K-1 Fiance(e) Visa Process & ProceduresK-1 vs K-3 , which is better?
Do the K1 or K3 depending on where you want to get married. If you are both ok with getting married in US then probably the K1 is faster. otherwise you need to go for K3 which seems to be taking longer in most service centers and always include the time it will take to get married before you can apply for K3 in your estimates. That said many people want to get married in their own country and then you may have no choice but do that, discuss it with your fiancee and decide on what's best for you - keep in mind that the foreign family and friends may not be able to come to your wedding in USA because of visa issues and money issues or both. Good Luck

K-1 Fiance(e) Visa Process & Procedures20 year old k1 visa help
You will need a passport size picture of her (and yours also) for filing the petition - so you can take her to a local photography store and do that while you are there. For the G325a - get her to sign all four pages - you will need to send all 4 originals with your petition (you will also need to do a set for yourself). Get some pictures of you two together and with her family and friends if possible. Don't worry about too much proof at this point. Many of us didn't send much and still got approved. Most of all - have a good time - the K1 process can take 4 to 6 months (or longer) so have fun. Good Luck

Like most big organizations - the mail is opened and the check is separated from the documents and cashed as soon as possible (they generally give a matching sequence number to the check and the document to 'marry' them up later. So, the good news is they have opened the mail and started your document on its process but the first step might be its just sitting in a pile with other documents for a few days or weeks. Good Luck

A tax return usually is a form '1040' or one of its smaller cousins - 1040A or 1040EZ. Its generally two pages long or more (if schedules are used) and one generally attaches tax statements from the employer or payers to it - W-2 or 1099. That said - he should also get a letter from the employer (on official stationery - with the company's name etc.) stating how much he makes per month and/or year. Good Luck

K-1 Fiance(e) Visa Process & Proceduresresult of visa expiration
You need to contact an immigration attorney to find out what you can do to stay here or even more important - to stay out of jail. Changing your mind on K-1 usually means you need to go back to your home but I am not sure if there is a way for you to stay here. It's better to go back and not marry if you found that you two are incompatible but it may be very hard to change your status to something else now that you are here illegally or out of status. QUOTE (Roy99 @ Mar 29 2008, 10:12 AM) <{POST_SNAPBACK}>

I sent for 2007 tax transcript today. Do I have to get 2005 and 2006 transcripts too? I would have to send to another state to recieve it because I live in another state the prior years and I do not know if they will come in around the same time. Is it alright to send 2007 transcript with 2005 & 2006 return copies with w-2?

You do not need state copies - just the IRS copies. And you can zerox them and send them if you have a copy from the previous years in your files and yes you should include copies of W-2s also. Good Luck

Yes she has to fill it out in english and any other documents writen in her native language has to be accompanied by an english translation. Goodluck

Incorrect. No she doesn't have to. Nor does she need English translations for all her documents at the interview time - my wife got her K1 in Bogota Colombia and she filled out the forms she got - DS230, DS156 etc. in Spanish - Not in English . Look for the instructions that come in Packet 3 - they will tell you if that particular country requires them to be in English. Good Luck

For K1 you do not need to show any family involvement or approval - neither for AOS nor for Removal of Conditions Nor for citizenship. Its just your and his personal life in wanting to have his parents involved with his wife/kids/life or not. Do not worry about the visa aspect of this - there is NONE. Good Luck

K-1 Fiance(e) Visa Process & ProceduresWhen can fiance return to get kids?
About driving - most states allow you to drive for 6 months on a foreign license but after that it's illegal - so it's a good idea to get the state license soon as possible - usually you will need a Green card or EAD to do this. the driver's license will expire when the green card or EAd expires - so make sure to renew it again if and when needed (using your extension evidence - for example after 2 years green card expires). Good Luck

K-1 Fiance(e) Visa Process & ProceduresBogota K1 rejection- delay Strange reason
My wife's friend went for her K1 interview today in Bogota. She was extremely nervous. Towards the end, the interviewer asked her about the dates on which her fiancee had visited her in Colombia. She told him about the two visits, the second one was in March 2007. The interviewer said the DAS records show him arriving by Delta in February or words to that effect. She said you have thirty days to come back with your fiancee for clarifying this, or else you have to redo the whole thing again. Anyone else had something like this happen? Any advice? Thanks:

K-1 Fiance(e) Visa Process & ProceduresVisa for Chilean
Unfortunately what many people will like to do is not possible to do. Most of us, would like to bring our boy/girl friend over and show them around and introduce them to family and friends and then decide whether we should go ahead with a permanent relationship or not. However, this is not possible in this world - there are too many security threats (real or perceived); too many fraudulent visa seekers, too many money hungry people doing visa scams etc. - this makes the process very hard and very limiting. So, you have a simple choice, do you feel strong enough to marry this person now - even though s/he hasn't been here or met your family and friends and doesn't know his/her job prospects etc.? If yes, then you can proceed with a K1 visa or a K3 depending on where you want to get married and how soon, otherwise you need to keep searching for the 'sure' connection. Unfortunately there is no trial period available for most of us (some do have this option from the VWP countries). Good Luck

I believe that this error is not significant. So just tell them at the interview and give them a corrected form, you should be OK. If you can fill out your signature, profile etc. others can help you more. For Example if we know which country you are applying for - some are more strict than others and people with the same embassy can give you their personal experience. Good Luck

K-1 Fiance(e) Visa Process & ProceduresHOW TO??
Many consulates have their own methodology - Colombia for instance tells people to put their documents in a certain order - this is done as soon as they are allowed inside the consulate. When they are waiting for their names to be called for the interview, they have a chance to make sure they have it in the right order. Once called the interviewer expects to find documents in that order. Some people are sent back to wait again and put their material in order again - this happens pretty much every day in Bogota. SO check with the consulate you are going through or just take your documents in an order that you can sort out if needed or find when asked for. Good Luck

Hey jook: The only thing I asked my fiancee to get translated was her birth certificate - and that was for AOS - for Bogota everything was in Spanish. And, she just paid a notary in Barranquilla less than $5 to make two translated and certified copies of her birth certificate. Don't worry, a lot of people have done the translations themselves and have been ok. Good Luck

The OP, is NOT at the Consulate stage yet. He is filing for I-129F at the USCIS so YES (again) everything that is not in english needs to be translated.

Motu, which documents in spanish did you send to the USCIS when you filed I-129F? If you sent them in spanish you were lucky you did not get a RFE. In the case of the OP, he needs to submit a copy of the divorce decree (that is originally in spanish, so it has to be translated when he files the I-129F), your case was probably different than his.

OP, about your question.. read the format what guatetaliana gave you.

I didn't send my fiancee's birth certificate to USCIS with my petition. It wasn't a requirement then, and I don't think it's a requirement now. (I have helped a friend file another I129 two months ago and he didn't need a birth certificate either - he was approved by the way - he is waiting for his fiancee's interview right now). For my fiancee's interview in Bogota - she didn't need the translated copy either - only for AOS. So, you do not need the birth certificate translated or otherwise at this stage - she may need a copy (in Spanish) for her interview but you do not need to send one to anyone. Good Luck

You can do a fresh I129 and add the 'missed' info and then tell them at the interview what happened and give them the corrected form - many people have done this to correct errors in names/dates etc. I would assume that there should be no real issues - since your fiancee is also submitting or will be submitting police reports. Anyhow, I actually want to ask about the letter of intent. After learning more about the K-1 process on my own (definitely not from my attorney) and reading many posts from this site, it seems that myself and my fiance should have supplied a letter of intent for the petition. My attorney's assistant never asked for this document from either of us. I am still waiting for my NOA2. Do you think it is possible to send in both of our letters of intent with a copy of the NOA1 before a RFE is issued? Will the documents be placed in our files?

Thanks in advance for any help.

Click on Example Forms (Top right hand side of this page) and it has a 'letter of intent' sample that you can use. An attorney is not necessary for this process unless you have a 'tricky' case or do not have time to read up on what needs to be done. Ask specific questions and people will try and help you. Do not send anything unless asked for - it won't get matched up with your file. Good Luck

Hey Roxy: Look into the K3 option also - you will get married in Colombia and she will come on K3 visa. You don't really need anything to file the K1 petition - your proof of naturalization/birth certificate is about all you need, along with some proof of meeting e;g; pictures. Later on - before the interview - you will need to provide sponsorship papers - and I134 and supporting documents; if you do not make enough money then you will need a co-sponsor. Read up on all this in the meantime. Good Luck
