I really hope it works out for you and you get your visa in time.  I suppose you could still come to the US and use the venue for a party just so you do not loose all that money (Please note I did not say anything about a wedding, I said party).  I am so paranoid about visa issues that I did not book our flight to Kazakhstan this summer until I had my visa from the Embassy in Washing DC and this would be my third, but they could deny me for some reason.

I wouldn't put down any non-refundable deposits until you have the visa in hand.  You will probably be fine - but there is no guarantee.  We got our NOA2 Mid April last year and it took almost a month for it to get thru NVC and sent on to the consulate and then another 6 weeks to get an interview scheduled.  Then a  couple of days after the approval to receive the visa. ( each consulate is different on that).  My fiance got a flight here within a week of getting the visa in hand..  So we got our  NOA2 in mid april and my fiance arrived here July 5th.  Almost 3 months and we didn;t have any delays. 

It's different for each embassy so please don't put any money down that you can't get back.  Good luck to you guys I hope it all goes well for you!

He cannot leave the country until he gets his AP card.  AFter you get married in the US, you will need to file AOS.  When you file for AOS  you will also want to file for AP (travel permit) and EAD (work permit)  It will take about 90 days after filing AOS to get combo AP/EAD card.  He can not work or travel outside the US until he has this card.

Read the embassy reviews for your country.  There are many things that are specific for each country.  Chat on this forum with people who have recently had an interview at the consulate you will be interviewing at.  Find out what questions they were asked.  All the things that people had shared with us about the consulate in Romania were pretty accurate - right down to  the questions they asked.  If possible attend the interview with your fiance, especially if there are "red flags" with your case.

Separation agreement was the doc that shows who gets what, what settlement was paid to who and all that stuff. Not everybody has one. If your divorce docs show when you separated, that will do, as well, I think. You just want to ensure that you were "free to marry" when you filed the I129f, and, although, probably technically ok (as long as the divorce was final before the filing), it could be a red flag if it seems like you were in this relationship while still married to (and living with) someone else.
 

 

It really depends on the consulate - read the reviews for your consulate and chat with others who have been interviewed there and see if anyone has had a problem with it.    I filed for K1 a week after my divorce was final ( no waiting period to marry in my state)  Obviously my evidence for proof of meeting was from a time period in which I was still married.   I was separated but did not have a formal separation agreement to show.  My divorce papers showed our separation date as only a few months before our divorce was filed - when it was actually a lot longer.  I went to the interview with my husband and it never came up.  We were prepared to answer questions about it but was not asked one thing.  They asked for the copy of my divorce decree and that was it.            

 

Each consulate is different and each CO is different, so read the reviews and be prepared and it will be just fine!  Good luck!

I attended the interview with my fiance.  Not only was I allowed in - I was asked more questions than he was!  It made it easier for him that I was there.  While it wasn't easy coming up with the cash for the extra trip or getting the time off of work, not going just wasn't an option for me.  Some person who has no idea who I am, 5000 miles away from me was going to make a decision on whether or not I get to marry my fiance ....  you bet I'm going to be there!

Not all states will issue a state ID - Missouri will not because I94 expires in 90 days and they will not accept NOA from AOS - will only issue ID or DL with EAD. We just went through this process.

Not a problem to travel within the US. Yes bring passport and you can still travel once I94 expires (and it will expire before you get your EAD/AP card)- just bring a copy of your NOA1 from your AOS. I verified this with USCIS, as we traveled after we had applied for AOS and i94 was expired but had not received EAD/AP and it was no problem - they only checked passport

Agreed! There was a post on here back when I first sent our K1 application in 2011, where a couple was denied because they had filed their K1 application 2 weeks before his waiting period was up. The reason given was not free to marry. You have to be free to marry when you SUBMIT the application - not by the time you might approval. I tried to search for the link but couldnt find it.

As others have already pointed out, this is incorrect. If a K1 was an immigrant visa, then the Adjustment of Status process would not be necessary for K1 visa holders because Immigrant Visa holders are given green cards on arrival.

Just curious, you said the CO didn't even know about his previous denials? But how is that possible? I thought there was a section on the visa form that asks whether you've ever been denied entry into the US. Shouldn't the CO have seen that or did your husband not answer that question truthfully on his form? Just curious.

 

  I don't appreciate your accusations!   Of course we answered everything TRUTHFULLY!   If we had lied why would we ask the CO about it at the interview? 

 

The question I believe you are referring to is ON the DS 156 (now the 160)  It asks if you have even been been denied a us visa and if so what type and when - and we answered yes, B2 gave the dates and the reason 214(b)

 

I can't speculate as to why he didn't see it.  I can tell you this, when we were called up to the window for our interview, the CO had our file, and the original documents we brought with us in front of him.  Apparently he had already gone through our case and knew the questions he needed to ask us to make his decision.  Its not like he sat and looked through the file in front of us.  He was very straightforward and to the point.  I got the impression that they go through your file a head of time - determine what information is relevant to that particular case, and then use the interview to make their decision - That was my impression of  it - NOT saying that is what they do. 

 

 If you prove you have a legitimate relationship, then it won't matter.

 

I have been a member of this forum for 3 years and I choose to participate so I can help people.  I  share what I have experienced personally and try not to give misinformation.  We certainly didn't lie on our application.

My husband was denied a B2 visa twice in a couple month period of time before we applied for the K1 visa and it had no impact on our approval.  I was there with my husband for his interview and after it was over and we were approved we were casually chatting with the CO and we asked him about the denied tourist visas (particularly what we could have done differently  because we thought he had strong ties) and the CO didn't even know about the 2 denials.  He then looked them up in the computer and said there was nothing we did wrong - that as along as he had a girlfriend in the US, it really didn't matter what ties he showed, he wasn't going to get the B2 visa and we did the right thing applying for the K1.       The main point here is do everything you can to prove you have a legitimate relationship and it shouldn't be a problem,

first, if you are not planning on using the K1 visa until April or May - be sure to check the expiration date on the visa because the K1 does expire, usually the expiration date is  6months from the date the visa was issued. You can apply for an extension, but not once it has expired. 

 

When your fiance enters the country with the K1 visa, you then have 90 days to get married.  So, to clarify things, the K1 visa is what gets your fiance a one time entry into the country.  The I94 issued at POE will be valid for 90 days ( the time frame you are given to marry within)  After you marry you will apply for the AOS/ EAD/AP for travel -it takes about 60 - 90 days to be issued the valid EAD/AP card.  while you are waiting on this your fiance can not leave the USA.  if he does, you will have to start all over with a spouse visa if you want to come back.    Once the EAD/AP card is issued, they can travel abroad, however they can not reside abroad.  For the green card you will need to be here if you are chosen for an interview.  Not all applications get picked for an interview, however, there is no way to know if you will have an interview or not until you get a letter in the mail from USCIS.  The amount of time you will need to be here waiting for approval of the green card can be vary greatly.  If you receive an interview you could get it within a few months of applying, others can wait up to a year.  Basically, if you take a job out of the country and your fiance will be going with you before the greencard is issued, you will have to abandon the greencard and wait and apply for a spouse visa when you come back to reside here.

Do not worry about it. Many people have been denied a visitor visa and then go one to do the K1.   My husband ( then fiance) was denied a visitor visa twice.  He was not asked anything about it during the K1 interview.

Go to Mexico before he enters to America and get married there.. Then come back to the states to get married.. You have two weddings, spiritual and legal like what you want.

If he enters the US then drive to Mexico for your wedding, he cant enter America once again.. Then you file... Spousal visa this time.. Not a good idea.

 

If you get married in Mexico before he enters the US then he can't enter the US on K1 visa.

I am in the process of beginning the K-1 visa application for my fiancée in Romania.  If she applied for a tourist visa to the US at the same time would this hamper the K-1 visa or her chances of getting a tourist visa from Romania, which is very low?  Does the Romanian government have access to information, such as my application for the K-1 visa? 

 

Not a problem to apply for a tourist visa.  Tourist visas from Romania can be difficult to get especially if she has a pending K1, so make sure she is prepared to show strong ties to Romania and proof she will return home.  If she is denied the tourist visa it will not affect her K1.

Cut to the chase, when I was 13-14 years old I dealt with a lot of issues with abusive parents and because I fought back, police had been called.  One time the police escorted me away to a hospital for teenagers (I was mad, OKAY!) but i was never convicted of anything.  Should I worry about this stuff or no? 

 

My fiancee, from Canada, is aware of these moments.  But since I wasn't convicted of anything, I'm confused.  I check with my parents (whom we have a much better relationship with now) and they confirmed they never pressed any charges and I wasn't convicted.  

 

Again, I was an upset 13 year old! smile.png

 

I'm also 25 now.

It doesn't matter.  As long as you're divorced before you file the 129, you're fine.

I am divorced, decree in hand, and waited 6 months (Oklahoma requires 6 months after divorce before you can remarry).

 

I too had some concern on this issue but it is very clear on the K1 app and all docs related to it. You MUST be free to marry once you sign and submit the petition. This is pretty cut-dry in what I've read. As long as this is the case, you have nothing at all to worry about. Simple as that. Good luck in your journey!

 

As stated, I'm free to marry.  I just had cause for worry because it really sounded like regardless if you were free to marry, the CO could still deny you because they believe you cheated on your wife/husband.  I don't want that.  My fiancee knows why my ex-wife and I divorced.  I was talking to her during that time and she was a big part of helping me through the situation and all the emotions that came with it.

It just happens. my fiancee and i have talked about my past and she is aware of it all. she knows we fell in love while i was still married, and while we had been together intimately before the divorce was even filed, it wasn't the reason why.
