Hello there, I just want to ask how many months it will take to get the letter from the Embassy or from USCIS to my fiance since i got my letter from the USCIS last saturday that my application got approved. And is there any payments that we need to pay prior to his interview? aside from the physical exam, i wanted to know how much is the payment for the physical exam because i hired a lawyer to assist my fiance but she asked me some money before even thou my application is still on pending from that time and then again, and then she asked me again for that . if your interview date is after January 30th, you will have to show 2008 tax return at the interview, there are other things you will need to send as well, like updated proof of your relationship, bank letter, employment letter, etc..., it would be wise to wait until you have an interview date

It is no big deal, but you will need 12 months worth of bank statements to show consistent deposits, I have B of A, they provided the same letter, minus the deposits for the last year.
I have online access, I just printed my statements at home.

I met my fiance (SA) by introduction over the Internet.

My fiance will not be allowed to return to the U.S. once married to me and leaves... until all immigration papers are approved for a marriage visa allowing her return to the U.S. Therefore my thinking is, we will have to live outside the U.S. for the duration of some 7-10 months until immigration papers are in order.

2. If the above assumption is correct: Where would be the best place for me to live outside the U.S. within U.S. time zones that offers the following: 1) Safety for Americans; 2) Low cost of living; 3) Broadband availability so I can work and call U.S. companies reliably. Places that come to mind that are close are: Bahamas, parts of Mexico, Canada. ANY SPECIFIC PLACES YOU CAN RECOMMEND?

3. What immigration paperwork will I need to file after we are married?


I'm sure there are issues I am completely unaware of and should have asked ... so please feel free to comment openly.

Yes, you are correct on this. According to the form directions, the K3 MUST be processed in the country where the marriage took place. We have one forum member in Honduras as we speak being interviewed.

Kevin B has just finished his inetrview and his wife is in the US now. You do NOT have to be a resident of the other country to do this. This is a loophole in the K3. The visa MUST be processed where the marriage took place. Kevin's process tok just 7 months start to finish.

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

yes the I-134 is the affidavit of support, there is a link on this website under "example forms" you also need a verification of employment letter from your employer, a letter from your bank, or 12 months worth of bank statements and a copy of your tax return

check with your interviewing embassy's website, I know that for the interview the passport photos required for my fiance have to be current within 6 months and she has to take new photos because the ones submitted with our I 129 were taken longer than 6 months ago

Call up the Consulate and tell them about the spelling mistake, they will correct it and print another one instead of this visa. It is a good idea coz nobody wants any problem later, right? It can be corrected. All the best.

I wouldn't worry about it, on my fiance's visa they added 20 years to her age, at the poe they just corrected it with a pen, remember, after six months the visa is void anyway

Wow, great research,I read the instructions for G325a and it says nothing of photos, but to be sure call them. that document is from 2005, and if they do require photos it will delay your approval. This was in the instructions:

use both last names in the last name box, my wife is the Latina, and that is what we were instructed to do (by a service that I hired) An addendum is fine, but there is a way to shrink the letter height, if you adjust your settings in the adobe, (I don't know how, they did that as well)

Your federal adjust gross income is what they want to see, not your taxable income, the $35,000 you mention is probably taxable income

He is a U.S. citizen and I'm from Peru. We have a difference in our ages...about 19 years. We just want to be together, that's all that really matter to us..but I'd read in some web pages, that a lot of times, Embassy denies the K-1 visa, because of the age difference..and I'm crazy about that because that really shouldn't matter.
We are trying to know whta is better to us.... if the K-1 visa or the K-3...
We want to make this work, but we need some good advice from you guys.

P.S: ooohhh I forget to tell, that we met for the first time on December 31.. and it's says that we should see us at least for 2 years..so that means that we can not apply for that kind of visa??



Do you mean that you meet fot thr first time Dec 31 2008?

If so, that is going to be a bigger problem than any age difference.

You really should consider not filing for a few months so that there is time to build evidence of a bonafide relationship.


Well, yes..I think so. But now we are thinking about maybe asking for the K-3 Visa. He is coming on June, because of his vacations.....so we are thinking that if we really realize that K-1 is not good for us, then we want to get married in Lima and ask for the other one...but I think that it would take us longer...or am I wrong.


My wife and I have a very large age difference. I considered a K-1 but due to the age difference and the fact that she was preggy we decided to get married there. I wanted to get our life together started and I was not going to let the immigration process interfer with that so that was the best decesion for us.

If you were to go the K-1 route it would probably be better to file after he comes there this next time. If you are like me you would marry there and then file CR1. No one way works best for everyone

I am 20 years older than my wife, it was never even addressed at any point of the process, I met my wife last December 07 and applied 2 months later in Feb 08, that was not a problem, however I did return to her country to see her 4 times throughout the waiting process,, and attended the interview.
