I was checking the list of the documents we need and the affidavit of support is one of them, my fiance works part time while he studies, he makes $10,000 which is $5,000 short of what is needed it for the k-1 visa, let's not go on the $10,000 short for the AOS, which form will be needing as in the list its says I-134, but like I say we are going for cosponsoring?

I was an Aupair too, I'm actually you do not need the police record I'm just taking one from Mexico just because, which is stupid because THEY DO NOT ask for one. So don't worry, besides if she did something wrong I bet is already on their system haha. :)

 

And btw I also stayed the extra month, after I finished my 13 months in NC, I had to renew my BorderCrossingCard -tourist visa- and they never say anything about overstaying, because like you said you are allowed to do it, and I've been visiting for 4 times since then

But as far as I know you cannot have two visa applications pending, our 2 visas period, I have my tourist one but when they give me the K1 they will destroy my BCC. 

So if you already have your K1 being processed then as far as I know you cannot start on the tourist one.

hi everyone, this week has been super stressful, mainly because fiance cant meet the poverty line, and the people we were asking can't reach either, so we still have more options, but I need to explain  what favor do I need, fiance was the one asking for the favor as the other people were his contacts. 

 

So I know I need them to fill out a I-134 for now, but when applying for the AoS it will be the I-864, so far, I'm right?

Now this person is the only one working, he has a wife and three kids, so 5 people and adding me, his household will be 6 people, right? So he needs according to the 2013 poverty guideline $40,000

 

Even though he is filling for me, my fiance also has to do it? So they will be co-sponsors?

On the question that says:

" I INTEND , DO NOT INTEND to make specific contributions....." what does my  co-sponsor should mark?

 

As prove; what does he need to send me? pay stubs -last 6-, tax transcripts - last 3- what else?, his income is way superior to the amount asked, so does he need to send copies of his house & its mortgage?

It shouldn't be a problem, first of all because people that work in there do not grant visas in a local way of thinking, meaning when I go to Juarez the person conducting the interview is not going to be thinking as a mexican, he or she will be thinking; is this person safe for US?, does she/he meet the requirements? and now that US approved the new law that means that for them same-sex marriage is as honest and has the same rights as an heterosexual couple. 

So good luck with this new journey, is tiring but so worth it at the end :)

Actually I know that you can't have two visa application ongoing at the same time, because when we first started getting serious we were thinking about the K1 and apply also for the working one, but somewhere on the US website said that you cannot have two visa pending applications at the same time, so we opted for the K1. Also as a tourist visa holder I know the moment we get the approval for the K1 right there on the consul they will take my BCC, so my advice is don't try it because you will waste money they will at least charge you $160, that it's if you live in the city where the consul is, but if not you will have to pay for transportation and so on. 

I would have my fiance visit me, or maybe meet him in another country as pre honeymoon trip :)

Why would the lawyer have you pay the visa fee already, how much did you pay, my lawyer did our process in steps.  Email the embassy at kingstonivappointment.gov and ask them what if I paid my visa fee to a lawyer and see what they say, because your really supposed to pay for it at the embassy day of interview, visa fee is $240.  Did you also register with DHL and did you scan and email the confirmation page of the DS-160, your supposed to do that too.  When you send the email yourself, address it to the embassy with your fiancé's information like this

and they will get back with you promptly, they are really come l, so email them for everything you need.  Let me know if u need more help....We are going through the same process now.

 

After we receive the last letters with KNG ....... We did DS-160(in my receipt that she gave it says visa application fee under DS-160)  and affidavit of co sign... I paid a total of 330.... I email them... hopefully I get good news....]

Start by emailing the embassy to see where you are in the process, then go from there. Put your KNG number in the email, so they know your file. Ask them what else do they need to schedule your interview.

Ok and  do you know the which one I would want to email about in the embassy info?

A KNG number is your file number with the embassy, that has been assigned by NVC that designates which embassy your petition is with.

OK, mmmmm. So you received NOA1 and NOA2. Th next step is your file goes to NVC and then they process it and then send it to JA. You then complete DS230 part one and email signed scanned copy to embassy. You still complete DS 160 and the other forms. JA schedules interview appointment. You take all paperwork, birth cert, police cert, and other documents to the interview. At the interview, you pay visa fee.

JA in their process is not like other embassies.

Yes I did et Noa1 and Noa2 and I just look over papers I received and I did et the KNG number and I look over paper where it says to complete DS-160 and we did that and have confirmation number as well.... Im not sure about DS-230.... Where do I go for that?

Are you filing for a k-1 or a visitors visa??? It sound like the steps you completed were for a visitors visa. In order for you to get interview for K-1, you email DS230 part one to embassy, you do not pay visa fees until interview, so how did you pay already?

Your best bet is to email the embassy to see where they have you in the process.

Do you have your KNG number? Is your file at the embassy from NVC? What paperwork did you send off and to where? I think that you are being misinformed on the process, and it has set you back three months.



I'm filing a k-1 visa....  I paid for visa application... I did the co-signer as well since  I did not make enough money( affidavit of support)... I paid all this with my with my lawyer.. please don't tell me that we did something wrong... If so what part of embassy do I email? thanks

 

I only got the approval through the mail.. And gave my lawyer the paper work... and we did the DS-160 together and I have confirmation of that...

So I'm really seeking from members. ??The last thing we file was DS-160 and that was back  in January sent paper work off and paid for visa application and still not receive anything about setting up for interview. We did the application online and sent the paper work off.... and still did not receive anything? What should I do?

Your welcome, yes email them the confirmation page only of the DS-160...I did the DS-230 form as well just to be on the safe side... I think you should do it and email that, but you have to have his signature on it...and scan it to them, but they only want part one, so it's ds-230 part I that you email..

The embassy will schedule your interview with a random date, however if you can't make it, you can email them and let them know you need more time...the appointment dates are running about a month and a few days later after sending in all your paperwork to the embassy they will also email your appointment letter with your medical intructions, remember to make your medical appointment as quickly as you can, we were told that Jamaica has a lot of upcoming holidays and that we will need time to get your medical results to the embassy in time for your interview...I think you will have enough time, I'm going to be with my fiance as well and was wondering the same thing, so all should be well!!!

The embassy should have a copy of the NOA2 (but I wouldn't take any chances and keep looking). You will also need the NOA2 for the AOS once the K-1 visa has been approved.

 

It coast a little over $400 to have the NOA2 replaced.

Here is a list of things you need for the K-1 interview

 

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
 

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

i was looking over the ds-160 form that gets filled out online and saw "National Identification Number" under Personal file.  Does Cambodia have a National Identification Number?  i would appreciated some help.  My gut feeling is that the country does not issue any number.  thanks

Hello,

I've read many discussions here but my situation is a bit different. I'm a Canadian citizen residing in Canada and my fiance is a US citizen residing in FL. We're both of Indian descent and have decided to get married in India in Dec 2013. My plan is to leave Canada in Oct and go to India to do wedding planning. I'm not sure how to start the paperwork as I want to come back to Tampa and live with him in Jan 2014.

It is now March, if we apply for a K-1 visa, will it come in time for me to leave Canada in Oct? I understand we have to get married within 90 days of us receiving it in the US. The wedding ceremony in India is only religious and we may not sign papers on the same day.

Once I get the visa and come to the US, can I live legally in the US? Or would I have to go back to Canada/India?

We've been dating for 2 yrs and he proposed to me in Jan 2013.

If someone can please help me out, that would be great!!!

Guys, just an update regarding my original post:

 

Our NOA2 got approved on Sept 27 and didn't get RFE for the missing "III" or "Jr" suffix. The NOA2 we received in the mail stated my fiance's complete name. It includes "III" although we forgot to put it in I-129F form. I guess, the name suffix doesn't really matter. :)

Those are part of the legal names but not sure if USCIS will have issue... nothing you can do about it now except be patient.

 

Just be ready if USCIS decides it is an issue and requests clarification (maybe a new, accurate G-325A).

 

Until then don't stress about it.

Hi VJ members! I'm a new member of this site. This is very helpful. Thanks to all of you.

 

I just want to ask if there will be an issue if my fiance forgot to add "III" (third) on his name. He also forgot to add "Jr." on his dad's name on G-325A. We reviewed the I-129F packet before sending it but we totally forgot the name extension.

 

Do you think there will be an issue regarding this? Or are we going to get RFE?

 

His name is Michael John III. His dad's name is Michael John Jr.

 

I would appreciate your comments on this especially those who have the same experience. Thanks. :)

Hi VJ members! Me and my fiance are starting to prepare the documents needed for interview while waiting for the letter in the mail. Our NOA2 got approved on Sept 27. I asked my fiance, who's the petitioner to prepare his paystubs, W2, and ITR. He said that he doesn't have W2 as that is being given by HR dept at the end of the year to file for income tax.

 

To give you an overview, he didn't have a permanent job last year. He got a temporary job and he had his house being rented. His income for 2012 was only $23K ($10K for temporary job + $13K for rental income). He started working permanently this year and he's above the 125% poverty level.

 

My question is, is it okay not to have W2? His ITR and pay stubs are available. He has also savings on his bank account. We'll include that when I have my interview at USEM. Thank you for your help. :)

You can submit few copies of chat logs and submit other evidences too. Try to Focus on primary evidence.

We did not send chat logs on our I-129F application and did not get RFE. We submitted evidences that we met within 2 yrs such as boarding pass, hotel receipts, ATM, restaurant receipts, passport stamps, receipts for dollar convertion, etc. For our secondary evidences, we submitted pictures, emails, phone logs, package receipts, cards, paypal money transfer receipts, gifts, etc.

Hi everyone!

 

I have read that if the photo page of my passport is damaged my visa could be made pending/denied at interview. Our petition just got approved, so I am planning on replacing my passport to be safe before I get to the interview stage. I am going to France for 4 days on the 14th of February, so will need my passport for that. I was wondering if I should replace it before I go (it might be pushing it for time) or will I be ok replacing it as soon as i get back. I am a little worried that if I wait my interview will be scheduled longer than 4 months after our NOA2 because of the 3 to 4 week waiting time for replacing a passport in the UK. I may be worrying for nothing ( i usually do : )). I just thought i'd ask and maybe see if someone could explain the time frame of the whole thing after NOA2, including timing of filling out forms (where i'm sure i would have to include my passport number).

It took month for me to transfer case from one embassy to another. I got new NVC case number when they transferred it. So just giving info about how long it might take.
