US Embassy and Consulate DiscussionPacket 3 help
QUOTE (warfruit @ Apr 25 2009, 06:14 PM) <{POST_SNAPBACK}>
Hi all

Firstly, many thanks for creating this amazing resource, it has provided much help to myself and my wonderful American financee.

We're now in the position where our petition has been approved, and the US Embassy in London has sent me "Packet 3". Could I just confirm a point I don't quite understand...

I understand I need to return: DS-230 Part 1, DS-156, and DS-157. DS-156K. (some in duplicate).

I noticed when reading DS-156K that it mentions my documents "must be attached" to apply for the finance visa, and now I'm confused. I thought all these forms went with me to the interview (financial support, police certificate etc), is this correct? Do I just need to return the above forms to the embassy (followed by the checklist when I have everything compiled) and haul all my paperwork to the interview, or should I be sending this with the forms helpsmilie.gif

Thank you so much for any help, and all the help I've already found on this site smile.gif I can't wait to be with the girl of my dreams for good!

All the best
'fruit

Hi I'm in exactly the same boat as you and I was wondering about this too. Sorry that I don't have the answer but I'm equally as confused!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsWaiting for NOA2
Hi, I'm new to this. I'm from the UK and my fiance has filed our petition with USCIS in California on July 31st 2008. We have not recieved our NOA2 yet and our case was last touched on Jan 8th 2009. I'm just wondering if anyone else applied around the same time and if they are still waiting for NOA2 as well. I'm getting paranoid because everyone else seems to be moving faster! Any advice would be very helpful!

I got denied on the visa waiver program in Dublin 2007. They never really gave me a reason why but the man at immigration said that because I had a boyfriend in the US it showed I had intent to be an illegal immigrant?!!! We didn't want to get married straight away because my mother was terminally ill so I wanted to be in the UK most of the time to be with her. We applied for a tourist visa because I just wanted to visit for a short time, however it was denied so I suppose that gives me another 'red flag'. Feels like it will take forever. sad.gif

Having one of those days when it all seems like too much! Hormones have a lot to answer for too and our weather is bad here. I think the hardest thing to deal with in all of this is the loss of control, because there is no timeline for security checks it feels like being stuck in limbo. If I knew for certain that it would take another 6 months, I would make plans to fill those six months so that I could cope but it's the not knowing that's driving me nuts - another few days, another year!!!! Oh lordy I'm a blubbling mess today, this is so hard. Thank you for letting me vent. Some days are much easier than this!! crying.gif crying.gif crying.gif

Hello everyone! Background checks for me too, filed July 31st and got NOA1 August 1st. I think I'm being checked because I got turned away at immigration checkpoint in Dublin. It's a nightmare, I've done nothing wrong, me and my fiance were being so careful and never broke any laws. I hate this, does anyone know roughly how long security checks take?

I understand you so well! I don´t think I have ever been that frustrated in my life. All I can think of is this stupid visa. I could cry all the time because I have this big fear that we will have to wait for years. I honestly think I couldn´t stand it.
At the same time I feel so bad because I don´t even pay attention to other people anymore. I feel sorry for my parents because they know how unhappy I am. And also my friends don´t know anymore what to say. Nobody knows a solution or anything to calm me down.
See I am also waving the victim flag.
I wished I would have some faith that we´ll get approved soon. Or at least within the next moths.

Oh I know exactly how you feel, I'm just wishing my life away because all I care about is this damn visa. My fiance thinks it'll be approved any day now but I have this horrible feeling in the pit of my stomach that we'll be waiting a very long time. I can hardly look at the other threads on this because others are getting approved and it makes me feel sick, I'm so happy for them but it's just a reminder that we are NOT approved. Not even getting any touches, at least that would be something. I'm on the verge of tears all the time and because the rest of the world is getting on with their lives, you end up feeling very isolated. All my friends are married and having babies - I feel like Bridget Jones! crying.gif

Wot an awful experience. I would've been frightened too.
You say that the officer asked you why you visited USA so many times. Did you visit for long stays on a regular basis?

I have visited the US using the VWP 3 times in the space of 9 months. 2 x 2 week visits & a 3 month stay..I personally didn't experience any problems.
I really thought that the VWP was separate from K1 but who knows for sure? We waited 9 months & 8 days for our NA02 (& we had no denial of entry) so maybe its coincidence. We do tend to think of explanations as to why this part of the process takes so long & sometimes get a little paranoid.

Good luck. good.gif

Hi Monkeyjuice, I was going out to the US for a few weeks or sometimes longer and then I would come home for a couple of months inbetween. I'd been doing that for a couple of years which is probably why they got suspicious. I was just very torn between being with the man I wanted to marry and spending time with my mum who was very sick. My SO came over several times but he can't take much time off work so he could never stay for very long. I agree with the whole paranoia thing, I'm starting to worry about every tiny thing, it gets ridiculous, I'm so careful about everything I do I think I'm verging on insanity! wacko.gif

K-1 Fiance(e) Visa Case Filing and Progress Reportsvisa waiver denial
When I read the post on the USCIS website that security checks pending more than six months had been cleared I felt a whole new wave of hope. Why then, is there a 'one year and waiting' thread that has started on this site?! Hopes getting dashed again. By the way I totally understand the massive expenditure involved once the visa waiver rights have been removed. Me and my SO have spent a fortune on trips to see each other. All the money I'd been saving for our 'wedding' has gone on flights out to Mexico - that's where we meet because my SO can't take much time off work, so it's easier for us if I do the long haul flights. I'm just getting worried because pretty soon I just won't have the money to put down on flights. crying.gif
Anyway, thank you everyone who has written on this thread, it helps to hear the experiences of others. Don't feel so alone anymore, and I feel like less of a criminal for being refused entry! innocent.gif

So, for those of you who were denied on the VWP and have now successfully entered the US with your visa... did you think you waited longer than others before your NOA2?

The only couple I can find that was denied entry and approved in the recent time frame is Wendy+Greger (Sweden), their NOA2 took 10 1/2 months.
http://www.visajourn...?showuser=48469
I know of a few others on here that were denied and approved, but they are not as recent.

I would bet any amount of money those petitions who were denied entry take on average longer to approve. I woudl love to have more specific statistics on that.

At least it looks like they're finally getting on top of the security checks backlog. It's hard waiting but hopefully it won't be TOO much longer. I got worried when I read about people waiting up to four years for the NOA2 but it seems like that doesn't happen anymore. We'll all just have to keep waiting! ClockWatch2.gif

As an American citizen, I wish to apologize for any representatives from my country who have treated anyone rudely. That is truly an embarrassment, unprofessional and unacceptable. Having formed relationships with some of my countrymen, I am sure you can trust me when I state that those people do not speak for all of us. I guess there are sinners and saints everywhere.

I do want to say that, short of being disrespectful or rude, I do want our immigration officers to scrutinize all incoming visitors. As most of you are aware, there are many people who do wish to inflict massive harm on Americans. Of course these folks are going to come over under false pretense i.e. student visas and so our officers must be vigilant. Again this never condones harassment (unless it is a terrorist, then harass away TSA!).

I strive to find win-win situations in life. It is quite a delicate balance between finding out whether someone is being truthful and acting overly skeptical. Perhaps these incidences reflect a need for further training in this area.

Again, I wish to apologize for any disrespect, since it does not reflect the noblest values of my people. I hope that you are able to see that demonstrated while living here.

All the best.

You don't have to apologize, that's very sweet of you though and I have to say that when I was with my fiance in US I found all his friends and family to be truly lovely people and in fact even strangers were very friendly (like yourself) and I felt very welcomed. I come from Northern Ireland so I fully understand the importance to look out for terrorists! Hope you get to be with your SO soon, not easy being apart from the one you love, good luck with the k1.

The man asked me why I kept visiting the US and I told him that my boyfriend lived there. Then he asked how I supported myself while I was there and I said that my boyfriend supported me financially, to which he sarcastically smirked, 'well he must love you very much' He asked me where my last job had been and I told him Southampton. He said, 'which state?' I said I didn't understand and he started yelling in my face 'which state, WHICH STATE?' So I told him it was in England, I'd never worked in the US. Anyway he was just so rude the whole time and kept yelling stuff about how I had no intention to return to the UK if I left, which is complete nonsense. I told him that my mother was termially ill so I would only go the US for a short time so I could be in the UK with her as much as possible but he basically told me he didn't believe me. I ended up in tears and eventually he started to be a bit nicer and actually said he was 'sorry!' It was an awful experience. He said we'd have to apply for a fiance visa but we didn't want to get married yet because my mum was so ill so we tried to get a tourist visa but it was denied. My mum died last June and that's when we decided to file for the fiance visa, it's been a difficult year.
Sounds like you've been having a rough ride too, I hope we get some good news soon, I've lost trust in immigration ever since my experience and I'm scared that we'll be denied again, I hope not!

Can anyone help me? I would like to know if anyone else was ever refused entry to the US on the visa waiver program prior to their K1 application. I was refused in Sep 2007 when I tried to fly out of Dublin to meet up with my SO in California. I was interrogated and although they had no evidence to deny me, I was told that they were removing my waiver rights because they thought I had intentions to become an illegal immigrant (not the case at all.) I have never overstayed or worked in US or done anything else that was not allowed under the visa waiver stipulations and I had my return ticket booked and showed them this. Anyhow we have since applied for our K1 but it is taking a very long time. We spoke to our lawyer about it and she said that the USCIS were DELIBERATELY PUNISHING us because I was refused on the visa waiver program. She said that they do this sometimes. I'm very confused. She says that they are delaying us on purpose but that we will still get it. It all seems very strange to me and I'm wondering if anyone has had a similar problem.

It's so awful that they have the right to ruin innocent people's lives and get away with it. I have started applying to colleges to study nursing - I can't keep living this way, my life is passing me by and I need to accept the fact that no matter how much love me and my SO have we may not be able to be together so I will train to be a nurse, it takes three years but maybe after that I might even get my NOA2! I'm so depressed these days and it's because of this. I always wanted to have kids but now I think I may not get the chance. Just wondering if they always alert you when they do background checks? Our case still says 'case recieved and pending' does this mean that they haven't decided yet or could it mean they are doing background checks? Our NOA1 was August 1st 2008.

Hi Caroline_L! We asked our congressman to do an inquiry and that´s how we found out about the security checks. When we look up our receipt number it still says "received and pending". So I don´t know if it would ever tell you on the webpage. We got our NOA 1 August 22nd. Maybe you are also in those security checks. Maybe not!

Hi everyone else! I´m not in the club yet but maybe soon. It is a shame that it exists at all. I´ve been following the thread since a couple weeks now. Good luck to everyone:star:!

Just wondering if they always alert you when they do background checks? Our case still says 'case recieved and pending' does this mean that they haven't decided yet or could it mean they are doing background checks? Our NOA1 was August 1st 2008.
