I need help for my friend.

She was asked to submit some (lacking) documents. She did but still not heard anything from them, and i told them to call them Embassy , her fiancee called the embassy and the CO told him to check the post office because they are mailing a letter/something. My friend went to the post office and got the letter and it says like this " we are unable to issue an immigrant visa because you have found ineligible under the following and so on..."

Below says WAIVER- You may qualify for a waiver of the ineligibility listed below...So on so fort....


How is she going to fix about this 212(a)(4)???
What are the possible ways so they can continue their papers or her visa???

I am guessing the problem is that according to the AOS your friend spouse sent in, he did not meet the 125% of the poverty guide line.

Im american military in afghanistan and my wife is filipino living in the philippines. We were married in the philippines in feb. 2010 and we want to get her visa issued by the time i leave afghanistan so she can come straight to the states. Im so confused about this whole k-3 visa process... Do i need to submit both the I-130 and the I-129f? Because from what it sounds like is that the I-130 is for immigrants and the I-129f is for non-immigrants.. but everywere I look for instructions on what to do says that you you have to file both? Any help or past experience would be appreciated..


Dont worry about the I-129f(k-3 visa), just file the I-130.

hey guys, i need ur help!!it's more for people who are filing in US embassy in manila. i had a few questions to ask u guys. how much do we need to spend all together?? i know u need to pay $131 at any BDO branch for the visa processing fee and $213.35 for medical. is there any other fees to be paid aside from these two?? i'm just confused. my fiance went to an agency to get a quote of how much he will need all together and they told him he'll be needing approx. 42,000 pesos, which is approx $930. it seems like it doesn't add up to me. they were also saying we need to pay some kind of US tax for $180. and other charges. i don't know. it just seems like too much money. is this a scam?? sorry to bother u all with these questions. hope someone could help me. thank u so much =)

Document requirements for K-2 Visa:

The documents to be submitted for applying for K2 visa are same as that for a K1 visa. While filing the application for K-2 visa, the applicant should submit the following documents-

•A valid passport (not needed if child is under 16);

•Two completed DS-156 (non-immigrant visa application) forms.

•Two completed DS-3052 Supplemental Application Forms.

•Two recent color photographs (taken not more than six months prior to the application);

•A medical examination report;

•Permission to travel from other parent;

•A copy of the child's official birth certificate issued by the Registrar of Births. The birth certificate of the child should disclose the date/place of birth and names of his/her parents;

•Evidence of relationship such as letters, photographs which demonstrates that you have a legitimate relationship with the person who has petitioned for you;

•Evidence of support which demonstrates that you or your children will not become a public charge in the United States. Submit a completed Form I-134 (Affidavit of Support) to prove that your sponsor has sufficient financial resources;

•Evidence of termination of prior marriage such as death certificate, divorce decree;

•Military record: you must obtain your record of military service, if applicable and obtainable;

•Police certificate: police certificates are required for every applicant aged 16 or over

I filed for K-1 last March, the week I finally got a new job after 8 months on unemployment. I just learned i will lose job first of July and do not expect to work staedy the rest of the year. (i do construction and there just no jobs period!!!!) I am also in the natinal guard and continue to get the monthly drill pay in addition to unemployment (450 a week plus 25 kicker). The total of both equals more than 125% poverty level.

Will they consider unemployment as income? Let me say before people jump on saying find a job fast, any job....GET A CLUE!
I plan to provide 3 years tax records, banking deposits and all avaialble pay stubs. I also have assets i can list. I do see a potential problem with 2008 tax records, since i was out of country my pay was tax free there for my taxable income is very low, though i did pay social security. How do i address that tax exempt status?

since you are in the National Guard do you qualify for the 100 percent of the poverty level since militray personel are only required to meet the 100% level.

First time poster here! While reading a forum, not sure where they discussed the need or better put the option of bank statements if you are above the 125% of the poverty line. Please see the in enclosed comments in quotes placed by another member below. My question is this true, and how do you formulate the 125% above the poverty line if you include yourself and your prospective beneficiary, and any dependents?

“If your income exceeds 125% of the poverty line when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME. “

My problem is, my fiancee- my future wife had her interview august 25th and was given a blue slip requesting evidence of my current sustained income. :crying: I am self employed and have established a cleaning business although I have not filed a tax due to the date of my business registration. The business was registered january 2010 and my filing date is not until january of 2011. Although, I do have a copies of contracts with my current clients. 1 contract is with an adult home who i have been hired as their maintenance manager and 2 residential contracts. Please somebody tell me if these are enough to submit to the consul.

2. Tax Number
3. Tax letter from WA state stating my filing date is not until jan. 2011

5. Invoices from the past few months I have been working with them

I was a full time student and just finished school late 2009 and soon as i got out, i worked on this business. Another worry that i have is. It wouldn't hurt to have your clients write a letter of agreement. It should show when the contract started, what the contract is for, how long the contract will go on, how much the contract pays and how ofter you have to perform your duties. This could take the place of an employment letter.

Since you called 911 did anyone get charged with domestic violence. If your husband did then you can self petition to get condition removed. I would definately see the advise of a professional divorce and immigration lawyer. Remember he signed a Affidavit of Support and your husband is legally liable for 125% of the poverty line of support.

my suggestion is to look up vacation rentals. I have found that you usually can rent a good condo for half the price of hotels. You have the option to do alot more by renting a good condo because you can cook your own meals and do your own laundry. Most usually have a maid come around twice a week and change the sheets and clean. The ones I rented have security guards at the entry and a receiption in the lobby.

Hello All,

Hoping that someone is in a similar situation that may have guidance or clues as to what's next during the I-130 process.

I mailed our I-130 Spouse petition on 1-28-2010 and received NOA1 on 2-10-2010.

Per USCIS.gov they state that it should be expected to recieve an appointment within 30 days for biometrics, getting close to the 30 day mark without any notice and was wondering what are the normal wait times for those who have filed from the Texas area.

If anyone has a good timeline to follow it would be much appreciated so we can both ease our minds about the ranges in time we've seen browsing the net (6 months to 2 years).

Also if this helps "Saw that there's a big difference between Permanent Residents/US Citizens' wait times when filing", I was born a US Citizen 'Fil/Am' and she's a Filipina.

Any info is greatly appreciated.

So I am taking a week to go visit Josephine I arrive on Sunday 3/28. I know only a week!! unfortunately the company I work for gives me 3 weeks 1 week at a time and did not approve my request for an extra unpaid week.

We will be going on Monday to Cebu the plan is to visit the graves of her parents and where she was raised. We will also visit her younger sister and 2 brothers.

We will be there 3 nights returning to Cavite on Thursday after noon.

my problem is I want to make our evenings as romantic as possible; here is what I want to do.

1. I have a prepared statement to read when at her parents grave site asking for their blessing on our future marriage a friend is translating to Tagalog
(This is a surprise; do you think it would make her happy and is there any advice on what I should say?)

2. I want to pick a nice hotel to stay in and pamper her such as visits to spas (this is also a surprise)

3 I want to have romantic dinners with her each night maybe a club to dance

4 She has us roaming around on Wednesday visiting a few sites like the Chinese temple, Magellan's church etc

The big problem is places like Plantation Bay are quite far from the city and I don't know of any hotels in the city that offer Spa treatments or the service you get from places like that.

Any ideas or comments are appreciated.

My wife and I stayed at the Crown Regency Hotel in Fuente Osmeña and found it a very nice place to be. They hava a great spa and I recommned the couples treatment. We were pampered like royalty.
I also stayed at the parklane hotel and it was pretty nice as well. Parklane is close to the big mall in Cebu. Book these hotels online.

In our country we are on our own. We work through collage or get loans and end up in debt when we finish getting our degrees.
In the Asian cultures its up to our families to send the kids to school. The burden is put on the shoulders of the oldest sibling. Usually the oldest sibling is given everything to succeed so they can help out the other kids in the family. In the Philippines it seems like the burden is put on the shoulders of the oldest girl to provide not only for her sibling but for the whole family. Why not maybe send her a little something every month to help her? Just see it as taking a little burden off of her shoulders. Just let her know that its all she will get. Any plans to marry her or plans to file a K-1 visa. I see you seem to have more love for your dogs then your honey.

What kind of medication?
Find out what medication they are giving you and google it to see what it supposed to treat. Ask the health professionals at the treatment facility as to why you have to take the meds and go through the process. I am sure they are not singling you guys out. Don't quote me on it but I am guessing the meds are for some kind of treatment for dormant TB.

Were in the same situation. Wife had something show up on her X-ray.
Her appointment for the SPUTUM test is on the 5th of July. I just couldn't believe it. I saw somewhere that only a very small percent of people who go in for the SPUTUM culture test come out positive for taburculosis. Dont worry, I mean you waited this long, whats a couple of more months right. I pray it all goes well for our ladies. Good luck.

My wife and I in the US cannot find any reasonably affordable way to talk to her family back in the Philippines. It seems everything is a rip off. I'm not willing to spend a bunch of money just to chat on the phone especially since we already have phone bills anyway. My localphone account, which acts like a calling card is 12 cents a minute, which is way too much. My original communication plan fell flat on the ground. I bought her family a netbook and set up their skype account for 3 dollars a month unlimited calling to the US and payed for them to have internet and phone. I found out later they stopped paying their internet bill so their service was cut off, so there's no use in trying that now. How can we call their cell phones and not get charged a fortune?

Wow you will be living on a tight budget. Don't forget when you leave the the Philippines you have to pay 500 peso for a exit fee.
So make sure you have a little cash on you when you leave. Do you have a debit card or anything you can have for emergencies?
Visa check cards and ATM cards do work in the Philippines. With only a thousand make sure nothing happes to you. Take along medicines from here just in case you get sick.

I send my wife money every two weeks and I use www.remithome.com. These guys are fantastic and very professional. The fee is 8 dollars for each transactions u to $2,500 dollars. You can have it delivered door to door, have it scheduled to be picked up at a bank or just deposited into their bank account. They can even set up reoccuring transactions for you. I really like these guys and have been using them for the last year and a half. Most western union pick up is at a pawn shop and its not very safe.
I also have another vendor you can use as well. Try WWW.XOOM.COM. These guys only charge 3 to 5 dollars a transaction but you get less favorable exchange rate. They have the same service as the remithome.

Come on, I can't believe what I am hearing. So let me see, then is this organization against all the legal filipinos who played by the rules, who spent the time to fill out the form, the ones who paid the proper fees, the ones who sufferd by being seperated by their families, who patiently waited until the US government gave them the permission to immigrat.
So why is it a bad thing to show your ID to an officer of the law, don't you already have to when you get pulled over.

I didnt take any chances and used the official copies from the NSO office. You dont have to have the original copies to file for the I-130 but you are required to have it jsut in case USCIS wants to see the original.

Hi all!

I have a few short questions that I can't seem to find an answer for. I'm putting the finishing touches on all my paperwork (I guess it's not the end of it by any means) and hope someone knows the answer.

When my fiancee signs her statement and her side of the G-325 (I know perhaps she doesn't have to sign that form yet, but I don't want to wait for them to ask) does it have to be the original document, or could it be a copy. During her interview they will have the original anyway...what do you think? I plan on having her send the documents (and her passport photos) to me, along with some of the photos of us that only existed on her camera.

We have had an apartment since May 2010, and I'm curious whether or not we should submit the rent payment receipts? I plan on sending some Western Union transactions as well.

USCIS dosn't require originals but require you show the original upon request.

I would send it in to show proof of continuing relationship.

I have made a few trips over to Korea and to the Philippines and I got to say that the worst flights I had was on North West airlines. The services were terrible and the stewardess were old cranky old ladies. The food sucked and the seats were uncomfortable. They called my name and said they had made a mistake and reassigned me to the back of the airplane. The best airline expirence I had was on Asiana airlilnes. The flight crew was very nice, great service, good food and the flight was very comfortable. Korean airline was great too. Let me suggest Asiana or Korean airlines next time.

PhilippinesFailed Medical - sputum exam

Help!!!

I am a bit devastated tonight! My fiancée failed her medical. One of the tests she took discovered a “possible spot” on her left back that could be turberluloisis. They are now saying that she will have to return to the clinic on July 13, 14, and 15 of July, to take a “sputum exam.” I’m not clear on this, but my fiancée said this could take two months to get the results back as to whether the outcome will be negative or positive for TB. On the other hand, I have read that sometimes they can have a negative on the “sputum exam” and allow them to clear the medical. So, what can we do? The question is can we send her to a private clinic and get the results back quicker, and then report such to St. Lukes? What is really astonishing is that my fiancée went through a complete physical a couple of weeks ago, before leaving her employment in which she had taken X-rays. The physician never indicated any such spots. Please advise, because I’m completely lost!

My wife just got done going through the sputum test. It takes three days. She has to go to the clinic every morning to give a sample. It's not painful, they just make you cough so they can get the sample for culture. Tell her to get some cough drops because she will have a minor soar throat the first day. Two days after the sputum test she has to return for the first results (will confirm if she has TB or not)and doctors recommendations. They will culture the sample for the next two months to confirm she does not have TB. If the sample test positive for TB then the treatment takes 7 months. She would have to live in Manila for the 7 months because, St. Luke's has to dispense the drugs daily. Lets not hope for that. Yeah two month delay, it sucks but what can we do but be patient. Good luck and I'll keep my fingers crossed for you.

Trying to be patient.... just hard when I see so many in February and MArch having NOA2 aleady..... Seems like I am in the back of the line..... COMPLETELY at the back of the line.... all requests for expedites rejected. Even with senator asking. And now, it is like falling off the face of the earth.... just nothing..I know there are people waiting longer then me... I feel bad for everyone having to wait... But I did everything asked for... followed all guidelines.... yes, I feel as if being punished for even having asked for an expedite and having a senator ask for me as well... just know I am not going to let this go with the approval though. I am researching, looking, and reading many things.... The more time I wiat, the more I read the Acts which formed the process.... right now, just feel like I am being punished for just trying to get my fiance here... LEGALLY...



It's really hard to wait for the paper work come through. Be patient, it's all worth it. Once the visa is granted and your fiance gets here and you get married, you'll look back and see that the process really didnt take too long. I know its very frustrating right now but hey she is worth it right.

I am a generally patient person I think but this is driving me mental... How do you guys deal with your stress? The wait is taking its toll on our relationship. It's hard to spend all this time on the phone and online and keep up a normal schedule.

This month the time changes here in Wisconsin and I will be an hour AHEAD of Carlos in El Salvador and that makes it even harder!! I work 6a-2:30p and 10 hours of mandatory overtime per week.

The worst part about this whole thing is his dad is the Deputy Chief of the USCIS Forms Center West and he can't even help us expedite anything. :(

Give me your ideas on how to get thru this trying time... :bonk:



I know what you are talking about. I know the waiting thing is hard on the heart. Be patient because it will be worth every minute of the wait. You know what they say, distance strengthens the heart. I hope the duration of your wait will be short and things happen soon. Hang in there. My wife and I always text each other everyday.

So your I-130 petition has been approved and forwarded to NVC
Now you are wanting to know if it has been received and a case number assigned
You can use your CIS (NOA) receipt number from your approval to find out.
On calling the NVC automated voice response number (603) 334-0700 you will.... press 1 for English press 2 for Spanish
press 1 for information about your immigrant visa
It will then ask you if you know your CIS receipt number.....press 1
(Once you have a case number you can use this.....press 2)
You then follow the instructions to key in your number.
If will then tell you if NVC has received the petition, and assigned a number.

This automated service is available 24/7.
Once you have your case number you can call them at any time to hear any updates on your case, using either the NVC case number or your CIS (NOA) receipt number.
