You can apply for citizenship 3 years after the date that says "Resident Since" but only if you have been living with and continue to be married to the spouse who filed for you in the first place. If you get divorced before the 3 years you will have to wait until five years after the date that says "Resident Since".

I hope I am posting in the right forum.My son and I got our 10 year green card approved in April 2012. Can anybody tell me when can we apply for Naturalization? We have been here in the US since June 2009. Married my husband on August 2009. Hope this helps a little in giving you an idea about our status. Thank you all very much!

If you filed ROC in November you can join the ROC November Filers thread (Please look for it in the Forum Lists). You will be able to talk to people who are in the same position and filing period as you are. you may get some better answers to your questions. HOPE ALL GOES WELL.

I submitted my I-751 a few weeks ago. GC expires early Feb.
What happens then from a work perspective? Am I still OK to work??? O_o

I am sorry to say that some of the things you people write are hilarious..(My boss- who is a Notary- has been filing immigration paperwork for people for over 10 years, so I know a little about these things)

As long as your spouse will file the ROC with you you should be ok..As long as you have proof that you both had/have a life together then you should be ok...Only people who spark suspicion of business marriage are asked in for interview after filing ROC and they are the ones who have to worry about the things you are worrying about.

Your spouse is willing to do this with you, he filed for you in the first place anyways, so if he is willing to file the ROC with you then go ahead and do your thing. If you get divorced there is a greater chance of your ROC being denied. Stay with your husband (even if you dont live together) and work out your problems and file your ROC together.

How does ROC filing affect citizenship? It will only affect it if you are applying for citizenship based on being married for 3 years. However, you can wait the 5 years and apply for citizenship on your own without your spouse after you both remove the conditions.



Hello people. I need some advice with my current situation. My visa status is still conditional together with my K2 and I need to file ROC
this coming January. But certain things happened and we decided to separate for awhile, but we dont want to file a divorce. He will stay where he is where we spent all our marriage life and I will be living out of state..together with my child, K2. I need to pull him off from school and enroll to the new state that we will be living.
My husband (petitioner) said that he will cooperate and still be involve with the process of the visa. I am just worried what if the Immigration finds out that I am no longer in that State that I used to live.. We will still have a joint bank account and everything else will remain other than that i have to moved out of this state for awhile. Thanks in advance for ur time to read and responses.

Hi Guys. Congrats to all who have been approved and prayers for those of us who are still waiting.

 

We got an RFE dated April 29, 13 but was received on May 2, 2013. They were asking for more evidence of good faith marriage, however I think the fact that we moved at the end of our lease at the beginning of March and did a change of address is the reason for the RFE. We had sent in all we had including bills, photos of ourselves and the kids (my husband's step-kids) at our wedding and on vacation, bank statements and anything else we could find. We have nothing else to send except for all the new bills, paperwork, etc. that we got since we sent the package in November.

 

I guess we have to prove that we are still together (due to the change of address). So on May 13, 2013 we sent in all the new bills, emergency contact sheet for kids at school with hubby's name, new lease, car insurance, recent tax return and more bank statements (all the things we acquired since we sent the application in November 2012) along with a cover letter. The documents do show the new address.

 

I do hope this satisfies the questions they have. It has been such a stressful journey.

 

Please update the RFE and REF sent dates for me thanks.

So..Not being one to wait around for stuff to happen..I did a walk-in this morning at the Processing Center and was fortunate that I was the third person there and the officer working at the front desk said that since it was a slow morning that she would let me do my biometrics.

I DID MY BIOMETRICS TODAY 2/7/13 (Early Bio)

Hi everyone.

I have had to call USCIS twice since filing my I-751 on 11/19/2012. I got my NOA dated 11/23/2012 and then nothing. I called in early January about not getting my biometrics appointment and was told to wait a bit more. I called again on January 30 and placed a service request.

Surprisingly, today I got two letters- one a notice about my service call which stated that their records show that I was sent a request by their office to go to one of their Application Support Centers for processing associated with my case and that my case was in suspense from further action until I attended this appointment, also that a copy of the appointment notice was included for my information. However, there was no copy of that notice in the envelope.

The second letter had my biometrics appointment notice...my take on the matter is that after I called the USCIS they realised that they had not sent me a biometrics appointment notice,,,so they sent it asap (the letter's notice date is January 31 - a day after I called and made the service request).

Housekeeper can you kindly update my info :-

Date of I-751: 11/19/2012 NOA1 Date: 11/23/2012 Biometrics: 02/14/2013 Approved: / /2013
