Does my fiancé(e)?s minor child need to be interviewed?

All visa applicants, regardless of age, need to appear at the Embassy for a visa interview.  We suggest that applicants appear at the Embassy at least 15 minutes before the scheduled appointment and plan to stay a few hours.

Does my petitioner need to attend the interview?

The petitioner need not be present during the visa interview.  Be assured that his/her absence, in and of itself, will not affect the applicant?s case.  However, the petitioner is welcome to accompany the applicant should he/she wish to do so.

Thanks for the responses.  The embassy is contacting NBI to address the situation.  The interview went fine.  We were well prepared except our NBI was 6 months old.  Hopefully this will be resolved quickly.

Hi, my fiance had her interview on January 7th and all wen well except we were given a 221g in regards to our NBI clearance.  She had one issued in July of 2013, but the embassy wants something more recent.  The embassy instructed her to do nothing and the passport with visa should be ready in less than three weeks.  Has anyone else encountered this situation?  My fiancee is from Leyte and has been displaced since the typhoon.  This is truly a burden.  Any idea how long this could take?

Thanks to all who have responded.  We have passed the medical and have been to the CFO.  We are on pins and needles as the 7th approaches.  I believe we are super organized.  I sent the final documentation package to Raffy by DHL two days ago.

Hi folks.  My fiance's interview is scheduled for January 7th in Manila.  We are a same sex couple.  My fiance's town was essentially destroyed by Typhoon Haiyan, so he has temporarily moved in with his cousin in the Manila area.  It's essential we have good internet and communication capabilities as we approach the interview date.

 

I'm looking to see if there are any other same sex couples on this site that are also being processed in Manila.  To date I have been impressed with the speed our petition and interview date have been handled.  I mailed our I-129F on August 2nd.  Does anyone know of any same sex success stories out of Manila?

 

I have been to the Philippines 3 times over the last 2 years for 3 weeks each visit.  I really do not believe we have any problems establishing our relationship.  You just can't help but be a little nervous.

Mailed I-129F and associated documents on Friday, August 2nd.  Our journey begins.  We are a same sex couple.  My fiancee is from the Philippines and I live in Massachusetts.  We have been a couple for 2 1/2 years and I have been to the Philippines 3 times for 3 weeks each time to visit my fiancee.  I am a new member to this site.  

 

I'd be interested in the experiences of othe same sex couples as time unfolds.

We are a bi-national same sex couple of almost three years.  I reside in the USA and my fiance resides in the Philippines.  We mailed our I129F on August 2nd.  Received confirmation of receipt on August 8th. And this week on Monday, almost 7 weeks to the day, we received notification that our petition has been approved.  The next day we were notified that it has been forwarded to the Dept of State for VISA processing.  I was caught off guard with the speed it was processed at.

 

So to all other same sex couples as far as I can tell at this point in the process we are certainly being treated fairly.

For countries where same sex marriage is not legal like the Philippines and others, many ask me if there are other alternatives to bring their same sex boyfriends or girlfriends to the US.

One way of course is to go to any of the mentioned countries above and get married there. But this involves securing visas, hotel and travel expenses, lengthy travel times, language problems, making marriage arrangements and other hassles.

In my column article three weeks ago, I suggested utilizing fiancée (or fiancé) visa petitions, which I conjectured, could be a viable option. I theorized that even if the couple is not yet married, they will be getting married in the US in a state (like California)  where same sex marriage is now legal. I figured that Secretary Napolitano, a reasonable person and other equally reasonable people involved in determining immigration policy ? would not object to fiancée visa petitions in same sex relationships ? as it is in keeping with the spirit of the law. I figured correctly.

Six days ago, Napolitano issued another official directive to the US Immigration and Citizenship Services (USCIS) ? stating that henceforth, I-129 Fiancée Visa petitions by US citizens in same sex relationships will be honored and  processed by her agency. This is a tremendous benefit for those coming from countries like the Philippines where same sex marriage is not considered legal. They can now come to the US on fiancée visas and get married here.

Hi folks.  Quick history - Back on September 30th I received an email from USCIS stating our I-129F had been approved and an I-797 has been sent to me in the mail.

 

It finally arrived today.  They sent it to the wrong address, an in state immigration lawyer.  They were kind enough to forward it to me.

 

It's not clear to me what my next step is.  The approval is good until the 29th of January 2014.  At the bottom of the form the Texas Service Center is listed with a customer service phone number.

 

Do I continue t track my case online like I have been?  Will they notify me or my partner?  Or do I need to call customer service?

 

Anyone in the know I would love to hear from.

Hi, we filed our I-129F on August 2nd.  I live in Massachusetts a state where same sex marriage is legal.  I know for sure on our letters of intent to marry within 90 days after entry did not mention Massachusetts.  But I do know in other areas I made sure to express that same sex marriage is legal in Massachusetts.  I did not include any hard copy of the Massachusetts marriage laws.  On 9/30 I received an email stating our I-129F has been approved and forwarded to the NVC for Visa processing.  I received the I-797 hardcopy in the mail this week.

 

We waited until AUgust to apply to give USCIS time to sort out their procedures in regards to same sex petitions.  To date the process has been quicker than I anticipated and hassle free.  I'm calling the NVC on Tuesday and attempting to get our case number.
