                     Pl.see below what happened in 2011 and how USCIS sorted the problem.

What is the Status of Backlogged 21,000 Family Based Petitions (I-130)?

backlog-243x300.jpgDue to a huge backlog in processing pending I-130 petitions in November 2010, USCIS transferred approximately 36,000 I-130 petitions from their California Service Center to their Texas Service Center. USCIS hoped that this redistribution of work would result in more timely adjudication of these petitions.

However, according to USCIS, due to a number of unforeseen circumstances at their Texas Service Center, many of these cases have not been processed and are beyond the estimated processing times. On Feb. 7, 2011, USCIS announced a rapid response plan to expedite the adjudication of these  petitions.   Ironically, the rapid response plan has been to transfer a ?large number of these Immediate Relative petitions back to [their] California Service Center to take advantage of resources currently available?. USCIS has indicated that petitioners will see an action such as an approval, denial or a Request for Evidence (RFE) on their case from the California or Texas Service Centers by March 1, yet this has not happened!

Also, as of February 14, 2011, USCIS provided an update on the processing status of these 36,000 cases: 10,264 have been approved; 55 have been denied; 4,137 have been issued a request for evidence or notice of intent to deny; and 408 have been referred to a local USCIS office for interview. Based on thee numbers, it seems that USCIS is less than halfway through reviewing these 36,000 I-130 petitions.

If you are an American citizen you have two ways to bring your foreign spouse (husband or wife) to the United States to live. They are:

1. Immigrant visa for a Spouse of a U.S. Citizen (IR1 or CR1) ? An immigrant Petition for Alien Relative, Form I-130 is required.

2. Nonimmigrant visa for spouse (K-3) ? It is important to note that application for the nonimmigrant visa for spouse (K-3) who married a U.S. citizen must be filed and the visa must be issued in the country where the marriage took place.  After the visa process has been completed, and the visa is issued, the spouse can travel to the United States to wait for the processing of the immigrant visa case. Two petitions are required:

- Petition for Alien Relative, Form 1-130; and
- Petition for Alien Fiancé (e), Form I-129F

I don't think its right. Because if you put 1 in part 5 qs 3, that means your part 5 qs 8 will be 3 when you add up part 5 qs 1 to 7.

 

I'm with you on this EOC4ever. For the question are u married Part5 qs 3 the answer should be either 0 or blank and not 1 because the household size total would go to 3 then.

 

Samreen I think you should either leave Part5 qs 3 blank or even 0 is fine there.

Yup all of us folks from April to June 2013 were officially screwed at ucsis and a bunch of us got stuck at Nvc as well. If somebody who is about it apply looks at our timelines they might change their mind about this visa :P

 

Count me in that list of people who were screwed by USCIS!!! I'm an unlucky April 2013 filer as well....................

As I said of the other person, if you have a joint sponsor, there's zero reason to fill out the assets section, unless you're using that to qualify in conjunction with a joint sponsor. But that doesn't sound like the case. Whether a bank letter will be sufficient, I don't know. You'll have to wait and see what NVC says when they review it.

Hi Saylin, Could you please clarify this for me............

 

In my I864 under Part 7 Use of Assets to supplement income, I filled the 7.1 bank account balance question even though my wife does not meet the income requirements. We just wanted to let them know that she has a bank account with a small amount in it.  We have a joint sponsor who meets the financial requirements and has provided all the necessary documents.

 

I included a letter from the bank where my wife holds an account stating her name, address, account details and checking account balance.... However I did not include any bank statements and still believe the bank letter would suffice to prove that she just holds an account with some money in it.... In her signed letter to NVC she has clearly stated that she understands that she will not be able to meet the financial requirements since she is not employed and hence has opted for a willing joint sponsor...

 

Do you think NVC might request for any other document since we filled the bank account balance question? Could you please clarify....

NVC says they may take upto 60 days to review AOS package. But can somebody tell, how long is it actually taking? and God forbids if someone gets checklist, how long after scan date, they issue checklist and time taken to review checklist?

 

Just check the previous page. Shinwary has got a CC despite have some corrections to be made in his AOS... NVC has instructed to bring the corrected AOS for the interview.

 

This really is a wonderful sign and could be mutually beneficially.... Just wish NVC could show some consistency in their decisions.... The real trend should emerge in the coming weeks..... Why wouldn't we be happy to carry our corrected AOS directly to the interview....

Ok, good.

 

Now I filled out my Affidavit of Support, this time I put N/A in all the parts for 7 a,b,c,d because I do not want to use asset as supplemental income. This is the stupid reason why I am in this mess. Everything is approved (cosigner and all documents) just my stupidity in filling out this section and NOT sending in bank statements caused my 2ND CHECKLIST. Even though I am below poverty line and even though my income wont be looked at.

 

 

Should I still send bank statements? I am so paranoid now that they will still be like "Well checklist said bank statements..." even though I completed a new Affidavit of Support and omitted part 7.

 
Now I included a letter explaining I made a mistake and i didnt want asset as supplemental income included and signed it. That is what a rep told me to do, he said you dont even need to include a new form and I said Well too bad I am sending it.

 

I dont know if should just send teh bank statements as well even though technically they are no longer needed :unsure:  :unsure: Then I am afraid I send them and they are like "why is he sending these for they are no longer needed, maybe he filled out form wrong...checklist!"

 

My case is exactly similar as yours... I too filled the bank account balance question even though we have a joint sponsor who meets the financial requirements. However I did not include any bank statements and still believe the bank letter would suffice.... Fingers crossed....

 

Now that you have the checklist specifically requesting for the bank statements I feel you should send the bank statements since they have asked for it.... Filling up a new affidavit form with Part 7 blank now does not sound like a great idea to me......

Hi all, 

I am a new Aug NVC filer.

I technically sent the AOS package (Sponsor and JS) in July, but got a Checklist (asking 2013 tax info that my bro in law forgot to send).
Everything will be sent this week:

- I already sent the IV civil docs

- my in-law will sent the 2013 data from the US beginning of next week

 

Next steps: validation and embassy appointment

By the way is your timeline correct? I see that the date you sent your AOS was July 14th. Is this correct because we all still believe NVC is working on the July 7th scan dates..... If your timeline is correct then its good news. NVC seems to be making some progress!!!

I just thought I would let you all know what happened in case anyone is curious.

 

I called NVC.  Got a really nice operator but forgot her name.  She told me that she actually wasn't sure about my questions regarding IV and DS-260 so she put me on hold for a couple of minutes and confirmed with her supervisor.  It turns out that I had to pay the IV online.  I have now paid the fee and it says IN PROCESS but I am still unable to do DS-260.  Most likely I have to wait for the payment to clear which will probably take a couple of days. 

 

Here's the part that makes things complicated.  My AoS packet physically arrived at the NVC in early July but they still haven't actually even looked at it.  They are have no information on any checklists or anything.  So, they will just be sending that entire packet directly back to us and we have to bring it to the interview along with the IV packet.  The crazy part is that since they are so backed up, they won't even be able to physically ship it out to me until September 10th.  So, the operator told me that it would most likely be best to simply remake the entire AoS packet to bring to the interview.  Luckily it contained no original documents that I can't get again but I will need to print and sign all forms and everything again.  Judging by another user's timeline who recently also was expedited to Tokyo embassy, the interview will probably be roughly a month from the date they approved the expedite which was 3 days ago... so I think I will have to be on the safe side and re-gather all of the AoS documents.  It is kind of a pain but I honestly would rather do that again 10 times than have to wait several more months.

 

Regarding the other questions I asked:

She said if ESTA visitors get temporary Alien Numbers that are later deleted, she said say yes to the question and then mark "do not know" next the number

She also said to put the cell phone number in rather than check "does not apply"

 

Knowing all that, I think we are pretty much good to go other than gathering everything again.  Hopefully we don't make any mistakes.

 

Goodness me!!! What the heck is this....... Your case seems to be paving the way for a new trend.... I wonder if this is going to be the way ahead until NVC clears the backlog???

Hopefully next week scanned date July 7-11 will hear some good news. And for sure Nvc will speed up once they are done with these dates. We filed in Oct 2013 where it got the peak time and Uscis started saying they are back logged. Then some good energies made Uscis to say " give us some time we will make it to 5 months target". After we got approved in April 2014 suddenly they said wait for 1month for a case number . When we send our packages in June 2014, something happened ( like a Tsunami) nvc was filled with more and more docs and said " 30 business days". Ok I thought we will wait for 30 business days... And suddenly an email ohhhhhhh. " takes 60 days..."!!!!!!!!! Now what?????? Everytime I wake up I think about Nvc. Think about how life turns. Nature is playing a game. I am not saying I'm unlucky but why these struggles to get just a visa. Sigh. I met one of my teachers and she said her daughter waited for 4 years to go to UK (spouse visa) because there was a delay getting a PR for her husband...I will now try to convince myself....

 

Easily the best post I have come across in VJ in the past 16 months....... Sums up this dreadful immigration journey that we all are going through beautifully... I'm an April 2013 filer and you described what I have been going through so precisely!!!

     Your very welcome, I had help from a beautiful friend that without her I would be totally lost.  Yes we just went to the IRS and asked for a letter stating he did not file for the years in question since he is retired.  I do believe they called it IRS Verification of non filing letter.  I put 0.00 but 0 works also.    We did the same thing you did so you should be fine, no worries.  I know how you feel, it's part of the process which non of us can avoid.   But you should be just fine.  (F) (L) (F)

    I read they request it but we sent a letter from the IRS for my father who is our sponsor but not for my mother who is co-sponsor or me and our AOS was approved. :D 

 

Thanks a lot for the information Soloenta.... I guess my case is as similar as yours. Could you please elaborate a little bit more like what IRS letter you sent for your father? Is it the IRS verification of non filing letter? And did you mark '0', 'N/A' or 'Not required to file' for part 6 of the I 864 form for you father?

 

I have sent my I-864 with IRS verification of non filing letter for 3 years, signed explanation letter from my wife that she is not employed and marked 'N/A' for Part 6 Sponsor's income and employment. Extremely nervous right now...... :cry:

Guys someone who has their I-864 approved please clarify my doubt,

 

My wife a USC living in California, has never worked, does not make any income and has never filed taxes. We submitted our I - 864, 2 weeks back along with a joint sponsor who makes well above the income guidelines....

 

Since my wife never worked and filed taxes, we submitted a signed letter stating she is unemployed and does not have any income. Along with the letter we also submitted an IRS VERIFICATION OF NON FILING LETTER (4506-T) for the last 3 years 2011, 2012 and 2013. I hope this will suffice the NVC no tax filed requirement....

 

Since my wife technically does not have any IRS tax return form 1040, 1040EZ  nor any income reported to IRS for any of the years, in the I-864 form, under Part 6, Sponsor's Income and employment we have marked 'N/A' for the tax years 13a,b and c and 'N/A' for the total income 13a1,b1 and c1. Like I said we have submitted a signed letter stating she is unemployed and does not have any income. And the IRS VERIFICATION OF NON FILING LETTER (4506-T) for the last 3 years 2011, 2012 and 2013 clearly states "We do not have any record of any filed form 1040, 1040A or 1040EZ for your social security number"

 

Do you think it will be an issue since we have filled the Part 6, tax years and total income with 'N/A' instead of  '0'? Will my wife's explanation letter along with the IRS verification of non filing not suffice? Some one please give me your views...

 

So it appears that there is a diverse point of view on how this question needs to be answered... '0', 'N/A' and 'Not required to file'.... Could I expect a checklist for this? What's your take on this guys?
