File the I-130[CR-1/CR-2] but don't mention you may be filing for K3/K4. [I-129F]. That way you will have a better option to decide which visa you want.
CRs are MUCH better visas. Cheaper and easier also!

what is a CR 1 and CR 2 and if why are they a better and cheaper visa? sorry if its dumb but i am so new to this i have no idea!

I have a situation like yours & offer the following information based on my experiance from the past 9 months.
If you have not done so, look on V J Forum area to find info on each subject that applies to your situation.
You must file a 130 for each of the immigrants. It is diffucult to determin from what you will see on the instructions but believe you do. This will give them CR 1 visa status. This process can take a long time. The timelines you can find on V J are accurate. I wanted to believe they were not ; they are. I hope you know that there are two agencies involved. USCIS & NVC. They each can take a long time as you will see on the time lines.
My case took about 5 months at USCIS. I now have waited 3 months just to get case # from NVC & still do not have it. The NVC process can take many months to complete after case # is assigned. Be sure you become familier with the flow chart for NVC & prepare to have all info ready before they require it to save time.
Are you aware of the ability to obtain a K 3 visa? To do that you will file the 130 first. Then file the 129F . File them as seperate cases. The 129F will include information on the child which will result in automatic K 4 visa for the child along with the K 3 issued for the parent.
The basic idea of the K 3 is to allow them to immigrate faster & be in the USA to await the outcome of the CR 1. One big difference is a 129 F goes thru NVC much faster & is then sent to the Embassy for review. The 129F requires a 134 form which is pretty simple. The 130 will require a 864 which is submitted to NVC at a later time & is part of the delay because of the timing in the flow of information.
Compare the timelines for each visa type & then decide what is best for you. My suggestion is to file for both because of the timing. USCIS can be very slow & they have a ton of cases now due to the people that beat the fee increase deadline. This has also created a huge backlog at NVC.

You'll also want to compare the costs including the costs associated with adjusting status, $1010 for each immigrant, if they arrive with K3 and K4 visas.

In your case there are three main purposes for the I-130 for each immigrant. One, (for at least the spouse) is required before or at the same time as the I-129F for the K3 and K4. Yes, just one I-129F is needed. The second purpose is that you can skip K visas altogether, and have them arrive as CR1 and CR2. This give them permanent resident status and all that goes with it, on the day they arrive in the US. The third purpose is that in order to complete the adjustment of status after arriving on a K3 or K4 visa, there must be an I-130 approved.

You could file the child's I-130 with the AOS papers, but it must eventually be filed even in the case of a K4.

With the changes now in place, I would look long and hard at whether it would be better to skip the K visas and have them come on immigrant visas, CR1/2. If you decide on the K3/4 route then I recommend filing both I-130s and the I-129F together in the same envelope. It will save you a lot of stress over the next year or so.

wow so much valuable information thank you. i dont know what i am going to do. i need to think! overwhelming all of this. sigh° but so worth it when i can finally hopefully get them here. one more question if i decide to go the k3 k4 route.. do i need to send in 355 dollars twice for his form and his daughter_ or just one price and put them both in one folder?

i do home daycare for a job. but i do not currently have any health insurance for myself as i have been taken off ex hubbys health insurance when the divorce was final.
i have married dirk from germany and beginning soon my k3 and k4 for his daughter. so what i am wondering i always see things about public charges ect. welfare. ect.
but a friend told me it is not wise for me to not have health insurance obviously and i work for self so i dont have any. i was calling to call family health plus which is a program in new york state to help those with no health care insurance. will this be a problem for me doing a spouse visa?? will see me as not able to provide dirk health insurance and deny us??

yeah, that's pretty cool, considering that each page of official notarized translation costs about $25 (here, at least)


last week before dirk and i got married we were told by my town clerk we needed his birth certificate and previous divorce all translated by a professional translator service before she could issue us our marriage license.. i had never thought about that! so we ran to my city and found someone who did it in two days for us. the cost for one small page and two bigger ones... $190 !

but i am assuming you can not use a family member? my mother is from germany as is my husband. she could translate all she speaks fluent english and german but i had thought i read you can not use family members. anyone know if this is accurate?

Frankly, I think it does depend on the actually wording of the custody document but can also depend on what the Consulate requires. That can vary based on the local laws and customs with regard to typical custody arrangements. For China, only the full custody court order was required. Other countries have different customs and family law issues to comply with.

A government certified translation of the custody document is the place to start. Once you have that and any guidance from the Consulate, you'll know your next steps. No need to delay filing though.

hi i am diane and i am married to dirk he is currently back in germany awaiting for me to begin our k3-k4 process. he has a daughter who is five years old. he has main custody of her.. the mother visitations. but the mother hardly ever takes her. its been 5 months since she saw her last. anyway dirk has told me that in german law when the father has laws for the child and main custody laws he can move where he wants with her ect. without the mother having to sign anything...
but from what i read the for the k4 visa the other parent must sign a paper stating she gives permission for this child to leave the country... has anyone gone through this situation or know if this is right? i personally believe this childs mother would never sign not because she loves her and wants her in her life but because she would make things ###### for my husband...

we had thought of that the problem was we had spoken to an immigration lawyer before he came to see what our options were. and he advised us NOT to have him stay after we married because no one would be lieve this was not planned. that was his 3rd visit to me in a years time and i had gone there one visit too. and we had emails that spoke of marrying and maybe some how if immigration wanted they could come and confiscate our computers. to be honest we were not planning on marrying when he came. we had plans on marrying in germany when i visited the next time but then we the week before he left we decided we wanted to do it. and another reason we didnt have him stay was because the week we married we had to get his birth paper translated by a proffessional translator for the town clerk and that later the immigration would find out too. so it was best he not stay. we didnt want to risk him not coming back or being deported. but sometimes i wish we would have taken the risk. we now sit here with him having a court date for his daughter with his sole custody papers ect. and now have hear from alot here that he will need a paper signed from his ex wife. that will never happen. if anything she will not sign it just to piss dirk off. and ruin his chances of coming here. so now i am sitting here getting ready to file k3 or CR1 papers and thinking maybe he will never get to come here now and i might have to move to germany with my children. i am just so frustrated and sad and i dont know if i am coming or going.

oh gooooood!! thank you. i began thinking for this and had fears they would say he overstayed!!!! now i wonder when they will let him back to see me.
he came for the first time in september of 2006. stayed 2 months. went home came back for christmas and they pulled him in a room and asked him questions why he was coming back so soon ect.
then he came back on june 18 and stayed until september 16 of this year.. so the full 90 days. so i think its best he wait 4-5 months before he try coming back to see me!! but when he does come back and they ask him questions and he says he married me the last visit before he left. will they let him in to see me if he has proof he is returning?? examples..letter from his boss with a return to work date, return ticket ect. ? because before he would say he was coming to visit his girlfriend and now we have marry. butttt we married legally. and he left to go home after we married so he didnt do anything illegal...

Well the instructions for medical exam's are part of packet 4 which is sent out after your interview date has been set. However, there is a way around this in that if you contact the us embassy in pakistan, they should provide you with a list of approved doctors. once you go to those doctors they will exam you and give you any vaccinations that you do not have. As far as the criteria for the medical exam, that too can also be provided by the embassy. Hope this helps.

i dont know the laws there when you are a child going in to the school but here you must have certain shots before entering school. so in that case your parents would have to have shown the school record of this. maybe you could get a copy from your school. they keep these for a long time. again however i do not know if your country has this law for the schools. good luck

i personally find that if they deny her that is complete BS. my god when i read some of the people on here and why they are denied i find it very very sad. exspecially considering more then half of america itself is screwed as a country. very very sad. my wishes are sent to you and i hope all goes well. makes me sick that you are suppose to be so honest to immigration but then when you tell the truth they say oh to bad goodbye. its all bs.
