I am back from India. Spent almost 6 weeks there with my wife. Tthis made the waiting little bearable but now back to U.S. :( alone and trying everything (service request, letters to senator) I can to get some answer.

It seems to me that there is something major obstacle for all of us who were transferred to TSC. There is not a single person who got approved and went to NVC with the approved petition. Also people with approved expedite are not receiving any decision even after month or month and half and finally even congressional inquiries can't seem to get anything rolling. To me it just seems that something major has happened that is stopping any work to be done on these cases. I just hope they haven't lost all of our files

Has there been any plane crashes en-route from California to Texas? Posted Image

You're right though - something major HAS happened, as even senators cannot get through. Our latest call to a very nice Tier 2 person, when confronted with the lack of action on our expedite was that he couldn't believe why it hadn't been dealt with. Another officer told us that she would fax Texas on our behalf, and then said "Mmm - that's weird, they have removed the TSC fax number". Very strange, and worryingly puzzling. We hope now for a miracle of batch approvals.....

Thanks Doc, I just called and talked to Representative, he Said i cannot create SR right now as i am under 180 days, and when i asked about my priority date he said currently we are processing 16 or 17 July petitions, well i think couple of weeks ago someone from this thread received a same statement from them , :bonk:

Yes, we were told three weeks ago they were working on July 17th petitions....

What the hell are they reviewing? They treat us like criminals, even worse because criminals are usually informed about the progress of their cases. They transferred our cases to speed up the process, what a joke...

I am REALLY curious as to whether ANYONE has got ANY paperwork up to NVC from TSC. I don't think they have approved a single case correctly, and we were all transferred on the 2nd November. I think it is our right to know what is going on there. US citizens have paid good money for the applications - this is not a charity. USCIS have part of their wages paid by customers, and, as with any consumer service, at least have the right to know exactly where they stand.

It has been 15 business days since our 130 was approved (Dec 9). Still no NVC case number. NVC says they do not have our file. I emailed TSC Dec 24 asking for the exact date that our 130 was sent to NVC. No response yet.

Dan - Given TSC said they never sent your file to NVC, I am pretty confident they did not send mine either. I will call NCSC Monday and demand an answer on the location of the file and why it has not been sent to NVC. Total waste of a month. What do they care?

I am completely on board with filing a class action lawsuit against USCIS. Let's seriously look into this and post about what we find.
Does anyone on VJ work in PR and know the best way to garner media attention for this issue?

I can only imagine how you and DanTes feel. I'm not sure whether I prefer to be in our position - expedited, but waiting impatiently for action, or apparently approved but still no further forward.

Does anyone know if ANY ONE, has been moved onto NVC and onwards from TSC? It seems to me TSC are on complete lockdown, and despite posturing, have actually achieved nothing whatsoever since all of us were transferred.

If anyone has any success stories from TSC, please let us know.

HAPPY NEW YEAR to all - may this be a better one than the last!

Has anyone had 30 days pass since their service request was initiated? I'm just curious. And caffeinated.

We initiated a service request on 9th Novermber (Expedite), and we were approved for expedite on 26th November - we received a Hard Copy from TSC.

30 days have passed since then, and so far nothing....

I don't see why they would even contact previous employers or landlords...that seems like bs to me. It has no relevance to a bonafide marriage. Yeah its great that they can say ohhh we need to do background checks and sometimes that takes time, but it doesn't help the fact that other people from our countries are getting approved in much less time than us. They gave you those answers to keep you appeased. I doubt ALL of our cases need more intensive investigations and that is the reason we are out of the 5 months processing time (it will be 6 months for me in just 5 days). They will never admit that this was their fault for not thoroughly thinking the transfer through and which filers to transfer. Like I said before, transferring any of us was a huge mistake....September/ October filers should have been transferred. Useful information, but it doesn't change the fact that we are still waiting six months later and some September filers got their NOA2s in less than 3 months.

I read somewhere on a USCIS site that the background checks done at this stage had nothing to do with employment/landlords. These checks are deeper, FBI/Interpol & name checks. I think the USCIS reps are saying anything right now to appease us and get us off the 'phone. I don't think even THEY know what is going on at Texas.

I follow this thread even though I wasnt transfered to TCS from CSC. I was instead sent to OPFO from CSC, same difference. They are a bunch on snails as well. We are still waiting for our NOA2 since June 2010 transfer date, NOA1 February 2010.

Some have lost their hope. What helps me is coming on here VJ, reading the sad or funny posts, calling USCIS, calling Senator Nelson's office and keeping close communication with my husband. Its all keeps me busy. Maybe too busy instead of working (dont tell my boss).

Inshallah, we will all receive good news after the New Years.

I have a case number at senator Nelsons office as well......I pray the next few weeks bring us all good news

Hello all,

Well, I had a pretty good experience with USCIS today, our processing date has already come and gone. We were due on December 9, but with everyone else we were transferred to the Texas Service Center.

I called the National Service Center today, and of course because of the transfer, the Tier 1 rep couldn't help me to much with the detail, except to tell me that I needed to wait until January 2,2011. He did contact a Tier 2 rep to see if they could submit a SR for me, and of course he could not do anything for me. After explaining to them the situation, and being very polite and nice, they transferred me to a Tier 2 Rep. After the 14 minute wait I was able to speak to the Tier 2 rep.

The Tier 2 rep, took the information that I had, and we chatted a little. She did explain that I did need to wait for the 60 days to pass before I should be calling. But she did manage to submit a SR for me, with a new number to find out what is going on with the case. She also explained a few more things that I did not realize about USCIS, in regards to there processing. My eyes were opened as we had a 20 minute chat about how things really did work at USCIS, and it's made me a little more paitent with there process.

The rep explained to me, that sometimes it is not the USCIS that is holding up the process, it can be the checks they are doing and the fact that there can be a delay, thanks to the employers not returning the information in a timely manner. So be paitent in this holiday season, as we all have loved ones that are waiting too.

She did provide me with a Service Request number, to follow up with the USCIS in 7 days. I know that is still next year, but at least with talking to them, and hearing the explanations, and getting the follow up SR #, I feel better today. So hopefully next week, I can post up something more then what I have.

Keep yer chins up everyone,

Thomas

Peace and good luck to you!

Yup. My friend just filed for her parents last November, and is already teasing me that with the way things are going, she might have hers earlier than mine. I said she should be glad she's my friend, or else I could have given her an uppercut. It would be nice playing on a level-field though, not like what they did to us.

The annoying thing is, we have actually PAID for this service, and as such, are customers. It is totally wrong for the petitions to be processed out of order. I wonder if we'll get a partial refund?Posted Image

Sooo I just called USCIS for the first time and spoke to an actual person and she said that on the 24th my case will be out of the normal processing time and to call back after that date to put in a request. Not any new information for any of us but I think that if I heard her tell me that "please wait 180 days after transfer" B.S. then I would've cried.

Jenny, try to get an officer or a T2 person. The CSR reps are there just to let you vent....they can't do anything really and know less then we do. I've called relentlessly for the past month and it's so draining but I feel it can't hurt to keep calling. I've gotten a few nasty officers but today \i got a very kind helpful one and she said she will work with me and instead of talking to different people every time, to ask for her. The girl at my senators office who is working on our case is out on Christmas vacation. Back on Monday. She seems to want to help very much but I just don't know how much clout they have.

It's not easy to get your case expedited. We more than fulfil the criteria in at least three areas as laid down by the USCIS. It wouldn't be right to air those reasons on a public forum.

So I have (yet another) question: if I call USCIS and get through to an actual person, do I just ask for a service request? Or do I have to beat around the bush first?

as soon as you get their automated voice mail choose English as the language you want and then hit *1 this will take you straight through to customer service, then you will have to listen to their STUFF.....which will be a total waste of your time.....when they are done, tell them you need to speak with an officer or a level 2 person. open a service request immediately if you don't have one already. I am absolutely DISGUSTED with the way this whole Texas thing is being handled. We have been totally screwed for time I am certain. Gary and I have been approved for EXPEDITE and the 23rd is our five month date. THis is giving me an ulcer. Good luck to you.

CONGRATS U&S, We know how you must feel!

We were told, in a conversation with USCIS on Tuesday, that what happened to you, is exactly what to expect. That is, no advice online, just a hard copy NOA2 in the mail.

He even looked at his screen and said something like "You could be approved right now - it doesn't need to show on my screen".

This is great news U&S, and proof that TSC ARE still working on our cases, and that we can be approved at any time.

Fingers crossed for all of us - what a Christmas gift. Posted Image

What a fair service to US Citizens....

We are the lucky fellows who got transferred to TSC and now we are supposed to wait for another month or so for getting a decision,,, let me mention one more time here that all late june filers and some of July filers are already out of 5 months. USCIS says us to wait another 60 days for these applicaitons.

AND CSC STARTED TO APPROVE SEPTEMBER FILES,,,, (THEY TRANSFERRED JUNE, JULY AND AUGUST FILES TO TSC, I GUESS TO TEACH TSC HOW TO WORK ON THE FILES,,, WE ARE THE TEST SPECIMENS HERE)

check this out
http://www.visajourn...5-got-approval/

We actually pay MONEY for this also, so we are customers. The luck of the draw I suppose, but it does sicken me that we are all in this little group. How very unfair, and maybe representations to congressmen/senators should be made. One thing that should always happen, is that the files should be processed in order - surely!!

Val and GaryNot TellingEngland2010-12-03 15:56:00

Here is my theory on this mrs.T - we are NOT approved and our case never was transferred to State Dept. We should still be in the Initial Review. They were doing something to our cases and messed up internally by choosing wrong boilerplate template and that's what caused the error. Subsequently, I know that so far U&S has also received a hard copy of that automated post decision activity email. This is probably USCIS error as well, as I believe (not knowing how their system works), once someone updates/touches/does anything to your actual case and tries to update the system, they choose different available boilerplates to update the online system. After that, system itself generates/prints hard copy NOAs to that effect. And the story ends.

Makes perfect sense, and also can explain the "YOUR CASE HAS BEEN TRANSFERRED TO A USCIS OFFICE" mails that some of us got, when the TSC has told people they haven't been transferred at all.

Fact is, we're all in Initial Review, and our cases are being worked on. I concur!!

I just got off phone with TSC. Same as Nile_Romance, this was my first time calling and the two people I spoke to were very helpful. My call was also escalated.

My NOA1 date is July 1 so my 5 month deadline was Dec 1. My most recent activity was the Nov 23 email and Dec 1 regular mail saying "post-decision activity" and that my case was transferred from the State Dept back to the USCIS.

The 2nd person I spoke to said she is more than 90% positive that I was approved, but that they failed to send me my NOA2. She said almost always if your file goes to the State Dept, then that means you are approved. She put in a service request to see why I did not receive my NOA2. Said to expect it within 30 days and that the other forms and interview schedule would follow.

If I don't receive something by Dec 16, I will put in another friendly call to TSC to see where things are at.

Hope this helps - esp. those of you who received the "post-decision activity" notification.

Thanks for sharing. That is more than helpful, and more evidence that TSC are working so fast, and have so little experience in these applications, that they are making errors.

Congrats to all who received that email!! Posted Image

New Information for Filers transferred from CSC to TSC and then to "USCIS Office"

Hey everyone, we were one of those couples who's petition moved to TSC and then got the notice that our case had been moved to a "USCIS Office". I just called USCIS to inquire where my petition was and the "officer" told me it was still at TSC and is being processed there. It never went anywhere.

I think these TSC agents haven't been processing I-130's for a while and are a little green on how to update the system correctly. :bonk:

PS - This was my first time calling USCIS. I got through right away, the first guy was very nice and helpful, he escalated my call, it went right through and then the 2nd guy was very nice and helpful too. For this part, it must be my lucky day. I don't know if my nerves could have taken the long waits and the negative responses from USCIS personnel that some of you have experienced.

Thanks. They kinda hinted at that when my wife called - you just confirmed it. I think it has been a long time since they processed I-130's, and I have to say, they DO seem to be working through them - but in reverse order!! Posted Image

OK so three of us (JamesandRosa, apeters, and me) on this thread who are at 5 months and have no decisions. There must be others not on this site who have similar NOA1 dates who are experiencing the same thing.

Clearly, they completely dropped the ball on early July filings considering some non-expedited August filers have decisions. This is so unfair. I hope they recognize this and expedite interviews once we receive approvals - whenever that happens. In the meantime, I am going to try and call TSC between meetings tomorrow although if it's a 2+hour hold time I won't be able to wait.

As a mid July filer, I totally agree with the unfairness here. It seems that Texas have the pile of I-130's upside down! Obviously, we are all pleased for the August people that have been approved, it's not their fault, but it does seem so very unfair that July filers in particular seem to be the ones suffering. I do believe though, that TSC ARE working their butts off now after months of nothing from CSC, and we will ALL be approved well before Christmas. Posted Image

I have no problem with August filers but now this is going unfair, august filers are getting approvals and june july filers are still at bottom of the pile.

Yes, I'm happy for them - it's not their fault, but there does seem to be an element of unfairness!! It's human nature for us June/July filers to feel a little a grieved.

I agree, and I think they make the process harder then it needs to be. I feel as though we the petitioners should have the choice of choosing which route we want to take instead of it being decided for us. If NVC doesn't want to process both the I-130 and I-129F at the same time then ask the petitioner to choose one and then go from there. I realize that they have already set their policy, but that doesn't change my feelings on the subject.

I notice your time line is very similar to ours also.

Yes, that just means it was transferred to TSC, but it is NOW BEING WORKED ON. My case says the same thing now, but at first when it was orignally transferred it just said it was transferred to TSC. It didn't say it was being worked on because I don't think the were working on it yet at that time. I think they just want us to know that they are actually working the cases now, so it's a good thing!

I agree with that.

I ALSO think now, the 129F & the I130's have been paired up again, so maybe we'll still be going down the CR1 route. That's my opinion anyhow.

Iam confused here No updates in my case yet, just a touch , is an update different from a touch ?? iknow i can check my petition's updates on the UCIS website but how do i know if my case got touched ?? please a clarification is required here.

No, an update IS a touch. When the website shows an updated date, then that is classed as a "touch". Posted Image
