Since you are planning to move to the US in the new year and have a job lined up from what I understand, your best bet is absolutely to get married in the UK and file the I-130 petition at the London USCIS office before leaving for the US. Then when the interview stage comes a few months down the road, you will be set up in the US with US income and able to sponsor her. So to keep things clear for yourself, I would focus on the DCF (direct consular filing) guide and the DCF forum. She will be getting the CR1 immigrant visa.

EDIT - Also, like pushbrk said earlier, you should backfile tax returns for the past three years. You won't owe money if you haven't earned more than the equivalent of about $82,000 USD a year in any of the past three years, but you still have to file and exclude your foreign income. www.irs.gov or the US embassy IRS people can help you. It's not as scary as it might seem at first. smile.gif

My test came back positive too, when I had a medical here in the USA. They gave me a chest X-ray which came back all clear. I found out later on at an Orientation/health and safety meeting, totally by accident when someone else asked about it, that because I had had a BCG vaccine when I was at school, any TB skin test I had in the future would always come back positive.

I just got back from MA where I spent a wonderful 6 weeks with my fiancee and now that I'm back in the UK, I feel so empty. He hasn't been paid for a while as his boss has been having issues with finances and it feels so frustrating having the package sit on the desk for over a month.

Problem is, I just feel so alone and empty now... everything I look at is making me upset. His clothes for obvious reasons, the clothes I wore while I was over there, thinking of how this time yesterday I was with him... even an old coffee cup that I left on the table just before I left to go visit him. Hearing his voice is making me just want to cuddle into him and cry.

I do try and talk to people about it but they seem to think that I should be used to this by now because I've had to leave him so many times (this is the 9th time we've seen each other over the past few years) but it actually feels the opposite, like the more times I have to do it, the harder it gets. That, or they tell me that I should focus on the happy memories we had rather than just feel sad that I'm no longer with him. But that's rational and love is not. Life felt so content waking up with him and finally getting time together after waiting, like we really deserved it... and having it taken away all over again makes me feel depressed. I don't feel like taking care of myself physically and can't even face unpacking right now. I was told lately that I need to toughen up a bit and this made me feel worse because I feel that I've tried to be strong about it for so long, and it takes so much power to walk away.

I was wondering if anyone has suggestions; what do people do when they feel this way?

I know it's best to keep busy and I start a new job this week (which is why I came back, to get some money) but that seems like such a huge hurdle because it's a physically tiring job and I feel so down. Hopefully I'll be able to go back to the US in 5-7 weeks but then the cycle starts again. sad.gif


I feel your pain, your emptiness and your lonliness when you have to depart and believe you me I understand that it gets much much WORSE everytime you have to leave him. You'll have to look after yourself physically and mentally as this process isn't designed for the faint hearted I'll tell you that now... If you guys haven't sent off the petition yet because of finances, instead of making yourself feel worse by going again in 5-7 weeks and facing the fact you'll have to depart again, spend the flight money on the K1 fee, that should be a start to your future. good.gif

We want to see eachother again in a few weeks time because *if* we receive our K1 visa following a successful interview this October I'm guessing, I won't be leaving right away due to things I need to work out with the house, the job, extended goodbyes etc.

He can purchase a one-way ticket on a K1 visa. Though sometimes return tickets are even cheaper than one way tickets! For tourist visas it's always a requirement to have a return ticket.


That's what I was thinking, but he had me second guessing myself!! Thanks for the heads up on the possibly cheaper round trips, I'll be sure to look at both when that time comes!!

If you read the FAQs and guides above it may help you understand what you need to do.
Alas the requirements are that you have met in the last two years, that both parties are free to marry and that you will be able to financially support her. As you are a student you could perhaps get in a co sponsor and take it from there.. think seriously about what you want to do as this process takes quite a while and depending on which country she is from it could taken even longer than a while. Also you don't need to have a property to be able to marry. The best of luck!!

I hope you find comfort in all the answers given to you...everyone here is extremely helpful and in the same boat as you. It is very very difficult I know sad.gif I only just got back from seeing my other half and I have three weeks til me USEM interview...if you check some timelines on here like mine for instance it doesn't take long at all til you get an interview. I would say 2 months at the most from your NOA2 if you have everything prepared and ready to send to the embassy.. if you decide to visit before getting your NOA2 or after, and you get denied at a POE, it will not affect your K1 visa status at all. But hey saving money is a good thing and it will help while the credit crunch is on that seems to be biting us all.. mad.gif

If it makes you feel better I got a good walloping and a grilling last week after the IO finally let me in...what a nightmare but it was very worth it!!! You'll be alright hon rose.gif

Last 3 years tax returns
Letter confirming employment on headed paper
Letter of intent to marry
Evidence of ongoing relationship

Have I missed anything? Also, just a quick question on the co-sponsors form: what should he have put down in the "relationship to petitioner" section?

The evidence demonstrating his return to the UK is sufficient enough but not sure they would be interested in even looking at it, but that's just my experience! I was prodded apart and grilled to the bone recently at a POE and I only went twice this year! I was also grilled about 3 times last year too. Just be ready to face the music should he be sent to passport control but he'll be fine! Whilst you are waiting for the RFE - I would suggest you go to a photography studio and tell the photographer you need 2 US passport sized photos. They will instantly know what you mean. Be sure to specify what visa it is for as it all depends. A white or an off white colour is needed for the background colour. Follow the guides above to be sure. The best of luck good.gif

It's perfectly normal after 6 weeks. The VSC and the CSC used to dish them out after 2 weeks.. I remember we got ours 6 weeks later actually. I wouldn't worry. You should expect your NOA2 within the next 3 months? I don't know the current processing times.. though if you register your case number online with www.uscis.gov you can follow your status from there. The very best of luck for a speedy approval and for the rest of you who are waiting for their NOA2s!!!

The correct answer is, NO, this should not be a problem. First of all, the Consulate in HCM is aware of how important the engagement party is to VN people. They will not be confused about the difference between an engagement party and a wedding. To take this a step further, I have sent an email to the Consulate asking about this topic. The Consulate states that it is aware that couples wish to celebrate with the family in VN before leaving for the US. The only thing that the Consulate is concerned with is that there is no legal marriage. So, you can actually have a wedding ceremony as long as there is no marriage certificate involved. No marriage certificate=Not married.

Now I have read of couples in other countries having non-legal weddings and being denied visas. This is because in some countries, India for example, a religious ceremony is considered legally binding with or without a marriage license. But, Vietnam is different. Remember, you are dealing with a communist government and religious ceremonies are viewed differently by the government.

I don't have a link to the post handy, but someone on VJ recently(about 4 or 5 months ago) was approved in HCM and they had had a full blown wedding(not engagement party) without a marriage certificate. They sent an email to the Consulate to be sure this was not a problem. The Consulate stated exactly as I have and they took the email to the interview as evidence but it was not necessary, pink slip, first try.

I'm sure that people are just trying to be helpful but have no idea what the visa process is really like in VN. That is why this post should be in the Asian forum where people who are familiar with the specifics of how the HCM Consulate works will be more likely to respond. Sure, you will find stories of couples that have had problems in similar situations, but I seriously doubt any of them will be from the HCM Consulate.

Besides, what is done is done, so, why stress out about it now? You have made it clear that the party was an engagement not a wedding. In my opinion, this is a good thing for you. The engagement party will be excellent evidence to bolster your case of a bona fide relationship. Trust me, you will have plenty of other things to worry about without adding this to the pile.

One last thing, according to the K1 guru, ME, the Consulate cannot deny your petition based on any information already approved by USCIS in your I-129F petition. Since, you included info about the engagement party in your petition and USCIS has approved it, then technically HCM cannot deny you based on that info.

First of all I was replying to the question itself, definition: ("singularly", "alone"). And, generally, the answer is YES. When you bring everything else in to the equation i.e. Vietnam consulate ETC that's a whole 'nother story so you would be correct in that case. It is infact a BIG problem where ppl DO get DENIED because of the Consul being suspicious by engagement 'wedding looking' pics tied to a 'K1' application. It happens ALOT - read up in other forums first before judging my answer.

That being said, there are also signs everywhere (including in the pix I sent the USCIS) that say LE DINH HON. Which means Engagement Party in vietnamese, NOT wedding. Our receipt for booking the party hall (also included in my petition) says LE DINH HON. Even included our invitations which say LE DINH HON party. Getting married in VN is not easy, you have to jump through quite a few hoops. It is not like other countries and there would be a record of it.

Do you think this will be a problem for me?

Draw a deep breath, relax and everything will be fine good.gif you guys will be approved in approximately 3 months time!! From what you have mentioned you have met all the requirements of the K1 including having met within the last 2 years.

Reasons they could deny your petition on a K1:
1) If either party is already married
2) The beneficiary has an extensive bad criminal record..
3) can anyone else chip in?!

If you have missed something out of your paperwork they shall consult you with an RFE normally between the stages of NOA1 and NOA2. CIS never usually deny a petition based on a missing piece of paper. I think the waiting game will cause the wrecked nervous part of you to disappear... as soon as you receive your NOA1 all you have to do is wait for your NOA2. Good luck!!

It's hard, we all know that - but you have to try and look at the big picture. All the other times you have had to come home, you haven't had the security of the knowledge that this time next year you'll be married and together forever.

I last saw my fiance in March (I left the US on March 10th) and despite the fact that I cried, I knew that the next time I saw him, it would be for the permanent move. So we have spoken on the phone every day and now i'm just 6 days away from being with him.

Your time will come, faster than you would think.........in the meantime, talk often, BUT enjoy the time you have left here with your family and friends, because once you leave, they'll be the ones you miss....
