it's a pity your ex isn't cooperative sad.gif but like I said, start contacting the places where you know you can get some paperwork showing you lived together, had an honest marriage. If you had a joint bank account, contact the bank and ask them for the old statements showing both your names. If your ex won't help you, I strongly belief you can still get a lot of prove yourself if it exists. Start calling ASAP!! smile.gif

About marrying your exsisting boyfriend...you may want to consult with an immigration attorney (many of them here by me have free consultations) ask them what happens if you do, you might have to go through the I-130 process again? (petition for an alien spouse or something). Explain to the attorney your situation with removing conditions, and your option to marry your boyfriend if you and he have already discussed marriage. And then decide if you do one or the other, or both?

Unfortunately only USCIS can decide if that is enough evidence, but I think you will need more then "some bills".
You will really have to search hard to find stuff proving your marriage was bona fide.
Contact landlords if you rented together to get old leases. Did you ever file your taxes together? Get transcripts to show you filed married-joint. I would send them some pictures, of your wedding, vacations you took together? Affidavits from friends. If your husband can't find any bills, (or you don't have any) start calling the cable company, phone company, electric & gas companies and ask them to send you old bills so that you can show you and your husband had mail going to the same address.
The burden of prove is on you to show USCIS your marriage was legitimate.

I agree with everyone else... it's a pity you forgot to include it, but wait for an RFE. It will never reach the rest of your package if you send it in without an RFE. I sent additional information in January to be added to my case (including copy of NOA & Biometrics notices) and my last touch date remains November 9.

Of the 5 pieces of evidence the USCIS specifically asks for, birth certificates of children born to the marriage is # 4... so I would say it rates pretty high on the scale of proving you have a bona fide marriage. Please don't get all defensive because you choose not to have children, it's your choice and we respect that... its our choice to have children and yes, it definitely helps the cause.

Mine was only 58 pages, of which 34 were 2005 & 2006's tax returns and 15 of which were leases for 2004 to 2005, 2005 to 2006 and 2007 to 2008. (our copy from the accountant)

I included:
What I think was "required"
Application, 2 pages
Copy of green card, back and front and son's birth certificate, all on 1 page
Property lease in both our names for 3 years, 15 pages
2005 & 2006 tax returns, 34 pages
State Farm insurance statement, showing both our names, I circled his truck and put "Norm's truck" next to it, and the same with my car, 1 page
Humana (health insurance) quarterly statement, I circled my name, his name and our son's name on it, 1 page

"Other"
Front page of recent bank statement, showing statement date and both our names, 1 page
Recent Nicor (gas) bill in his name, 1 page
Recent ComEd (electric) bill in my name, 1 page
Affidavit from our mutual friend, it was not notarized, 1 page

Wow! I'm surprised too. Don't stress, you have the proof that you are legitimately married, and you have two wonderful babies. If it was me, I wouldn't bring my son (just because of his age) and I have his birth certificate, what more prove do you need that your kids exist?

Bring their birth certificates and all the other information you submitted. I'm sure this is just for quality control... and who knows, they may approve you right there and then.

PS, I *think* you need a valid barcoded passport to cross over the boarder by land too as of Jan 31, 2008. It was phase 2 of the Western Travel Initiative, you can read more about it here: http://www.dhs.gov/x...0669485238.shtm

I sent mine in a few weeks early and they returned my application in an envelop and a few days later a bigger envelop with all my evidence. From experience, filing early is a waste of your time, they will just send it back to you.

I would definitely say YES, you CAN do it by yourself and NO you do NOT need an attorney. Remember, whether you're paying an attorney or not, you will still have to gather the evidence yourself.

I have completed each of my application myself with no problems. Applying for a J1, switching from J1 to F1, applying for EAD and then F1 to Perm Res and now lastly I-751.

Just read though the application instruction form and if you have any questions from there, ask us. Most of the answers I've seen on this website are very accurate.

If your husband does not want to sign the form jointly, you have no choice but to file alone.

In order to do this you need to get divorced and include the divorce decree in your application.

You do not have to be abused to file alone. The only burden of proof for removing conditions is to prove your marriage was bona-fide.

It seems to me your only choice is to get divorced, file alone and prove to them your marriage was legitamate.

PS, talk to a family divorce attorney too... as long as your divorce is uncontested, you could be divorced within 3 weeks in some counties.
