My Fiance has medical scheduled for October 30th. Does anyone know of a nice Hotel/Pension House that is within walking distance of St. Lukes (preferably across the street or next to the hospital). Please provide cost and any helpful info is appreciated. Thanks in advance for any reply.

I asked a question similar to yours to my attorney on email. Below is his response:

It is my understanding that the K2 Visa is valid for one year after
issuance. My fiancée has a 3 year old son whom she would like to leave with
relatives in the Philippines until he is school age.

Can I apply as his stepfather for him to be admitted to US under
immediate relative status?

Yes. Provided he is under 18 at the time of marriage.

You become the stepfather of your fiances children upon marriage.

The I-130 Petition is what you would use. A U.S. citizen or lawful permanent resident of the U.S. may file Form I-130, Petition for Alien Relative, to establish their relationship to certain alien relatives who wish to immigrate to the U.S. A separate Form must be filed for each eligible relative.

In my case we decided to get her son a K2 visa and then she will get him prior to the expiration of the visa. I think it's an easier route to go that way since your spouse is with the kids and can take them to the interview and medical. Hope this info helps.

It is better to get the SSN card while still a Fiance. Take your Passport/K1 Visa and I-94 to your local Social Security Office and fill out an application. You can change the name on your SSN card after you marry with your marriage certificate.

It also helps to have written correspondence like cards and letters. You have nothing to worry about. I have read that the K2 is valid for one year but my stepson was given a K2 visa by the US Embassy in the Philippines on November 19, 2007 and it expires 08 May 2008. My wife got her green card on March 25th and is now in the Philippines retrieving her son.

Contact him and see if he is willing to help you. If the US citizen initiates the divorce it will be recognized in the Philippines. The Filipina can not initiate the divorce. Her husband may be willing to go along with the divorce if it is non-contested and he doesnt have to pay anything. Some guys might think a divorce is not necessary if you marry overseas thinking that nobody will know of the marriage here in the US.

You dont have a timeline posted so I am assuming that she has not had her interview yet. If she hasnt had her interview yet then she likely wont have the visa until after Christmas anyway. Family is very important in the Philippine culture. It's a huge transition for her to come to America and adapt to our culture and ways. I wouldnt take it personally that she has expressed a desire to be with her family for the holidays. Your little baby wont know the difference that you aren't there. Perhaps she is having post partum depression and wants the comfort of family while she adjusts. Lots to consider. Best wishes.

Once you hire a lawyer you really lose control over the process. You have to go through that person for everything and often times once you pay their fee they suddenly dont see the importance in returning phone calls or emails. The guides on this site are excellent. VJ'rs will assist you. If you make a mistake you will get an RFE (request for evidence). Respond to the RFE promptly and it wont delay your case much if at all. When you hire a lawyer then a paralegal will likely be doing your paperwork and they really aren't concerned with timely processing of your case. Ever been to the DMV, you get the picture.

A child support case may take months to work it's way through the courts and then when a court issues an order for child support it is often retroactive to the date that the petition for child support was filed with the court. The net result is that your boyfriend could owe several months worth of child support all at once putting him over the $2,500 threshold for getting a passport. So he may not be a deadbeat Dad. I would ask to see the court papers and he will provide them to you if he is being honest about his situation. Child support payments are often excessive in this country and the court system is commonly used by bitter ex spouses to extract revenge on their ex. I have to pay my ex child support even though we have joint custody and equal time with the kids. I am the higher wage earner and she chooses to be under-employed. She lives in a new townhouse and I in a rented apartment. She eats out regularly, wont buy the kids necessities, refuses to pay her share of kids medical bills, the list goes on and on. If he has a bad relationship with his ex it will directly impact your life for years to come. You may want to reconsider whether this is the life you want for yourself.

You're welcome! If everything goes smoothly I'm sure you will get your visa in time....unlike ours, we got NOA2 5 weeks ago and it still hasn't been sent to NVC. When did you get NOA2 and has NVC received your documents?

You can do your medical in advance so you could book the appointment (it can take weeks to get an appointment at some panel doctors). Start filling in the forms and gather all the documents and evidence you will need. NSW police checks need to be sent directly to the consulate so I'd wait until they have your paperwork before doing that. Also get your fiance to start working on the Affidavit of Support. I was just reading in the step-by-step guide for the K1 and noticed one of the steps said "Go back to the SSA office and bring your SSN Card and marriage certificate. Change your name."

I only have the copy of my husband's birth certificate, incase if needed ;his passport copy and report of divorce
issued by US trial court. Unless the Embassy in Tokyo specified that they need the original copy I wont bring one.

Hey all!

Unlike many folks, I actually currently live with my finance overseas (in Japan). I have lived here for a couple of years, we met here and have been living together for 2 years. We started the K1 visa journey so we could move back to the US, get married and live there for awhile before deciding what country we want to settle down in.

The problem is, we recently changed apartments, and when I tried to update the new address, I couldn't change it from an overseas address to an overseas address. I called up, and was told that the staff's computer wouldn't allow them to make the change either, and I would have to write a letter to the California service center in order to get it changed.

I am a bit loathe to do this, for fear that it would put a glitch in the process, and make it stretch out even further. We are early July filers, so are hoping to get our NOA2 soon. (The NOA1 arrived just fine at our address in Japan). The post office will forward any mail to our new address, so I don't think it will be a problem. But you never know...

So, what do you think? Is it best just to leave well enough alone, not go through the headache of changing address for a place we don't plan to be in that much longer anyways? That is the way I am leaning, but figured I would gather some advice.

Using a foreign based address had better not mean a return - we have no current USA address on our i-129-F and we got our NOA1 OK to the UK. We did put a USA address on the i-129F form 'Question 14. Address in the United States where your fiancé(e) intends to live.'

Doesn't it make sense that some people might be living together in other countries and not have a USA mailing address for whatever reason?

I live abroad too, in Japan with my fiance, and my I-129F was just approved yesterday without any problems, so they should be OK.
