Hey,

 

My fiance was denied a K-1 in Mumbai on Sept 30th. It was one of the worst days of my life. 

 

We decided not to re-submit, we are getting married in Manipur on Christmas and will pursue an I-130 afterward.

I have been following timelines from Nebraska so I can better gauge when we should receive our NOA2 and it struck me that all IR-1/CR-1 Visa petitions from the Philippines are approved in just over a month. 
 

What is up with that? If it's accurate it's really not fair to every other petitioner filing for their loved ones from other countries.

 

Kinda upset about this! :-(

Yes, you are right. I was answering him as," Even she is from America still....." he stopped me and asked me that oh because she is from America ? I said no, let me speak and while i was speaking more. He issued me that white slip very quick.

I understand that it was my answer i started in wrong way but it was his job to ask all enough question instead of making it final only in 2 answer. Make sense ?

If he would ask me enough question and then issuing 221G or something, still i would be fine with that. Do you think that Senator can do much more than just Inquiry ? We are trying for 2nd Interview now and wondering that what can be possible for it ?

My fiance had his interview in Mumbai Sept 30th and was treated very poorly by the CO, he asked only a few brief questions in which my fiance answered truthfully. He was given that same piece of white paper that I am sure you received. They were sending the file back to USCIS.

 

To this day we don't know the reason for the denial, we can only guess. 

 

I have contacted USCIS several times since then and they cannot tell me anything. They can't even find the approved petition, however, we received our letter from NVC saying it was approved and they set us up with an interview date. How can USCIS not have the approved petition!!

 

I think the person handling our case messed up the paperwork. We'll never know. 

 

I am traveling to Manipur, India in 24 days and we are getting married on December 25th, a full traditional Manipuri wedding.

I am sorry you had to go through that, the embassy in India did the same to my finance. Treated him with very little respect and at times were rude to him. We were denied our K1 visa too...but they did not keep his passport. I would take it as a good sign they kept your passport. I would provide them whatever they are asking of you, maybe they do just want to do some checking  of things.

 

It doesn't always have to be bad and it can always become positive.

Hi all VJ members,

 

I filed my I-130 petion with the following support documents for bona-fide marriage:

  • Evidence of Bona Fide Marriage
    • Copy of Registered Marriage Certificate from Manipur, India
    • Joint 2013 Tax return with application for ITIN
    • 18 months of phone records
    • Photos evidencing our relationship and marriage ceremony
    • Copies of greeting cards /Wedding Invitation
    • Copies of airline boarding passes and passport stamps for trips to India
    • Affidavit in support of marriage from my mother with photograph of us in Manipuri Clothing. (She was not able to attend)

Since filing the petition we have more documentation in support of our marriage:

 

  • Life Insurance on myself with husband as beneficiary
  • My 401K lists husband as beneficiary
  • Wills
  • Western Union Transfers that I have made to husband

My question is what is the best way to provide new/additional support documents to USCIS or NVC, can I send them to NVC once I start that process? Or should we just plan to have it at interview time.

 

Based on our past K-1 experience with the US Consulate in Mumbai, I think it would best to have a completed file before NVC sends it to the consulate. Of course when we go to interview I will have all originals / copies / and everything else relevant.

OP, while this is technically true, I've seen it posted many times over how people save evidence such as pictures for the interview and try to pass it to the CO only to have the CO immediately pass it back without so much as a glance.  While such items should be brought to the interview, even if they are included in the petition, it does not hurt to include them at the outset.  Furthermore, including them at the outset makes them part of the file that is reviewed prior to an interview taking place.  Ultimately, it is your choice.  Since it was brought up through reference to the instructions, USCIS and the Embassy/Consulate will not expect a couple living apart in separate countries to have joint finances, joint leases, or own property together.

I would send the photos, it can never hurt to have more than enough evidence front loaded into the file.

Reading what you said is exactly what they said to my fiance when he went to his K-1 interview in Sept 2013. They told him for me to go to India and get married there. Was your fiance's interview in Mumbai? They never put us in AP just sent the file back to USCIS. 

 

We were married on Dec 25, 2013 and now we are on the I-130 route.

I don't believe your information above is completely accurate. It is true there is a 30 day waiting period, however, it does not say you need to be in India during that 30 days. Only one of you has to be a resident for at least 30 days. See below:

 
  • The parties to the intended marriage have to give a notice to the Marriage Officer. 
  • This Marriage Officer is chosen on the basis of residence of one of the parties. For example, you will apply to the Marriage Officer in whose jurisdiction you or your spouse has resided for not less than 30 days prior to the date of notice. So if you are applying on June 30, 2010 you should have lived in the jurisdiction from May 30, 2010 to June 30, 2010.
  • The notice will be put up in a noticeable point at his office.
  • If your spouse is residing in the area of another Marriage Officer, a copy of the notice should be sent to him for similar display and publication.
  • The idea of putting up such notices is to ensure that the marriage is legal and that no one in the community has an objection to it.
  • The marriage may be solemnized after the expiry of one month from the date of publication of the notice, if no objections are received.
  • If any objections are received, the Marriage Officer has to investigate into the matter. He will then decide if it is ok to solemnize the wedding or to refuse it altogether.
  • Registration will be done after solemnization of the marriage.
  • There is no rule of when the certificate can be issued. Sometimes it may take less than a few hours. At other times, it may take about 1-2 weeks to get the marriage certificate.
The registration office may require you to submit a NOC from the embassy which is an affidavit from you stating you are free to marry. 
 
I am getting married in India on December 25th, however, we are getting married under the Hindu Marriage Act. Our marriage will be solemnized by a priest and then we will go get our marriage registered.

I don't mean to invade your privacy, but there is one other issue that I don't think has been mentioned here that is sometimes a problem when there is already a red flag (the lack of time spent together in person).  I pose it because of the 17-year-old son.  Is there a significant difference in age between you and your fiancé?

 

I suppose my file has many red flags. It's $2000 round trip flying back and forth to India. If I could afford to fly back and forth more I would have.

Unfortunately, seems mainly North Africa, there are internet cafes full of men trying to hook someone to get the a Green Card. They look on it as a family investment for a better life, modern day Pride and Prejudice. Lots of horror stories on this site, hence the term red flags you will see.

 

The Consulates are very familiar with what is acceptable and normal locally, which is not the same as in the US.

 

I am not saying this is the case here, but invariably there will be tarring with the same brush if you fit the profile.

Lets put it this way if your son went on Spring Break in (name your Central American country) and came back a week later saying he had met a lady he was going to marry and sponsor to the US, what would your reaction be?

 

It's more than that...this is the 21st Century. Consider this site for example, you all have been giving me great advice for the past two days now. Without this computer, or the computer your on could that happen. We live in a world of on-line this and on-line that. Our kids of today are meeting kids from all over the world using social media networking sites. Today you don't have to fly 8000 miles to see the person you love, you can log-in and see their face, you can hold a conversation, you can laugh and share, just as easily if that same person was sitting next to you. That's what I have, Months of Vonage phone bills, hundreds of pages of on-line chat, emails, short stories I've written him about us, cards, gifts, and yes we did get to meet, to touch, to hold and feel. I miss that the most, and I can't wait for us to be together again. How do I send that in a form and how does he express that through a bullet proof window. 

 

But to answer your question, I would kill him. :-)

I do not see this as an issue in your case, but you will see here where people have lied to try and obtain a B2, said they were married when they were single seems quite common, and then when they apply later for an Immigrant Visa the 2 files are compared and ooops.

 

I completely get that. We messed that one up bigtime!!! But we were not trying to mislead or lie, we were just trying to make our chances at success a little higher.

Whim is the wrong word, it is not capricious.

 

Invariably the cases you see discussed here are the off ones but even then like this case the decision is entirely logical.

 

And of course we only get part of the information, the CO has a lot more.

 

Boiler, you have been a member on this site for years. I am just learning. We are here because we are requesting advice, need help, or in my case completely heart-broken by the outcome of our decision. My fiance and I were trying to do everything right, but yes we made a few mistakes. Maybe what is logical to you and other senior members of this site is not often the case for us newbies. 

 

We just need advice, we don't need to feel stupid too. Not everyone can have a perfect file.

One the one hand the OP said that she started this relationship in 2010, and supplied the USCIS with evidence of this. Then one year later the fiancé applies for a visitor's visa and during this application he does not reveal that he is wishes to visit her, and instead says he is to visit someone else (in this case the USC's mother). Sounds to me like misrepresentation on the application for the fiance's visitor visa in 2011 is the main cause for denial of the K-1.

 

I am sorry I don't understand what you mean. We didn't lie or try to mislead anyone. They asked if he had ever been denied a visa, we replied yes and gave the date and location. I think what you are saying is that in the eyes of the CO my fiance is lying about who and what relationships he has with people in the US because we used my mother as "Sponsor" (I have learned that this means Person Completing Affidavit of Support) We merely used my mother and her income, assets as a tool for him to better achieve his B-2. We failed. 

 

It would be very easy for me to prove she is my mother, too bad the CO didn't ask who she was!!! He could of explained just as easily as myself.

 

Can we fix it now? Any thoughts on that?

Short answer = 5 weeks facetime. Thousands in RebTel fees though, I have the receipts and I want a TShirt from them actually.

 

My case is somewhat different as far as immigration goes and you shouldn't use it as a gauge.

 

I met my then Fiance in person, not online or introduced, we are from the same city, same language, same religion, same culture, etc Our marraige had USC guests that travelled to Nigeria for our wedding, which was attended by all of her siblings and 3 out of 6 of my siblings. Our parents were in attendance as was family elders from both sides (the COs live in the country and know the local culture).

 

I am certain on why our K1 was denied (it was an error in answer/translation by my Fiancee due to her using an interpreter). This was most unfortunate but in retrospect I thank the CO for denying us then. It gave me an opportunity to give my Wife a rightful cultural wedding in Nigeria.

 

One of the things that I learned from my short time on VJ is that whenever you have flags such as yours (one visit is really not enough but I am not judging) you are almost better of by filing CR1 instead. That in itself is not an automatic approval and you have to bolster it with visits and other stuff that they want to see by your individual embassy.

 

Another thing I learned is that even if your packaging was put together by the Pope himself that it is still at the whim of the CO.

 

So you are going to file for a CR1 but you need to have more visits, more evidence and your Husband will have to become an expert on you.

Well no, I can't predict the future, but I am saying that doing the bare minimum is not likely to help your case very much.

 

Being in a relationship with a foreigner is expensive and time-consuming, there is no way around that.  I would plan more than one more visit.

 

Edit:  To respond to the above, you keep saying you "met the requirements." There is not a set list of basic requirements, because if that were true every scammer and fraud would just do that to get to the US.  There is more to this process than filing paperwork, though that is an important component of it.  The reason you were denied is because you didn't convince them this was a bona fide relationship, because of the timing, lack of face time, general mismatch.  It is your job to go above and beyond to show them they are wrong, to show how you make sense as a couple, and you didn't do that, yet.  I think if you focus on that aspect you'll have better success in the future.  I am sure it is frustrating. You problem here is that the K1 and CR1 look from an external basis more as a means for him to immigrate to the US than for Family Reunification.

 

Only you can decide how you will best address this.

 

You wanna know how I feel Boiler, Pissed off!

 

I met a man on the internet, a good decent man. We were friends, became more and now want to get married. 

 

We met all the qualifications for the K1, we filed our petition, we sent our proof. He passed the medical, received his vaccinations, got his police clearance. We did everything we were supposed to do. And now just less than a year later we are being denied and not given any reason for it. 

 

We all can sit here and speculate all day, but none of us really knows what was in the CO's head the day my fiance got denied, for all I know maybe he didn't have is coffee yet.

 

Maybe if the CO had given him more that 5 minutes of his time, he would of realized that we have not committed any fraud, that we are a real couple, that we have spent more time having conversations about life, our families, our jobs and our future than most married ( in person ) couples have. 

 

I suppose I could write a few letters to my local representatives, but for what, I guess I will get nothing more than the the canned letter my fiance got the day he interviewed. 

 

It seems pretty unfair to me, and maybe if the CO's put in a little bit more time, maybe as much time as I have, our result would have been different.

You can not, you can send in I 134's but usually that is a sign of both desperation and issues.

 

He of course did not get the visa.

 

Like everything to do with Immigration there are odd cases at certain Consulates where an I 134 helps, Very unusual.

My mom is 70 and I am seeing now how much of a mistake it was.We were already aware how hard it was to get a tourist visa and we thought someone of who had life experience, with some assets and income would look better. Our mistake. 

 

And, you can have sponsors for B-2 Visas, we did.

OP:  I don't think that going over on one more trip to marry is going to give you a different result.  That's a bare minimum, one visit for K-1, then one more visit for marriage after denied K-1.  You should try to spend more time with your fiance in person, that's the biggest thing you can do to make things go in your favor.

 

Take your kid along, it'll be the trip of a lifetime.

 

And btw, if your kid is 17, then why does he need care?  First you said you need to take care of a mom, then you said you need to take care of a son, then you said your son is 17.  

 

He is 17 and I can't very well leave a 17 year old alone and travel 8000 miles to a foreign country, secondly I do take care of my mom as well, she is 70 and is on set dementia. Can I leave them for a couple weeks to go to India, sure. But I can't do it multiple time and like most people I have a full-time job. For some maybe it's easier to get away, unfortunately not for me. 

 

So Harpa, are you saying that if I do decide to go to India this Dec and get married, our result will be the same. Denied?


Sorry to hear that - one thing I experienced that the Attorney can be helpful (may be) but the best option would be to take a flight and get married. It will be faster than following the K-1 proceedings.

 

That's what I am starting to think too.
