3) No. And as others have pointed out, a more precise definition of "illegal" is needed. Did he enter without inspection or did he overstay his allowed period of stay?

I am back on VJ because I need the help of the VJ Masters.

I have a friend who is a US citizen, and has been married almost 2 years to an illegal immigrant from Mexico. Her husband has been in the United States for a good number of years (not exactly sure how long).

Is there a forum, links, ANYTHING that will help her and her husband?

They paid $500 to an attorney to do the I-130. They have received the NOA1. The petition has been forwarded to the NVC in Portsmouth, NH. The attorney told them that she needs $1500 before she can do the next process. The attorney will not tell them ANYTHING of what to expect for the next step of the process... and they don't have $1500.

Questions:

1) Do my friends HAVE to hire an attorney for the K3 process? (he is one of the illegal immigrants already here who wishes to begin the process to be here LEGALLY)

2) What exactly IS the next step for them?

3) Is there a forum specifically for the illegal immigrants already here and their U.S. spouses?

As far as I know, if anybody entered to USA illegally (no inspection) is not allowed to Adjust. He will be deported then.
I think that K3 is only for spouse living aboard (no in the USA). I'm right or wrong? and if all of this is true, that is not a immigration lawyer, he might be a notario, cause I lawyer should know all of this off hand.

Please correct me if I'm wrong.

Only a person who is married to USC can apply for citizenship after the 3 years marks on their GC. It doesn't matter if your mom is married to a USC, you mark period to applied for a citizenship is 5 years. Now that you will be 18, you won't get a citizenship either from your mom, but could apply on you own when you turned 5 years holding a green card.

8.1)...When can I apply for United States citizenship?
A...As a spouse of a US Citizen, you can apply for citizenship 3 (three) years after approval of your Adjustment of Status. Back at the AOS interview, your passport was stamped with the I-551 stamp and a date. The 3 year countdown begins with that date. This 3 year period does not include long absences from the United States.
If you came to the United States on a K2 visa, you can apply for citizenship 5 (five) years after approval of Adjustment of Status, as only spouses of US Citizens are eligible to apply for Naturalization after 3 years. However, if a K2 is very young, it is possible that they may be naturalized along with the parent, if the parent becomes naturalized before the K2 turns 18.

I just learned today that my friends who have applied for an I-129 nonimmigrant work visa (H1B) on april 1st, they got an answer today that says thier case has been sent to vermont along with thousands of others for processing. This might be some of the reason for such delays since then. Just a thought. Good luck.

if you have, include some bills .. even if they are not in both names... include some in each name... it still would prove that you live at the same address....

That's what I did, since some bills are under my husband's name and other are under my name, at least it will show the same home address.

What about credit cards, debit cards? any stament showing a joint account?

I see we both send our application the same date.

You can travel with your NOA1. As far as I know after the biometric and if everthing is okay, the only thing else to follow is WAIT. Vermont is working a little bit slow, so expect around 6 or 7 months to received your green card or your interview date.

You are not so late. I sent my husband I-751 on April 27 and he's greencard expired on 5/16, so it was 19 dates left.

Also add the state ID or drive license of both of you, that still prove your home address.

Just a quick update. As you all know we sent I-751 on May 18th , and they received it on 21st. Today we got the extension letter ( which was prepared on May 29th)in less than a month. We also got a biometrics receipt last week.

I looked at tour time line. We got married in October 2004, and sent our papers in December, 04. Although you sent your papers way earlier than ours, my wife got her greencard in July, 2005. The thing I want to say is how come she got her conditional card earlier than yours? It is interesting.

We are planning to travel , too, but my wife says she will not leave here until she gets her 10 year greencard. She is scared of having a stamp .... I do not know why....


I will let you guys know about our NOA , and etc. Because while we were checking some other timelines we saw that most checks were cashed almost in 30 days.

As soon as you get your temp (2 year green card) your years start counting. But you should be married and also had obtain your green card thru your USA citizen spouse.

The 5 years waiting period to apply for your citizenship is when you obtained your green card thru a non-citizen.

thx guys! actually i have my receipt notice that telling me my status is extended for a year, but I'm still waiting for NOA (Notification of Approval???? or Notice of Action????).


Well if you have your NOA1 you are okay, you don't have to worry about green card to be expired. About recieving your approval that might take up to 6 to 8 months, depends on your service center.

It stand for Notice of Action.
