Hmmmm, I don't know. This has come up before on VJ and it's a tricky question to answer when you're not talking about benefits that are specifically excluded on the I-864 (example: federal student aid, Head Start, School Lunch Program, and others).

My take on this: First of all, the USC and any USC children are always entitled to any benefit afforded USCs if they can get it. The immigrant spouse shouldn't come into it. But that's not as cut-and-dried as it looks when you're talking about assistance that affects an entire family, like Section 8 housing vouchers or food stamps.

In this particular case, a co-sponsor who's above and beyond the requirements should be enough. But...see, here's the thing. Put yourself in the mind of a USCIS adjudicator. Are they going to look at a family receiving a large part of its income through public assistance (if the immigrant's not working yet, say) and have some very real doubts about the sponsor's (or sponsors') ability to support the immigrant?

I don't know. I'm just askin'.

I think I'm past the edit time, so let me add: *this* case isn't my concern, as it doesn't look like we're talking about the family receiving a very significant portion of its income from public assistance. But other cases where that IS the situation...that's what I was referring to about putting oneself in the mind of the adjudicator.

If we expedited cases wherein there were fetuses, babies, or children involved, the net effect would be zero—because there would be so many "expedited" cases that an expedite would mean nothing.

It's 2006. Pregnancy is not a miracle—it's a wonderful experience, but people make babies every single day. Roll the dice with Manila and best of luck to you, but don't hold your breath.

that can be tricky...my fiance came to italy legally but then overstayed his work visa...so he is able to obtain a police record no problem...as for you, they still might do it, but there are no guarantees...you just have to ask them and hope that they say yes...if they take written requests i would do that...you can write that he lived in the country without papers, and hope that they are nice enough to give it to you.

those albanians are so silly sometimes...lol =)

i dont think it will be a problem...if they say anything, tell them that you are trying to get him a US visa and that he will be leaving italy as long as he gets the police report...if they give you trouble, you can just write in the request...you shouldnt need the NOA2, but keep in mind that the police report expires after 6 months

oh that i dont know about...my fiance has been in similar situations, but they never fingerprinted him...if they didnt bring them to jail or anything, just told them to leave the country...the cops might have just been trying to scare them and there may be no record of the incident at all...if thats not the case then im not quite sure what you need to do...you should try and get the police record first in order to see if there is anything on there...if there is then i think you need to look into a waiver (?)..dont quote me on that tho...if there isnt anything on there, then youre home free =)

My fiance came to Italy, the country where we met and stayed together for over 2 years. Now that we are trying to get married, I am worried about going to the police to get his police report that says they had stopped him, noting that he leave, having entered illegally. I am worried that the police having this notice may stop his paper work. Has anyone else had a similiar problem?

In addition, he is from Kosovo, which is currently governed by the United Nations. He has to go to Macedonia for the interview...whenever that will be. Also, does anyone know what would happen if Kosovo receives independence, and all new passports have to be issued? How long could this take!


im a little confused...did your fiance get arrested or something? why are you worried about the police report...i know that in italy you can write in a request for a police report as long as you send a copy of id with it...message me for that info...

i was informed that the uscis only cares about us visas, not ones issued by other countries.

no problem...also...i dont know if you pay for the service you use to chat with you SO, but you can always print out bank statements if necessary...thats another thing that i did, which i left out in my previous post...bank statements showing many many many charges to that same international calling card...

dont forget tho...dont JUST rely on the chat logs...theyre good to have, but definitely copy your passport stamps/visas, plane tickets, bank statements with purchases in SO's country, photos of you two together, receipts receipts receipts, etc

yea i tried to get phone records from my international calling card, but they told me that due to customer privacy laws, an itemized list of calls was impossible to obtain without a court order...ridiculous, considering how i AM the customer

i did the best i could with this and printed out some cell phone bills, which show me dialing the 1-800 number several times a day for hours at a time...i then photocopied the actual card which shows the same 1-800 number printed on it...there are also incoming calls from my fiance's cell phone listed on the phone bills, hope that was enough proof =/

chat logs will definitely suffice

as long as he has legal residency in Oman, which it sounds like he does, then you have nothing to worry about...as for the embassy there, i would try and post on the MENA (Middle East and North Africa) forum...im sure someone there will know something

wow you guys are harsh...try and remember what it was like before you knew everything

granted i asked this same question about a week ago (and have seen it one or two more times since then), but sheesh cut the kid some slack....i have spent months reading, searching, reading, studying, reading, and i still dont have ALL the answers that i need to complete this process...everyone has insecurities and doesnt want to mess this thing up...isnt that one of the reasons why a site like this one is created? we get support from those who are in a similar situation, and who can understand our frustrations/confusions....dont be so hard on em...its just discouraging...

if you dont want to be bothered with posts like this one, then move on and dont post back...its much easier that way...someone else will gladly respond

I actually did send in one that had expired. After noticing I called the USCIS and they told me if they cashed the check then they accepted it. I truly hope this person knew what they were talking about this doesn't come back to bite me.

a word of advice...i was checking over my packet and realized that my i-129f was expired...make sure that you check this before mailing in any forms!

im fairly sure that you will need a sponsor...the loans dont count as income as far as i know...and as far as the bank account...
if you were to earn $3,000 a year,
and the minimum you needed to earn in order to qualify was $13,000
then in order to claim assets (your savings account), it would have to equal 3x the difference
$13,000 - $3,000 = $10,000
In order for it to work this way, you would have to have a savings account of $30,000

was that clear? its kinda confusing

i used giant paper clips and binder clips...i had it in a large envelope, but because i mailed it express mail, the envelope wouldnt fit! so i just put them all in the express mail envelope...it was still organized though...i had these nice little transparent envelopes that came with the passport photos...i attached those to the g-325a with a paper clip and i put the photos of us together in a ziplock attached to the section on meeting in the past 2 years =0)

if you dont put it in a folder, just make sure the pages are labeled with your info

i also did a sort of table of contents for each section...i have my i-129f cover letter (general outline for the entire packet), then one for having met in person within 2 years, and another itemized list for proof of an ongoing relationship...

if there were any gray areas in my case, i explained them on the cover page for the appropriate section...but if there is nothing strange about the situation then they should be able to figure it out...

for example, i use an international calling card to call my fiance, so rather than my bills repeating his phone number over and over again, it repeats a 1-800 number...i was able to explain this to them in the cover sheet for the section on having an ongoing relationship

yupp...in albania the only houses with numbers are the ones located right in the city centers...they dont have zip codes either...so basically my fiances address there is his name, street name, city and country....no numbers at all! i couldnt believe it when he told me...he also informed me that they have to go to the post office to get their mail...he said that if you dont go and pick it up, you wont get it

i was just wondering if one only needs a court record if they have a criminal record...if my fiance has never been to court, does he need to somehow prove that? or does the police record take care of that?
