it 100x easier. If you don't have one yet, I highly recommend it.

K-1 Fiance(e) Visa Process & Proceduresapply for k ? but work in canada
Ah ha, you are in the situation I wish I was in!! I'm in Sarnia and my fiance is in Detroit, but I'm hoping to get a job in Windsor and keep it after I move.

I already applied for the K1 so if I do get a job in Windsor, I'd still have to stay in the states for 2-3 months after we get married while waiting for the green card. Then I would be able to drive back and forth. For the K1, your work would have to let you take a potentially 3 month long leave.

I think CR-1 (married visa) is your best bet. You'll have to live in Canada while the visa is processing (you can visit) but you'll get your green card shortly after you move to the USA so you can immediately go back and forth to work.

Good luck...is your fiance right in Detroit? Mine is in Ann Arbor but grew up in Dearborn. :) Add me as a friend if you'd like, it's always nice to meet more future Michiganders.

My suggestion is to try and send it again, but this time include a copy of the rejection later and your reply to it, stating you did actually do what they're asking. Point out it's on a continuation sheet as per USCIS regulations. I would make sure you have all of that (with the conjunction paper) on top of the rest of your papers, where it's easy to see.

Gee, that's pretty incompetent of USCIS.

A good place to frequent after you send in the package is the Case Filing & Progress Reports forum: http://www.visajourn...ogress-reports/

You can join or start a thread for September VSC (Vermont Service Centre) and that way you can be in contact with people with similar file dates. Also, make sure you keep an eye on Igor's List: http://www.visajourn...tion=2&sortby=2 to view the recently approved petitions. It'll give you a good idea when it'll be your turn!

Good luck and congrats.

K-1 Fiance(e) Visa Process & ProceduresMarriage
You can get married the same day he does his POE. There is no need to wait, unless your marriage license requires a waiting period (as most do). But you will need to look into your county's regulations for that.

Edit: if you have your marriage license in hand when he POE's and you have waited the waiting period (usually a few days to a week) then literally, as soon as he steps foot onto American soil (after customs of course!) you can marry.

K-1 Fiance(e) Visa Process & Procedures6 Months til we get married-K1?

Exactly, thats why i said her comment is not true about leaving CSC black hole and getting the visa faster. Because she doesnt know the issues with montreal and just because you leave CSC it does not mean that it is faster for everyone after that. Consulats are different and montreal has been badly backed up lately. - edit the Original Poster of this question IS from canada. and is having the interview IN montreal.

I think one of us has misunderstood...someone else told gap1 she is out of the black hole after NOA2 because she's in the UK. The discussion had nothing to do with Montreal...at least, that's how I understood the conversation.

This isnt true because montreal is a black hole lately. They even have a DOS team there to fix the issue with a bunch of peoples visas that were told they printed but were never printed.

Gap1's fiance is from the UK, not Canada. :)

K-1 Fiance(e) Visa Process & ProceduresIs it OK if fiance's address on I-129F differes from current address on G325A?
Well to add some experience to this, I used a PO box for 4 years. On my petition documents I didn't list the physical addresses, just the PO boxes. I also put a different address than where I was currently listing as I was about to move. I explained it in the cover letter and I'm not too worried about it.

K-1 Fiance(e) Visa Process & ProceduresIs it OK if fiance's address on I-129F differes from current address on G325A?
If I was you, I'd just list the parents' address as the most recent and current address on the G-325A and on the other documents. It'll be less confusing that way and other people do the same when they either can't receive mail or somewhere or don't want it going to a particular address.

If you choose not to put it on the G-325A, I would definitely explain it in the petition cover letter. I don't know if I would trust just doing that, though. I'd just put it on the G-325A...

K-1 Fiance(e) Visa Process & ProceduresWait times at CSC for I129(f)
They told you April because that was 5 months ago; their processing goal. As far as USCIS is concerned, they want you to believe the average is 5 months. Realistically it's usually less but USCIS isn't going to tell you that.
JlovesAFemaleCanada2010-09-26 16:20:00
K-1 Fiance(e) Visa Process & ProceduresJust wondering...answer please!

Thanks!!! I think our best bet it just to do the K 1 visa. I just miss him and was hoping for a quicker way!! It's been 1 year and 6 months since we've seen eachother.

Probably not an issue, but you need to file within the next 6 months. USCIS requires that you have met in person at least once in the past 2 years. It doesn't matter if you saw each other a million times before that, it does have to be within the last 2 years.

So hurry up and get the paperwork in. :)
JlovesAFemaleCanada2010-08-01 09:14:00
K-1 Fiance(e) Visa Process & ProceduresFiance letter of intent question
I don't think USCIS is really reading them thinking how much effort you both put into them or is judging your creativity. It's just the fact you said you will marry each other and you signed it. Just imagine how many people here have used the same letter, the one from this website. USCIS doesn't care, it's just business. :)
JlovesAFemaleCanada2010-09-30 16:28:00
K-1 Fiance(e) Visa Process & ProceduresOnce you have filed for your fiance visa...

You're welcome. :) You have to remember, the 5-month wait is average waiting time...for some members, the wait has been longer than that, and a fraction of them receive an RFE late in their process (kinda frustrating when you've been waiting that long then the first piece of news you get is an RFE...not pretty).

Even more interesting, the feds announced fee increases on some of the applications, effective November. I-129F fees, however, will go down from $455 to $340. I-485, I-765, I-131 and biometrics fees will go up. Makes you wonder how that will affect application volumes as a whole.

In the meantime, let's hope none of us get any RFEs :)

Actually, 5 months is the "official" timeframe to be approved/denied...if you look at the historical stats on this website, you'll see the average is more like 90 days. 5 months is what USCIS "guarantees" to have you approved/denied by, it is not the average. Simply looking at people's timelines disproves the 5 month theory...

K-1 Fiance(e) Visa Process & ProceduresOnce you have filed for your fiance visa...
From what I've noticed looking at people's timelines, they usually happen no earlier than 2 months into the wait. I can see why you would assume you'd get RFE'd early on as that actually does make sense, but in reality, your file sits on a shelf for awhile before anyone looks at it. So that usually takes a few months. Of course, there are always exceptions but 2 months seems to be the norm.

There are probably 5 threads going right now about this. You should get in the habit of checking Igor's List (click Immigration Timelines at the top of the page) to see who is actually getting approved right now. The VJ estimates are based on user timelines and therefore aren't always accurate. Also you may want to check out the K1 Progress Reports forum to see other people's progress.

At my N400 interview, they had all the envelopes we ever sent petitions in (I-751, I-90 x2, N400)... don't know why they keep them, but they're in your file.

That is interesting, I never would have guessed that.

K-1 Fiance(e) Visa Process & ProceduresCan the beneficiary be the petitioner?

Like I said, it was just my opinion :)

Yes it is your opinion but it doesn't correlate with the facts. In all likelihood, the envelope your petition arrived in is immediately thrown out. It wouldn't make sense for USCIS to care or observe where the file was sent from, considering lots of Americans do travel and probably do the forms with their fiance in the fiance's country. Or even if they're on a working holiday or something.

If you've ever heard of someone being hassled about what country was on the envelope, maybe I will change my mind. But I've been on this site for awhile now and have never heard of that. The process doesn't need to be made more complicated by paranoia.
