That's right....we only contacted them after almost two months of not receiving our NOA1 or our check yet to be cashed. Let us know how it goes nevertheless....


Yeah i dont think they are going to do much, but at least they reacted and asked for our NOA1 even tho we told them already that it was from November 4th...we'll see what happens, we faxed it yesterday. If we hear any news ill post it...

Btw I emailed our congressman in NJ, and friday we got a letter that they want to help and asked us to send in our NOA1 with the receipt number...idk how much this means but it gives also hope!! good.gif

Also about the police record i thought that if the embassy wanted it they request it themselves by the police? maybe im wrong...thought we didnt have to care about the police record as long as they didnt ask for it.

I just called the USCIS...picked 1 for english and then option 2 about case status, then picked option 3. I got to talk with a lady and she was kinda nice but she had to forward my call to another person that was going about I129F cases...so i got to talk with a friendly man, (was all happy i had a friendly person on the line), he asked my name, my receipt number and then he said are u the beneficiary...so i said Yes. Then he told me 'i cannot give u any information because I have to speak to the petitioner'...argh!!! mad.gif

So if u call, make sure that the petitioner is calling!! he at least told me that if u want to talk with one of those guys ask for an 'immigration officer' and they will forward ur call to one of them. good.gif

Im not sure if my fiance used his own bank account, but I think as long as you pay the fee its ok.

If its only for the case number...that will be on your NOA1 that you'll get in the mail. On the back of the check is the same number printed...so you can just go by your NOA1

If u didnt add the check I think they will return it to you...

Was his J1 visa not subject to the Two-Year Foreign Residency Requirement?

When i had my J1 visa back in 2006 it was and i had to stay 2 years in NL before i could do anything. So i applied for a waiver for the J1 visa...

Was just wondering because if it says that on the visa you should try to get that waived first.

We made an account at the uscis website for updates on the status of our case.....guess what, I try to insert the Application Receipt number and its not going!!

Validation Error(s)
You must correct the following error(s) before proceeding:
Customer Portfolio Insert Failed
Attempting to add a case that does not exist. Check the app receipt number.

I used the receipt number from my I 797C Notice of Action in the left upper corner...what did we do wrong? Is something wrong with the case?

There is 2 stamps..one is on the I94 and the other is on the visa..both in red from DHS...i have my SSC and that says valid with DHS authorization only...so if i have the tsamp dus it mean im good to go?

I arrived in the US on my K1 visa and they put a Homeland Department Security stamp on the visa....when i asked if he stamped my visa for being able to work he said..yes for 90 days...so this little red stamp means i can work? Little confused..but im offered a job already and i dont want to let this chance go by...

I emailed the NVC my choice of agent and it was accepted a few days before I recieved the DS-3032 by mail.
At the end of November it took between 10 and 14 days before the responded to emails. I don't know how it's now.
You're probably quicker to use James shortcut, but I wanted to be safe and you probably only gain 5 to 10 days.
I'm not completely sure how much time you safe with the shortcuts, but henever you're waiting later on for the DS-230 and you don't mind creating your own barcodes I would advise doing it because most people wait for 3 to 4 weeks before they recieve it (like us).

I also suggest taking the CR-1 route. That is what I did, and although it took probably longer it is in my option a better way and in the long run less paperwork. We got married in May 2007 in the Netherlands, filed in June 2007 (we had to wait for the international marriage certificate) and was approved early May 2008. Although it took 11 months, we were able to travel back and forth as much as we wanted.

Hmm.....if I remember it right you can apply, but at the end the process will be denied if you have not fulfilled the 2-year home stay requirement. I came here on a J-1 in 2004-2005. Filed a petition to have the 2-year residency requirement waived since it was placed on the J-1 by mistake (I still had to pay for the waiver). This process took forever because they kept losing documents. We got married in 2007 so I already had fulfilled the 2-years, but they asked me in 2008 at my interview at the embassy if I had filed a waiver and wanted to see all the documents related to the J-1 visa. I can't remember exactly how it all worked, but I think it tells you on the J-1 itself what the regulations are.

I have checked the eleigibility requirements for naturalization of spouce of a US citizen and all rules say that my wife needs to have continuous residence in US for 3 years preceding application for naturalization. Since my wife has only been in the US for two years yet, i beleive we are not eleigible for applying for her naturalization.

You have to wait till she has been 3 years continuously in the USA. I'm in the same boat, got married in May 2007, finally got my greencard in May 2008 (and moved to the USA), and so now I'm removing of conditions to get a 10-year green card. Next year I/we can apply for citizenship if we want to.....so that will be a very expensive 10-year greencard if we use it only 1 year.

The above quote is what I read from USCIS I was wondering if they will ask me the Petitioner to get fingerprints by appointment or my husband the beneficiary? How does this part work? (I know husband will get fingerprints later after NVC right? so I was wondering if this refered to me the petitioner.)
If someone can clarify this for me that'd be great!

I (the Dutchie) went the I-130 route and never got an appointment for the fingerprints neither did my US husband. They will obtain your fingerprints when you finally get your entry permit and you enter the country. At the customs at the airport you are set apart and they take your fingerprints and order your greencard.

We never recieved a NOA1. Our case was tranfered from the Texas to the California service center and found our receiptnumber on the check after that was cashed. We called a few times to ask for our NOA1 and got promissed twice to recieve it soon. Our I-130 got approved in November and we did recieve our NOA2 but never NOA1. I also had signed up for the emailservice but never got any emails whenever they touched our case neither when it got approved.

Sorry, can't give you any advise in this. Only have experienced that it doesn't mean they don't have your case if you never have recieved the NOA1.

I got married almost a year ago in the Netherlands and applied for a CR-1 visa. I don't advise this if you want to get a visa quick since I barely will make it over there with an appoved visa for our first anniversary. But I like to correct a few things about getting married in the Netherlands.

What takes longest is the paper for the IND (dutch immigration service) in which they basically decide if you just get married to recieve a visa for the Netherlands or not. It took us 6 weeks to get the paper appoved and I doubt it will give you much trouble.

After that I went back to the courthouse (the paper needs to be filled out by you and send out by the courthouse) to go "in ondertrouw". My husband wasn't able to come with me since he was in the USA so I already had a paper organised which he had signed in which it said he wanted to marry me. We were clearly not living together at that time and that was no problem at all!! You have to wait 2 weeks till you can get married in the Netherlands.

There are no (!!!!) other rules to get married, so no income check or whatever. That is all needed for an immigration visa but not to get married in the Netherlands.

I'm glad we did, it was nice to have been together with my whole family and friends knowing that I would leave and might not see them all back together.

Not sure why nobody mentioned this before, but you probably end up going home for a while but if you want to live in the USA you can look into a student visa, or a work visa (related to a job). A friend of mine did it this way: first was a student, than applied for het H1B visa when she got a job. Although she eventually married a US citizen she never applied for a visa in connection to him.

If you want to have your marriage legalised in the Netherlands, make sure your check first with the county/gemeente if they will accept a Las Vegas marriage, there are a few which don't! Where we live now (in the States) the county doesn't accept our Dutch marriage, but who cares......everybody else here does.

Not only for the K-1, I did the CR-1 route and had the X-ray for TB (tuberculosis) too.

Hi Channah,

I assume you're talking about the medical done in Amsterdam?! Nothing to worry about, you do not have to go naked! They weight you, measure you height, check your bloodpressure and just ask you general questions (have you ever been depressed, on medication etc). Oh yeah, they also take some blood, so if you wear something with short sleeves so they can reach your elbow easy you do not have to take off any clothes.

The X-ray is done at a different place (at least when I had to do it) and I did have to take my shirt and bra off. I didn't have a bad experience, nobody touches you and you just have to stand in still for a few minutes and you're done and can dress up again.
