K-1 Fiance(e) Visa Case Filing and Progress ReportsDecember 2008 K-1 Filers
Well Deanna is on her way to the UK to visit me as I type. She is landing in the morning and I am so so excited. Really don't know what to do with myself. I mean I need to sleep but knowing she is on her way and as every second passes she gets even closer to me is just an amazing feeling. It has been almost 100 days since I saw her and it feels so long ago. I really don't know how I will behave when I see her. I mean it will be like meeting all over again.

I'm a mix of nerves and excitement right now. I just really can't wait to see the love of my life in person.

I hope you are all well and that you see your loved ones soon or are with them now.

All the best

Luke.. and soon Deanna.

Yes of course it does. Ha.

They received it in December so I think your OK.

Well your NOA1 may already have been issued but you will receive the hard copy at a later date. Our NOA1 was issued on the 19th but we got it in the mail on the 29th. Seems like they use the slowest possible mail.

Hey everyone.

Just wanted to see how you are all keeping. So now that December is over and done this is it now. The chance to become a CSC December filer is now over, our lines are now closed...

So where are you all? There must be more than this.... Well if this is it then that's OK.

Well I hope everyone is doing well. As time goes by it brings us further away from the day we sent our petition but closer to our day of approval... Hopefully.

So Deanna is coming to visit me in the UK in only 4 days after nearly 100 days apart. So I am very excited about that.

Anyway, hang in there everyone and look forward to hearing from you all.

I was wondering that. Trying to figure out what path they take. Like I said they don't update it very often so you just have to wait it out. Ours arrived in the morning on the second day after posting. Thing is with Christmas I imagine the USPS are really busy.

Just keep checking it online and hopefully it will arrive for you soon. Then you have to play the other waiting game for you NOA1!

Good Luck guys.

Well Congrats on sending it out. That is one small step closer to your goal. I hope it arrives soon for you, as long as you can track it at least you know when it gets there. Although they are pretty slow at updating the tracking site.

Deanna was almost a little sad to let it go after we put so much work into it.

Alright then guys, thanks for keeping up posted and for updating your timeline. It's kind of nice to see yourself on the list and check to see what number you are and how many places you have climbed.

We are checking the mail everyday to waiting on our NOA1. Hope it arrives soon.

Hey that's great guys.

Well use tomorrow to get it all perfect. Check it over, make sure it's all in order and your cheque/money order is the correct amount. Deanna did a really good job of organizing ours and tabbed it all out into sections to make it easier for the adjudicator. We sent it via USPS express which was supposed to arrive the next day by 3 but arrived the next day so we got our money back.

Good luck getting it sent and let us know when you send it.

Ohh, and make sure you fill in your time line when you do. The you can see yourself on igors list.

I was just wondering....

What days is the CSC open and what are their working hours?

Just thought it would be nice to know when they are working as to weather to expect any news or not.

So if anyone knows this info or wants to have a guess, then post away.

Well our package finally arrived. A day late but at least it got there. It arrived at 11:20 and was signed by a V Semegi.

So now we play the waiting game.... According to the Immigration Timelines, the average wait (over the past 6 months) from sending to receiving NOA 1 is 8 days.

So going by that we should hope to get ours on the 23rd of December. We'll see I guess.

Will keep you up to date. come on man, where are all the December filers..ha.

Hope everyone is well.

Hey Guys.

Well it is time for us to move from the main forum, join this sub forum and play the waiting game.

So anyone out there who has or is filing their I-129F petition in December 2008, post your dates, details, info and any thing you want to talk about regarding this long and very testing process.

We are better together so lets help each other out guys as we all have this one massive life changing thing in common.

So to start...

We sent out Package out on the 15th of December and are awaiting confirmation of delivery. Checking the USPS tracking page every freaking hour, ha.

I hope everyone is well and looking forward to Christmas and New year.

K-1 Fiance(e) Visa Case Filing and Progress ReportsAnyone November people getting NOA-2???
We filed in December of 08 and were approved in May.

I think you may be out of luck hoping for an NOA2 right now.... unless the timeframes have changed since we filed. Last I saw it was 6 months.

Some do get lucky and get approved very quickly. We have some friends who applied a week before us and were approved in March.

Anyway I hope all goes well for you and you get your NOA2 sooner rather than later.

We were checking ours all the time too at first. But then just we stopped checking ours and had been approved for 2 days without us even knowing.

A watched pot never boils as they say.

Don't rely on the e-mail notices as they never e-mailed us during our K1 process. They have been with the AOS so maybe they got better.

Good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresForm I-693
Just beware of the RFE a lot of people have been getting (including myself) for the I-693.

It asks you to submit a properly completed and signed I-693. Even if you already did. This RFE confuses people as it is not specific. Some just go and get the full medical anyhow, some get their congressmen involved and some like me just submit the vaccination record again. Not sure if my way works yet but fingers crossed.

Good luck

I don't understand. Are you going there on a K1 visa?

If you have a K1 visa just show that. If you are going on a Visa waiver then are you going to get married then return to your home country and file that way?

More information is needed.

K-1 Fiance(e) Visa Process & ProceduresToo Many Names...
Hey guys. Im just having a go at filling in the I-129F as a rough draft to see how much info I don't know so that when it comes to doing it for real i'll know the form like the back of my hand.

I was just wondering, My name is Redmond Luke Sebastian Hayes. (No laughing). So under family name I put Hayes, First name = Redmond. Now, under middle name I put Luke. Now there is an option on the form to put

"Other names used (including maiden name)"

So, do I put sebastian there or not?

Sorry if this is a real stupid question but ive heard they can be pretty tough with these forms if there is anyone thing wrong.

One more thing, Is it necessary to put None in every box that doesnt apply to you or is just once under the same question number ok.

Cheers for any help in advance guys...

K-1 Fiance(e) Visa Process & ProceduresBoxes too small...
I know you can fill out a seperate page but it just seems silly to put a single name on a seperate sheet.

As far as the months I was refering to the G-325A past 5 year jobs and residence questions. Is it ok to abriviate the months as spelling the full month out does not fit on the form.

Cheers.

Luke.

K-1 Fiance(e) Visa Process & ProceduresBoxes too small...
I have been filling out the I-129F and G-325A forms online and I have a question....

Some of the boxes, Like the one for my middle name on the I-129F form don't fit my name in. Luke Sebastian is my middle name and when I type that in it doesn't show it all. It shows half of it and a plus sign.

Does this mean I have to do an attachment sheet just for my middle name?

Also, it's the same for the dates on the G-325A. The months September, November and December do not fit in. Is it ok to put Sep, Nov and Dec instead or does this call for yet another attachment sheet.

Sorry if i'm overthinking all this I just want to ensure that when it is sent it is sent right.

Cheers for all your patience and words of advice.

Yeah, I have done an extention sheet as it won't all fit on the one form. I took a while but I think I have managed to get all the addresses and dates (some a close guess as I don't remember exact months) filled in.

Well im hoping this move to the USA will be my last. haha

Hi everyone. Filling out the G-325A and I have a question.

I am 22 and have lived in like 7 different places in the past 5 years. I tend to move every six months and the same with my jobs. I never tend to keep a job longer than 6 months.

Ok, here is my question. Is it neccesary to put all the places I have lived, even its its for only 3 months?
What do they use this information for?
Will they look down on me for moving so much and not holding down a single job?

Cheers

My fiance, Luke was the one speaking in the posts and after reading the feedback I'd like to say thank you for it all. It will be very helpful. Luke and I want everything to be done and sent properly. As of the concent issue I understand that my parents should be the ones writing it but as she is sitting next to me now, no one is left in the dark in this situation. Luke is extremely helpful with the process and I am very thankful for that. He's a darling.

pushbrk, you're making a lot of assumptions that seem to be unwarranted. He's asking what the form of the letter should be. That doesn't entail that he's writing it on behalf of the parents any more than someone following the guides here is arranging for a spouse because they got to see the sample letter of intent, or that someone asking for a sample of an answer for Q18 is planning to lie about how they met.

I dunno, maybe it was the "Of course I'll have them sign it." that gave me the impression. no0pb.gif

Opinions vary. I understand that.

I actually said

"I will have them sign it before I send it"

I said that on my second post, right after you had already made your assumptions. So your above point is invaild.

I am not making our relationship sound like anything. I was just asking a simple question...ok, very simple question. I got that.

As for it all being on her back. Me and My fiancee are doing this together as it is not a very easy process, and the reason we are doing it is so that we can be together. I just like to help you know?

I actually thought we needed this letter to include in our I-129 package? But by what you said, we don't need that until we are actualy appling for the licence?

Thanks again for responding

She's not the applicant. She's the USC petitioner. The answer is yes, she can.

That surprises me. What is the age requirment then?

I believe as long as she can marry then she can apply. But correct me if i'm wrong.

A letter of consent for your fiancee's parents, is her parents' responsibility. I take it she is the petitioner. If she and her family can't figure out how to write such a letter on their own, I would have serious doubts about the validity of your case. The letter is a simple statement that could be as short as a single sentence, plus a date and signature.

Couldn't have said it better myself. Check State requirements and check with Clerk of Court.

I have checked. We require a letter of consent from a parent. As there are example forms on the site of how to write a cover letter and fiance intent letter, i just figured there might be a certain way this letter needed to be worded.

Thanks for your responce

Hi, yes she is the petitioner. The reason I ask is because I know that everything has to be just right with the application and I don't want to delay it by missing something obvious. I kind of thought it was a silly question, but I always like to double check.

The only reason i am doing this form is because I am printing everything out. I will obviously get it signed by her parents before sending.

This forum is designed to help people so thats why I asked this question, not to have someone respond in such a childish way. You don't ask, you don't know.

I think the key word is 'relationship'. I think the intent may be to stop abuse by relatives (particularly if the age of consent is 16)

I found this on another website for the description of Significant relationship

"Significant Relationship: A situation in which the actor is:

the complainant's parent, stepparent or guardian;
any of the following by blood, marriage or adoption: brother, sister, stepbrother, stepsister, first cousin, aunt, uncle, niece, nephew, grandparent,
great-grandparent, great-uncle, great-aunt; or
an adult residing, intermittently or regularly, in the same dwelling as the complainant (except complainant's spouse.)

This term replaces the previous term of "intrafamilial relationship" which was more precise but which tended, especially in small communities, to raise a
presumption about the victim's identity."

Do I fit in anywhere there?

Oh, her parents are fine with me. They don't have any problems with us.

The only sentence that worries me is

'Neither mistake as to the
complainant's age nor CONSENT to the act by the complainant is a defense.'

I don't understand how she is at the age of consent, yet this is talking about between the ages of 16 - 18, and how her consent to it is not a defense.

Hey everyone. I hope you all had a great Christmas and New Year.

I spent the holiday season with my girlfriend in Minnesota, USA. Was wonderful. Was there for 88 days in total, now she has come back with me to the UK until mid March.

I have an appointment at the US Embassy, London for a B2 tourist application as I am hoping to spend the summer in the US. I am a little concerned though after reading some websites about Minnesota Statutes. I am 23 and Deanna is 17. The age of consent in MN is 16 but, I came across this paragraph.

609.345 CRIMINAL SEXUAL CONDUCT IN THE FOURTH DEGREE.
Subdivision 1. Crime defined. A person who engages in sexual contact with another person
is guilty of criminal sexual conduct in the fourth degree if any of the following circumstances
exists:

f) the actor has a significant relationship to the complainant and the complainant was at
least 16 but under 18 years of age at the time of the sexual contact. Neither mistake as to the
complainant's age nor consent to the act by the complainant is a defense;

Does this apply to us, if so does that mean I can't tell the officer at the US Embassy that I am applying for the Visa to see my girlfriend?

I don't want to lie at this interview but I don't want to get into trouble because I was unaware of it.

Please help.

Thank you

K-1 Fiance(e) Visa Process & ProceduresFinancial support/sponsor
Hi, my name is Deanna. I am a United States citizen and my fiance is from the UK. We will soon be applying for the k-1 fiance visa and had a quick question about the financial support.

I am 18 years old and currently a student. As I am not working I will not be able to support my fiance. My dad is willing to be a sponsor. He is head of airline mechanic and has a well income. Will this effect our chances of getting the visa approved? If so, how? Any advice?

Thank you,
