Sure.. there are ways to avoid this.

what you guys can do is apply for a Fiance visa. He can come over to the United States. Get Married. Apply for Ajdustment of Status and then go back to india for the big fat wedding.

I always preferred this route...however.. things got complicated in india because of cultural issues. Applying for I-129F is just more $$ like (1200 bucks extra) and a lots of documentation. But i think its still better than dealing with a long distance relationship. We just went through this paperwork in 2009.

its a lot of work! Aplying for Fiancee visa, adjustment of status, removal of conditions... and then finally apply for US citizenship which we just did. if you need any info feel free to call 2016753879

It does make sense... you cant keep on filing for K1 every other year and get non-immigrants in the country... remember all K1 applicants are eligible to adjust their status.. and once they do that.. they are eligible for citizenship. the government cant promote people in filing K1 again and again.. if you are filing K1, then better get it right the first time. When you are 100% assured that you are in love only then file it....

You cannot file for a K1 anymore as per IMBRA Law. Imbra Law states that you can apply for K1 only once in your lifetime... However you can keep applying for Spouse visas but not K1. K1 is only a one time deal.

these are painful times... i have gone through so much filing and waiting and paper work.. it seems that productivity at all the processing centers is very low..i believe they give preferences to non-citzens than citizens..
its just hard to believe that even if they do that, the overall filing of H1B visas has dropped significantly. So where is the work getting generated from at these processing centers???
why is the process so slow and not helping people who have legally been in the united states.

TSC seems to be processing stuff very slowly... wait and watch what happens next. the only thing you can try to do is to call your congressman and senetor and explain the situation. but they wont help much if the case is within the timeline.

hope things get resolved.

I am a US citizen applying for GC for my husband who currently lives in India. Got NOA2, and have sent in the 864 package. Since we are gathering documents for the DS -230 package to save time, I had a few questions

1. In india my husband has lived in Kerala, Chennai, Manipal and Mangalore (currently in Mangalore) since the age of 16. Does he need clearance certificates from the police office and local passport office from each of these 4 states?

2. How easy/difficult is it to get these documents? Does he have to go in person? Or can he ask people in each of these places to get it for him?

3. Does he have to provide any letters/ documents to get these clearance certificates?

4. And lastly what is a "certified" copy of beneficiary's birth certificate? Does it mean notarized?

1) Whereever he lived the longest amount of time, you should obtain the certificates.. if he stayed in chennai for 5-6 months then you may not need it..

2)it is very difficult to get. waiting in the lines and so on. not an easy process at all. i believe the passport office provides a PCC stamp on the passport. once that is done and if you have like 2 certificates from the local police station where he lived that should suffice

3) they must have their own checklist of documents.. drivers license etc...

4) yes it means notarized.. make sure its readable

no you cant be a US Citizen because you are leaving the country for over 6 months which violates the continuios requirement which is needed for applying for US Citizenship. You can try to apply for waivers and things like that but your case is considered an extreme situation. you will have to wait until you meet this requirement.

My wife got her permanenent greencard on April 24th 2009. As per Section 319a she was eligible to apply for citizenship on Jan 25th 2012. (3 year anniversary - 90 day early filing date). So i filed N400 on Jan 26th and we received the notice of action (acceptance) as of Jan 26th 2012.

Everyone i know has received their Biometrics appointmnet letter. This letter is mailed within 30 days of the acceptance and 14 days in advance of the appointment.

She did go for her biometerics in March 2011 when we applied for lifting conditions on the greencard. So is it safe to assume that we didnot receive the bio metrics appointment because the fingerprinting is valid for a stipulated timeframe?? Does anyone know about how long the biometrics are valid for?

Any input in the matter will be greatly appreciated..

I applied for citizenship in Jan 26th 2012 and have received a notice saying that i am in queue of scheduling. No further notice i received. However i did get a yellow letter asking the same information. I have received all the transcripts for tax returns for three years and stuff. should i also mail it to USCIS?

Since you did not file taxes there is no way you can provide tax transcripts. You should then submit Form 1722 which is a verification of non-filing which IRS provides to confirm that a taxpayer did not file taxes for a particular year. It can be requested by completing IRS Form 4506-T, checking the box marked "Verification of Non-filing" and mailing it to the IRS or by calling them and have them faxed it to you. Yes 4506-T is Request for Tax Return Transcript but that's what you need fill up. Just check item # 7 for Verification of Non-filing.

Goodluck on your interview and I hope you'll pass and have your oath the same day too! I had mine done in Denver too and I know you can do it!!!

what happens if we delay the citizenship interview.

so here is the deal

i applied for N400 - Jan 26th 2012
received letter that i am ready for interview scheduling on Mar 26th 2012
received letter that i fingerprints are expired on June 3rd 2012
received new etter for fingerprints scheduling on July 6th 2012
expected interview date on Aug 14 - Aug 30 2012

we are leaving for italy for vacation in Aug 20th.

what should we do? i dont want to risk it because what if i dont get the passport in time even if i get the interview call. Should i defer the biometrics interview? or should i defer the citizenship interview? any suggestions are welcome.

Hello everyone

My wife came to the US as a K1 fiancee. We got married and filed for AOS. We also received the greencard without any interviewing. I am done with USCIS for sometime from now. However, we will face them again for lifiting conditions procedures. I was checking the check list for all the items they need as proof. One of the items states that we have to provide them with proof of co-habitation. SO we need to give them a lease. However, my lease terms have already expired and we dont know if we will stay in the same apartment for the next 12 months. I cant renew the lease now because we may have to relocate depending on my spouses college admission. What do we do???

There is an example sworn statement in the Example Forms section (near top of page next to Downloads); Example

Note: Example shows a place for a Notary Public to sign/stamp, but it seems a Notary is not really necessary any longer (if it ever was). Signing in front of a Notary is at your discretion is the general consensus.

It's important, but not needed. For example, I live with my in-laws with my wife as she finishes here degree as it makes so much more financial sense right now. We had no bills in our name, no utilities and certainly no lease. We sent a signed affidavit from my in-laws explaining that we were all living under one roof. Lifting of conditions was approved very quickly (by Vermont standards) with no questions.

Copies of our individual health insurance plans addressed to the same address
Copies of car titles showing our shared address at home
A copy of airline reservations for multiple vacations including the United Kingdom and San Francsico, CA
Copies of Boarding passes from a trip to the UK in December 2008 and San Francisco in May 2008
Copies of various holiday cards we have received since being married
Copies of various tickets from events we have gone to together
Copies of various photographs taken of us from 2007 to 2009 during our marriage

Fromw what I understand, you are now living with your parents and have no lease, right? And the lease is required for the Removal of Conditions stage, so I can see why you (and immigration) would have problems with such, as they will ask for such evidence when the time comes.

The solution: Ask your parents (or whoever else is your landlord) to write a sworn affidavit letter saying that you and your spouse live there, and that you are living there (regardless of if you pay rent or not). The statement should be written by the landlord and notarized by a notary to make it official. This should suffice for immigration purposes, in terms of fulfilling the requirements for a lease, when there is none. Do not write any "fake/false leases" as that is seen as fraud and can be used against you. As well, get any other joint evidence that shows that you and your wife live at the same address (such as what you listed in your post, that's a good start there), and you can provide pther evidence and affidavits from others (friends, co-workers, neighbours, relatives, etc.) that have known both you and your wife together too.

The package will be sent back to you if arrives prior to the 90 day window.

When your application is accepted you will be issued a one year extension for your LPR status. That will cover the period of time for processing (in most cases). So there is no need to worry about not being able to reenter the US.

thank you for all the support so far... we are very happily married and awaiting our time to file for removal of conditions... from the timelines i see that it takes like 6 months to process the removal of conditions

i have 2 questions..

1) what happens to the status during the green card is getting processed? for example.. if you need to renew your driving license, or if you want to go out of the country to visit friends/family or if you want to change jobs, school etc.. are we out of status when the conditional gc expires..

2) from what i understand we can apply 90 days in advance of the green card expiration date... please confirm that my understanding is correct. so we do apply 90 days in advance..... what kind of priority do we get? do they process applications which they have received first, or do they process applications with greencards getting expired...

maybe i have asked more than 2 questions.. thanks in advance for your response

Missing not really, if anything I'd lean towards oversharing but I don't think that is bad.. some people send a lot, and some send in a minimum amount of things. There are some things which I doubt you need, but I guess sending it in wouldn't hurt :)



I believe you are correct. i am kinda oversharing. but the instructions are so vague so it makes me take a very conservative route. i highlighted every bit of important information for their review. i guess i am now ready to send this out on Jan 24th.

so this is what i suggest.. you have gone too far in this process and on top of that you are in the uNiTed States... so if she wants something bigger.. i am sure she is not asking you to spend like 40000 bucks.. she just dont want anything simple.. so as someone said earlier.. you can have a great wedding for 3500 bucks.. now if you can borrow money from someone like 5000 bucks and take some from american express credit card.. (my BFF) you can have the budget to pull this off.

she aint selfish or anything.. you guys are getting married just for once man.. so you know what.. have a bit of fun instead of worring so much about money. and that is what i did. i took some 5000 bucks on my credit card and i paid it within sometime.

and by the way as you must have heard from people on this forum.. getting the fiancee visa is a mess these days. it takes longer to process. so dont miss out on the opputunity. make her feel like home and no kidding man.. just do this as she says. i got married in like 10K bucks which also included our trrip to vegas as a honeymoon.

its not too hard to come up with 10K in this country. so be a man and pull this off.

She has good reason to back away from you. What happens if after she arrives, she does something to displease you, and you decide that she doesn't warrant your support in adjusting her status. I think your capable of that. If you can threaten to pull the visa because a gift doesn't arrive on V-Day, I think your capable of pulling support for AOS when she doesn't answer her phone immediately, or doesn't tell you every day how grateful she is for you.

How old are you both? Some growing up needs to happen here before a real relationship happens.

Things become more complicated when there is 10+ years of age gap and especially it is difficult to prove a relationship rather then marriage. the way harsh was treated was unjust. but at the same time, it is important to know why they do that. there are many people from asia who use the K1 channel to come to the US on a contract based marriage. and this happens very frequently. it is frustrating that you have to deal with this. it is their way of authenticating information. they are testing his integrity and i am not suprised why are they doing it.

some of the responses to the questions which my wife had to answer were the following

did you guys have an engagement ceremony? did he get you a ring? how much was the ring? how many people attended the engagement? who all attended? did the parents attend the ceremony? whose parent did? did anyone besides your husband flew to india? how many times you met your husband? she had to correct the officer that he is not my husband... he is my fiancee.where and when you met? did you guys meet alone? you guys went to overseas alone... this is not permitted in your culture before marriage.. why you went? why did your parents allow that to happen? are you sure you are not married!!!!!? do you guys have a plan to get married in america? how come you dont have a plan to get married in america if you guys are getting married in 3 months from now? when are you getting married in america? why you want to get married in america? who will attend the marriage in america? are your parents going to attend the wedding in america? if not why not? how much does the wedding cost in america? who is paying for it? why is he paying for it? who is paying for the ticket?

for more than 2 hours she was grilled.....

when i look back in time..... i was furious why they are treating her like that. now i think all these questions were valid....they are doing their job and their intent is to make sure immigration fraud doesnt take place.

However you do have the right thought process

1) Husband is correct - US Tax laws dont apply to him yet
2) Income from india is too small to worry about
3) You should file married filing jointly to get the maximum refund
4) India and US has a tax treaty, If the income in india is arised from wages, salaries or tips - income is already taxed in india and it is repatriated from US tax structure. This is done to avoid tax duplication.
5) Income is only taxed for the portion above the 91K threshold.
6) You should file MFJ to serve as proof for your immigration paperwork and avoid confusion

I had an engagement ceremony and i presented them pictures. The maharaj who did the religious ceremony also documented in english and in gujarati that an engagement event has taken place. the document was signed by both parties. I guess all of this was not really needed. I dont know how much all this will support the case. The general rule of thumb is that one needs to provide primary form of evidence. Like railway tickets, airline tickets, visa stamps, baggage stamps, boarding pass etc. You need to submit some form of pictures doesnt need to be engagement. If there is an engagement ceremony which has taken place but the ceremony almost appears to be like a traditional hindu wedding ceremony, then you have to be careful. DONOT submit obvious pictures where both the bride and groom look married... like a bad example would be a picture with garlands or doing the seven pheras and stuff like that.. regular pictures like you are exchanges rings or family pictures or something is fine....
this is what i did.. please tell me if someone is not on the same page as i am..
