K-1 Fiance(e) Visa Process & ProceduresInterview, who should answer?

We can NEVER know how many borderline interviews were turned into success stories, or how many "certain refusals" were given a second (fighting) chance, all because the petitioner was on the consular premises and the CO was so told.

While this is certainly true, that is a lot of money (hardship) for the majority of folks that can make a big difference. If a flight could have been gotten for the same price that I paid in October (850$), I'd have done it, but that is not the case any more. You can't honestly say to your fiance: "I bought you cheap." (From this great thread, for anyone who is interested:
http://www.visajourn...unication-woes/

I could have gotten a last minute deal for around 1000U$ yesterday afternoon with me flying out today and returning Thursday, but my other half told me: Are you crazy? That's 1000 bucks!
We know that statistically, his embassy doesn't have a history of harassment or being punitive for funsies.

This visa is the single most expensive wedding accessory for probably most of us here.

K-1 Fiance(e) Visa Process & ProceduresInterview, who should answer?

I think that with K-1s in particular, I've noticed a lot of fiances in the VJ community going without the petitioner without issue.

Are there many fiances in any other kind of visa?

K-1 Fiance(e) Visa Process & ProceduresInterview, who should answer?

In Lima, it's a good idea for the petitioner to be present, but not mandatory.

My fiance's interview is Wednesday this week. Because of the lack of reports of problems or potential issues, we decided that we'd prefer to have that extra flight money in our bank instead of with the airline. Of course, that being said, I am gonna check flights right now for a superbargain just in case it happens and I CAN rush down there...

Does the question have any qualifiers like: "List each child" versus "List each child only if you want to" or "List each child he has custody of" or what? Answer the question as it is asked. The majority of them are very simple and direct and leave no room for doubt if you take them at face value.

We just went through everything again via Skype for the interview tomorrow (this!) morning. He has all the cards, postcards, and letters I have mailed him. He even included the birthday cards that I sent to his parents and printed off several more photos that he likes. It makes me happy to see his enthusiasm for this "event".

GOOD LUCK !!!! so excited for you!!! I have been following you guys since I joined -- not stalking though, LOL
Your notebook sounds a bit like what my Gordi will be taking with him with the dividers and the pencil case with the zipper pocket, except I wasnt as creative enough to think to add a bit of extra stuff and now that you mention it, I will do the same, thanks !! LEt me ask you a question. How is he going to pay the $350 fee? Check? Money Order? Cash? I've been told yes cash, and I have been told no cash...which is it?? BTW...his Packet 3 is on its way...he still has not recieved it by mail yet. He called the embassy and they told him his interview date over the phone. So i dont actually know the small details yet.
Also, do you know about registering with DHL to recieve the Visa, is that done at the embassy the day of, or do I do that ahead of time online??
Thanks again and GOOD LUCK...let us know how it goes !!!
[/quote]

Thank you for the kudos. I know he is nervous to the point where he is just this side of freaking out and I want him to be as comfortable as possible. When I am nervous and upset AND I have chapped lips, well, it can be disaster-ha ha ha. I also included a packet of Kleenexes, too. I bet the restroom in the embassy has TP, but then again... (Another thing to note: Their notebook paper seems to be a different size than ours--because the notebook is from here, with things from here in it, I am hoping that will be a subliminal message to reinforce the legitimacy of our relationship. Seriously, there is a tiny tube of hand sanitizer in that pocket, too. I think it is only in the US that people obsessively carry that stuff. I want every cell of his being to say, "I BELONG with my American fiancee!!!!!!!!!")

If your other half is a gum-smacker or bubble-blower, include some candies instead. Werther's Orignals are a sure hit. :) :) :)

The comment about copying everything is a good one. This is why I have my own matching notebook.

For the fees, he is taking both plastic and cash. He can also always run to the ATM and get more cash, if needed. (ATM's there have both US and Peruvian money.)

For the DHL thing, we did it online together one evening while screensharing on Skype. It looked a bit complicated but then we were finished and it was like, "Oh. That's it?" I think it took us about 10 minutes. We did that a couple of weeks ago. You have to select which of the locations and there are tons around Lima and a couple outside the city. You'll need his help picking which one is best.

I told my guy to go take a long walk today so that he is physically tired enough to sleep tonight. His mother Skyped with me last night to tell me that I should be there for the interview because the Italian embassy requires it for their citizens and because they do this-that-and-the-other, then we should expect the same. hahaha. I reminded her that 1.) I am not Italian and 2.) We are not moving to Italy.

Another thing to note. He went to San Isidro for the medical but they refused to give him a copy of the DS-3025. I'd suggest he pick the doc in Miraflores.

Moderator, this might be best in the Latin American forum since it is so Perú-specific. Thanks.

K-1 Fiance(e) Visa Process & ProceduresI am stressing out...putting together package to send him for the interview
My Peruvian fiance has his interview in less than 24 hours. This is what he is taking:

Each item that is listed in his appointment letter
A notebook (like used in highschool to make organization easier) with dividers for each section (Application, Interview, Evidence, AOS, plus a couple of blank sections, 2 folders that he can remove, photo pocket pages with tickets to things we did together with a photo of us there (ie--bus tickets to Nazca with a photo of us on top of a hill with the lines visible in the background with our tour guide standing with us), one of those zipper pockets (with pens, chewing gum, chap stick, and post it notes), and some trivia about his new home state, city, and country to read while waiting to distract him from being so nervous. The evidence section has pockets for him to include cards, letters, extra pictures, tickets, receipts, etc. I also put picture collages in the front and back covers because I am a chick and I enjoyed doing it.
A wrist watch
A book or newspaper

Please keep in mind that when you are sending something in the hands of another person that you should not burden him/her with too much #######. Luggage space is limited and there is a weight issue, too.

My other half will bring this notebook back with him so that we will continue using this (along with my matching one) for maintaining all our immigration stuff for the next few years.

I am gonna try to post the photos he took of his packet that he received in a few minutes.

K-1 Fiance(e) Visa Process & ProceduresEmigrating Airline deals??

The Only trick is to do homework on different Carriers and Book in Advance.

This has been one of my hobbies during our K-1 wait time (marinade time???). But, yesterday, I found one of the best deals for 2 weeks in advance including insurance to change the flight from AeroMexico. Look at EVERY site--Orbitz, TripAdvisor, LonelyPlanet, Expedia, individual airlines, and check each potential Point Of Entry, too.

For us, I don't want my beloved to deal with the Miami airport. The reputation of the folks there is much less than pristine and they are so overwhelmed that problems of some kind seem to be experienced by almost everybody. Here where I live, Houston, the airport has a good reputation and I want his POE to be the smoothest experience possible. I especially don't want him stressed about having to catch another flight after going through the airport "interview".

K-1 Fiance(e) Visa Process & ProceduresRFE to NOA2?
Our RFE was in early November and we received our NOA2 in Jan 10th with our NOA2 dated January 13th. He received the embassy packet on Feb 14th and the interview was March 14. I am sure that our RFE took longer than is typical because it was on the desk of someone on vacation for Christmas.

I really, really, REALLY wish I would have known about frontloading. I sent in the original application EXACTLY what was required as per the instructions. Those instructions should be changed if it automatically dings you for an RFE by being exact. I had no idea that it would be okay to include more stuff with it. Finding this site took me about 6 months of web browsing amongst all the lawyer websites. Visa Journey needs to be the number one hit on Google!

(Our RFE details are in a thread that is linked in my signature, if anyone is interested.)

K-1 Fiance(e) Visa Process & ProceduresSkype and filling out K-1 forms with your other half
Skype is still free. That is not the problem. But when I tried to screenshare with him this morning (something we have become experts in since beginning this lovely K-1 adventure), it asked for $$. I elected to update late last night.

Another thing that I don't care for is the small viewing window. I liked to have both the little one for him and the full screen because of the resolution. Of course, I like him life-sized, but often, the signal between the distance leaves a bit to be desired and I can see more clearly with the small pop-up window. That now is not available.

I haven't seen any pro yet to this version and I don't seem to have the option to regress back to what I had a day ago.

I did the new update last night and now I have to pay for screensharing. This was how we did most of the forms and I have helped out my sister with her computer woes and such.

If you use SKYPE and use this function, don't update it yet.

Good luck, everyone.

K-1 Fiance(e) Visa Process & ProceduresChances of getting an RFE?
I sent in photocopies of our evidence (in our RFE) and on the copied page of tickets, I included a photo of us in that location. Example, if you have your ticket stubs to enter the Eiffel tower, show a pic of the two of you in front of it that is unmistakably in that location.

Our RFE was a PITA but it is thankfully over now and the interview itself was a breeze.

Keep in mind that each person who looks over things has to use his or her own judgement. What one will not care about, another might have a serious peeve about. Besides, what if s/he picks up your file right after getting to work when the dog peed on the carpet, the newspaper was thrown into the kid's pool, and coffee just spilled everywhere? An RFE could be just a normal reaction of hypersensitivity to everything resulting from personal stress.

haha--BTW--one of our evidences that my honey presented at the embassy has my nationality wrong--it was a train ticket that said I was Brazilian. The guy looking at it didn't care or notice.

K-1 Fiance(e) Visa Process & ProceduresWhat is the procedure after contacting US Congressman - No sign of NOA2?
Or they could have lost the files/documents/etc. This DOES happen sometimes. Being a squeaky wheel sounds absolutely warrented right at this point. ( I know someone who had this situation. She and he waited patiently, he was working in the US but returned to his country for a temporary contract job. The delays were so lengthy that he ended up losing his job. USCIS lost the application along with all the documents that were ORIGINALS. It was a nightmare for them. There are too many applications for them to deal with for errors to be completely avoided.)

It might not hurt to place a post-it note over that with it written as well--this is not official, but for a quick glance, it might make it a bit easier on the person who is having to type all that in.

Let me see if I understand what you have written. Your fiancee has the letter. You want US to tell you what that letter says.

Huh???

Ya know, since she has the information, she can probably call the medical office herself and ask any questions. I am pretty sure that's probably be a much better resource for getting information.
EminTXFemalePeru2012-03-20 16:48:00
K-1 Fiance(e) Visa Process & ProceduresTotal Fees
The fees are something that I have now budgeted for and keep in mind. We are having a no-frills wedding since the visa will be available 4 months after when we originally planned and he has to go back home for more semester of school--everything has to be filed immediately. It is possible that we'll have to start over but we've elected to take our chances.

On the plus side, if he and I had been married this past year, the difference in my taxes would have been 3000U$--roughly the same cost for the first year of Visa-adventuring.

I DON'T consider these to be normal unexpected expenditures. We can plan for these and we do. I also have a truck account that is set up for auto repairs and future vehicle purchases. (Car payments? Should always be paid into a savings account before you ever buy a car so that you don't pay interest.) We have an emergency fund, too--that covers funeral travel, vet bills, plumbing issues, etc. 1/4 of my takehome pay goes into these various accounts.

By being in a relationship with a foreigner, you ARE going to have many expenses that you wouldn't have with the lover down the street. Is it worth it? For me...ABSOLUTELY!

K-1 Fiance(e) Visa Process & ProceduresFiance Letter of Intent

What if the documents get lost in the mail

I am paranoid about this kind of thing, too. We made duplicates of every form and copies of things that had to be originals (example: birth certificates). I keep my own set of originals and sent him a set, also. This way, if things WERE lost, we'd have another set to fall back on. To be even extra sure, I have scanned copies of almost everything in an immigration folder/file on my computer. We have (almost) matching immigration notebooks.

I realize this is overkill in most cases, but this is something where the whim of a stranger will make a major decision about our future together and it deserves all the extra effort and attention that we can give.

K-1 Fiance(e) Visa Process & ProceduresFiance Letter of Intent
What is done is done. You can't change what you have already sent in to them. If the USCIS worker doesn't like it, you'll get an RFE. Wait to hear back from them on that or to get the NOA2. There is nothing else immigration-wise you can be doing right now except making sure that you have evidence of an ongoing relationship. YOU will have to provide that. Save any birthday/Valentines/holiday cards, letters, envelopes of stuff that he sends to you with the postmark. (I know that lots of people gripe about that but for the cost of international postage on a card from the US being 98 cents, that is a pretty cheap and easy way to provide a little more evidence and it really doesn't take that much effort.) Go through everything and gather together tickets of things that you did together--if you have a picture of you together at that place--put them together (one of the evidences that was looked at our interview yesterday was some museum tickets with a picture of us there at that museum in a border city in Perú). There is no way to know what they will ask for so this is the time to organize and prepare.

Other than that, get a hobby, research the state you will be living in along with all the places near your new city that you can drive to in 5 hours or less, and learn about where you will be.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresFiance Letter of Intent
Our letters of intent also had no address on them but we DID make two of them each--one typed and one handwritten--his had it written in Spanish on the upper half and the English translation on the bottom half to make sure all bases were covered (he doesn't speak English). Our interview YESTERDAY was successful so perhaps all these little details paid off.

is it okay to send a letter of intent as scanned pictures? pls help

What on earth??? A letter is a letter. Put your pen on paper and write in your very best handwriting and get it done. Then type one and hit print, too. Sign them both. So much of this has to be original documents with signatures that I can't figure out what this question is actually about.

Ronzkie, before posting any more questions, please take the time to READ over the guides and other threads. Write down your questions somewhere to look for while reading. You'll find almost all your answers before posting. After you've spend some time learning about this process, then you'll be much better prepared and way less nervous about all this.

I hope some other folks can benefit from the suggestion. One thing--don't send any chocolate candy and hope that it will be chocolate-therapy for the stress of the interview. It gets gobbled up immediately. hahahaha

If your beloved is a gum smacker/popper/bubble-blower, you might wanna send some hard candies instead.
EminTXFemalePeru2012-03-25 14:59:00
K-1 Fiance(e) Visa Process & ProceduresDangers of the Interview
The better you know each other, the better. We searched for all the interview questions we could find in various posts about interviews on here and other sites. Each week, we took around 10 or so and each mailed our answers to the questions and then discussed them. To be honest, it was fun and gave us lots to talk about. This prep helped him to answer the questions he did get in his interview without any hesitation whatsoever.

On another note, an international postage stamp from the US is 98 cents. Take the tiny effort to mail things sometimes. Physical evidence is a good thing. Plus it is delightful to get something in the mail. I know very well how easy and modern email/chat is but it is not gonna kill anybody to show some love and spend a buck now and then. (I sleep with his Valentine's card on the table next to my bed every night. Before that, I slept with a different card that he sent. We did this about once a month or so. His cologne is a very nice touch, too. There is nothing romantic to see about a chatlog on display and it is not a very romantic keepsake.)

I provided my fiance with things to make the interview wait time a little less stressful also. In the clear pocket of the notebook, he had some gum (from the US--a subliminal hint that he could only have gotten this from me), some pens, Kleenex tissues, Chapstick, and a tny tube of hand sanitizer. I printed out some trivia about his new country, state, and city to read that might distract him a little. I wish now that I had also written a letter for him to open only during his waiting time in the embassy to tell him how much I love him and believe in him and all that mushy stuff.

Good luck in your immigration adventure. :)

K-1 Fiance(e) Visa Process & Proceduresbirthdate Error on NOA1--Pls help what to do
Call them and tell them. If you get RFE'd, then include that in the cover letter and highlight it with a yellow highlighter. Include a copy of the original document with the birthdate also highlighted. If not, then deal with it at the embassy.

My fiance's birthdate was changed at the NVC. No biggie. The embassy said they'd take care of it. We will see.

I work in a busy ER in a major city and I have patients that sometimes tell me that they got a new birthday when immigrating. Apparently, as long as it is fixed before a social security card is issued, it can be fixed, otherwise, celebrate twice!

K-1 Fiance(e) Visa Process & ProceduresLetter of Relationship History-Ongoing Intent
I chose to rewrite/update my letter of intent. I stated, "It is STILL my intention..." with the current date of writing and I printed it out from the computer. I then hand wrote the entire contents below that to make sure that if that particular person who might look at it prefers one or the other--then all bases would be covered.

See what is acceptable on the forum that is specific to your country of question. Those folks can certainly give you more of an informed idea of what the culture is like in that embassy (hard asses, bored, rude, kind, bullies, etc.).

I posted a couple of suggestions that aren't related to your specific question, but might be some things you wanna do anyway.

K-1 Fiance(e) Visa Process & ProceduresLetter of intent: signature & printed name underneath

They state to use black ink, I used blue.

I was required to take a legal issues class about a million years ago. We were taught to always use ink that is not the same color as the rest of the document--navy blue or dark gray or different in some way, or, yes, blue since most people making copies don't bother making color copies. (Pressing the paper enough to dent it is good, too.) If it is your habit to do this always on any legal document from a check to forms to whatever, this could come in very handy sometime in the future. (I really, really doubt it ever would for immigration, though.)
EminTXFemalePeru2012-03-28 18:24:00
K-1 Fiance(e) Visa Process & ProceduresLetter of intent: signature & printed name underneath
Because each embassy has its own quirks, we each had it typed on the top half and then handwrote it exactly the same below that and signed them. My fiance did it in both English and Spanish. This is probably overkill, but then again, since the folks that made all the decisions about our paperwork were faceless and us without any opportunity ever to question or ask about anything from them, overkill is often a good thing here (as long as it is not hundreds of pages of volume, that is!).

Before the embassy interview, I sent him another to take with him stating "It is STILL my intent..."

Kelly,
You have to send many original documents. Because you are using originals of other things, why don't you do the same with this. It is just as easy to print this 3 times (one to send and 2 back up copies). If you have already sent something, why would you then scan it? Scan it to what? Your computer? Fax it? I am completely unclear on what you are asking. Before posting more questions that seem to indicate that you are freaking out (example: ????????????????????????????????????), try reading the guides and hang out here a couple of weeks reading different posts/threads. The common questions seem to be re-asked twice a week from people who haven't bothered to just look over the site or read through the latest threads. Once you have an idea of what you are doing with a visa application, you'll be better able to ask questions that pertain to your specific situation. It might be good to look up country-specific information, too. Some embassies are monsters.

K-1 Fiance(e) Visa Process & ProceduresConfused about the two year requirement.
Learn about "frontloading" before sending in your papers. Read every embassy review for the last few years for Haiti and see what kinds of evidence they are partial to and what things they seem irritated by.

Try to give them what they want.

It might save you some trouble/stress at the interview.

When you read "met" think of "met up", not encountered for the first time. "Meet me at (any location)" = come and see me face-to-face.

Good luck!

K-1 Fiance(e) Visa Process & Proceduresissues about calling your fiance "hubby" on emails.

Seems crazy to me to judge if someone is a "legit couple" or not just by whether or not they email?

It seems crazy that you want something and you have to play by the rules to get it. You want a visa, you have to provide evidence. There is a list of evidence that is successfully used by many people. In the time it takes you to wait on your interview, you have plenty of chances to continue your relationship and keep records (evidence).

Send a letter. It will cost you a little over a dollar in postage. Send a card. Send a post card. Maybe the mail is unreliable, but it isn't always. SOME things should get through okay. For such a cheap and easy thing, I can't get why people gripe about it. It costs less than a Coke or a cheap burger. (Not all of our letters/packages have gotten through, but most have and I never mind doing something easy to demonstrate my love--even if it means re-sending a letter. From July through March, we had several from Christmas cards to Valentines cards to letters with pictures inbedded to silly pop-up cards that I made with our pix to postcards where I circled our neighborhood on an areial photo to whatever. He had something coming regularly to perk up his week. His family could also see the evidence of these regular items or read the post cards and this made them more accepting that *I* am legit!)

I, personally, love the cards/letters that I have gotten. I can smell his cologne and read his words and can carry something with me that he touched very recently. It is wonderful.

When you visit, DO something together. Go to the movies. Go on a tour. Go do something that is great for pictures and has a receipt. Go to the doctor, if you need to. Save that receipt, too. Save your boarding pass/luggage tickets. Make sure you have a variety in your documentation.

You know, once upon a time, it was popular to save momentos of times that you were with your loved one along with all the letters and cards that you've gotten. That is pretty much what a lot of this is.

With all that we had gathered, the interviewer asked for a few pages of the organized-in-plastic-pockets evidences that were in the notebook. This included tickets together with a photo of us there, boarding passes/luggage stubbs, a doctor receipt with a photo we took outside there while waiting for the taxi, pix of us in scenic places near the embassy, and I am not sure what else. I think that 7 of the pocket-pages were looked at. It was a well-organized variety.

K-1 Fiance(e) Visa Process & Proceduresissues about calling your fiance "hubby" on emails.
I'm in the same line of thought as the folks wondering why you are sending emails in the first place. If you are a legit couple, you should have plenty of evidence without those.

The only email we included was my itinerary for one of my flights. Other than that, we had more than enough real letters. I knew for SEVERAL MONTHS that we would need to produce evidence so we made sure to send letters/cards/postcards--it really isn't rocket science.

That with photos, ticket stubs, boarding passes, etc are excellent evidence.

"What if" this is not the first time such a thing has happened and a search was done to read about other people's actual experiences instead of advice in general. People who have actually been through that particular process are probably going to be able to tell you a lot more.

"Search" really is your best friend here. (We were all new once. The first advice to someone asking a common question should be to search for prior answers and their follow-ups.)

How about this answer, "Because we are spending so much money on immigration fees."

hahaha

Seriously, compile all the interview questions you can find here and in other places online and talk about 5-10 of those as discussion points every week to make sure you two actually do know vital information about each other. The one question that we hadn't covered in our conversations was, "Why isn't your fiancee here with you?" His truthful response was "for work". His interviewer was satisfied with that.

I know that you are sweating it like crazy because of all the stupid stories and rumors and crazies that like to just stir up drama in other people, but just try to keep things together, always be honest, and focus on each other as much as you can--these will probably help your odds of success more than anything else.

Oh yeah, determination, too. That will really help you. Knowing that you will succeed no matter what or who tries to discourage you.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresFiance entered the US illegally can I still file k1 visa?
The difference in the tax rate for us would have paid for the entire immigration fees and processing costs.

If only I had known then what I do now...

K-1 Fiance(e) Visa Process & ProceduresHow long an I-134 and income verification letters are valid for?
The letter that I had from my employer was dated May 2011. The letter from my bank was also dated in May. In February of 2012, I included 2 recent paystubs, 2 recent bank statements (from the same account), and my current tax return (along with the past 2). It was not an issue at all.

I never found anything saying that these had to be within a certain date and if you have evidence that these are still valid, I can't see why the letters would be an issue.

The interview was March 14th of this year.

It is not just "income verification letters" that you are submitting--it is a group of income evidence. All of it should support the other.

K-1 Fiance(e) Visa Process & Proceduresphone records
We submitted/provided zero phone records. That is only one (very popular) type of evidence and it really doesn't prove much.

If you are a legit couple, there should be plenty of other varieties to submit so don't sweat this one.

If you want to make sure that you have good stuff for the interview, how about writing some letters/sending cards regularly? It is a nice thing to hold something that your beloved actually touched and in the several months it takes to get to the point of the interview, delivery should be no problem. My fiance took almost every letter and post card that I had sent, including ones that I sent his parents for mother's/father's day and birthdays. The interviewer did take the time to look at some of those. It seems to me that handwritten itemsthat are signed with postmarked envelopes are probably more convincing than a log of phone calls/chat that could honestly be from/to anybody. Besides, it's cheap. And romantic. And so easy.
