Waivers (I-601 and I-212) and Administrative Processes (221g)221(g)

my wife's interview went well, but she still got the 221g for some documents .. I sent them to her within 2 weeks, she lobbed it over the fence via CITIC bank courier, and she was ISSUED her visa about a month after interview day.   Timeticks in my profile - click my name or the twins, have a look.

Did she have to return for a second Interview or was She able to just send in her Passport? In our case ,they want addintional Evidence of our Relationship and they also made us e-mail a resume and info about CCP,Although she told them she was not a Member..Response from the e-mail is what will take the longest ...The Addintional evidence was sent in a couple of days ago.

So,how long was you in AP after you sent in the CCP E-Mail? Was there a 2nd Interview or did they just ask to have the Passport Mailed to them?

Interview Date:  March 15th 2013

In AP since then <still in AP>

Reason is she is/was a communist party member.  I'm still not sure when we'll be approved.  I went for the K1 visa route because it's suppose to be faster - clearly I was in error....

We are in AP For the same reason..that and they wanted more Evidence of our Relationship..everything has been sent in about a week ago..let me know how it goes!!!

WOW, A Lawyer doing the Marriage Translations.this is where the civil affairs office sent you?..I have to take Original Single Cert. to Nanning as it has the Chinese embassy Authitifcation seal on the State Notorized copy ,which is stapled to the Notorized Single Cert.ahhh...how much is the cost for all the fees?

police cert not needed to file I-130.
it's needed for NVC doc intake, later.
suggest to get police cert after I-130 approval.

when at NVC, use NVC Electronic Processing, then only scans of civil docs are needed, and SHE can email you stuff, as scans are allowed at that stage when using EP.

don't waste time on getting police cert for an I-130 - as it will expire before a Vice Consul will see it for the interview.

--
usually, there are two seperate translation offices - so bear that in mind.
chinese to English translations, used for marriage, birth, police cert - that's one office.
english to chinese - used for single affadavit, that's another office, and always gleaned from the marriage registry office - only they will tell you which office they accept the translation from.

The lawyer doing the wedding cert. translation said two weeks. We should have it this week.
I hope they accept the copy of the single cert. for translation. You will probably have to bring the original in to the translator. When the translation was done, I had to take the original in and they stamp the original and translated version together, half the stamp on one and half on the other. The registration official checks that the two halves of the stamp line up.

Thanks for the reply,I got the single cert. notorized and then sent it to the Chinese Embassy in Houston to get their seal.I Have that now,and i e-mailed her a copy to get translated along with my passport. The civil affairs office gave her a phone number to get the translations.also she has to get her Police cert. translated to english so i can bring that back to file the I-130....So you are still waiting to get the translated marriage cert.?...how long of a wait...because we can't file I-130 until i have that!I wonder if it is the same place my Fiancee is using???????????..i will ask her, once again,txs...

BPierce,
Hang in there brother. I read something comparing the Chinese wedding to the US. The guy wrote that China hassles you up front, but the wedding is low keyed. For me that was true. Here's what I learned about the affidavit of marriageability:
First, it's easier to get it in China than the US. To get to Nanning, I generally fly through Shanghai. So I made an appointment at the Shanghai embassy to get the paper notarized. You could do the same thing in Guangzhou or Beijing. My appointment was only 3 days before we were to register, so the fiancee was stressed that something would go wrong. I stayed overnight at a hotel near the Hongqiao Airport. It was less than 30 minutes by taxi to the embassy. It took less than 1 hour to get the paperwork signed and notarized and the embassy staff was friendly. I killed some time and took an afternoon flight to Nanning.
There is only one Marriage Office in NN that handles foreign marriages. Ask your fiancee to call them and get the name of the official translation agency.
I got up the next day, took a bus to the agency near the Five Elephants Plaza. The three young women in the office were very friendly, and relaxed. They asked if it was OK to give me the translation the next day. I think if I was desperate, they would have done it on the spot for the right price. So 48 hours after landing, I had my "single papers" and was all set. The registration was the equivalent of transferring your driver's license from one state to another. After filling out a few forms the woman handed me a little red book and said "congratulations." And a little voice in the back of my head said "holy sh!t, I'm married." Let me know if this is helpful. I can connect your fiancee with my wife if that helps.
I guess I misread your questions. I am still waiting for the translation of the marriage certificate for the I-130. At the registration office, the woman gave us the number of a lawyer or notary public to translate and vouch for the marriage certificate. It's a different process from the translation of the marriageability affidavit. It's taken about 2 weeks. Good luck.

i am going to Nanning to marry in Feb. . It has been a nightmare getting the Single Cert. and then my Fiancee says the civil affairs office need it translated to Chinese(they gave her a number to call)I know the single cert and the Athu.seal from the Chinese Embassy have to stay in tacked.Did you have any Issues with your Single Cert.?Where did you go to get the Marriage certs. translated to English?I'm assuming it would be at the same place that she will get the Single Cert. translated...and how long did it take you to get back the Translated marriage certs., for filing of the I-130?

It was real easy.  From your contact window right click on your contact and select "Message History" then "View Local Messages" from the menu.  Then right click on the contact icon tab on the left and select "Export Message History".  When the window comes up click on the "Save as Type" drop down and select how you would like it saved.  The rest you should be able to figure out.  I exported to mht then opened that file with internet explorer and copied everything there into a word doc so I could edit and format better as it is quite large.

Thanks,I got it!

After what seamed forever waiting for the NOA-2,  yes I know I have no right to complain as many have waited much longer than me,  we are starting to prepare for the visa interview now.  There is much to do and I have been scouring the net for any and all information I can find about what to expect and what we need to do for the interview at the Guanzhou consulate.

Some of what I found scares me a bit but I have been unable to verify how old this data is or if it still is even true about the Guanzhou consulate.  From what I have found the Guanzhou consulate is one of the hardest consulates to get an approved visa through.  They are specially hard on K-1 visa applicants when one or more the following conditions are true:   Chinese applicant is unable to speak good English,  large age difference,  engagement with only one or on first visit together,   Applicant has never been to the US, or the petitioner or applicant has 3 or more divorces.

I found this information on a China based website for a company that helps with immigration from China to us and this scares me very much because my fiancée English is not very good as she is still learning and my Chinese is even worse and I do have three divorces.

You may ask if we do not speak each other?s language very well how we talk.  We muddle through in English and use google translate a lot.  Our letters are all in English as she can read and write English fairly well it just slow and difficult or her.  On qq or via text I type in English while she does it in Chinese and we both run through translators.  We do talk voice on qq a little but it is not very much.

We do have quite a bit of other evidence but I fear they may reject us just because of these two items.  I?m posting in the hope I can hear from others as to their experiences with the Guanzhou consulate and or get some advice as to how to overcome these issues.

They Denied our K-1,So we got Married and are at the N.V.C. Phase right now.I put everything I had into the I-130,for Evidence and intend to add more at the N.V.C ,since I have filed.

I have hired a attorney and my wife hire a attorney in China as well....we will be well Prepared this time

As for the Embassy,They did not look at any Evidence she took to the Interview and they had already made a Decision BEFORE SHE ARRIVED THERE! Trips to visit her ,i think is a Key to sucess and to have ALL the Evidence in front of the Interveiwer Before the Interview.

Best of Luck to both of us,the Officers there do seem to always be in Bad Moods..but don't ever give up,we didn't and we have been trying to be together for over 2 years and March 7 we will be married for 1 year ...and we are apart now!

ChinaAdministrative Processing 221(g) China

Hello, I am a new member, but a long time follower. My fiancee and I have submitted our application and I-129f around April of 2012. We finally had our interview at Guangzhou consulate June 30th of 2013 at the time we got put on administrative processing. We have been stuck there every sense. My fiancee is a CCP member. For those of you who dont know what that means (Communist Party of China), although she is just rank and file and only needed to join the part just so she may work at the university as a teacher. We applied and got all the waivers before the interview. The problem is not that she was denied, but it is that we were put on administrative processing. We have been waiting over a year. My fiancee are thinking it is due to her education, having a master's degree and all. Due to her membership with a support group on QQ. It seems that they are making it hard on anyone that has an education over a 4 year bachlors degree. I have had an attorney for the last few years, although I find he is not as proactive as his advertisment makes him out to be. I am looking for anyone in the same situation as me and what you have done about it.

Things that I have tried, but never seemed to work. I have contacted my senators office in Arizona, I have contacted my attorney, I have contacted Guangzhou Consulate, I have contacted the USCIS, I have contacted the Dept. of Consular Affairs. I truly have run out of options. The fact is by now being 3 years and all if we didnt truly love each other we would not be here today and now asking for anyones help. If anyone has any suggestions I would greatly appriciate it very much.

We had our Interview in May,2014..we had to send in the CCP E-Mails and resume for her past membership. We did that right after the Interview and we have been in AP now,for over the last 2 months waiting for conformation from Washington D.C. to send to the Embassy..I hope we hear something soon..I have read where it can take 2 to  6 Months for them to complete the Background check...but 1 year...that is Crazy!

I wish there was something or someone we could contact to hurry the process..but i don't know....

ChinaApril 2014 "Blue Slip" Filers...

For those that are interested in this K-1 CCP issue, my fiance just got a notice to go get another body exam for her Visa, which I take it as good news since it didnt out right reject her application.

She filled her answers for the CCP "blue slip" on April first, and she got her notice by email on October 15, which is about 6months.

She joined a QQ group in China for people of the same situation and she said some people that filed on March and May also got their notices to take another body exam. So depending on luck, it might be 5-7 months.

The email you will received is titled "Immigrant Visa Follow-up Instructions"

AND DONT LET THE EMAIL SCARED YOU LIKE IT DID FOR ME!

because of stupid english to chinese translation, the first sentence you read will be "Under the section 221(g) of the Immigration and Nationality Act, the Consulate General is unable to issue you an immigrant visa at this time." After reading just that, i was like "F*** Y**" i waited 6 months just for a rejection letter! but if you actually keep reading, its trying to say that since your body exam had expired, you need to go take another and resubmit it again, then the embassy can issue you the Visa.

Wow,good news..my Wife's case got an up-dated last week and 1 up-dated today..Her Interview was in May..so we are hoping for some good news soon..(A.P. for CCP)
