K-1 Fiance(e) Visa Process & ProceduresMeeting in a few days - but birth cert problem - Need advice please
Hey Andrew,

in my own experience, your problem isn't as big as it seems to be. When I had my interview last year in Germany, I did not know that I had to bring proof of my army service ... or maybe I just forgot. :whistle: Anyhow, when the officer noticed that I didn't have that last document, she gave me a so called "Pending Worksheet" with a checklist, address, fax number etc. on it, but she still continued with the interview.

I was supposed to send them the missing document as soon as possible, by fax or email. So after I came back home I collected everything I needed and sent them a fax. Unfortunately for me, somebody at the consulate did put it on the wrong desk or so, because they couldn't find it after I called in order to make sure that they got it. So I sent it with a registered letter in order to get proof about the delivery.

But anyhow, after some more phone calls from my fiancee, I finally had my visa in hand. And what I'm trying to say with all that is, that you probably don't have to worry about your birth certificate. The worst thing that can happen is, that you have to wait some more days, before you have your visa in hand (depending how soon you can send them the "long" birth certificate). I just hope for you, that your consulate keeps better track of their paperwork, then my did. :D

Just updating my information ... MY CARD GOT ORDERED TODAY!!!

At least I received an email informing me that a card has been ordered. So it took them almost exactly 10 months to process my application .. but I guess there is no better way to start the new year than by knowing that it is finally done and over! smile. smile.gif

Removing Conditions on Residency General DiscussionI filed my I-751 ... any suggestions?
Hello to everybody!

I haven't posted here for quite some time ... but now it's time again. wink.gif

Last week, I filed our joint application for "Removal of Conditions" from my green card. My application was received at Texas Service Center on Friday, 02/29/2008. Here is what I included in my package:

Tab 1: Petition
- Form I-751
- Copy of Marriage Certificate
- Payment for Processing and Biometrics Fee (checks safely attached in a separate envelope)

Tab 2: Green Card, Passports, Airline Tickets
- Copies of the passports (and green card) of me and my wife.
- Copy of our airline tickets for a vacation that we took in December of 2007 (see passports as well).

Tab 3: Beneficiary Designations / Insurances
- Beneficiary designation for my state retirement to my wife *
- Dental Insurance Coverage for my wife through me *
- Beneficiary designation for my life insurance to my wife *
- Beneficiary designation for my 401(k) to my wife *

I also included the following statement:
* My wife is currently enrolled as a full-time student at … University (since 01/2007), working on obtaining a Masters Degree in Public Administration (please see attached copy of student ID card). Therefore, she currently does not have any benefits that can be designated to me.

Existing savings and/or retirement accounts (from my wife’s former employment) have been used to finance part of the costs for going to school and are now exhausted, which makes a designation to me impossible. Of course, once my wife is employed again (with benefits) she will designate those benefits to me, if applicable.

Tab 4: Car Ownership, Car Insurance, Car Loan
- Copy of the title of our car, showing joint ownership.
- Copy of a car insurance notice, showing joint coverage
- Copy of a car loan statement, showing joint ownership

Tab 5: Other Financials
- Copy of bank statements, showing a joint account
- Copy of credit cards, showing a joint account.
- Copy of our Home Improvement Loan, showing joint account

Tab 6: Tax Returns
- Excerpts (copy) of our 2006 + 2007 joint US tax return.

Tab 7: Pictures
- Pictures showing us together with other family members on several occasions (pictures taken in the US and in Germany)

I just thought I would share that with everybody out there who might be interested and will have to file an I-751 eventually. I'm also interested to hear if anybody has some ideas or thoughts about what else I should have included in my packet. Of course, I'm hoping not to receive any RFE's .. but if someone in here thinks I missed something important, please let me know so that I can prepare my documents for eventual RFE's. Thank you!

My conditional green card expires on 04-28-2008 and I'm getting nervous about not receiving any word from TSX or any other service center.

I called today because my cheque was cashed on March 10 and was advised that they have until one month after the cheque is cashed before they will investigate. I will definitely be callling back on the 10th and having them put in an inquiry for the NOA. I was able to get my biometrics number, however, (no appointment, just the number) when I talked to the immigration officer. She looked it up based on my A#. It does work on the website and I am now able to track my file.

You will probably want to do several things: first, obtain a copy of the cheques showing both sides; second, call the Information number and use the selection for 'filed a petition, haven't received a receipt" - when the recorded message starts, press 1 and you will get transferred to a person. Explain your situation to that person and if they don't offer to transfer you to an immigration officer, ask to have that done. The officer can give you your biometrics number. With these two items in hand, and you can probably do it on the same phone call - make an infopass appointment at your local USCIS office. Bring these items along with your passport, your green card, and when you register at the USCIS site, you can also print out the message that is there, to the infopass appointment and have them put the I-551 stamp in your passport. It will revalidate your status for a year and that will satisfy your employer.

Does anyone have any advice or similiar experiences? I know that the TSX in particular is known for not being the fastest (and by saying that, I'm making an understatement), but my employer knows that my green card is about to expire this month and will request proof of extension.

Alright, I guess the "spell" is broken because I received mail that for some reason I did not think I would receive ever. This last Saturday, I received a Notice of Action, extending my green card for another year ... something I should have received three months ago and that could have saved me a trip to my local USCIS office to get a stamp in my passport ... and I received my biometrics appointment.

I hope this will give some hope to the other ones that applied around the same time I did and are still waiting for a NOA and/or biometrics appointment.

I have contacted two congressial aides from my district and one told me to wait until August and if we did not have anything by then to contact their office once again. They told me to go to INFOPASS if we needed the stamp but we did that on April 30th. Personally from the data from VJ and two other sites that I am active with it appears that the few files that were transferred were sent and no transfer notices were set to go out from TSC/VSC and that the files were moved and maybe not completely entered in the system to trigger them to issued BIOS. Only a select few of us got this treatment and I even researched to see if we were all K1 or CR cases and it appears we are all a mixed lot.

Also, VSC is sending multiple BIOS out now to a few select and from my research even some of the older transfer cases are getting NOAs once again. Just make sure you have your 551 stamp to show proof that you are in legal staus now is my best advice since we have a limited or no paper trail.

We are thinking about involving our congressmen as well but I guess we wait for another while ... until August as you said. And then we will see. Anyway, thanks for your research and I'm looking forward hearing more about what you can find out.

Well, seeing the time lines of everybody who filed after us makes me almost depressed ... it seems that almost everybody who filed after February 2008 already received their Biometrics, while most of the February filers are still waiting for it. Does someone here have any idea why that is? My online status said that my case haven't been touched since 03/18/2008, which is the day I got transferred to VSC. Not even after I had my Infopass appointment on 04/25/2008! Sorry, just needed to vent a little bit about my frustration.

Hey folks!

I had my Infopass appointment last Friday in order to get the stamp in my passport. After driving 3 1/2 hours to get there, waiting another 30 minutes in line, it took the immigration officer only 1 minute to give me the stamp and send me back home, which meant another 3 1/2 hours driving. My wife and I were so angry that we had to waste a full day for just one minute of work! And on top of it, they kept my green card which would expire today. The only thing the officer said is that they got a lot of people lately, requesting the stamp in their passport. But she didn't elaborate any further.

Anyway, I'm good for another year now and my employer is satisfied as well. Now it's time to wait for the next step.

Hi everybody!

So, here it is ... my wife attempted several times to get any information from USCIS regarding my case ... but they refused to give it to her since she is just the petitioner, so we had to wait until I came home from work to try again. After a long wait on the phone, we finally got some information and my tracking number. As it turns out, I got transferred to Vermont as well (I updated my timeline), and of course, I was supposed to receive a notice about it, which, of course, I never received. laughing.gif

But anyway, at least I know whats going on now and made an Infopass appointment for the 25th of April in Louisville in order to get my passport stamped. I will keep you guys posted!

Just a quick update from me ... my wife just called immigration in order to receive some information about our application.
She didn't get the most helpful person. All she told us is that the number of my check serves as temporarily proof for my green card extension (what?????) and that she will put in a special request into the system as of why we haven't received anything yet. She refused to give any information (also no tracking number) or to connect to an immigration officer at NSC. Of course, we are slightly annoyed right now and will try calling again in some minutes, hoping to get someone else.

Thanks for the "Welcome" ... but (as probably everybody else around here) I was always hoping I wouldn't have to "join" a group like this one here. no0pb.gif After all, we all were hoping that our case would be different and would receive an appropriate processing time. But I guess we all learned our lesson at some point while dealing with the USCIS.
