K-1 Fiance(e) Visa Case Filing and Progress ReportsDecember filers....

Ok, so one of 3 things happened today:

1) No December Filers approved (Obviously this is only CSC, VSC December filers should all have been approved last October)
2) December Filers who received approvals are off celebrating and have not had an opportunity to share their joy
3) I'm blind and missed the CSC approval threads.

I'm hoping it's #'s 2 or 3.

We're starting to get the 'last kid picked for gym class' syndrome, and I'm usually the king of patience (comes from being a life long Saints fan, I suppose).

Dont worry - I was feeling the same! But then yesterday we were approved and I was really not expecting it. I just knew that we'd get an RFE!! Lol. It'll come on the day that you dont wake up and run straight to the computer to check!! Good luck!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsDecember filers....

Wow - this is really maddening. 3 days in a row now we've been touched. 2/27, 2/28, and now 3/1 and nothing in email and no change on status page. What could they possibly be doing? HuskerKiev said it was a 15 minute process.....aaaaggggggghhhhhh!

At least you've been touched :P

I have recently started checking for updates at least 2 times a day now - before I went days without checking - but as the 70 day mark approaches I'm starting to get more anxious and a lil bit nervous! There doesnt seem to be that many approvals at the moment - but hopefully CSC will suddenly shower us with approvals and the december filers can start seeing NOA2s!!

Middle East and North AfricaPLEASE HELP FOR SS NUMBER

hello ..
iam in America now 8 days Ago with a K-1 visa and i dont know yet what i have to apply for to get married in 90 days ...
if someone can help and Give me some instructions will be thanksfull...as i read i need a Social security number and i dont know how to apply for one i have my passeport and my form I-94 juste ...
Thanks for evreyone can help

you dont have to be married in order to get your social security card but just wait two to three weeks after you arrived, before you head down to your local SS office or else they wont have you on file. My husband just took his passport/I94 and a copy (not the original) of his Birth Certificate (which was not in English) and a form that we had downloaded from SS website-which I filled out in English for him He said it was painles. Then got a letter saying his SS card would arrive in a week or two... and it did but the first time he tried to use it, they told him no such number existed...so he went back to get a letter showing that SS # was assigned to him...and all is fine...you'll also need that to get a drivers license which will expire the day your I-94 expires (THAT SUCKS) but its just another reason to hurry up and get married and file for AOS...so good luck

that varies probably by state - nessa's license didn't expire in kansas.

yeah you're right, it does vary by state...sorry.... But that's the way it is here in Arizona.

I was told by the AZ DMV that you can extend your drivers license when your I-94 expires if you have proof that you applied for AOS

K-1 Fiance(e) Visa Process & ProceduresQuestions about the K-1 application
Hi everyone - I'm new to this forum but it seems great to me. I'm actually writing on behalf of my american fiance (my job allows me more time on my hands!!). Ok - so the story is that we started talking on the internet in September 2004 as he was moving to England (where I live and i am a citizen of) as he is in the US airforce and his new base was there! We officially met in October 2004, got together in Feb 2005 and I moved away from London in Jan 2006 and we are currently living together. We have not been apart from each other for more than 2 weeks in the nearly 2 years we've know each other. It's now time for him to move back to the states as he'll be stationed in Arizona. Of course I want to join him over there. I have no doubt that our case is very strong but i just need some advise. He is due to start in his new base in November. I'll be travelling the month of October/November to central america to learn spanish as i realise that in Tucson, i will definatly need some spanish skills in order to get a job! November 19th I'll be flying to Tucson from Costa Rica and will be staying until Feb 14th (as i'm a british citizen i will not need a tourist visa). This is just so i can get a feel of the states and have a little rest from working, plus i want to be near my man!! Is it possible for him to start the process of the K-1 visa whilst I am in the states? I hear that it can take from 3 - 8 months to be processed. Once I am back in the UK i will then work until i get my visa (however if it takes a really long time is it possible for me to fly over for a couple of weeks to see him every now and again?). Now my questions about the application? When i was 18 (i'm now 24) i stupidly got married to a Tanzanian guy (more like tricked into it) - we are now divorced but will this affect my application? For the evidence that we have met we have 1000's photos but we dont have that many emails and phone call logs etc as we have lived together for the last 8 months, what else can i bring? All the bills for our house are in his name! Sorry for a long story but i have so many questions!!! Thanks

K-1 Fiance(e) Visa Process & Procedurespotential problem with passport/birth certificate?

hello Tamzyn base on my experience we need to follow what it says there in our birth certificate even we didnt used it just like my sister's name sinse shes studying elementary grade until she graduated in college shes using lolita and then she found out her name in birth ceritficate is not lolita but LULU so she start using her name in the BC and she dont have any problem about it bcoz she used taht also in her passport........but its just what i have experience....

soo good luck to both of you and hope i help a little....

Thanks for the info - i have one question though - why should he have to use a name that has nothing to do with him as the second part of the double barrelled last name is his mothers ex husbands name, not even his dads name? it doesnt make sence

K-1 Fiance(e) Visa Process & Procedurespotential problem with passport/birth certificate?
I was wondering if anyone could advise me .. my fiance(us citizen, I'm a British citizen) had alot of trouble obtaining his US passport, even though he was born to us parents, lived all his life in the US and is in the us airforce because the name on his birth certificate is wrong. When he was born they registered him with a double barreled last name (very complicated story - they used his mother last and her ex husbands last name!!) He finally managed to get his passport last year (even though he'd been in the US airforce by then for 5 years!) but now we are applying for a K visa and i'm worried it will complicate the situation as his birth certificate shows Jamal Washington-Smith and his passport is just Jamal Washington. Does anyone know if this will delay the process or what we can do so that it wont? Hope this makes sense!

K-1 Fiance(e) Visa Process & ProceduresWhy does it take so long to process a K-1 visa in the Californian office?
I dont know what to do! I have been living with my fiance now for nearly 1 year (in the uk ... he's in the us airforce) and now he is changing bases and moving to arizona. The last place that he lived was PA, where he lived all his life, which only has a processing time of 37 days and NOT 93 days! Is it possible to somehow apply to this processing centre as I just dont know how i can be apart from him for the 173 estimated days that it states!! It seems so unfair .. because it takes such a long time for them to process a stupid visa, we are gonna be split apart for such along time. We havent been apart for 2 years!!! I feel like every thing is against us - CA is the longest processing time and London is one of the most longest processing times of the embassys. The thought of not seeing him for all that time is just making me well up with tears right now and i'm at work!!! :(

K-1 Fiance(e) Visa Process & Proceduresproblems if i visit mexico?
My fiance (USC) will be moving back to the states in October after 2 years of living in England (where i am from). In november i'll be travelling to the usa on the visa waiver programe and staying with him for 87 days (just to see how it will be over there and also to spend thanksgiving, christmas, his birthday and my birthday together!) The moment i ener the states we will send the application for the K-1 visa. My question is - can i visit mexico whilst i'm over there? We'll be in Tucson and so close to Mexico, somewhere i've always wanted to travel and we wanted to go there for a weekend (beach) for our birthdays (5 days apart). will there be a problem to re enter the states if my K-1 application has started pending? I have all my return flights to England and but i wont have a job(i'm going to temp whilst we await for the visa) and will be staying with my parents - as i live with my fiance now and when he leaves will not want to stay where we are at the moment. Hope this makes sence!

K-1 Fiance(e) Visa Process & ProceduresQuick question about phone records
I know that phone records are very good evidence, however i read on another thread that it help that the phone bill is in your name. Will it be ok if its in my parents name? Also I will not be calling the states from my parents landline without going through a cheap access number which will not show what number i have called in the world. How can i overcome this? Thanks

K-1 Fiance(e) Visa Process & ProceduresIs an age a factor when applying?
Just out of curiosity I was wondering how the immigration officers look at younger couples applying for a K-1 visa. Do you think it sways there decision? My thought is that I'm 23 and my fiance is 24 - of course we would wait if we were both citizens of the same country but he is my soul mate and i love him very much - the only way we can be together is if we get married. Whats the avarage age of people on here who are in the situation of a K-1 visa?
JamalNTamFemaleUnited Kingdom2006-07-31 09:52:00
K-1 Fiance(e) Visa Process & ProceduresHow should I send in the evidence? (email/photographs)

Okay first of all, he is stationed there so it is easy to show he has been to UK. Second anything with both your names, bills, receipt, bank accounts, etc. would work. Also statements from family notorized stating you lived together for that length of time would help.

Ok thanks - the only thing we will have his his assignment papers showing he was stationed in the UK (but i'm not sure how confidential they are) and photos. We dont have any joint accounts or bills that are in both our names as he pays the bills. I have my own cell bank statement with our address so would providing both his utility bills (his bank statements go to his APO address) and my bankstatement for the same period be sufficiant?
JamalNTamFemaleUnited Kingdom2006-08-07 06:53:00
K-1 Fiance(e) Visa Process & ProceduresHow should I send in the evidence? (email/photographs)

Remember you have to prove that you have met in person within the last 2 years. Emails do not prove that. Photos are secondary evidence. You should send copies of ticket stubs, copies of passport stamps (with picture page copied also). hotel receipts, anything that shows you both at same place and same time within last two years. Including emails may help but do not prove that you met. Dont overwhelm them. I sent 8 photos, copies of passports and copies of tickets. I also sent some emails but they were more to prove that we had known each other prior to last fall.

If we have been living together in the same country for 2 years ( my fiance is stationed in the UK ) what proof can we send in except pictures?

K-1 Fiance(e) Visa Process & ProceduresK1 application when alien fiancee is divorced
Its an official Tanzanian Government divorce certificate and the divorce is registered in Tanzania now. The thing is because of the nature of the government over there, my ex husband had to bribe the local magistrate to get it done because as soon as they found out I was from England, they suddenly said I either had to file it as a woman (as men cant) or we give them money to get it done. We had no choice (blackmail i guess) and so gave them 150 GBPs and the divorce was registered 2 days later and the certificate was issued. I'm sure anyone can agree with me if they have lived or been to that region that the only way to get things done is with bribes and blackmail! It sucks but I really hope it wont cause any problems with thw US government as I am now officially legal to remarry again. Any advice?

K-1 Fiance(e) Visa Process & ProceduresK1 application when alien fiancee is divorced
I'm the alien fiancee and my fiance is the USC. When I was 18 I stupidly got married to a man in Tanzania. Only now (5 years later) have we finally got divorced (long story - havent seen him or been with him for those 5 years) and in November me and my fiance will be applying for my K1 visa. We have been together for 2 years etc as you can see by the timeline. The question I have is what evidence do we have to submit that my previous marriage is over? Because of the way the government is ruled etc in Tanzania we managed to get our official divorce in 20 days and have the certificate and everything to prove this - both muslim divorce and government divorce. Will the immigration officials accept this divorce certificate as proof? The system there is different and no Divorce Decree is required there. Do you think this will cause some problems and what can i do about them? I'm a UK citizen. Thank you - i'm so worried about this and do not want anything to make the application any longer than it has to be.

I hope that made sense!!!

K-1 Fiance(e) Visa Process & ProceduresJust a quick question
We are going to apply for the K1 visa in November and just have a query. My fiance (USC) is in the military and has a chance of being sent to the stupid desert at anytime without warning. What would happen if he gets sent whilst the visa is being processed? For example it's approved and I get my interview and then the visa is issued but he cant return within the 6 months that are granted for the visa. Does this mean we would have to go through the whole process again??

K-1 Fiance(e) Visa Process & ProceduresProof of relationship
Just a quick question regarding the proof of relationship when you've lived with your fiance and dont have any telephone bills or emails etc. I'm currectly living with my fiance (usc/airforce) and hav been for 1year now. He's going back to the states and we are applying for K1. We have this as proof of relationship - do you guys think it will be enough?
-A letter from his section chef (master sgt) at his UK base shop saying that he's been stationed here r 2 years
-His airforce orders showing the dates that he's been here
-Utility bills addressed to him and my bank statements addressed to me around the same dates at the same address
-so many photos of us both together, in the uk, in the states and other countries we've visited together
- Airline and vacation itineries showing both our names for various vactions and flights that we've taken together.

Any one have any more suggestions?

Thanks

K-1 Fiance(e) Visa Process & ProceduresVisiting my finance

Tamzyn,

The information that you offer now was unknown when I wrote my previous post, so it being suspicious is most certainly not what I wrote. I suggested simply that you be able to explain without potentially shooting yourself in the foot. For example, an answer such as "I'll be living with my fiance for the whole time and he'll be paying all my expenses" could cause a CBP officer to be concerned that once you move in you may not move out.

The information that you give here is less likely to hurt you than my example, be able to document it should the issue arise. It may not, but be prepared for the possibility.

Yodrak

Tamzyn,

....

They can also refuse entry for financial reasons such as you have no means of supporting yourself while in the USA and so may be forced to work, which is illegal. You write that'll be 'on the road' for 4 months on this trip, have traveled extensively, and have no job - how are you paying for it? Think about how you might answer that question without hurting your credibility on the issue of non-immigrant intent.

Yodrak

Ok - so that fact that I have been working at my current job (that I will have to leave so that I can go to central america/USA) for a year and saving nearly £500 a month to live on will seem suspisious? I am just so worried now - I have over $4000 of travellers cheques to take - but I'll be giving them to my fiance before he leaves as I dont want to carry that amount with me as I travel by bus through Central America for a month. So all i wont have much to show the officers in Phoenix. ....

Sorry - didnt mean to sound as though i was saying you were suspisious - I meant the us government! Thanks for the info :)

Tamzyn,

CBP can refuse entry if you are asking to enter as a non-immigrant and they get the impression that you may not leave, as a non-immigrant should. Other posters have addressed things that go to this issue.

They can also refuse entry for financial reasons such as you have no means of supporting yourself while in the USA and so may be forced to work, which is illegal. In Novemeber I'm going to the states to visit my fiance for 87 days. I'm a British Citizen and so I'm going on the visa waiver programme. I wouldnt have applyed for my K1 visa then, We'll be applying when I'm in the country. Can they refuse entry into the states if I have not applyed for any visa yet? I have a return flight ticket and would be arriving from Costa Rica (as I will be travelling for a month and doing some spanish lessons previously to arriving in the states). I've started to get really worried as I was told by someone that they can refuse you just by saying you have a boyfriend in the states! The reason I'm going over there before we apply is to see what it will be like, to spend thanksgiving, christmas and both our birthdays together and because I'll miss him. (He will be leaving the UK on the 16th October after being stationed here for 2 years). The trouble is that because of the long duration I'll be outta the UK I will have no job to return to and I will have no house/lease as I live with him at the moment and when he leaves I plan to live with mum until I get the visa and move to the states for good. Any advice?

My advice

Do not lie to the Immigration Officer. Telling them you are visting friends and them finding out you are actually visiting your fiance will create serious implications (immigrant intent etc....).

Be honest, tell them the deal and i'm sure your be fine. Be transparent.

We'll be going to visit many family memebers across the states (Philly and LA) - should i advise the immigration of all the addresses that i'll be staying at?

OOPPS -

should i just say that I'm visiting friends or travelling the states - I've been many times before but not for the long period that I'm going in Novemeber and never had an issue with entering - I do travel ALOT and have stamps in my passport for visiting places like Ecuador and India for period of 3 months too - will they take that into concideration?

Just wondered if US airforce base passes with my photograph on - showing that my fiancee sponsered me on the base (he has to be with me at all times) is a form (just one, not the only) of proof that we met. It has the date, his name, my name, his signature and my photo on it. We have hundreds of these thats we've accumilated over the last couple of years. I was thinking of submitting 2 or 3 with various dates. They are official government base passes.

The trouble is that I'm not even sure it does state the grounds for divorce in Tanzania on the certificate. Will this make a huge difference? It was all very rushed, and I dont know the ins and outs of Tanzanian law but I knwo that my ex 'husband' had to bride a few people to get it done because as soon as they found out I was from the UK even the local magistrate saw a chance for a few quick $'s!!!
JamalNTamFemaleUnited Kingdom2006-09-26 09:37:00
K-1 Fiance(e) Visa Process & ProceduresDivorce certificate
Ok - so now I'm waiting for my divorce certificate in the post. As I've said before, when I was 18 (I am the fiancee alien) I stupidly got married to my 1st love in Tanzania. Basically only 5 months later I discovered that he was using me to try and get into the UK and I broke it off with him and have not seen him since. As I was young, I just ignored the fact that I had got married in Tanzania - always used my maiden name (I never really considered myself married as it was such a short time) and did not let anyone know about my marriage. Since I've been with Jamal and having to concider apply for the K1 visa so I can be with him foreva :) (currently in the UK on Active Duty but moving back to the states next month) I started to investigate the marriage that I had and obviously, not wanting to be rejected or have anything in my way, contacted my "husband". He has been dealing with the courts in Tanzania and filled for divorce under the grounds of not seeing each other for 5 years. This was approved on the 4th Sept and I have to wait for the 23rd Oct for the court to officially produce the English version of the divorce certificate. We will be applying for the K1 Visa about 1 month later. I have 2 questions - 1st is that I will have to types of divorce certificate - one in Swahili and one in English - should I submit both or just the English one? 2nd is that I'm worried that the immigration officers will look at this application and think that I'm just trying to get to the states as it's been such a short time since my divorce date (it would be officially 4th Sept) and the fact that I got married in Dar es Salaam, Tanzania. We have sufficient evidence to prove that the relationship is legit (lived together for a year and been together since her arrived in England - have photos, documents to show this etc) but I'm so scared that the whole marriage thing will bring suspision and that it will make the processing time longer. Sorry if I went on a bit in this post but it's really palying on my mind!

K-1 Fiance(e) Visa Process & ProceduresCan a UK citizen enter the US and then apply for a K1?

Not to beat a dead horse, but just to make one point more clear...

You can come to the US and marry on a tourist visa. HOWEVER, if you later try to file for a green card/residency you will be found guilty of visa fraud and your green card/residency will be denied. Unless you can provide mountains of evidence that you had no intention to marry when you came to the US as a tourist, you are asking for trouble.

Read the K-1 guides and follow them. Doing the process the right way will keep you out of trouble in the future.

I actually called the guys at USCIS (I think) and asked them if it was possible to come to the US on a Visa waiver and apply whilst in the country - they said yes. As long as you dont overstay your allocated time (90 days) then you will have no problems with obtaining the visa . Going to the states on a VWP and then gettin married and applying for a green card is a completely different thing all together.

K-1 Fiance(e) Visa Process & ProceduresCan a UK citizen enter the US and then apply for a K1?
This is what I'll be doing! I'll be entering the US on the 90 day visa on the 19th Nov - the next day we'll be sending the K1 application off (which we've already put together) and then I'll be staying there for 87 days before I leave back to the UK. At least then we would have waited 3 months together during the long process! We also arranging a trip for Jamal to come to the UK when I get back too! We've been living together for a year and been in the same country for 2 so we are trying to keep the time apart as little as possible!!!
