Well my husband has been trying yesterday and this morning and when he gets to where he is supposed to type in the receipt #...he gets a recording saying this is unavailable at this time and the call gets ended

Has anyone gotten through to a person....yesterday or today

Perhaps not, but with the kind of resources our nation has there should be no excuse in it taking months or years to process family based immigration petitions for relatives of "US" citizens. I expect more from my government in this area.
Although I do prefer that Muy Solo make her voice heard to his political representatives rather than a public board.



Oh I agree I expected more from the US government also and it should not take the length of time it is taking....but that is no excuse for a blatent disregard for the law or to post on an immigration website after a few months of waiting. and as I previously stated I have never nor would I ever consider entering illegally.

okay, let me get this straight....he husband was previously deported and planning on coming back illegally!!!...there is a hefty fine and a jail term plus a life long ban with no waiver possible if he happens to do this and gets caught

she filed the petition less than 2 months ago!!!!

I am one of many sittting here waiting...in my own case almost 3 f**king years from filing the petition and no end in sight yet, I have been screwed over by USCIS so many times it is long past being funny
and NEVER not once would I ever consider entering the country illegally
I am sorry Muy Solo if this sounds harsh, but after less than 2 months of waiting you have not even earned the f**king right to complain

Once Vermont recieves them they will send a receipt notice with a new case #...you can check online status on the USCIS website for the waivers.

The working without authorization - this one I am not sure of

The overstay question - You are allowed 6 months out of any given year
returning to Canada for a few months and then going back to the US is going to put you into an overstay position....as you will have spent more time in the US than in Canada.

Arrest without conviction...not sure on this one either

but I would say in all probability you will have to file a I-601 waiver

My congressman contacted the Director of the Vermont Service Center a few times and got nowhere....he then wrote the Director of USCIS in Washington in April and it was only then we got some action in May...we still do not know if they lost my security checks or they allowed to expire as they were done back in August 2005 the FBI confirmed this in Sept 2005. I hope your Senator is able to help you...keep me posted

mine is also for an overstay...I see in your timeline that the Embassy would not accept your waiver....why the h ell not....you can use the reciept # from your waiver to track you case on the online case status....you will get nothing out of Montreal......have your Senator contact Vermont....they are the ones making the decision and holding the file. Once the waiver is processed then it gets sent back to Montreal.

the latest news on my case is that the file was touched on May 18th and again on the 19th...Vermont emailed my congressman's office on May 23rd and stated that my waiver was in the clerical section for the decision to be typed and mailed.....so far we have nothing....nothing online case status and nothing in the mail....contacted congressman's office yesterday to have them contact Vermont and hopefully at least tell us what the decision is.

There is no direct phone number where you can contact Vermont, they give the customer service number as a contact...the customer service center is merely a call center. My congressman's office has been in constant contact with Vermont in regards to my case since last July....we have been handed every excuse in the book....the latest being on May 23 that my file was with the clerical section for the decision to be typed and mailed. Haven't seen a damn thing yet.....

you have not posted your timeline so I am a little curious as to why you filed the I-601 with Vermont if you are immigrating from the UK. Vermont only processes Canadian Waivers....waivers for the UK are processed at the Embassy in London. Have you had an interview for your K-3 yet??

Question 11....on the form list what you have room for and attach a seperate sheet listing the dates you can remember....I also wrote since I am a Canadian citizen and I live close to the border I have entered the US many times.
I am not sure about immigration status...I think I wrote spouse of US Citizen approved 1-30 petition

No your fiance does not need to sign the I-601, but he does have to write the hardship letter they have to be HIS hardships should you not be allowed to enter the US.

Also they made me fill out a new form in Montreal as it has to be in triplicate so they let me copy what I had on the form I downloaded but they did require me to fill out the form they had at the embassy...and they were very good about giving me directions on some of the questions.

we have still not received anything from Vermont stating the denial or the basis of the denial
our Congressman is trying to find out why they were denied....guess they were not happy with

This is some advice from Laural Scott ( Immigration Attorney who specializes in I-601 waivers) for writing your own hardship letter. I have copied it from www.immigrate2us.net

DO NOT OVERWHELM THE ADJUDICATOR WITH LOTS OF WEAK ARGUMENTS.
You want to give the adjudicator your strongest three to five arguments for hardship and PROVE your hardship with documentation. Don't 'bury' your stronger arguments among lots of weaker ones. Start with the strongest arguments first and include weaker ones later in the brief. Same thing with supporting documents. Support your points, but don't overwhelm. If you have a doctor's letter explaining your medical condition, you don't need 20 pages of lab reports.

SUPPORT YOUR ARGUMENTS WITH EVIDENCE
If you say your mom has a medical condition, supply a doctor's note. If you say you have unusual job skills specific to the US, get a letter from your employer. If you say your ex-wife would not allow you to take your mutual child abroad, get a letter from her if you can. Getting supporting documents can be a pain in the ###, but DO IT! If you ask the doctor for your records and he doesn't return your call, CALL AGAIN! If your mom's psychiatrist says he needs a release form from your mom, get her to sign one! If you're embarrased to tell your boss that the reason your performance has been slipping is because your wife was deported, bite the bullet and tell him and ask for a letter. Note: if you have a very strong argument, but you absolutely cannot get evidence - e.g. your spouse was the victim of a hate crime in her home country, but never reported it - include the argument anyway and give LOTS OF DETAILS. Telling a very detailed story with names and dates can sometimes substitute for lack of evidence if it is credible that no evidence would exist (e.g. you had a surgery ten years ago relavant to your current state of health, but the hopital has purged the records).

KNOW YOUR STRONGEST ARGUMENTS
Below are just examples of various arguments on a scale from 1 to 5, with 1 being the strongest and 5 the weakest. It is not an exhaustive list.

Level 1 arguments:

(a) you have a MAJOR medical condition (e.g. brain tumor, multiple sclerosis, cerebral palsy) which makes you unable to move abroad and for which you really need your spouse in the US to help take care of you,
(B) you are caring for an elderly, chronically ill, or disabled relative who needs constant care and whose condition is bad enough that you either MUST live with the relative or you MUST spend at least an hour a day assisting the relative with things like hygiene or physical therapy, and this makes you unable to move abroad and makes you really need your spouse in the US to help you care for your relative and manage your other responsibilities, or
© your spouse's country is in a state of war or major political upheaval (e.g. Liberia).

Level 2 arguments include:

(a) you are the primary caregiver for your child(ren) from a prior relationship and the child(ren)'s other parent will not allow you to take the children out of the country AND the child(ren) have formed an emotional attachment to your new spouse or fiance(e),
(B) you have a serious medical condition that makes it very difficult for you to move abroad and you need your spouse to come help you (e.g. you need to have major surgery sometime in the next year, with an expected recovery time of several months),
© you are caring for a moderately disabled relative who normally can care for him/herself but occasionaly has episodes in which he/she needs a lot of help from you and during those time you, in turn, need help from your spouse,
(d) a relative is unusually financially dependent on you (e.g. your mother has just gone through a nasty divorce with your father in which she got nothing and because she has never worked, she doesn't qualify for social security, so you are supporting her in the entirety for the rest of her life),
(e) you have a child that you are putting through college or are about to put through college, or
(F) your spouse's country is on the verge of major political unrest (e.g. Boliva) or negative political change (e.g. Iran) or the country is known for oppression of one sort or another (e.g. you are a Christian woman and your husband is from Saudi Arabia), or it is in the infant stages of post-war recovery (e.g. Afghanistan).

Level 3 arguments include:

(a) you are the non-custodial parent of a child from a prior relationship and you have an actual relationship with that child and the child's other parent will not allow you to take the child out of the country but your spouse or fiance(e) does not have a relationship with the child at this time,
(B) you have a significant condition that makes it inconvenient for you to move out of the country (e.g. severe asthma and your spouse lives in Mexico City),
© you have been diagnosed by a licensed psychologist/psychiatrist with clinical depression due to your spouse's immigration problems (I've argued to the Administrative Appeals Unit that this condition should be taken more seriously by adjudications officers, but at this time I am listing it as a 'moderate' argument),
(d) you and your spouse have young children together or you have full custody of your child and can bring him/her abroad and your spouse's home country has bad public health conditions and bad public education,
(e) your job requires a license in both the US and abroad and it will be very difficult to get licensed abroad (e.g. attorney),
(F) you have job skills that are very specific to the US (e.g. a tax accountant with extensive familiarity with US tax law),
(g) your spouse's country has a very bad economy (e.g. Chad),
(h) you have a close relative who is partially dependent on you financially (e.g. your mom gets social security but needs your extra $500 per month to stay in her present apartment) or physically (e.g. your mom pretty much gets around ok, but her health has been declining and you expect her to need more of your help in the near future).

Level 4 arguments include:

(a) you have debts you wouldn't be able to pay if you moved abroad,
(B) your spouse's country has a high unemployment rate,
© your spouse's country has a high crime rate,
(d) you've been depondent since your spouse left the country, but haven't sought professional help,
(e) your parents are getting old.

Level 5 arguments include:

(a) you got a high score on the Holmes-Rahe scale,
(B) you and your spouse want to have children in the future (but are not currently pregnant) and either the wife is getting older or the foreign country has a high infant mortality rate.


Don't get discouraged if all you have is two Level 3 arguments and a couple of Level 4 arguments. While one Level 3 argument by itself might not make a strong case, a few put together can be very strong in the aggregate. Just present your case in the strongest possible light. If all you can think of is a couple of Level 4 and Level 5 arguments, I recommend that you pay for a consultation with an attorney to at least see if you can brainstorm some stronger arguments.

Note: whenever you claim that a relative is dependent on you either for direct care or for money, you must explain why no other relative such as one of your siblings can provide the same care or support.

Vermont service center sent me a letter on December 4th
addressed to my address and city but to the wrong province and no postal code
I got it on Dec 8th....so 4 days for a letter that was incorrectly addressed....I have to say was pretty good service.

did your lawyer prepare you for this?
did you have hardship letters and supporting documents prepared and were they filed with the waivers??

If so your waivers will be sent to the Vermont Service Center...you will recieve a recipt notice from Vermont for both of the waivers and new case #'s for each waiver....once you have the new case #'s you can track them on the USCIS case status.

There is a group of Canadians and others on www.immigrate2US.net
in the I-601 forum who also have filed waivers and their time-lines for the waivers are also posted there

Ok this doesn't relate to the visa per se but I had to thank whoever it was that suggested the English Toffee Cappuccino from Tim Horton's. I saw it on a thread here last week before I went to Kelowna, BC to visit my fiance. I think I had two of them a day while I was there. Now I will be going through withdrawals. :P

He wants to buy a case of coffee before we move him down in the Fall..... :P


Thought I would let ya know that you can buy Tim's coffee on ebay, it's a little more $ than buying it in Canada. Some guy from New York state sells it on there by the can or case. There is also a couple of Canadian food web sites that sells it as well, but the final price with shipping was cheaper on ebay. We bought a case a couple of months ago after running out...not as good as the real thing brewed at the store, but better than anything I can find in these parts. Funny thing, my american hubby was actually more excited to get it than I was! I do wish they made 18% coffee cream here, makes the coffee taste so much better, half and half just doesn't quite cut it :crying:

We have had those laws here in New Brunswick for a few years now...in the begining the law stated that Bars and Restaurants must have an enclosed separate room for smokers.....then they banned somoking in public places completely. PEI has already started covering up the tobacco products in stores, which will start here in NB very soon. All tobacco products must be covered by a drape so they are not visible to the consumer.

So Ontario and Quebec are only playing catch-up with the Maritimes at this point.

We filed our I-130 in March
it was sent to California in May
last week I got this email from USCIS

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: This case has been sent for a standard interview.

On June 20, 2007, we transferred this case to our NEWARK, NJ location to conduct the interview that is a standard part of processing this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. You will be sent a notice when the interview is scheduled, or if the office needs something from you.

Since Newark does not process I-130's I had my husband call the mis-information line
Customer service told him that their computer does not show our petition being sent to Newark
and to just wait until we heard something from Newark

Has anyone else had this happen???
