We drcide to go on K-3 process, it will get me in USA faster.

I made the same mistake! headbonk.gif

Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3! You have to have been married for 2 years for an IR, CR1 is married.
The K3 has to adjust status which cost $1010 + $131 visas application fee. True, plus the initial filing fee.
Have to go thru the cost and hassles of getting a I-693 also. You mean CR1s don't need a medical or vaccines?
K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?
That’s the second interview if they are in doubt of your relationship.
Also a possibility of being deported. Yeah doesn’t happen much but it happens. What possibility of being deported is there on any K visa if you are following rules and timelines?
K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN.Not true. You can apply for a SSN about 2 weeks after entry. This is so the system is sure to have you on it.
Can’t do a LOT of things without SSN. Like work or get a drivers license in some states. True, a K3 cannot work until they get their EAD. It takes 60-90 days from adjusting status
Some K visas don’t get GC for a LONG time. Usually those who don't file their AOS for a long time!
If petitioner goes belly up before you get GC you stand a chance of being deported. Not according to new laws introduced recently that come into effect at the beginning of Jan 2010.
If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status! True.
CR-1 cost about $470
Get their GC and SS card in the mail within 6 weeks of arrival.
No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.
I’m sure I’ve missed a few things.
Bottomline is anyone that goes with the K3 the way things are now are masochist!
Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

Thank you for very valuble information, but our I-130 petition was aproved with mistake made by USCIS saying that i am in USA. They were sepose to send letter to NVC, and they told us that may take up for a few months. So we decide to do K-3, and honestly i am ready to risk and suffer in USA with my husband, then suffer in Tashkent/Uzbekistan without him for a 3 or 4 month more. Ever been in Uzbekistan? It is not europe and it close to Afganistan, so what would you choose after that information?

I was looking at your timeline & I believe we are filing the same thing PLUS that was extremely fast. Im so happy that once the NVC assigned you a number it got sent to the embassy thee exact same day. Im waiting on my case to be assigned a number. Once the embassy receives your case, any idea of what's next once its received?

I recived a letter from consulate in my country that they contacted with NVC and pakage of K-3 was sent to them on Nov 4, and they say that in a 2 weeks they should get the pakage and after that they will contact me to shudle appointment for taking instructions for visa and set up appointment for an interview.

You should be happy that your wifes or g/f have a habbits like that, you just dont know how lucky you are. Just imagine that - we all childrens of time when Soviet Union fall and Democracy didnt come in our world yet. There was no food in shops, there was no normal clothes, there was no normal plastic bags even. Just put yourself in our shoes guys, thats all, when you live half of your life in place where you need to eat only potato or BORSH for a week you start to collect everything what you have "Just in case". So give us a break guys and just let us get use to a new life. Oh and what about taking shower befor bed and wash hands and feets it is just a question of beeing clean and smell good and i dont think that take a shower after long day will make someone feel bad... Oh one more thing why we do the beds in hotel SINCE WE BEEN A LITTLE GIRLS THAT IS WHAT OUR MOMS TELL US TO DO AND IT BECOME SAME AS BRUSH YOUR TEETH IN MORNING. Hard to loose habbit in a one day, and dont worry about spoil woman, as much as i can see that is a husband job to spoil his wife! Isnt it??

P.S. Sorry if i miss spell any words.

K-3 Spouse Visa Process & ProceduresK3 and CR-1 visa advice needed
I'll tell you one think CR-1 is good stuff if you want your spouse start to work or get SSN right after landing in USA but it willtake longer time for your spouse to get in USA then K-3 trust me i have same setuation. Also CR-1 will save you extra 1000$. It all depends on what you want. If you want to be with one you love ASAP then take K-3, if you want to save money take CR-1. It up to you. I choose K-3, money is not everything in life for me and my husband.

If you really want, file for both together. Then continue with whichever one seems to be processing faster.

The K3 might save you a week or two. But the IR1 has other advantages on arrival. However, if cost/working is not an issue for you, go ahead and file for the K3 and IR1/CR1.

Thanks alot good.gif

We are very newbies. Not to the "system" so much as to this site. unfortunately, the internet has afforded us mostly with a lot of doom and gloom, "easy" Visa firms and lawyers. So we firmly believe the old addage, "If you believe everthing you read, maybe you shouldn't read".

We are confused on this site because it seems most are convinced that the CR-1 Visa is preferable to the K-3, but yet the histories shown indicate A LOT of time saved getting someone HERE by the K-3. And Anna in Uzbekistan and we not sure if consulate at Tashkent processing CR-1. Our goal is to be together asap. We are not concerned about costs and hassles once Anna gets here. Could we get some straight, correct answers on this? PUSHBRK, please respond!!
Anna and Mike unsure.gif

If a consulate processes and issues K-3's it also issues CR-1's... both are done at a consulates IV unit.

History has shown that a K-3 is faster but history is a changing

Is that basicly telling us GO AHEAD AND DO CR-1?

I'm studying yer timeline - yer 'within parameters' for the I-130.

Perhaps was an error in the letter?

I suggest calling USCIS, get a human, inquire, ask specifically WHEN the casefile will be sent over to NVC.

But - I don't have enough info for what yer doing.

I DO RECALL that folk who had a K-3 DENIED, would wait a few months, then KICK the APPROVED I-130 into play with an I-824, thus forcing it to move to NVC.

But it's NOT THE NORMAL THING.

Do you have a prior K-3 that was denied at the Consulate/Embassy?

We called them and they say that they made a mistake. They assumed that i am in USA blink.gif So now they will add a letter to I-130 explaning that and send it to NVC. I am amased what kind of headbonk.gif work there.

That form is used for 'action on an approved petition'.

Strange , indeed, that they ask for this.

Can you give us any details?

I can't imagine WHY you would need it - normally the casefile is transferred to NVC, and a dearth of 'more forms' and processing occurs at NVC.

Very Strange.

The I-824 has a payment on it too - 300 bucks, I think? #######?

IMO, something's wrong.

NOA just say that if we want to process I-130 we need to file I-824 form to USCIS and pay those 300$, and I-129F NOA say that it been forvarded to NVC. i dont know what is going on.

Anyone ever were getting that before?

Uh, tough choice. CR1 makes more sense since it's cheaper, less hassle but it might be another 2 months before an interview.

K3 must look tempting, right now.

Uh, I don't know.

Could you please fill in your timeline.

We did. How does it look? heheh

IR-1 / CR-1 Spouse Visa Process & ProceduresStrange luck in CR-1
We were set to go for the CR-1. Then USCIS pulled another one of their OOOoops, we boo-bood's. The I-130 was approved but stated that since my was in the USA......blah-blah-blah....I-824??..yeah right!!! Thanks folks. Thanks so very much.

But the good news is I called NVC today and they had a case number for us on the I-129F. So...I respect your opinion and would very much like your feedback on which way to go now. Getting my wife here is of primary importance, sooner the better, we were hoping by our first anniversary the end of the year. Called USCIS by the way and they gave me another number, a "reference number", and told me that it could take a week, or it could take a month, for NVC to do their thing on the I-130. NVC said they would be sending to the I-129F to the Embassy in Tashkent.
The question is what we shall do now K-3 or CR-1?
