IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavits
Good... affidavits from the US would no be hard to get notarized but it is hard to get them notarized in the philippines and I need to get one from my current and previous landlord saying we both resided together even though the lease wasn't joint.

Also I am guessing affidavits from foreign family members would not be given much credit since the family has an interest in lieing and can't be punished for false statements?

I was planning on getting affidavits from 2 of my best friends in the US who have both been privy to details of the relationship throughout (one of whom has visited and stayed with us twice here since I moved) and my two landlords.

i am hoping that the affidavits and the photos we have (digital so they'll need to be printed) and receipts for bills such as the engagement ring on my first visit will be enough. Also the fact that we waited 6 months after getting married before we even applied for a visa hopefully will be given some credit.

Also I know for the interview she is the only one who HAS to go but I will be there is it a problem if I sit in on the interview too or will they even let me?

I would like to have a few people complete affidavits regarding our relationship and confirming we have been living together since married. Are there examples or generic forms of these somewhere to look at? i am guessing they need to be notorized??

IR-1 / CR-1 Spouse Visa Process & ProceduresFraud Indicators

My husband and I have over 20+ years of age difference and we know that it will be looked at. That was the first question I was asked during the interview. We were very well prepared and anticipate the question so I managed to looked at the interviewer's eyes and answered him with confidence.

We applied for our marriage license 3 months after my husband's previous divorce was finalised. I don't remember anyone really brought that up. But if you do have a bonafides marriage, you have nothing to worry! :D

What question did they ask you about the age difference? My wife and I are 18 1/2 years apart

IR-1 / CR-1 Spouse Visa Process & ProceduresWhich address should I use on my I-130
I know you don't have to be in the US, but you have to have a residence in the US. It's not possible for me to file in the US as I'm not there, but they won't let me DCF file here either because I don't have a permanent residency visa. There are no mail services here that will go to a postal box other than regular postal mail which is unreliable, so I'm going to send it to my parents (which is also the address i'll be using for my US/contact mailing address) and have them mail it to the lock box, so it will be coming from the USA.

The question about last residence with the wife is not about the address, but what the last date should be since we are still there and will be until her visa comes in.

I'm still not sure on the first page when it asks for petitioners address if I should use my US address or my filipino address. I think probably USA but I don't want to put the wrong one.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhich address should I use on my I-130
Also on page 2 it asks what the last address you lived at with your wife and what dates from and to. I still live with her at this address, so what do I put in the TO date??? the date filed?
BigJohnMalePhilippines2010-08-13 08:11:00
IR-1 / CR-1 Spouse Visa Process & ProceduresWhich address should I use on my I-130
Also, I am confused about page 2. Page 1 says the petition is for my wife and we have the same married dates. On top of page 2 it wants yout list the husband wife and children of your relative. Do I need to list myself there again?? I don't want to leave it blank and get it kicked back if I'm supposed to fill that out for myself.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhich address should I use on my I-130
I'm the petitioner (us citizen). I live in the Philippines with my wife. I would direct file but I'm on a tourist visa not permanent residency. Should I use my philippines address on my i-130 or use my US mailing addres? I'm guessing I should use my US address. Is it a problem if this is a postal box? I can use my parents address if not.

So when I file this packet of papers how do they want it organized? how should it be held together? staples, paperclips, etc? should i staple related pieces of paper together or leave them unstapled? does it need to be in a binder or folder or just a big lump of paper?

i don't know about your location, but here where I am they will make you get them again by their authorized medical place because they don't trust non-sanctioned places. They will make you take them again and pay for them so just wait.

IR-1 / CR-1 Spouse Visa Process & ProceduresPlease share your medical experiences at the St. Luke's Medical Exxtension Clinic
I hate to tell you but what you have heard is true. I have a friend who is working on getting his visa and his wife has had to do the medical portion more than once now. The big holdup is the TB (Tuberculosis) test. They will take an x-ray of your lungs. If they see ANYTHING that might be considered abnormal, they will require you to do a sputum (spit) test. you have to come back every day for three days in a row, so be prepared to stay for 3 nights!! Then it takes 2 months to get the test results! If the test results come back positive (there is a fairly high false positive rate) they will require you to live in manila and take medicine for TB for 6 months then you will have to redo the medical. You just have to hope that your x-rays come back perfectly clear and that the doctors that day are not trying to scam you out of extra money by making you come back for more tests.

What you think of st lukes does not matter -- they are the only approved medical testing center to get a US visa.

We just got our ds-230 packet from the embassy. When did you get assigned a medical appointment date and do you have an interview date yet?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 question
One more question:

#23 Current annual income - should it be what it is for the current year or should it be what is shown on last year's taxes? if last year's than gross or adjusted?

Also am i reading it right that the only supporting evidence i need to send in are taxes/w-2 copies?
BigJohnMalePhilippines2010-11-15 11:13:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 question
OK, question 8 says:

I am sponsoring the principal immigrant named in Part 2 above.

so i check that because i'm sponsoring my wife listed in part 2.

10. Enter the total number of immigrants you are sponsoring on this form from Part 3, Items 8 and 9.

Answer: 01

21. Your Household Size - DO NOT COUNT ANYONE TWICE

Persons you are sponsoring in this affidavit:
a. Enter the number you entered on line 10.

Answer: 01

Persons NOT sponsored in this affidavit:
b. Yourself.

Automatically 1

c. If you are currently married, enter "1" for your spouse.

Answer: 1

h. Add together lines and enter the number here. Household Size:

So if I add these up, it comes up to 3, not 2 - so how do I answer this question I don't want to put 3 but 1 + 1 + 1 does not equal 2 - that's some government mathfor you :)

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview (CR1) in 7days @ Manila Embassy
i'm a DCF filer in Manila.

The instructions they sent me said I needed I-864. I read that link from the embassy on what forms to bring and in the section where it lists the different I-864 documents, it also says

"Notarized Confirmation of Job Offer and Salary for employment–based applicants should be on the stationery of the employer’s business organization and it must have been issued less than one year prior to the visa application."

Do I need this if I have the full I-864 with last 3 years taxes??

Yes this helps very much. Thanks you sir!!! And by the way thanks for the advice on not traveling yet to the Philippines,,the wife read your post and agreed that I not travel untill we receive a date for the interview. Nice to have good folks as yourself traveling along on this journey!

Just an FYI, the stamp you get goes on her visa once she gets it. If she takes the seminar before she gets the visa, she has to return to get the stamp placed on her visa (make sure to bring the receipt). If she waits until after she gets the visa, they will stamp it the day she attends. When you leave the country be sure to take the receipt for the seminar with you as well I heard of one filipina being hassled even though she hadthe stamp because she didn't have the receipt. It's BS but it always pays to be prepared in the philippines. Always take EVERYTHING with you when it comes to this visa game and government officials.

Also i have heard at the seminar if it's the one run by the nuns they tell them a bunch of horror stories about being abused and treated like slaves so tell her not to freak out if they do :)

Hey Everybody,

Figured I should give an update on our visajourney.

Lara had her medical--Had to get a Gardasil shot... Didn't expect that! (Cervical Cancer is not contagious!)

Had her interview on Friday, April 3rd, 2009
EASY, 2 questions:

What does your husband do for a living?
&
How did you meet?

They didn't ask to see any of the photos or other proof she brought.
and that was it!

Only problem was her passport photos (she had to show her ears--something new I think)
They have a machine in the Frankfurt Embassy, so no worries.

Visa Approved!

She picked up her Visa yesterday! April 7th 2009
She could have got it a day sooner, but didn't have the time to drive to Frankfurt on Monday.

We bought her plane tickets in advance, so in 5 days Lara will be in the United States as a Permanent Resident! (Conditional, of course)

April 13th 2009!

One day before our 1-year Wedding Anniversary! biggrin.gif

All together from the Notice of Action #1 till she picked up her Visa was 99 days!

Faster than I ever expected!

Now I have to clean the house before she gets home and kills me! hahaha

P1620.00 pesos is the philippine travel tax....so call where you purchased the ticket and asked if it is included. If not make sure that she brings the amount to pay for it....i would also suggest to have her claim the ticket before her flight to avoid the hassles...

P1620 is for filipino who travels abroad (going out the country)...OFW are exempted to pay this.this is not included when we purchase the ticket, but their are some ticket office/agency who have a counter for this,so we can pay it there right away after we buy the ticket,so no need for us to go to Philippine Tourism Authority to pay for it or to fall in line at the airport counter...terminal fee is also needed...for domestic flights its P200 and international flights is P750 (i cant imagine its P750 now).

I actually printed 3 copies of each DS form when I filled it up online. You need 2 copies of the DS 156 & 157 form. (one of the DS 157 form copy should have a validation of your Visa payment by any authorized BPI branch. Don't forget that. Its ok to xerox it but be sure its a clear copy. The pictures though you need to glue individually. 2x2 US visa passport picture with a white background. Glue it on your DS 156 form. Only the AOS ( Affidavit of Support ) needs to be notarized, have your partner notarize it in the US. Most Fedex has notarization services, so when your partner sends the docs, have the AOS notarize at Fedex as well. FITRs and W2s need not to be notarized. Although the USEM ask for the latest copy, that will be the 2007 FITR and W2s. They return the other older ones ( 2006 down). Call Delbros too and update them of your DV, I am having trouble with mine now, and is causing the delay for the release of my Visa.

Word of advise, memorize all the data you put in the DS forms, they ask questions on that. Be consistent with your answers, and answer the questions only, dont elaborate, Good Luck on your interview.

On the day of the interview at window 37, they were asking me if I already payed delbros. I said yes. And they ask for the bank receipt from metrobank so I gave it to them. She will have lots of problems if she is still married. I doubt the USC understands or knows this. They are not married, she can't legally marry someone while being married. Your friend needs to get a legal divorce which will probably need the help of the USC.

she wasn't married here i think she said in LV, thank you. yah i bet she is in big trouble right now. even the ex husband married another filipina in year 2007??
