The bolded part is the answer...also "if they leave the country" means permanently before becoming a citizen. Also, as stated above in BaWa's post it will also die out if and when they become a US citizen.

I have run across yet another very specific problem.
My fiance (the petitioner) has a home address, which he may possibly be moving from this coming October (we hope to send in our I-129F application in June). On top of that, he always has all his mail sent to his work address, including his credit card bills. How can we get the USCIS to use the work address for any communication they need (like RFEs - God forbid!). And if he does move, do we need to send a change of address to them, or to the NVC, if it's been moved onto them? It's a tricky issue, I know. I hope you visa gurus out there can help me!


It is best to use the address that will match the information that you will be sending to them during the process. Passport copies, drivers license copies, tax forms etc. There are procedures for changing your address if the need arises.

I remember reading somewhere, I am not sure if it is in the I-129F instructions, that all sheets should be signed and dated. I used two additional sheets to catalog or list all the evidence I submitted for Question 18. I signed and dated both (ALL) additional sheets so please remember to do that.

Also be sure you go to the www.uscis.gov web site to make sure you get the newest I-129F form. They have a new version out that expires in 2012. I noticed this when I was posting an answer to a question from a member that had used an (unfortunately) out of date I-129F from VJ's forms.

02/19/10. 07/30/07 and 11/24/06 editions can be used, no other editions accepted.
As you can see the February revision that expires in 2012 is listed along with 2 other very older versions that they still accept, and I highly doubt that anything on VJ was "unfortunately" out of date. Just because the link sends you to a form that is older than the newest version by no means does it make it unusable.

There is never too much information in Manila...the Phils are a high fraud rate immigration country so you should take as much as possible, it is best to inundate them with so much supporting evidence they have no choice but to see it your way.

Hi, I own 2 small homes both worth about $50,000 and they're up for rent. I get $800 of rent a month for one, and $1100 of rent for the other a month. How do I prove this income? Are the rental receipts enough? What documents should I provide to prove home ownership? Thanks.
This is for the I-130, spouse petition.

...also, I purchased these homes December of 2010, and they went out for rent in 2011, so they are NOT listed on any filed taxes.

I was jobless until January of 2011, now I work and have kept my pay stubs. Can I select "self-employed" and a "w-2" worker? Or do I select one option?


The best way to show these as income are to get copies of the checks from your bank along with your bank statements showing you putting these amounts in your bank account. You will need to provide the paperwork that you got when you purchased the homes, along with the leases or rental contracts you have with your tenants.
If you are referring to self-employed as your being a landlord someone else will need to chime in on that one, I don't think so, this is just considered income from property that you own, remember if you have mortgage on these properties your income is only the difference between what you receive and what you pay out for the mortgage, taxes etc.... Your paystubs and a letter from your job can be used to show your current income.

Sigh....I obviously need to do much more reserch on all of this...Like I said, we never noticed that we would be needing a cosponsor due to me being unemployed...I just figured that since my Fiancé is pretty well off, and will be selling his apartment here in Denmark and taking the money back to the states with him, and also me starting back to work once we get to the states would be enough to show that he will be of no financial burden once there. Urgh, but It's okay...we'll do it this way, whatever works I'll take! :) So, where do I need to go exactly (website) to find the information needed for my mother to fill out,(forms,directions etc) so we can get started on that pronto...You guys have been such a help, I really appreciate all the comments and help! :D

Along with the "we didn't wanna wait for the tourist visa" leads others to believe "so we just filed the fiance visa knowing we weren't gonna get married".

Seems you don't really need any answers because they aren't going to fit what you have already known all this time.

And they won't change. Way to work the system.  

And as has been stated in the past, it's you that makes it harder on others in these processes.

This process is a serious process for some, and those that are just using it to "take a joyride" "test the waters" "drive the car before I buy it", actually harm the process for others.

So don't get your feelings hurt when someone calls you out.

The foreign fiance is the only one that is going to have the interview for a K1 visa.  Check the consulate website and see what it states need to be original document and what can be copies.

Get a letter from your employer stating your expected earnings on a yearly basis, take that with your pay stubs as evidence of the pay you have been receiving.  Usually you can't get IRS transcripts until around May when I had to get them, unless it has changed.  Also, I would submit a letter stating why you don't have past 2 years tax forms.

Even if you are a person who works in a foreign country, and you are a US citizen you are required to file your taxes.

Were you unaware of this or is there a stipulation that says you are not required to do so?  There are some exclusions, exemptions but you still must file.

Doesn't need an address, not for the ones that go along with the I-129F petition, and not for the updated ones that will be needed for the K-1 interview. The format I posted in this thread works. It is not required to put an address or use a formal letter format for your statements of intent to marry, period.
 

 

 

I am not trying to confuse anyone I am stating the fact that the example forms supplied by VJ call for an address, perhaps you should consider the fact that some is actually USING them.  Everyone saying you don't need it when there is one on the form is where the confusion lies.

To add an address or not...what to do...some say do it some say don't.

While it is not REQUIRED, if you are using the sample forms that so many people say to use on this site that show an address, you could go either way.

Since many have passed following the GUIDES and using the sample forms, do what they ask.

If this letter if for filing for approval use the address where you are sending the paperwork, if it is time for the interview at the embassy use the consulate address.

It seems a much more appropriate "letter" to address those that are receiving it rather than making a quick "jotted down note" format.

What exactly is your question?

This form is used for many different types of visas.  You are using it for the K1 visa therefore this question is Not Applicable.  Hence the answer.

Helping isn't needed.  

You either qualify or you don't, they don't look at it and say...he qualifies and look he has even some equity which makes it better.

You could have $1. over or $1,000,000. over the qualifying amounts and get the same answer.

Ok people, just talked to Marc Ellis two times today. He called me back from Ho chi Minch city, wow. He advised me with confident that he did not see any problem with my case (after he listened to my story and the timeline that I stupidly wrote) and that he has helped several cases just like mine ( I felt like a thousand pounds just got off me.) He also stated that the entire consulate knows exactly who he is and that they would know my fiance is one of his client since he will be writing a legal explaination of my timeline and put her name on the list of his client(?) The man sounds confident and knowledgable. Of course he will charge a fee for it. At this point, I am willing to go with Marc since he is over there and ready to step in should my girl gets a denial (even though he does not see it happens that way due to my personal background, job security, and our evidence of the relationship. By the way he said that the way to win is to stop the consulate from sending the case back to USCIS. Ke knows so much about the local culture and why I did what I did (married her in front of her family and friends and filed K1 sine I thought that I was not legally married to her.)

I just want to thank all for your support and understanding and I hope and pray for the wedding in America for both of us.

By the way, he requested that I should be there for the interview even though they, the consular officers, would likely not talk to me.

I think you have made the wisest decision possible under the circumstances.  Marc has a very good reputation in the Immigration circles.

 

His advice to be there is spot on, although they more than likely will not allow you in the interview, they will know that you are there to show support throughout the entire process.

Also ask to have this moved back to K1 process.

My attitude is, when dealing with any bureaucrat in the US, go further than they ask in the first instance in order to avoid any unnecessary delays later.

That said, as I mentioned above, I've got an RFE for the NZ police report despite having already applied for it and it being on the way. In your case if your fiance was over the age of 16 when he was in Thailand then I'd get the report.

And please accept my apologies, it might only be 6 months residence in each place, not 1 year.

He needs to get a certificate for every country that he's lived in for 1 year or more since the age of 16. I just received an RFE for my NZ one (kiwi living in England) because the NZ consulate applies on the beneficiary's behalf for the cert (and the UK follows that practice) and you don't have to get it yourself. You may want to check on the country specific forums if there's anywhere else that does that too.

Not entirely sure if I'm correct, but if an E or L visa is one that you can adjust your status from and your work is sponsoring you wouldn't it be better to go with one of those, marry and AOS than to go the K1 route? As it was mentioned above, you can't work until you do AOS / EAD from a K1 anyway. I think that you can find out which visas you can AOS from on the Department of State website.

I would recommend using XE.com and setting up a trade account through them to transfer your money. They don't charge anything at the UK end and the only fee you'll pay is the US end. They also track the mid-market exchange rate so they probably have one of the best rates around. It would be a good idea to set that up before you leave the UK. It's also a good time to transfer money as the exchange rate is in favour of changing GB£ to US$.

Definitely concentrate on the financial info required (tax return, form, W2, payslips) and having original copies of certificates in case they've lost them. They didn't seem to be interested in proof of relationship - I guess that is what is assessed at the USCIS stage. I took photos / emails etc and they didn't want to see them. Just make sure all of your evidence for support is in order and you'll be fine.

Emailing the embassy is pretty painless - they're quick and efficient with replies, but you will need to call the extortion line first to receive the weekly emailing code. In fact, if you're calling the extortion line you may just be able to request your replacement packet over the phone (but a follow-up email might be a good idea).

Your question about the address: the current address for the fiance is the address that is supplied to London. All further correspondence will be going to the fiance as beneficiary and not the petitioner. It could be confusing to be filling in the paperwork for the beneficiary so it's usually easier if they do it :)
