Hi Taka,
I am a Japanese who have been married to American for 11 years , and am in the middle of processing to get a green Card as well.
We have two children and currently they have dual citizenship, US and Japan.
But in Japanese law, when my children become 21 years old, they have to choose either one of the citizenship.
Because Japan doesn't allow to have dual citizenship.

There is a question.
As I read your post, you are already over 30 years old. How do you keep dual citizenship Japan and US ?

I love my kids to have dual citizenship in the future, but currently there is not way to do that legally as far as I know..
I love to have a US citizenship in the future as well if I can keep Japanese citizenship, because I can live in Japan and in US anytime..
I have a green card, but my husband got a job in UK, and we all stayed there over 5 years, so my green card is no longer useable. Now I with my kids and my husband are separated for more than 6 months to apply for the green card again...



I really appreciate if you can advise me on this..

Hi,
My husband filed our I-130 on March 1st, and I-129 on March 31st. But we haven't approved yet.
We have been married for 11 years, and have two children 5 and 8 yrs old.
I saw lots of people who filed on the same time or after us have been approved, but ours has only a few touches, and haven't been approved yet. I started thinking that USCIS is delaying our case on purpose.. I actually had a green card issued in 2000, but since I had to follow my husband to England for 5 years, my green card has been abondoned.
Everyday, I and my husband are fighting, and blaming each other for the reason why it is so slow to be approved.
I and my 2 small children have been separated from my husband (their father) for over 7 months now.
I haven't been back to Japan for over 10 years till now, and our children started forgeting English, and hardly speak their father on the phone. (Because they are not comfortable to speak English now)
Everyday, they ask me when we go back to thier father's and why we can't go back to US. When I check visajourney, most of people are being approved for 3 or 4 months, but ours is in 5th months already..
Does anybody know that if people had a green card before, and the green card became abondon, does it diificult to apply for another one again ?
Everyday, I don't know what to do, and it is causing family problems.. :crying: :crying: :crying:

But I think K-3 is still faster way I believe. We had just a bad timing and bad luck. I believe if we filed in Feb, the things went faster.

Hi,
My husband made mistake on I-129F application. We have 2 children together, and they have US citizenship, but since they are with me in Japan, my husband filled their names out on under " list of all children of your allien fiance" and wrote "US citizen" next to their names.
I believe this is the spaces for applying for K-4.

Since our children are US citizens, we don't need to appy for K-4 visa for our kids.
Will it be a problem ? Since ours is taking so long to be approve in USCIS, I am thinking this is causing us the delay.

Also,
How many of us in March fillers who are applying for K-3 and K-4 are not approved in USCIS, yet ?

There are two type of tourist visas for Japanese. One is for Visa Waiver program which people from some countries including in Japan are allowed to enter US without visa. This is for 3 months.
Another is B-2 Visa, which allow you to stay in US for 6 months for tourism. But I heard it is difficult to get.
Once you are applying for K-1 visa, or K-3 visa or CR-1, during the process, your fiancee (or spouse) can enter US with visa waiver or B-2 Visa. This is not illegal. But since it is depends on the officer , it is too difficult to assume if she will allow to be entered. if she brings the proof of strong tie to Japan, it is more likely approved to be entered. But this time, you should not tell the office "a lie", tell him honestly that she is visiting her husband or fiancee for a short time and make him believe that she will be out of US when the visa is expired (She MUST get out of US no matther what) and bring NOA1 of I-130 or I-129F. That way you can explain him that she is in the process of obtaining those visas.
I myself didn't try this (even my husband is recommending this) because I am affraid if I am turned down..
But I know that lots of people who did this sucsessfuly very recent. Well, I just know people applying for K-3 or CR1 who did sucessfuly. I don't know about K-1 people...
The key is "tell the office the truth"

Don't confuse "getting away with it" with "legal". This is not legal. It is visa fraud.

As I see it, you're advocating visa fraud. The fraudulent scenario you are describing is based on the idea that if the wedding takes place more than 60 days after entry, you have a better chance of convincing USCIS that your lie is truth. The lie you must tell for this fraudulent scheme to work is that the decision to marry, took place after entry. I advise against this path in the strongest possible way. IMO, the post containing the suggestion as well as my reply quoting it should be deleted by a moderator ASAP.



Yes, pushbrk is right. It is visa fraud to enter US with tourist visa if she is entering to US for the reason.

For this method though, we just weren't sure because one of the ladies on the USCIS phone thing said that it takes the longest (more than a year)...?


USCIS always say "longest time". So that they don't receive the complaints. Off course, some people are experiencing " more than a year " but those are very few people..
USCIS site says that they are processing "Jan 2007" right now, but according to people in visajourney, people in March and April have been approved.


If we don't go this route, then I think we will probably do the same method as you did maekai! After your husband went to japan and you married eachother, he could just go back to America to wait?? Would he have to go back for any other interviews or other stuff in japan, or just for the wedding to get married?? (not that i don't want to go to japan, i really love visiting japan, but right now i have to stay at my job so that i can show proof of being able to support... i think?)

My husband is in US applying for I-130 and I-129F (K-3) in US, and I am in Japan and waiting for K-3 to be approved.
Since this process is taking too long, we are considering that we cancell all of this process , and start over again like this..

I will apply for my husband to get Japanese residental visa, and he comes to Japan and stay with me for at least 6 months, then we will reapply for I-130 directly from American Embassy in Japan together. (To do this, you have to have legal 6 (at least ) months residental visa in Japan)

Off course, if you take this method, you will have to quit your job, and come to japan to marry her. then you stay in Japan for 6 months hen you can appy for green card for your wife from American Embassy in japan
Once you appy in American Embassy in Japan direclty, it is only 2-3 months to receive Green card

Does it make sense ? Sorry if I confuse you

You have severals way to do.

1) She can come back to US with Visa Waiver, and get married in US
*To enter US with visa waiver to intened to get married is illegal. But at the time of entry if she is not planning to marry, then it is not illegal even if you guys married after that. so that problem is that she has to convince the officer that she is not entering US to marry you.. That means, of course, she has to have return ticket to Japan, and proof that she will go back to Japan after three months.
I don't recommend this, if she get caught, then, you guys will face the problelm. Probably she can't enter US for 3 or 5 years..

2) You will appy K-1 for her, and she will wait in Japan till K-1 is issued. I think K-1 visa is faster than K-3 visa
And you guys must marry in three months after she enters US. I think K-1 will take up 8-10 months

3) You go to Japan and married to her in Japan , then you go back to US and fille I-130 and K-3 ( We are taking this option) This will take up 8-12 months. If USCIS and NVC don't speed up.. If they do then it could be faster.

4) You come and stay in Japan with Japanese residental visa for at least 6 months, then you can apply for her green card directly from American Embassy in Japan (DCF) then she will get green card.in 2-3 months.


We are currently doing (3), but we are in 6th months, and still not going nowhere. We are now considering to do (4)..
But then, I will have to get my husband a japanese residental visa.,which it is not that easy thing to do, either..

My husband in US is planning to come for interview at Embassy in Tokyo with two children.
So whole family will go to interview. But I don't know if they will come to the interview room with me. They might wait for me the outside of the room while I am interviewed.

I am Alan01's wife. Ours also passed 180 days since we filed, so we contacted to our congressman. He said that our file went to "Extended review". That means our file is stuck in FBI name check for a while. Most of people are sent to FBI for name check, and come back in 72 hours. Ours went to "extended reviews", so it stuck there.

Actually, because of personal reasons, we applied for green card three times.. This is third one. That's why we thnk it is stuck there. It sometimes takes for years to finish up name check when it's stuck..
Now, we are thinking Writing letters to USCIS, FBI, etc to expedied our name check at FBI and if it would not slove then, we are getting ready to sue USCIS taking long time.

USCIS won't tell the truth so easily. Once we got response from our congressman that ours went to extended review, then we called USCIS again to confirm. They told us first that ours is in still normal process, then when we told them that our congressman mentioned ours is in extended reivew. Then they admitted.

You really should get the infomration what is going on your case, then you can think what you can do next..

Maekai, sorry to hear that. If I were you I would try to enter USA like tourist. I think that Japan is with visa wavier program. If at US entry post allow to you to enter US you can be together all the family for 3 months.


Thank you for the advice. But I am afraid of being turn down at entry and worry about kids' schools to be changed.

Neil, when I called and found out my case was with an officer, it was about 3 days later we got both forms approved. It will probably be less than a week for you! Pre-congrats!!!

I would say don't worry, because in my resach, the most of people who filed in March were transfered to Californina Service Center in May, and getting approved now..
My case also filed in the begining of March 07 to NVC, and my husband called a congressman, he said that California Sevice center just received our applilcation and put it into computer on May 2nd. So ours were being hold for about 2 months..

I really can't say, because ours is not approved yet, but I am hoping it will come pretty soon just like other March filers..

As of today, still nothing. There must be something going on at CSC that is delaying all of us March filers with no NOA2's. If anyone gets any info, please post. All of our inquiring minds are desperate to know. Good luck to you all!


We send our I130 at the end of Feb07 to NSC, and then it got transfer to CSC on March 1st. The USCIS's website says it arrived on March 1st, but when our congressman person called to CSC, they said that the actual date that they put our application into the system was May 2nd... Because CSC had received too many applications, and they overloaded.
Our applications sit there for two months for no reason.. :crying:
It seems like that's what it is happening at CSC.

Oh my...
We have two children as well. I can feel your pain.
Ours took long time to get approved, too.
The reason that ours took so long was that ours went to FBI's "extended review" for name checks.I
I heard that it could take for over a year.
Once we thought about sueing USCIS for taking so long to make decisions. We contacted three laywers, and they said we have a good case.
Also, we contacted two congressmen, and Ombudsman. They work hard and help us lots. They called USCIS, wrote letters to the top of USCIS, and so on. They pushed USCIS so much for us.
Finally we got approvals.
I can tell you this, without their helps, ours haven't been approved yet even by now.
You should contact them to see what they can do, and also I heard that writing to the first lady will help as well

Thank you everyone for all of the comments.
Our case was stuck in FBI name check for "extended reveiw". I heard some people would stuck there for over a year.

so, we were seriously thinking about making a lawsuit against USCIS at one point,
but our 2 congressmen, and Ombudsman helped us a lot.
They made lots of calls, and wrote letters and push them to look into our case.
USCIS finally approved us. We are sure if without their helps, our case wouldn't have approved yet even now.
people on visajourney helped us lots as well to make us not loosing hope.

I think
Your US spouse has to be with you outside of US, and she also has to hold the valid resident visa( more than 6 months) for the country where you will appy for CR1 by DCF.
I don't know exactly about embassy in Fiji, but at least US Embassy in Tokyo require those things in order to apply for CR1 by DCF.
Both you and your US spouse have to be show up in person at embassy to turn in applications.

Hi,
We have an appointment day for interview at US Embassy in Tokyo! Its Nov.26, 07.
A lady from US Embassy in Tokyo called me up for some missing papers, and when I explained my situation (we have two small children waiting for being reunited with his father), she gave me the appointment day on the phone without me receiving package 3 yet!!
I could book earlier day for the interview, but I need sometime to gather paperworks to bring in for interview.

Our case went amazingly fast after being approved in USCIS!!

I hope that people on visajourny.com will be reunited their love ones soon.

Hi,
I finally received K-3 visa in my hand today.
My interview date was Nov.26, and he only asked me one question that I was a legal resident before, and I will return to US to stay again.
I said "yes" and then, the visa was approved! it was only 10 seconds interview.

Now we can be all together.

Thank you for people on visajourey for all the help!
We are planning to go home to US in Dec19th.

hi,
I know how much stress you guys are having...

I am a March filler, and our I-130 took 7 month, and I-129F took 6 months.
We found out that ours went to "Extened review" at FBI name checks after normal name checks.
We believed that this was becasue it was my 3rd green card.
We got help from 2 congressmen, Ombudsm, and they helped us a lot, and finally one of our congressmen pushed USCIS to promise to approve our case in a day, and they did it!!
After USCIS, our I-129F application went very fast. It went to NVC in a week, and got to Embassy in a week after that.

You guys should call your congressman for help.

Hi, everyone,
Thank you very much for replies. Sometimes, I had some unreasonable and unclear answers from USCIS, embassies, etc,
So I just wondered if I pointed those things out to them at interview, what they would act to me.
Well, I guess I should not take any risks for that.. I should treat them like a god till I receive the visa.

In any case, my husband wants to come to Japan to be with me at final interview for K-3.
Does it make any difference on the result of the interview ? will it be easier ?

I rather my husband to come to pick me up in Japan when I leave to US than he comes for my interview..

I wonder recently.. People say that to pass an interview to receive a visa depends on an interviewer that you deal with..
If the interviewer is mean, and unreasonable, and if I ended up with arguing with him, and he doesn't like me..
Can he turns me down even if I have all the papar works and had enough proofs that I am legally applying for visa ?

If so, then he can do anything. like receiving bribes..?

You have to check if you filed for K-1 or K-3. You should have filed for K-3 if you are married already.
If you enter with the wrong kind of visa, you will have a nightmare coming up!
I filed mine (K-3) in March, and hasn't been approved yet.
I feel your pain..

We are having the same problems here.. it might be worse. We are separated over 8 months now for the process of visa after 11 years of marriage with 2 kids. crying.gif
My depression is getting worse..
Kids already start talking about staying in Japan with their daddy and me.
Maybe, it might be easier to do since Japanese immigration is not that bad as much.
Your applicaton is in already in NVC, right ? Ours is not even approved yet in USCIS after 6month waiting period.
Our kids don't speak English anymore.. So they hardly talk with their daddy on the phone.
