This is simple. But I'm not too certain.

 You have been a PR since 03/03/2011 right?

if so, your Conditional GC expires 03/03/2013

You are still married to the same US citizen right?

Your NOA for the ROC filing extended your GC for a year up to by 03/03/2014 by which time you would have been a PR for 3 years

 

My question is?  even though you have a pending ROC, Shouldn't you be able to file for naturalization N-400 by 90 days before your 3rd anniversary as a PR which will be 12/03/2013. (90 days before 03/03/2014)

 

If so,  you should have filed N-400 instead of waiting for ROC approval unless you need ROC to file for N-400.

Answer 1. Affidavits are not necessarily a must. But they cant hurt your chances in any case?

Answer 2. Pix are also not primarily strong evidence, quantity is at your discretion

Answer 3. If you cold send statements spanning entire period, I'd say do that.  If not, send periodically too. It should be fine.

Answer 4. Include all insurances old, new, terminated, current etc

Answer 5. Historical bills for online account can go back as much as a year or two. Check yours if not more that 3 months. Ask the utility company if they can email them to you

 

& Yes, The immigration stuff can be annoying but just find something to occupy your mind to maintain some level of sanityidea9dv.gif

Since you got married in 2012,you dont have tax return for 2011.Also your window for ROC opens in february.

You are left with the choice of sending  only,all i think you should send copies of w2 for both for 2013 and you should be fine.

 

Getting rfe or not depends on other documents and luck so you should not worry about it.(getting transcript from irs takes around 2 to 3 weeks after processing of tax return,so there is no question of waiting for transcript in february)

Thanks Flora01. W-2s are in place now. we will file this week and send tax transcripts for 2012 & Returns/W-2s for 2013

 

 

 

 

You have two options as to what to send in tax wise: 1) send in only the 2012 tax transcript as that is the current last year return as required by the USCIS, or 2) file your 2013 tax return now and either wait for the IRS to process it and get a copy of the transcript or include a copy of the complete return with your ROC package.

 

I would send in the ROC with the 2012 tax year, file my 2013 taxes and get a transcript just to cover myself should the USCIS want to see the 2013 tax return.  I would want to get the ROC started ASAP and not have to wait for a tax return. We had 3 years worth of returns due to timing, but most have two if they are lucky, and some fall into your situation where there is only  one year of joint returns.

 

Do not get hung up on taxes that you forget other important evidence of a bona fide marriage.

Thanks Dave, Yeah, We have a fairly decent evidence including Health, dental, Auto, Rental & life insurances as well as 401K, Bank Statement, Leases and tax returns. Utilities & other work benefits like term life, accidental etc Not forgetting drivers licences(old address & new),forms Ar-11 & i-865 for when we moved in 2012 which I'm hoping will be enough.

 

 

 

 

What you "need to" send depends on several factors, such as: what other evidence you have, who your adjudicator is, etc.  You really have no way of knowing exactly what any one adjudicator will want to see in combination with your other evidence.  My wife and I only sent a copy of 1 tax return, not transcript, and we had no problem.  We also sent a lot of other evidence - insurances, joint car loan and registration docs, beneficiaries on retirement accounts utilities in both names, DLs of both of us, joint bank statements (but not too many - only one or two from each year.)

 

Some people got RFEs for not having any and/or all of the above - none of which is an absolute requirement.   Some people didn't receive an RFE for a supposed "required" doc because the sum total of the rest of their evidence was enough (for their adjudicator.)

 

The best advice I can give is:  send what you have readily available, cover as many different avenues as possible (utilities, banks, insurance, autos, IRA/401(k), joint taxes) and be ready to send them more, if they ask.

 

Take it for what it's worth, but I sometimes think those who send 30lbs of paperwork appear to be trying too hard and USCIS gives them more scrutiny.

Thanks Ryna, I'm hoping mine doesn't add up to 30lbs so I'm not so keen on affidavits, pictures, addressed mails etc but if the 'core' ones amounts to 50lbs, then I may have no choice smile.png

I tried to explain reasons in my very first post, but you got hung up on me not answering your questions. Key reason - is why would I ?

You need to provide evidence of bona fide relationship, not support documentation for affidavit of support. Beyond two first pages of a tax return, there is absolutely else in its multiple pages that would be relationship related.

 

Note I also filed married filing separately for both years which is against nonsense VJ "truth" that you have to file jointly or your RoC will be denied  - this way I ended up getting about ~$3k more in tax returns.

 

Overall I tried to make my packages as much adjudicator friendly as I only could - and I adding multiple pages of multiple years of tax returns would be the opposite. I keep thinking this helped in getting my conditional GC approved in 2 months and RoC in less than 3. But maybe it was just pure luck and I am completely wrong on that - not that it really matters.

I'm sorry for mixing things up but maybe I understand your "English" differently (But then again, I'm a bloody immigrant right? biggrin.png )

 

The questions were never about filling jointly or separately (most folks here know none of that matters (that's the real VJ "truth") nor was it about using for affidavit of support. Most folks here know that for ROC it is to show co-mingly of finances which again, doesn't imply joint filing.

 

Another VJ "truth" would be sending tax transcripts is better option. As this eliminates the 1st, 2nd or all pages of tax returns and I would think USCIS prefers that since that is official 'summary' of your taxes from IRS

 

My questions was should I send ROC with 2012 taxes only which is what is available now with 2013 taxes yet to be filed .

 

Your analogy would have been ideal if you didn't file/send any of 2011 & 2012 but you did file for both of them so I just get confused the more on what exactly the point you are trying to make. But I must be really dull biggrin.png

First of all, take the last response with a grain of salt because not all cases are treated the same.  There were some people here who had submitted only the first few pages of their tax return and got an RFE requesting for more evidences supporting their tax filings - whether because it was incomplete or the adjudicator did not believe that was enough evidence.  Tax transcripts are great because you don't need to submit so many pages.

 

Second of all, there have been cases on VJ that people was only able to submit one year of tax info as they are in the same situation as you.  I remembered clearly one lady here submitted around this time last year and was able to provide only one year of tax transcript and received an RFE for the second year of tax transcript.  Now, whether or not you will get an RFE for the same reason will be hard to say because some people were able to have no issues with only one year of tax transcript.  But this could be because they had other evidences to support their marriage or the adjudicator understands that the window for submission falls before they could file for taxes.

 

If I were you, I would go ahead and submit now and if the adjudicator has an issue they will send you an RFE.  It just means you have to wait longer.  But at the end of the day, it's your choice.

Why do you want to send full tax return ? What would be the point ? It is not used to verify you're paying/filing taxes, it is used to establish whether bona-fide relationship exists between you and your spouse.

 

I send two first pages from 2012 tax returns (mine and my wife's) that showed we filed married filing separately and each of the returns had spouses name and SSN. That's it - nothing else. I was approved in less than 3 months with no problems at all.

I'm not sure which of my questions you answered.

I asked at least 3 questions. Please expatiate a bit more on the response if you may

 

So maybe i should ask you a simple direct one since you wrote you filed using 2012 tax.  

Did you file for ROC using only 2012 tax returns?

 

(whether what you sent was full returns, first page, transcripts etc is irrelevant to me).

Most people file for ROC using at least 2 years tax returns covering period of their marriage

Please excuse my questions not being simple or events not be chronologically arranged.

 

So we have only the 2012 tax transcripts as married.

My window opens on February 7, 2013. We want to send our ROC but I have not read where people only send tax transcripts for just one year.

So my questions are: 

Do I wait till we file 2013 taxes and send returns & W-2s with ROC package? ( I definitely won?t wait for transcripts to be available J) ???

 

Do I send the ROC with just the 2012 transcripts and other evidence???

 

Will the latter choice (with only 2012 tax returns) prompt RFE later by past April 15, 2014 (I don?t think it should lead to that given my AOS (read details below)???

By the way, we are waiting on just one of the W-2s to file 2013 taxes but I don?t know when that will arrive in the mail as the W-2 is not available online.

 

Now, additional  background info.

Married January 2012

Filed AOS February 2012 with I-864 affidavit of support filed with Spouse?s tax transcripts for 2008,2009 & 2010 because her 2011 taxes were not yet filed until late March 2012. Of course receive no RFE and we were not even asked at interview (May 2012). Even though we tendered all additional documents including her 2011 Tax transcripts at the end.

 

 

So ROC with one year tax(2012) or two  (2012 & 2013)????

I was considering including our Pre-nuptial aggreement in our I-751, just wondering whether this might be good or bad, has anyone ever done this before?  I have property along with stocks and mutual funds which I hold separate in case something was to happen to our relationship.  Any thoughts on this?

Per bolded part above, Just curious, are you sending a copy of AR-11 or i-865 for the address change if you filed those when you moved?

Or what exactly do you mean by supplemental form?

The NOA1 you received extends your conditional status for 1 year not your I-751 petition as stated clearly on the letter

 

 

 

The NOA1 also states that you can find status of your case online upon receipt of your ASC appointment notice (AKA Bio-metrics letter) So wait for that and you can use the the application # to check status

 

 

 

Yes, This NOA1 can be used to renew your licence.

As others have stated, if it is a long drive plus the two or three hour wait at the local SSA office some people do not feel the time and effort to remove the wording is justified until they are REQUIRED to do so when they become a USC.  Yes, a DL and a SSC without the wording works for the I-9 as those are List B items.  A GC is a List A item and does not require anything else.  A good employer would ask to see your new GC after conditions were removed, but that rarely happens.  I have not shown my SSC to any employer in my life.  Of course my SSC has the wording "FOR TAX PURPOSES ONLY.  NOT FOR ID."  A couple of my jobs were before the I-9 form also, but I now show my US passport.

 

To have the wording removed or not is a personal choice.  The OP can use the GC with the extension letter and the employer would be within their rights to ask to see the 10 year GC when it arrives.  No need to show a DL and the SSC as the OP would also have to show the GC anyway.

I agree.. it's all about convenience.

A good employer will follow the letter of the law. By requesting I-9 lists of type A or B plus C lists of document and NOT insist on seeing ROC approval or your 10 year GC

 

 

since we are talking about personal preference  due to cost and time implication,

 

Personally,

 I prefer DL & SSN (cost of replacement $25 & $0.00 respectively)

to

Passport and GC - cost of replacement ($110 & $450 respectively)

 

But then again, its all down to personal choice

The only time you are required to have the restricted wording removed on your social security card is after you become a US citizen. I haven't gone there to do it either since the nearest SSA office is not exactly nearby.

 

The key word is REQUIRED but why carry SSN with such wording when you can have it removed with your 2 year conditional GC.. I mean its not as if you have to renew your SSN card after some time or pay for re-issue.

 

Had mine removed after AOS. Never had to show GC to no employer.

Drivers license & SSN card should always suffice  and I couldn't be bothered with ROC or not

Math problem.

 

So the conditional green card expires after 2 years.  A "regular" green card expires after 10 years.  What is the expiration date of the new green card after ROC if the original date of issue is 01/25/2012?  Is it a simple add 10 years to the aforementioned date?  or is it 10 years after the conditional green card expiration which in this case was 01/25/2014?

 

Bonus question.  

 

Where do they print green cards?

Let the conditional card issue date = X

 

Therefore conditional card expiry date  = (X + 2years )

 

Let the ROC approval date = Y

 

Therefore, Expiration date of the new 10 year card= Y+10 years

 

note: New 10 year card 'Residence since' date = conditional card issue date = X

 

 

Doesn't get easier than that :goofy:

looks like they missed the first order and had to resubmit it. No harm no foul. Now your card will be valid to 2/20/2024.

 Nah, don't think so. Your GC will expire ten years from now with same day/month as the initial issue of the conditional GC.

 

which is why it doesn't really matter for ROC when you get approved, be it 9 days, 9 weeks or 9 months etc, You will still be able to file N-400 90 days before 3rd anniversary of being a PR (i.e initial conditional GC issue date +3 years - 90 days)

Its incredible that not one of January VSC has been approved yet, May be I will relocate to the faster processing center when app-ing for N400   :goofy:

If it's any consolation especially to VSC folks, Early/late ROC approval doesn't change or affect N-400 app.

That it took, say 9 months to get ROC doesn't mean you won't be eligible for N400 before someone in the group who got approved in two months. AOS and not ROC approval date is the determining factor.

I guess Its just the stress/anxiety of not knowing when approval will come as time ticks by.. hopefully twill be soon

but I limited all docs to about 1 inch thick by sending only cover, signature & beneficiary info pages. I know I risk RFE's but I will be ready and I dare them actually to send one. I will reply with a box of load of document smile.png

What all do we need to bring for biometrics?  When I went for AOS I forgot our marriage certificate, but they let it slide as they found my application in the database and saw that there was a name change.  Do we just need our permanent resident card and drivers license?  Or should I bring my passport as well?

 

Your bio letter &  state ID/DL/ passport will do.

 

Your GC is only needed if biometric is for naturalization N-400

 

Read the ID requirement on your letter again if in doubt

I guess this really depends on states.

I live in MN and I have never had any issues with drivers licence renewal/replacement

I got my drivers licence 2 months after arriving in fall 2010 on an F-1 visa. It was valid for 5 years (expiring on my birthday in 2015)  but had the status check of July 2013 (which was my I-20 expiry date)

Once I AOS'ed & received  my 2 year conditional GC. and changed address, I applied to change address & remove the status check date entirely from the DL. 

My 2 year GC or NOA expiry date does not affect my DL in anyway as my DL is valid till 2015 even though my 2 year GC expire this may, 2014

 

So I am surprised with the DL expiring on GC anniversary or extended for 1 year based on NOA posts I read on VJ

Or could it be that they ignored all those in my own case

Received letter yesterday with Biometrics appointment for 03/12/14!!

Does this mean they found my evidence ok and I should not be worried about RFE any more?  dancin5hr.gif

 

Not Really, It just means USCIS accepted your payment (e.g check in the right amount) & the I-751 application form as correctly filled /signed.

Only those two documents (or earlier than 90 days app) will prompt returning your package back before being issued NOA1 or biometric letter.

 

The rest of your package will be examined later leading to RFE, Interview or approval.

 

Usually files are not even examined when transferred from VSC to CSC meaning you can even still get RFE after transfer

So let me get this clear. I filed my i-751 I got a notice that my green card has been extended for a year and that I have a bio-metrics appointment. I won't be having an interview to see if my 10 year green card is approved or not?

You may get an interview or not. Most ROC applicants don't get interviewed.

Besides, You should not be bothered about that at this time.

Get your bio-metrics done next month and sit back and wait to hear from USCIS by probably the month of May if not June (judging by timelines of other ROC applicants).

Since you didn't apply to VSC, Your case is not even going to be transferred to CSC etc..

By late May, Early June or thereabout, your case/file will be adjudicated by the examining USCIS officer, only after then will you will be getting

1. Approved

2. RFE or

3. Interview

 or perhaps one before the other.

 

Until then, You will need plenty patience or pretense that you couldn't be bothered.  Good luck!!!

We filed our I-751 on 7 Feb; got NOA1 a few days later with the application number (WAC#)

 

Then we just got our NOA2 (bio appointment) today with a different application WAC number, but the service center says ESC.

 

Is that normal?

 That's normal, I got the same thing too. 

You can use the WAC on the biometric letter to sign up for text & email updates.

Finally your NOA1 date is not the day you receive the NOA but the date on the letter itself. I'm not sure your letter could have been dated as recently as 02/14/2014

I found out in sending my ROC package, This is less fun or maybe I'm less enthusiastic compared to AOS application. I mean, I was grumbling trying to decide what to send or not. complete pages or not. (I sent bank statements in full though, as RFE seems to be common for those). Yes, I know its better to send all documents/pages but I just felt there's nothing to be worried about as regardless of RFE or delay in getting approved. My PR start date will be May 7, 2012 and that is all that matters to determine when to file for naturalization if & when I decide to do that.

Hence I decided NOT to send pix, addressed mails, affidavit, as they are considered light weight evidence in any case

 

I sent

Residential Lease,

bank statements in full

Drivers licenses for both of us

tax transcripts(2012), returns for 2013 + W-2s),

Auto, Renter's, health, dental & life & term life Insurances

401K plan/beneficiary for both of us

Electricity & insurance bills for both of us.

 

Should be good enough but you never know the mood of the examiner or adjudicator

but I limited all docs to about 1 inch thick by sending only cover, signature & beneficiary info pages. I know I risk RFE's but I will be ready and I dare them actually to send one. I will reply with a box of load of document smile.png

 

I wonder where all my 2012 AOS February folks are. I hope we all are finding time to enjoy our lives regardless of trying to prove to USCIS or not.
