K-1 Fiance(e) Visa Process & ProceduresContacting a Congressman
I had good experiences walking into the Congressman's local office and talking to the case worker in person. Just bring the file you have and they'll get what they need. If a personal visit is out of the question for whatever reason, maybe you can just call them up and tell them what assistance you're looking for.

I was under the impression that drug testing is not part of the K1 medical unless the doctor suspects drug abuse. I know my husband was not tested for drug use.

Most illegal drugs, even weed, will not show up in standard drug tests after abstaining for a couple of weeks. Although THC metabolites can remain in the system for several weeks, in standard drug testing (e.g., the preemployment type), the concentration required for a test to show positive is pretty high.

It was a part of the medical in Jamaica.

I wonder why...

K-1 Fiance(e) Visa Process & ProceduresI made A MISTAKE!?
To the OP: Contact the Consulate in Addis. Contrary to what the first responder to your query said, the Consulate in Addis is not all that bad. Nani and I had a very positive experience with the Consulate when we obtained her K3 visa. Yes, I was there for the interview but only because they agreed to see us while I was there anyways. We sailed through that Consulate - from picking up the letter to picking up the visa - in 9 days. Calendar days, that is. Nani's mom - unmarried and without what would typically be considered significant ties to Ethiopia - obtained a visitor visa w/o problems to come to be here and help when our daughter was born. No tricky questions, no rejections.

So, again, contact the Consulate and ask them what it will take to rectify the situation that the errors on the application seem to have caused. They'll respond and you take it from there. Be respectful and polite when dealing with them. They hold the key to what you want.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresCan my US fiance just be refused time off for emmigrating/helping me move?

Let's all pray the new manager is transferred out soonish, ya?

In the meantime, yer man should be able to to ask for, and get, unpaid time off.

There's other names for this, as well.

unpaid vacation leave
unpaid days off
'not schedulable due to family'

the language varies, by state.
and
He'd have to request it.

Failing all of that, he can explore the avenue of 'unpaid leave of absence', as well.

Good Luck !

I thought the issue was scheduling rather than having benefit time available. If the manager refuses to grant the time off even if the employee has earned benefit time, then I just don't see how that same manager would then approve an unpaid leave request. That makes no sense.

It's a glance of what you're getting yourself into. Not sure how thing run in NJ but down south, you'd be sh!t out of luck in this scenario. Having a earned a vacation entitlement doesn't get you around the manager discretion in terms of whether to approve a specific time-off request. Now, they'll have to approve the time off eventually in a way that's meaningful to the employee but you can't really go and make plans prior to having arranged for your time way from work.

In my opinion, managers that screw their staff on vacation schedules are pizzpoor managers and don't deserve to be in that position. Personally, I bend over backwards for my staff when it comes to time they want to take off. It pays off in many ways - loyalty, productivity, motivation and retention - that it's a no-brainer to me. But there other types out there thinking that being a tight ####### with the staff will earn them the next promotion. More often than not, it doesn't. But by the time they find out, too many staff have suffered.

It's all a matter of what you want to say. I wrote a sentence, in the small space provided. Some though attach a seperate sheet of paper. I wrote that I met him through a friend and then traveled to Ghana to meet him in person. There was never a problem with what I wrote.

QUOTE (Bill y Bella @ Oct 18 2007, 10:36 PM) <{POST_SNAPBACK}>
Be careful with this. I think that the answer varies with the embassy.

Although, it states vaccinations are not required for K1, until AOS. It is true, the answer varies with the embassy. My husband was required to get them before the interview, per the embassys instructions. That is in Ghana though. Becareful, if she has to get them there, make sure she tries real hard to get a copy of the vaccination worksheet(and keeps that herself for AOS, not to turn in at interview), has to be signed by a civil surgeon, for AOS purposes. http://www.cdc.gov/n...x-a_693vacc.pdf
The civil surgeon my husband went to in Ghana, would not give him the form and so that caused a bit of problems when we wanted to get one here in the US for AOS. All of the doctors I called claimed they could not sign the I-693A without perfoming the whole medical exam again. So anyway if she wants to get them there just try to get that form signed, if it were me, I'd bring the form with me to the doctor and insist I need it filled out. I wish you the best.

K-1 Fiance(e) Visa Process & ProceduresIntent To Marry document with the I-129 submittal
On the I-129f, I only used the little tiny space provided. I basically said we met through a friend and I traveled to meet him in person and we had a good family time together. Also, we did not provide the letter of intent to marry when we filed the petition. We had NO problems at all. I thought we better submit the letter of intent though at the interview, for the both of us. So we used the example form here on vj. Did not provide any details, just put exactly what is on the example form. Of course everyone's situation is different, and you do what you feel is best. Best wishes!

If it were me, I would not send them the original divorce decree. From the way it sounds you need to send them a legible copy, it doesn't say original. K-1 Fiance(e) Visa Process & Procedures? about processing times

Hello all, I have checked the uscis website to see where they are at, as far as the processing times for the I-129f. I saw a couple weeks ago, that the California service center was currently processing applications dated for May, 2nd. Yesterday, it said, now processing for April, 18th applications. My ? is, do they always move backward instead of forward? If anyone happens to know. Also, when calling the 800 number, is there anyway to talk to a real person and not an automaited computer system?, I have not had any luck. Or maybe they have already began their Thanksgiving vacation.

I never relied on processing times because they didn't seem too accurate. Our I130 took around 90 days to get through USCIS and I have noticed many with I129f's seem to be about the same or quicker. Yet, it really depends on many factors. Take heart and don't worry too much about the processing dates.

Thanks, for the reply, I am not so much worried about the processing times, I just wanted an idea of how they operate. Thanks again, have a happy thanksgiving and be safe.

At least you recieved your IMBRA RFE. I have not received anything, since the transfer of our paperwork in June!!!

Honestly, I dont believe in anyone anymore!!! I wrote my Senators and they say that CSC is reviewing files in STRICT CHRONOLOGICAL ORDER! Then I go to this website, and people are getting approved, who file in August???

I dont know anymore, maybe we are just not meant to be :(

Oh dont say that. like someone else said you have to have faith. Hebrews 11, Now faith is being sure of what we hope for and certain of what we do not see. Prayers also work, you may not get the results intantly, but they will come. Be patient and trust in the Lord. All things come to an end, this too shall pass. The Lord puts us through testing at times. I read something a couple months ago, it said, the tests of life are designed to sharpen us mentally and strengthen us spiritually.
I hope you do not give up, because going into the process, you should already be aware that the immigration can and will move at their own pace. What can you do? but wait. Good luck to you and I pray the immigration will hurry along with your case. God Bless.

K-1 Fiance(e) Visa Process & ProceduresBest Type of Visa

I am in the initial stages of getting a girlfriend to the US. We met on line and she and I want to proceed. I have read a lot of info on the net, but I am confused by all the information. It seems that the K-1 visa is the Fiancée Visa. But I did read that the fastest way is to for my Fiancée to apply for a tourist visa and then apply for a change of status. I could go there to meet her as required, but the expense and time away from my job to go to the Philippines would make things tougher than necessary. Besides, if she came to the US, we could spend more time together to see if how things may work out. But I also read that if the intention is to come to the US on a tourist visa, with the intent to marry, the visa will be denied.

I hope someone can help me with this confusing process.

Thanks
Harris

Is there any way you could find out the price for the airline ticket, and see for sure how much time you can take off work. Maybe 2 weeks, just as long as you have met. The ticket may only be 1,000 - 1,500. Explore all the options. I really didnt think it would be possible for me to go to Ghana the ticket was 1,400 and I flew with martinair the first half and klm the second half, but I said ok I am going to go and then did all the things necessary, it took me a few months to get the money and all other things, passport, visa, shots. etc. I have actually read that the fastest way to get your fiance here is with a fiance visa. I have also heard that if someone travels to the US on a tourist visa and their actual intent is to marry, it is visa fraud, and they will have to go back. I found this site after submitting my I-129f, but found it to be very useful, I love it and wish I would have found it sooner.
The only advice, I can think of is travel to see her, or she can travel here, but without marrying. But when you think of it, it's probably easier for you to go see her. For you to get a visa is much easier, then for her to get one to come here. Anyway, hope you are having luck with getting the answers you want

K-1 Fiance(e) Visa Process & ProceduresGreetings Friends, New Here with 2 Q's

Good day all
I have two quick questions about this process. A little background: I am going to bring a female, high school degree, no english, 25 y.o. from Peru. I am 26 m from WI with a university degree.

Where do I send this I-129F form, and all my info??
It said on the I-129F form that the place for me to go is Nebraska, is that correct?? Even if Minneapolis, and Chicago are closer?

ok, 3 Q's please. I was just reading a question a minute ago. He said that he needs the 2007 form, will I have to send this before Jan. 1 to be able to use the 2006 form still??

and my last question. If her birth certificate is in Spanish, do I have to have that translated to English?? Would a Spanish high school teacher be fine to use to have her translate??

Thank you very much all

Without trying to be rude in the least, al respect intended if you have a degree and you can't understand the six pages of instructions on the I-129 please get an attourney because it gets worse from here, Good luck, Jim

Wow, Jim you said you were not trying to be rude, hummm.

To answer your questions, raspect, first of all you dont need an attorney, anything you need to find out can be found on this site, or if you dont find it, ask. To my knowledge the only reason you would need an attorney, is if you have a criminal background, or things as such. I hope you have met this lady in the past two years, as that is the first step. Even if the other states are closer to you, for sending the application, you still must send it to the place they specify. About using the 2006 forms, I believe as long as they have received them before the end of the year, you will be fine. But you better hurry up, cause you know the holidays are near and I'm sure they'll be closed. And if you send in out dated forms they will promptly send everything back to you and ask you to submit on the revised forms. I know because it happend to me. Also some where I read that all forms must be translated if in another language then english. I think that should answer your question. Not sure about the teacher for the translater, maybe it is ok, you should do some more research on that. Well the site doesnt say anything about the intent to marry having to be typed, send it in the way it is, and if they want it typed they will send you an RFE,
I wish you all the luck,

K-1 Fiance(e) Visa Process & Proceduresk1 visa and other visas pending

Possession of a business visa will not impact the petition process. You don't need a lawyer unless you have complications in your case but it never hurts to have an initial consulation with one to be sure. I would suggest one in your case due to the work visa and to be 100% that there will not be any problem traveling to that US with this visa while the K1 is pending.

Spend some time reading through the guides to develop an understanding of the entire process.

About the NOLO book - I've never seen it firsthand but I've read several posts indicating that there are many errors in the book (or perhaps it's outdated).

could be true about the book, I was checking the site she gave and it says the book went out in 2005, well things have changed, I am sure since then. There probably are some things that are out of date or incorrect. Thanks for letting me know.

K-1 visa is a fairly easy one to apply for, nothing complicated.

Hey everyone.

I have a couple of questions regarding this process....my fiance and I want to apply for the K1...IS it really necessary to get a lawyer to do this for us or is it
something that can be done without spending the $2000????

Also if my fiance already has a business visa is it still possible to apply for the K1 visa? will having the other visa hinder anything?

I am new to this process so I need to know what I am getting into...thanks!

Hello, I don't think you need a lawyer, because everything you need is on this site and any time you have a question, come here and post, someone's bound to answer. Browse around, I have found a lot of the answers to my questions, reading old posts. This is a great site. I think the only reason you need a lawyer, is if you have a criminal background or things as such. Look under Guides and you'll find some info. for getting started.
I am not so familiar with, if your fiance is having a business visa, but I believe on the I-129f, it asks if the fiance has ever been issued a visa, I would put it on there. Someone will probably answer that question a little better then I can.
I wish you all the luck,

ok here it is, from the guides section, on the bottom of the page, under other important things to know. It says affidavit of support tips, in case you want to read all of it, but I'll give you this little info.

The US fiance is ALWAYS the primary sponsor, but may have a co-sponsor. If there is a co-sponsor, both the
US fiance and the co-sponsor will EACH have to fill out the affidavit I-134 or I-864 and EACH will have to provide
supporting documentation.

I believe you must also fill out the I-134, I quite remember reading some where, that the petitioner must file the I-134 and if you don't make enough then you have a co sponsor. I wish I could remember where I read that, if I so happen to find it, I'll post it on here. Hope this helps for now, Best wishes

If she is aq mother w/3 kids on welfare she should go to the local trailer park bar and meet a husband. She got no business being approved.

That was the most ignorant fu!!ing remark!!!!!! Just because she is on welfare does not mean that she is a low life or less of a human being than you are. I am on disability and have two kids, I was on welfare for 2years before I received my disability. I attend school so that I am able to get a job that my "physical situation" will allow me to support myself, my kids, and my fiance. There is no problem with a person being on welfare if it is needed. And unless you "KNOW FOR A FACT" that she is on welfare just because she does not want to work......then I suggest you shut your FU!!!! mouth. She came here to ask a question and get some advice and help, she did not come here to get knocked down and ridiculed by some AS!HOLE like you who believes all people on welfare are low lifes. Look in the mirror, the only FU!!!! low life I see here would be you, and I pray to God that your fiance realizes what a selfish, ignorant, heartless person you are, and deceides to make a better choice for their life.

I was just thinking that instead of worrying about filling out all the paperwork for a petition the person ought to try filling out an application for a job with health benefits ( UFCW) so we don't have to pay for number 4. Oops I mean so her sponsor doesn't have to And about the stupid part. Who is stupid enough to think if u on wefree u gunna get approved/ 3 kids and self Get real!!!!!!

my opinion is do it yourself, as the others have said. VJ is the best site around and you will have all your questions answered, from others that have gone throuhg it. The lawyer has experience, in the sense as filling paperwork for other people. But until you have gone through the process yourself, do you really gain the knowledge. K-1 Fiance(e) Visa Process & ProceduresOther fees?

I've been doing alot of reading at this site. I knew about the fee for the I-129f. I have noticed in other's timelines that there are other documents, each with their own fee. Some have them listed and others do not. What is this elusive "packet 4"?
Have I overlooked the list of what forms are needed? Ex: 1. I-129-f $180 2. I 130 $???

On the FAQ, it lists really only 3 forms: i-129f (fee), G-325A(no fee), and I-134 (no fee?). What others are needed and what are their fees (if any). I'm sure that most of us poorer folk would like to be able to prepare ahead of time instead of wondering which bill to put off. What fees (and/or bribes) are needed at the consular level? Is it dependant on whom you go thru? Any extra forms that I can send to aid in the process?

Thanks alot!

hello, I am not really sure of the other forms your fiance will need for the interview. DS156 and DS156K I think come with package 4. But really i dont know for sure, because Im still waiting for noa2. there is going to be a form to fill out DS230 with package 3, I have hear it is part 1 for that. As far as fees for those, not really sure. But there will have to be money for the medical exam, police report, and visa. I'm sure someone else can answer your ? and you mention the I129F is 180, I believe its 170. that is what I paid, unless they have changed it. I dont think any bribes will work when you get to the consular level.

K-1 Fiance(e) Visa Process & ProceduresLetter of intent
My fiance and I did not include the letter of intent for either of us. We got the approval last week, no rfe. I thought we would for sure get an rfe. Well, we'll type a couple up for the interview, something tells me they'll want them there. Good luck, I would not worry about it so much.

K-1 Fiance(e) Visa Process & ProceduresAverage number of Touches before NOA2
My case was never touched. So, i guess it depends. But I don't think it really matters. Don't worry you'll soon be getting your noa2, I've seen Vermont is very fast. Good luck.

K-1 Fiance(e) Visa Process & Proceduresletter of intent to marry

wow I feel dumb, in our letters of intent to marry, we wrote why we wanted to marry. I made these statements about how we have spent time finding if we were compatible on several levels and how we are happy and in love...but I didnt say in 90 days, I assume that is understood.

His letter....oh my god, I cried when I read that letter. I plan on keeping a copy so when we get into an arguement I can re read it. It was really heart felt.

I believe it should say something about intending to marry within 90days of entering the US. I would not worry so much about it, I didn't send in one with my petition, for either of us and had no problems, 0 rfe's. We plan to make them up for the interview though, as the CO may be looking for them. Do you live in Tampa, I see that is your local office? I live in Tampa, so just curious. Best of luck, Lisa
