I agree with Mike and Dwar

I'm fed up with the way this process is conducted. If we don't get approved by my birthday, August 21st, I think I'm going to fly to California and start taking names.

IMBRA Special TopicsTo those of you griping about IMBRA
I recall reading that USCIS is being investigated for allowing visas for a good number of people who shouldn't have been given visas. Seems like they need to get their act together in the basic immigration process before they add more layers of complexity to the system. Refine what you've got before you add on more cr*p...

Yup, I saw that, Onyxrev. Excellent!!

I also wrote to someone at the most widely read city newspaper this evening suggesting a serialized story on our situation. I proposed that they track myself and others through this process while investigating all that is going wrong. Whoever it was that said we need to get the media involved...I was already thinking along exactly those lines. If we all got our local papers involved, that would create enough of a stir that we could get ourselves picked up by television reports. That's where the real pressure is...Anybody else with me...? Let's build some more momentum. Time for a little justice where USCIS and especially the CSC is concerned!! :bonk:

Let's do this thing!!

I'm down for making a fuss in the media. In fact, I'm used to that approach! I'll ask my sweetie if she'd mind some publicity...

I signed. I would frankly recommend that we all write individual letters to President Bush and other highly placed people like our senators, congresspeople, minority and/or majority leaders, etc. One letter is all you really have to write...then just change the names and headings. Pretty quick process really. But the more noise we make, the more likely someone will actually pay attention. I have a few other tricks up my sleeve, as well. I'll fill you in soon. The old saying is true, though..."The squeaky wheel gets the grease." If that doesn't hold true at the CSC, then we'll have to go over their heads...I've made lots of constructive, respectful noise before in other situations and come out on top. No reason we all can't do it with this one. It has to stay respectful, though. The minute we start going overboard, we'll be dismissed as rabble-rousers. We have to talk the language of the people in Washington...

The list is getting longer. I wrote my Congressman two weeks ago. USCIS keeps them in the dark also, and there isn't really anything they can do to "push" any of the cases along. I am really optomistic we can get 1000+ signatures...i have a strong feeling if we can get them people WILL HAVE to listen. I know a few people in the news media outlets, as I am sure other people do also, and we CAN DO this.

I'm posting this everywhere it's appropriate and I think people will care enough...

I wrote a letter that's designed to compliment your efforts and am posting it on VJ.

US Embassy and Consulate DiscussionCanadian Direct Consulate Filing - Possible??

Background: been waiting six months for fiancee visa. Sick of it. Looking into Direct Consulate Filing for my fiancee in Calgary.

hi,
Useless is as useless does?

Your answers are in the pinned thread in the DCF Forum titled DCF Canada: Yes Virginia, You Can : USCs Resident in Canada Only
and/or in the DCF Guide.

I didn't really understand your email either, and I do know that asking a Consulate about "DCF" isn't the best way to get the info you want.

Anyway, no. Crossing the border is not sufficiently 'resident' for a Canadian filing; they are NOT oging to open the floodgates (again). Canadian Consulates refused to accept petitions from USCs who really are resident there, for many years.
Word on the street (and the official site, ref'd in the above post) is that you must live in Canada for one year to be elgibile to file there. It's not a drive by Consulate.

I didn't expect it to be a drive by consulate - just was trying to weigh my options. Thanks for the info.

So I guess the only other question I have is whether visiting Canada would be enough 'residence' to quality for DCF...

US Embassy and Consulate DiscussionCanadian Direct Consulate Filing - Possible??

I guess the idea the consulate got by reading your e-mail - and to be quite frankly, that's what I'd have understood too - wat that you were asking about K3, but were confused about it, when in fact you wanted to ask a different question.

According to http://www.visajourn...mp;cty=Montreal and http://www.visajourn...p;cty=Vancouver DCF is possible.

Also: "> I see that, while some countries have the option to apply for a temporary residence visa, the US does not have this option because a passport is all that is technically needed to visit Canada as a US Citizen. Does this entry entitle me to temporary residence status? And does this temporary residence status enable me to then file the I-130 at the Calgary consulate?" - this should be asked to the embassy of Canada in the U.S., since you're asking a question on how the immigration laws work in Canada, not in the U.S.

That's a very good point! Thanks! I had that confused.

US Embassy and Consulate DiscussionCanadian Direct Consulate Filing - Possible??
Background: been waiting six months for fiancee visa. Sick of it. Looking into Direct Consulate Filing for my fiancee in Calgary.

I just got a useless reply from the Vancouver consulate on the subject...

I sent...

> Hello Vancouver Consulate,
>
> I am a US citizen and am interested in information regarding Direct
> Consular Filing of the I-130 petition in Canada. My fiancee lives in
> Calgary and we are interested in marrying in Canada. I have noted that,
> in order to file an I-130, I would need to be a resident of Canada.
> What does this residence requirement technically entail?
>
> I see that, while some countries have the option to apply for a

> passport is all that is technically needed to visit Canada as a US
> Citizen. Does this entry entitle me to temporary residence status? And
> does this temporary residence status enable me to then file the I-130 at
> the Calgary consulate?
>
> Thank you!

And they said...

> You cannot file I-130 petition for your fiancé, you can only file I-130 for your spouse, children and parents. You are required to file K1 (fiancé) petition, please read attached information and you may visit www.travel.state.gov for more information. Thank you.

Um. Thanks? Way to answer the question!

Sooooo. Does anybody here know if that's possible?

K-1 Fiance(e) Visa Process & ProceduresBeen reading for months, just joined...
FYI, this is the letter I just faxed in...

Dear Senator Dayton,

My name is Dan Connor and my fiancée and I have been patiently waiting for
a K-1 fiancée visa for 136 days under petition number LIN-XX-XXX-XXXXX.
I'm sure you are aware that new legislation including IMBRA has caused
substantial delays in the process. Our petition was transferred from the
Nebraska Service Center to the California Service Center because Nebraska
decided to no longer process this particular petition. California has been
seemingly struggling to surmount the additional load and, in the process,
has caused many people desperately wanting to legally marry their loved
ones to resign themselves to being in the dark as to what is actually
transpiring with regards to their petitions. The Vermont Service Center
seems to be able to process petitions in about half the time.

Many of these petitioners share the experience and provide support on the
forum at VisaJourney.com and there are many rumors involving what's going
on. The latest rumor caused by feedback from other senators is that the
approval process is now being prioritized based on receipt dates of IMBRA
Requests for Evidence instead of the original petition receipt date. I
hope this is not true.

It is a difficult thing to have such a bureaucratic process come between
two people who love each other very much and are ready to make a life
together. I am contacting you to make you aware of the situation in a more
personal context and, while I know you are a busy man, I would appreciate
any insight or assistance you might be able to provide.

Thank you very much,
Dan Connor

Hey everyone,

My name's Dan and my fiancee, Sheryl, and I have been wrapped up in this whole debacle just like all of you. I've been reading and observing this forum for several months and decided to finally join and contribute.

We applied for our 129F in March, were transfered from NSC to CSC, and are now waiting for our NOA2.

I have emailed both of my senators to get more information or some assistance, not really expecting anything in response.

At any rate... I wanted to say hello and to share the experience a bit.

We are seriously considering doing this as well.

I think we are done waiting for them anyway. This mess is creating unbelievable hardship for us.
She is just going to come for the 90 days she is allowed and not work.

I just need to find out how long she has to stay in Canada after the 90 days is up before she can come for another 90 day stay.

Fiancee and I get on skype (webcam and voice) daily

Thank god for skype, webcams and the internet. Can you even imagine going through this nightmare without the internet? We would all be freaking out in our own private worlds with zero information and nowhere to turn for help. We just recently got webcams (best money I've spent lately!) and it's a godsend.

Seeing all the recent approvals, I've now moved on to obsessing about how long it will take for our case to get to the consulate in Mexico and how long he will have to wait for his interview . . . never a peaceful moment for me!!!

No freeking kidding, man...

K-1 Fiance(e) Visa Process & ProceduresEver ponder this...
It is a very good question. Personally I don't think it would function as a filtering process for a greater purity of marriages as much as it would function as a splendid training for very explicit communication skills and, thus, would cause a decrease in divorce rates.

Anyone here ever ponder if the average U.S. Citizen marrying another U.S. Citizen had to go through what we go through to marry our soulmates from overseas or connecting countries, if they had to file all the paperwork, had to wait forever to hold their loved ones in their arms again, had to wait for permission from the government to marry. How many marriages would still take place and what would the divorce rate be?

Just a question that I've pondered the past few days. Now that packet #3 has been submitted, the day is drawing near when packet #4 will arrive and my soulmate will finally have her interview. All that I can say is for everyone to have patience and never give up!!! I'm very lucky in being able to talk to Xiang at least twice a day on the phone and being able to see her everyday on the web camera. She is one very special lady that I could never live without, she gives me life, she gives me strength, she makes me complete!!!!!!

Thanks,
Keith & Xiang

K-1 Fiance(e) Visa Process & ProceduresA real CSC phone number...

I'm a recall with a March 6 NOA1, March 31 NOA2. My NOA2 approval expired July 31, and I got totally unsatisfactory email responses from McClellan at CSC and NVC about what effect the expiration has on my case. Receipt of my IMBRA RFE was acknowledged by email July 11. My fiance is desperate as he has lost his job, and his mother is very ill in a third country. He has been holding off going to see his mother until this visa thing gets sorted out, but we're beginning to think there is no end to this delay. It is almost 90 days since he returned his instruction pkt. to the embassy in Paris on May 5, and then the petition was recalled due to IMBRA. If there is any way I can actually talk to someone at CSC with real knowledge of the status of my case, I would be eternally grateful. Thanks!

You got it!

I've managed to dig up an 'emergency' CSC phone number that appears to be genuine. Does anyone else have experience calling this number? I'm a bit reluctant to post it here because I don't know what constitutes an emergency and I wouldn't want to abuse the number's intent. The after-hours message says that a USCIS agent will return all emergency phone calls...

Curious, no? It might be worth it for the few people who have been petitioning since before March and have seemingly been forgotten. What's say y'all?

Actually it does make sense and this is what I expected... they say in their contact info that one should use the processing dates listed to get an idea for the expected timeframe for the petition to be processed. Since NOA1 dates are no longer used for that purpose after the 6th, why would they update the timeline if it's all RFE at this point?

The way things been going, how much longer do you think it's gonna take for them to reach to the July cases? Seems like they are about five months behind according to their web site. But yet I'm seeing many threads claiming that some of the June cases have been approved. If so why aren't they updating their status?

Honestly, it's totally 100% random.

Here's what my senator's office got when they asked about the current timeline situation. The congressional liaison said that...

"Each petition is unique and therefore, worked on a case by case basis."

In other words there is no time frame, just patterns that you can follow if you want to put forth the effort of gathering other people's timelines.
