IR-1 / CR-1 Spouse Visa Process & ProceduresList of documents that my fiance needs???

So, after reading through all the information, my eyes are crossed, and I have a killer headache. blink.gif Does anybody have a quick refference or list of the documents he needs to have through the entire process. We are just going to get prepared early.

Thanks!

It depends which visa you'll be going to pursue: K-1 or CR-1?
Look @ the guides here: http://www.visajourn...amp;page=guides and read them depending on if you get married or not before you start the process.

Good links for a CR-1 are:
LingChe
How do I bring my spouse to live in USA

Read them carefully before you start everything. K-1 will shorten the process (eventually) with 1-2 months but will cost you much more at the end. CR-1 is preferable good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresUS Embassy In Jordan
QUOTE (Fawaz @ Oct 27 2009, 07:06 AM) <{POST_SNAPBACK}>
Hello Everyone,

I would like to Inquire about interviews date and scheduling at the USA embassy in jordan, How long do we have to wait until we get scheduled......my spouses case was completed OCT 9th 2009 and we still waiting, thanks in advance.

VJ is a website for general answers from members' experience but it's not a legal immigration website providing exact dates for interviews. No one knows for sure when the NVC will assign an interview date to your case. It's case to case bases. Keep calling NVC and listen to AVR to find out if interview has been scheduled for your case, but most likely you'll receive an e-mail in a day or two from NVC stating that an interview date has been assigned to you.

Do we know how long you'll have to wait until you get scheduled?....... No, we don't know for sure, just approximate of 1,5 -3 months unsure.gif unsure.gif unsure.gif

I looked at the stats for Jordan for the past 1 year on VJ - average is 172 days after NOA2... or about 45-60 days after case complete. It's just approximate VJ stats according to other Jordan VJ members' timelines... Hope that helped you get an idea... Be patient good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat next? NOA 2 received case at NVC
QUOTE (JaJo08 @ Oct 26 2009, 02:37 AM) <{POST_SNAPBACK}>
So it seems to me that our case is moving along pretty fast and wanted to see what all was next on the horizon for us.
We submitted the 1-130 on 8/14/09 and received the NOA 1 on 8/25/09. I've been out of town for the last month (visiting the wife smile.gif ) and got home tonight and saw the NOA 2 in the mail as of 9/25/09 and also that the case is now at NVC. Does this seem faster than normal? I have a form instructing me to pay the $70 fee for NVC as well as the DS-3032 Choice of Agent form. Once I pay that fee and fax the DS-3032 to my wife to have her name me, how much longer (approximately) is left? It seems there is the whole affidavit of support piece, then the medical and interview in Montreal, but about how long on average are cases at NVC at this point? Are there any other key docs to obtain? My wife and I already have passport photos, she obtained her long form birth certificate, and I believe she has yet to get the police certificate so I know we'll need that too.

thanks everyone!

You should call first NVC and give them both yours and your wife's e-mails, so they can generate the bills. Once bills and DS-3032 are generated, your wife could send via mail or e-mail DS-3032 choosing one of you both (preferably you) for an agent. Get the rest of docs ready to be sent soon. You could pass NVC in no time if everything is organized and ready to be sent to them. The interview will take the longest in the whole process (unfortunately for Canadian citizens due to Montreal interview assignment delays) but don't loose hope. Follow the guides on VJ to finish the process good.gif Good luck good.gif

Welcome to VJ as a member good.gif

Yes, no matter you are the agent, your wife could pay the bill.

Also, wanted to remind you... as you might not be familiar with that - every VJ member should have a VJ timeline (different than signature). Yours would be here: http://www.visajourn...le.php?id=75573 you just have to create in and fill it in. That would be helpful for other VJ members to answer your questions and would help the VJ stats good.gif Good luck with the process good.gif

P.S. I just noticed you've posted ur NVC case number in ur signature. If I were you, I'd delete it - it's very confidential info...

maybe everything does happen for a reason. smile.gif

good luck to everyone else having interviews in november!!!!

WELL,

Perseverance helps. I just got off the phone with the Damascus embassy, and hubby has a new interview set for November 8, 2009.

He actually contracted a serious virus which led him to be hospitalized for over a week with pneumonia like symptoms. He had been freaked out about the swine flu issue (apparently it is now in Syria as well), but thankfully it is not swine flu. Just needs some antibiotics, chicken soup, and a lot of sleep. And he's got his medical all done as well, thank God, so we are set to go!

Kat, I'm so sorry about Sam getting sick just at the time of the interview. But yes, as you said, everything happens for a reason. Anyway, hope he'll be getting better these days and nothing serious with his health now... Take care, hun rose.gif heart.gif

21. If filing for your husband/wife, give last address at which you lived together. (Include street, city, province, if any, and country)

Do I need to mention current address where we have recently moved (few days back) OR I can mention previous address where we had one year together.

Appreciation for your reply.

If I were you, I'd put the last address where you lived together for 1 year. It's a good proof of an ongoing relationship and bonafide marriage. You'll have a chance later to put the current address as well good.gif

I think your lawyer did you a favor by going for the CR-1 visa and not the K-3. K-3 is not obsolete anymore - it takes almost as long as CR-1, costs much more than CR-1, and does not have the benefits of CR-1 like immediate work permit once entering US. Hi everyone. It is now our open enrollment for next year's medical/dental/vision insurance. My husband is planning on being here sometime in February. Should I enroll him now and just pay for January although he will not be living here? I can't do a change in status because we will have been married for almost a year. As it stands my HR department told me we could buy an individual policy for a month then drop it, and I can enroll him that way. We will check into seeing if he can work for the same company I do now (that is how we met, so he has experience already). But as you know, in life, there are no guarantees.

What are your thoughts? What did you guys do for your spouses?

I'm in the exact same boat! Open season starts in a few weeks, and my hubby will be here in February too. When I added him as the beneficiary on everything at work(i.e. life insurance, retirement, etc...), they told me that I could add him on my health insurance as soon as he moves here. Well, I'm not sure I believe that! I'm not sure what I'm going to do either, though I think they probably need an SSN to add him so it may not even work.

It is true. Ins co will not enroll someone who is overseas and does not have a valid residency document yet, as they do not cover medical cases outside USA. They don't need only his SSN, they also need his GC good.gif

Hey kaushalia, it was open enrollment for my company too... I went ahead and enrolled her since I'm hoping on her being here... I also thought it would hold some more weight at the interview... But, the main reason was is because she won't be able to get enrolled until next open enrollemnt, I did'nt think of the individual policy idea.

I guess it differs from state to state, from ins co to ins co, but when my husband tried to enroll me last winter after marriage, he's been told that because I am outside US and do not have the resident (green) card yet, they could not enroll me and we should wait until Dec 09 (as I could be enrolled only 30 days after the marriage).
When I got back in Sept, I called the ins co and spoke to them and said: I'm in US already, I'm pregnant and don't have ins. My husband has been said that he could not enroll me earlier because I was outside US. Well, now I'm in US and I'd like to get enrolled under his ins...
Then the ins co agent told me that they do not enroll until Dec 09, and I'd have to wait. Then it became a long story but calling both the ins co and my husband's employer, after all, someone in the payroll dept sent a letter to my husband requiring some docs from me. They admitted they didn't know that there is another window opened once the beneficiary enters the country. There is also something else. My husband's employer likes to play games with people, so we think they purposely delayed us with that matter. Now out of a sudden we got that letter stating that I could be enrolled not later than 30 days after becoming a legal resident. Well, I've been a legal resident since Sept 1st, but now is the end of Oct. I've passed the 30-day window. So what I did was I gave them a copy of the welcome notice dated Sept 30th, and I also gave them a copy of my GC, plus a copy of the USCIS letter stating they ordered a production of my GC on Oct 1st. I did it only because it states on my GC that I'm a resident since Sept 1st. So, now we just sit and wait to get an answer if they accepted it or not.
Meanwhile, I bought an insurance from another state ins co, as I need it due to my pregnancy and due to the fact that in our state (MA) every individual needs to have an ins, otherwise they charge you a fee for each month with no ins when you get you tax refund.

Hope that info helped you, good luck good.gif

Ignore all K-3 paperwork. If you've started the NVC process, do not worry about the K-3 documents, simply do not respond to them. You can call the USEM in Cairo as well and let them know you've chosen the CR-1 route...

Congrats smile.gif

Social Security Card is the document that is like your social insurance (for retirement) and that lets you work and pay taxes and gain retirement.
Green card is the document that makes you permanent US resident and also lets you work + other benefits.

It takes different for every member to get them in the mail. It depends on where you reside in US. For example, it's been 2 months since I entered US and still no SSC, and I got the GC in mail in a month after entering US.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-3032 choice of agent Question
QUOTE (vijo @ Nov 4 2009, 12:12 PM) <{POST_SNAPBACK}>
HI ALL,

I was looking into The DS-3032 aka "Choice of Agent form".

we donot have any lawyer, my wife is outside of usa & I(In USA) will make payments and be primary contact, HOW to fill DS-3032 form?

We should select?

YES for I APPOINT ----MY HUSBAND-------------as my agent or attorney to receive mail about my application. Mail from the U.S. Department of State concerning my immigrant visa application should be sent to:

Please advise.Correct me if i am wrong.

Thanks

the ds-3032 is to be signed/sent by the beneficiary, because the beneficiary is the one choosing the agent. if your spouse lives in India then she should either e-mail a template of ds-3032 to NVC choosing you as an agent, or mail the ds-3032 to nvc and choosing you as an agent since you say you're going to make the payments and send required documents to NVC.

to send an email with ds-3032 there is a template on VJ that needs to be copied and pasted into compose box and filled in with the right info of the beneficiary before emailed to NVC: Email DS-3032 form

hi, mononoke28, i meant the nvc page where you sign in , when the sign in fails that usually means your case is completed 1 day after or at least that's what i've been noticing in the time line process of almost everyone in here

hi "Chris and Ani" thank u for your answer, and yes i will post my timeline today . smile.gif

mononoke28 is right, you don't need to get a real operator to find out that ur case is complete as the AVR will state it anyways...

hi, my name is carmen and i'm from peru, this is the first time i post in here but i've been a member for a while reading all of your cases that has really helped me through this journey . well today i finally sign in into the nvc page and the sign in failed which i thought was awesome because that means tomorrow my case will be closed and sent to the embassy in my country. but i asked my husband to call the nvc and they told him that my case was still under review so im kind of confused .. should i wait till tomorrow to call and confirm my case has been closed or am i wrong?

hi carmen, you shouldn't be worried that they said it's under review because this is their usual answer. your case will be complete in a day or two, nothing to worry about. congrats on case complete good.gif

also, could you please take the time to create ur VJ timeline here: http://www.visajourn...le.php?id=49993 and fill it in? would be nice and helpful good.gif thanks smile.gif

Hello All,

I just login in NVC site, I am getting login failed..then I called NVC and the operator told me that our case is still under review..

I send my last paper work they required 2 weeks ago.. anybody here has the same expererience ? please share.. is this a good indication that our case is completed and the operator system is not updated yet?

Thanks
Bigbear

Congratulations! Login failure means your case is complete at NVC! AVR is slow to have info there, but if you call an operator tomorrow, you will hopefully be able to get updated information from them.

Oh. Guess I was wrong about the IR. biggrin.gif Thanks.

According to the Department of State website, you were correct and kaus&Sanu was wrong.

http://travel.state....tml#Conditional

I don't know who is really right or wrong. If IR means immediate relative, what is the spouse status under CR? Conditional? Well the residency is conditional but does it make you a conditional relative as well, or you're still immediate relative of the person applying for a visa for you? Just my 5 cents...

As I thought it would be ( c )(9) as you are adjusting your status.

But I searched the forums just to make sure I was right and found this: http://www.visajourn...showtopic=76165

It's exactly what I thought according to the I-765 instructions and what you need good.gif

Hi,

Wondering if anyone can help me, I was on H1B visa which expired in September and currently am unemployed. My husband, who is a US citizen is filing for my greencard
and I am filing my I-765 concurrently. What do I write in the "Current Immigration Status" field? I am no longer a student/visitor/H1b worker. Please clarify.

Thanks

Hi VisaHell,

First, please create and fill in VJ timeline here: http://www.visajourn...le.php?id=76181, it will be more helpful to other members answering you questions, as well as to you getting an appropriate answer.

Visit the USCIS website HERE to read more about this form. Download the instructions and read them.

There is a paragraph 7 that describes what you should write if you are adjusting status (in your case you are doing AOS).
More about CR-1 and AOS just so you know the difference, you can read on your other thread HERE.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo they go through DS-230 at the interview?
QUOTE (maisflocon @ Nov 11 2009, 10:44 PM) <{POST_SNAPBACK}>
I was told that at the CR-1 interview, the VO will go over all the sub-questions for DS-230 question 30 with the beneficiary, is that true in your case?
Do they go over any other questions aside from this?

I am helping my wife prepare for the interview and want to make sure my wife understands the meaning of each question thoroughly before attending.

As a reminder, some of the sub-questions for DS-230 question 30 are:

"An alien who has communicable disease of public health significance; ..."
"An alien convicted of, or who admits having committed, a crime ..."
"An alien who seeks to enter for the purpose of performing skilled or unskilled labor ..."

the only questions from my DS-230 I've been asked on my interview were about my education back home and in USA and also about my working experience both back home and USA.
other questions I've been asked were not related to my DS-230.

Hi,

I recently got married to US Citizen here and am going through the filing hell! My question is, my H1B expired in September and I left my job before it expired.
We subsequently got married and we live together now. I've filled out all the forms but am a little confused about I-864A, if I am the intending immigrant being
sponsored without any dependants (we didn't have children in the last 4 weeks that I know of), do I need to fill out I-864A or does my husband just fill out I-864
and include my assets as part of that form? What about my tax returns for the last 6 years - do I need to include any of that?

Thanks!

VisaHell, please create and fill in your VJ timeline, here: http://www.visajourn...le.php?id=76181, it will be more helpful to other member answering your questions in order to help you.

timeline.gif timeline.gif timeline.gif

As far as I know, you won't need to include your tax returns, only the petitioner, in your case - your husband.

AOS means adjustment of status, it's done when marriage took place in US and beneficiary is adjusting their status as staying in US by not leaving the country.
CR-1 is a 2-years conditional immigrant visa issued to beneficiaries outside US in order to become legal immigrants and enter US.

In your case you are doing AOS, so guides6ly.gif on the top of the page.

Good luck smile.gif
