Last week I was able to logon the site to see if my AOS and IV fees were invoiced -- after the system upgrade this weekend, i too got the "Case being terminated" message. Upon calling them this morning, they were very snotty and didnt want to provide any assistance whatsoever. they basically told me i shouldnt do anything until they mail everything out...

Does what sound right? Including proof of citizenship in the AOS package? The petitioner doesn't, but if you have any joint sponsors, they have to include a copy of proof of US citizenship/residency. It's clear in the I-864 instructions.

Sarah, Have you received a response from them yet? i didnt want to be pushy -- its only been a week, but i called them twice already and they said they dont show anything in the system just yet -- they said to wait another week and then call back. i was surprised as i seen other vj members get case complete in a week. Also, for the i864, did you send in proof of citizenship? i read you might have to, but didnt see it on the vjwiki...

 

I gave them 401K and IRA statements that had the acct #s printed on them.  I never much money in my checking account, but there is a lot of money in those accts.  Well, if they have a problem with it then I got nothin.  I'm not submitting that info through e-mail.  There are too many bad people in the world.

Nope, didn't password protect or use any encryption. Not sure if NVC would accept it if you did. If you don't feel safe sending the packages by email, then you can mail them if you wish. You'll have to opt out of the EP program first though.

So I did submit my paperwork through e-mail, but for my account numbers, I used photoshop to black out the first several digits of the account/routing numbers and leave the last 4 digits of the account.  When my husband goes to the interview I'll have him bring the real statements with the acct #s on them, but there was no way I was going to send account/routing number info in an unsecured e-mail.  Good luck everyone!

 

The account # is the least of your concern -- anyone can get that if you write them a check. the account number and routing number is printed on the bottom of each check. i didnt want to take a chance and alter anything, before they thought otherwise. but hopefully this works out.

i was also very hesitant on doing this... in fact we just submitted ours via email today -- i did read it does get faster response times -- so i finally opted for sending it. i do plan on saving the emails locally on my hard drive then deleting permanently once done.

CanadaHelp with my RFE

Hi. Me and my fiance just got a RFE and we do not know what to send them. Originally we sent them photographs, facebook chats and letters from friends saying that they have met both of us. in our RFE it says that photographs are secondary evidence of us meeting and facebook chats are not proof. I live in windsor and am a Canadian citizen so i dont have any plane tickets or passport stamps because I am canadian they do not stamp passports. I called the border and they told me I can not get records of me crossing. I was wondering wat can I use for evidence? I am stuck. We have a planned trip we will be going on but its only in my fiances name. Also my bank statements dont show where I have been in the states just sjows the currency exchange rates. I am lost and have no idea what i can send o them that will be good enough that we have met in person. I have been coming to visit her often and all we reall have is photographs but apperently thats just secondary evidence. any info or insight would be great.

 

apart from pictures, the best bet is to show comingling of funds. have your significant other add you to his bank account, share a credit card, etc. good luck!

Yes, when we went they CO asked for an updated police certificate and updated financials from my husband.  Good thing we had all of that.

 

The petitioner is not required, but it helped me to have my husband's support.

 

YES, go early.  There will be a LOT of people there.  If you go at 9:30am then you'll be there all day

CanadaMontreal Interview -- Petitioner?

Hi guys, its been a long process, but we finally got an interview date in late October at the Montreal Consulate. Question -- I have been back and forth about going with my wife (beneficiary) -- for those who have went so far, is there any added benefit for going with my wife? I dont mind going, but its difficult to get the time off in the middle of the week.

 

Also, they put a time on our interview letter for 9:30 AM... Almost every review i read on here, folks ignored that and just went very early. is that recommended? Lastly, for those who got interviewed, did they ask for any additional documentation other than what was listed on the Packet 4 that we should be aware of to bring?

  1. We have kept my wife's maiden name throughout the documents we filed because she never changed her last name in Canada. Is the DS230/260 or keep everything the same for consistency?
  2. Im a joint sponsor for my dad on his brothers application. do i have to list that and does it negate me from using the I864EZ?

Great news guys! the i130 was recently approved!! :)

 

Since shes not here, and living abroad -- im assuming the next steps are they will contact her now? i got the NOA2 but it was simply a notice saying it was approved and to wait for further action. Is there anything we need to do on this front to organize any documents?

Thanks folks, I read somewhere that if you file the I-485 it might help because it will trigger them to look at the 130... But I'm skeptical on that.

I filed my i130 for my spouse in January, 2013 via Chicago Lockbox. She is a Canadian Citizen and I'm a USC. She lives in Canada (and is there currently). I received my NOA-1 very quickly but since then nothing. I called USCIS and spoke to a tier2 on several occasions. Finally, in early march I was told my case was sent to my local field office in NYC. I had some shimmering hope... Then a month later, the case went cold again. The last time I called the tier2.. A week ago.. They seemed to have gotten irritated.

Anyhow my question is, I know it'####### or miss on approval processes, but how much longer can this take? Should I take a lawyer to help push this further? I heard local offices take much longer. Is there any other forms I can file in the interim to keep the case going? I know I can't do the i485 because she's not living here....

Any help would be GREATLY appreciated.

So... I submitted our documents via email to the NVC on Aug 12... Assuming 20 business days would've put me to tomorrow. I've been calling every other week since the and they acknowledged the Aug 12 date as the date received... I called today to find out status, and all of a sudden they changed the story. They are saying they received it on Aug 22 now... And I won't hear back until sept 19... #######?! Has this happened to anyone filing online via NVC for MTL? Anyone to escalate this too? What should I do now??

i hate to be the bearer of bad news, but the statements are true -- the NYC office is incredibly slow. I seen some I130 Filers in March of this year in other offices, get approved WAY faster than the NY Office. Thankfully i didnt wait 7 months or so, it was only a 4 month wait. hopefully things work out for you!

She will only get the green card in her passport name.  The cost to change everything in the USA will be rather large (green card is $450 -http://www.uscis.gov/i-90  Passport from USA: $190 - $260 - http://passportcanad...=eng&region=USA)

 

Her marriage certificate, if Canadian, will always have her maiden name on it because thats who she was when she got married.  Her birth certificate will also always have her maiden name on it because that's who she was when she was born.  

 

Option 1: It's her passport that is the issue, which if you want the green card in her married name, get a new passport expedited to you.  She has to reapply in the married name and they'll need the marriage certificate to do it.  But from a passport office you can get it in a couple days.  It's still cheaper than a new green card and getting a new passport in the USA,  http://www.ppt.gc.ca...e.aspx?lang=eng

 

Even without expedited people generally get their passports in 2-3 weeks. 

 

Option 2: wait until removal of conditions to change the name on her green card.  If she changes her passport before then she just pays the fee for that.  She can change all other ID in the USA using the marriage certificate. 

 

Thank you NikiR -- I followed what you said and decided it was in the best interest to leave it the way it is. We came this far... dont want to mess it up! I also read on another forum, that we can simply tell the Consular Officer and they *should* be able to augment it for us. We'll try that too.

Hello All, 

 

We are in the final stages of filling out and completing the i864 and DS260 (online version of DS-230). My wife currently resides in Canada and she hasnt changed her last name since we got married almost a year ago, because she would have to change it again in the states. Now, we are going through the process of filing the I864 and DS260 but we arent sure if we should put her maiden name or put her last name as mine. I understand the DS260 will be the one that will dictate the Greencard and social security name once approved. The problem is, her canadian documents all have her maiden name and they are asking for scanned copies of those. I dont want it to conflict with the scanned copies, nor hinder the process.

 

Should we file the I864 and ds230 with the maiden name or the new legal name? Does anyone see this causing a problem?

I'm working on finalizing the G-325A and I-130 documents and I'm wondering if I'm going a little overboard.

 

For the sections on employment and locations of residents I'm making sure there are NO blank spaces. So, for example I haven't lived, or worked in 5-6 different places, only about 2 or 3, I'm putting NONE and N/A's in everything..like:

Also, i'm filling out all of my forms I-130, G-325A, DS forms and I-864 in ALL CAPS...okay? I know I-864 is the only one stating to put all caps, but I figured it would be okay.

When we did ours, we simply attached a secondary sheet and put SEE ATTACHED FOR ADDITIONAL INFORMATION. on the G325A -- No issues with that.

 

i also preferred to type the forms in caps to avoid any issues with misinterpretation of letters (ie. L and I)... JUSTTT IN CASE...

The CR1 process is the way to go. As mentioned, DCF is no longer available to Canada. The process would be:

Chicago Lockbox: (I-130+G325A(x2))
NVC: DS261, DS260, i864
Interview

The good news is, the NVC phase is completely online and can be handled via email/online forms.

Question: odd that you got denied re-entry even with the process not even started yet. What made the BCP officer deny you?

Hi Guys, i tried multiple searches but i didnt find anything (checklist is such a broad term to search for on this forum!)

 

i received the dreaded checklist from NVC. the one thing i got dinged on, was failing to put in a state for my country of birth. Unfortunately, my country does not have a state. Im assuming, they just want me to put N/A there?? the second, for the ds-260, was for not providing the full birth certificate (found it, and sending it now).

 

Does this mean, they want me to submit ALL documents (Tax returns, proof of employment, etc) back to them? or just the i-864 and the ds-260 document?

 

should i put a cover letter again and use the cover letter sheet they sent? (its sketchy, because it says not to use it, but im not sure if im supposed to use the original cover sheet when i submitted the package for the i864).
