[font="Comic Sans MS"][/font] Hey Guys! Just wanted to let you know of the experience I just went through.
I'm now with my baby in the States. I flew out yesterday and after reading most of the advice on here, I can tell you, I certainly was pooping myself, with regards to whether or not I'd get through immigration.
I decided to go against the advice on here with regards to luggage, and took three of the biggest suitcases ever seen, as I had Christmas gifts and also Birthday gifts to bring over with me unsure.gif
So already i was a bundle of nerves right? Anyway, it was only myself and my little boy (4).
Flight, so on, fine. Got upgraded to Business Class. kicking.gif
The scary part begins from the time they give out them darn immigration forms on the flight! So the panic set in blink.gif
Now I can honestly say, I have never seen such a long long queue in my life, and i'm English! lol!
Anyway by now my son is beginning to whinge, he's tired, etc...... Really didn't help with the nerves.......geez!
So as usual it's like 3 windows for visitors and like 30 for US residents. Blah, Blah! They then decide to get the other windows to take some of us on, so in all we queued for like maybe under an hour.
My turn came up, and I was absolutely cr*pping it now, I can tell you.
I went to the guy who looked like he really really really didn't want to be there, so you know how that made me feel helpsmilie.gif
Anyway, he just asked the usual questions. ....you here to see your partner? how long have you known him? how many times have you been over?
What threw me was when he asked where my son's father was??? I was taken aback, but of course they had to right, as my son has his father's name?
Anyway, i guess it was the nerves, as I responded, ''he's probably doing his girlfriend''! I got a laugh mind. All the time he was stamping my passport and taking fingerprints, so I reckon he just tried to scare. I did take a letter from my son's school ,and a letter from my boss just in case mind!
So in all it wasn't so bad at all! I think reading some of the advice on here just freaks you out a bit more.
Because i'll go back to the luggage issue, it's advised on here not to travel heavy, but i'm not sure for everywhere in the States, but i know for New York and Chicago and Philadelphia you don't have your luggage with you at immigration, you get that after, so they couldn't possibly see how much luggage you do have, if like me, you really try, but just can't travel light!!! A point my SO commented on when he lifted the first case......lol

Anyways for any of you going over there soon and as nervous as I was, I just hope this helps a little bit.
I mean it's only my first proper day here, and i'm nice enough to share this now, instead of when i got home............lol! What am i even doing up already?
I'll be home in two weeks, so i'll fill you in when i get home..........not everything of course!!
Who needs USCIS touches right now? OOOoooh! Not me!!

you shouldn't have any problems. i'm over with my partner right now and apart from the unusually long line at immigration i had no problems at all. the guy did ask how long i was visiting and how i met my partner, but that was it.

after reading some of the advice on here, i was nervous as heck and was all about to bring just a weekend bag as folk had advised not to take too much, but i took 3 cases for only 2 weeks as i had gifts for the family with me.
immigration dont have to look at your luggage as you go through there before you collect it.

so dont even worry about it. i've been over twice already now.

Hi all!

just a few questions which i know i can find the answers on here, but i'm soooooo lazy. blush.gif

my four year old son and 17 year old daughter are on our application although my daughter is not joining us right away as she wishes to stay here and finish college whilst staying with my parents. my questions are:

do i need to do a police check for my daughter?

do i need to bring them both with me whenever my medical and interview come up?

oh and how come vermont have staff of what seems like 300 and California only seem to have like 5?

You can keep her options open for six months by getting the visa at the same time as mom.

You can keep her options open for a year by arranging a "follow to join".

You can't actually cut off her one year option to follow to join. They'll keep it open anyway.

An adjudicator can move a file to any desk, you know. And it doesn't have to be the one you are hoping for.

I don't know that we can necessarily correlate the one action (calling the RFE line) to a result (administrative review). That would be a severe abuse of power, and probably a firing offense. I'm sure it occasionally happens, but I have to believe, on the whole, the adjudicators are more professional than that.

we had no intention of abusing that line and i can totally appreciate the frustration folk that have genuine rfe's must be going through.

It got to me when we saw folk using it after filing only in January.

We were obviously due around now which is why i guess we got approved so soon after calling.

It is funny though how my SO called for the first time on the 17th of March and we were touched and then again on the 18th of March. Now we have NOA2.

We had not been touched once since October.

Okay this is the posting we followed. It caused alot of controversy on here wacko.gif

But all the same it does work.

The issues raised were mainly because folk were using this trick even though they were nowhere near their processing date. Only use this once it's been say 4 months or more. We did it last week for the only time and it worked for us.

Good luck!

Here is what I did to shake things loose. The keys are to [1] reach a correct person, and [2] speak USCIS's language.

Call 800-375-5283, then hit 1,2,2,4,2,1; enter your receipt number; hit 1,1. (There is no need to wait for all of the recorded options to be read before you hit these buttons.) The recording will almost certainly say that "additional evidence is required," but don't necessarily believe it.

When the phone rings, you should be speaking with an actual Immigration Officer (not a clueless front-line screener who can tell you only what you already know). If the recording said that "additional evidence is required," ask the ImmOff exactly this: "Why does the recording say that I have a Request For Evidence?" He/she will almost certainly tell you that there's no record of an RFE; thank him/her profusely.

Then (or first), ask exactly this: "Will you please tell me exactly where in the Division my file is?" He/she will tell you. Then say exactly this: "I'm aware that several files received after mine have already been approved, and the USCIS website clearly says 'we process applications in the order we receive them.' Will you please send an e-mail to the floor, and ask the person at the ____ station [whatever the ImmOff told you] to please hand-carry the file to the next station?"

The ImmOff will appreciate your "speaking the language," because it is so different from the usual plaintive "do something!" that they hear all day, every day. The e-mail should at least cause one of the processors on the floor to handle your file, and your record on the USCIS Case Status website may soon reflect a "touch."

The procedures that I have recommended are worth it, and you should feel better afterwards. Depending on how long ago you have submitted your application (the longer, the "better"), you can repeat this process every 10 to 14 days.

Do NOT mention that you are part of an on-line community; this is not necessary, and mentioning it could hinder your success. However, feel free to post your stories on VJ!

If you check my timeline you will see that we were only touched twice and that was the week prior to receiving our NOA2.

Two and a half months is really not a long time to be waiting to be touched. unsure.gif In the USCIS case anyway! biggrin.gif

We got our NOA1 way back in October and were approved just over a week ago, so unfortunately, you may still have quite a long wait with regards to being 'touched'.

Just don't dwell on it. Keep checking the timelines on here, they helped me alot, and watching our case move up and up Igor's list was a blessing.

My SO named my daughter on our initial petition as the form stated we were to add the names of all my children under 21 years.

She is not coming with us. She's 18 now and working and has a boyfriend. (I know right?!!) unsure.gif

Anyway once I get the packet 3 do I just omit her from it as she is definetely (spell check) not coming.

Of course she'll come over and visit but as we are part of the VWP she won't have any issues there.

I just want to check that it won't put our case in jepardy (spell check again) geez I'm terrible. lol

Will they still expect me to bring her to the interview/medical?

you don't need to take copies of those forms with you as they have them there, hence the interview date. good.gif

some folk on here take duplicates just in case but it's not necessary as you merely need to sign them in front of the officer.

i had my interview last week and i didn't need them.

I went through a similar fiasco with my K-1 visa petition of my fiance from Lagos. It is a very bad embassy to work with. We were denied in Nov. of 2011, and have been fighting ever since. By the way- we never received anything that looks like the yellow page you have received. The only reason for denial we were ever given was to print at the top of our petition "FOR IMMIGRATION PURPOSES ONLY" . I contacted my attorney (who helped us file), 2 congressmen, 2 senators, the ombudsman in DC, the USCIS, the NVC, and anyone else we could think of that might be of some influence. No one at the NVC, OR USCIS knew what to tell me. Everytime i would ask a question, I would get a different answer. The embassy in Nigeria would not even answer their phone- it rang and rang- not even a voice mail (I got their number from the State website). Since we were getting no answers, (and were being told that they could not locate our paperwork, and could not therefore get a reopening of our case, or a re-interview,) and the time was quickly approaching that our validity period for USCIS was ending, I made an appointment to visit my local USCIS office in Boise Idaho. I took all of our proof, and information (which was not even looked at, at the interview,) to explain our situation, and ask for an extension of our validity period. I was treated rudely by the officer at the counter, and basically laughed at. He said he had no way to extend the expiration date, and told me I was welcome to get more forms and re-file. I found this sooo frustrating. If the embassy is sure that we are trying to "scam" the system, wont we still be "scamming" if we re-file? and- if we re-file and are approved, does that mean that they were wrong with their first denial, and they will refund our money? We have been together for almost 3 years, and it makes me sick that money is keeping us apart. In the world today, it is very easy to meet someone from another country, shouldn't the laws change to reflect an easier way to be with the one you love?? The system is broken. It needs fixed. I want to fix it, but I don't know where to start. I feel your pain, and I have felt it for many years, it never dies, until you are with the one you love. Couldn't agree with you more!!! This whole system just seems so unfair sometimes, I have found it seems to be one rule for one and quite another for someone else. Also some of their rules just seem ludicrous!!! Feels like your banging your head against a brick wall for a lot of people on here I am sure :(

On April 19, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice

Yeah we are going through the K1 process now, just worrying about if it gets denied since I have 5 kids to come with me. Trying to see what our options are if this doesn't work, boy I wish all of this wasn't so hard we just want to be together :(

No I didn't mean it is fraud to marry, but on all visa's needed to marry in the usa or other countries all seem to state that you can't marry on them. There must be one which allows you too?!?!? Like when I went to usa I entered via the vwp and I am sure one of the clauses on that was I must not marry while in the US using that kind of paperwork to enter the country.

I don't get how CR1's are even available since it is fraud to go and marry a partner in any circumstance :/ it seems no matter what way either person enters a any country your not supposed to marry while there :S How is anyone supposed to marry while staying within the law to be able to apply for the CR1?!?!?

I have been trying to follow up on past posts about Dublin being a POE but all the info I'm finding is dated back at least 2 years. I was just wondering if anybody has used dublin as a POE recently and wondered how it went for them :)
