Hi Everyone,
I needed some advice with filling a K1. I am a U.S. Citizen and will be getting married to an Indian girl in India in the month of January, 2009. I know that as I am getting married I should apply for a K3 visa, however can I apply for a K1 if I do not register my marriage and bring her to the U.S. and get married that way?

Do keep me posted on any suggestions as they will be very helpful.

I am hoping someone can help me with this, I am getting married in India in the month of January, 2009. I want to know, what is the current timing since the time you file for the K3 to the time your wife comes to the U.S.A. I live in Michigan, and my wife lives in Pune, so Mumbai would be the embassy where the NVC will send all the documents. I heard from a lot of people saying the entire process has become a lot faster and quicker, is that true? Do keep me posted if your spouse lives in India and you have applied for a K3 visa for them. Any suggestions or tips will be appreciated as well.

As I am in the process of gathering the required documents for filling after I get married, I am looking into filling for a CR-1 visa as well. However I am a little confused on the process after the I-130 is sent to the Chicago Lockbox and I receive the NOA1 and NOA2 approved. I have looked at the Step-by-Step guide under CR-1, and after the I-130 gets approved, the Pre-Interview documents, does my wife send that over to the NVC or do I need to send it to the NVC, her consulate will be Mumbai. What is the process after that, when NVC gets the forms. Do keep me posted, as this would help me take and apply for the right visa for my fiance.

Hi All,
I have recently gone ahead and mailed the I-134 Affidavit of Support with all the required documents to my fiancee yesterday. Also I did receive a mail on March 17 that the NVC will be sending the I-129F petition in a weeks time to the Chennai consulate where her interview will be taking place. My question is relating to getting the Police Certificate, what forms are required?

As part of the package that I sent over to my fiancee, I did include two print outs of form DS-156 and a print out of form DS-156K. Copies of all the documents including the letter that states that the 1-129F petition will be forwarded to the Chennai consulate in a weeks time. As well as copies of NOA1, and NOA2. What documents can she take, to get the police certificate.

Any suggestions will be very helpful.

Thanks Dan and Pushbrk for your replies, so based upon your reply CR-1 is a better option to consider taking into account the time it takes for performing an AOS status and getting a work permit? In that case I will look into CR-1 as well. Also do you have any helpful hints as I get ready to start collecting paperwork, which makes the process faster.

Hello Fellow K3 Filers,
I wanted to check, on the filling fees when filling the I-129F form in conjunction with the K3 visa. Based upon my research, I would not need to pay the $455 check, since I am already paying the $355 when filing the I-130. Is that correct? Also with regards to sending the I-130 form and the other required documents, it has to be sent to the Chicago Lock Box location, however since I know the center that will be processing my file, can I send it directly to that location "California Service center"? Do post your updates.

Hello Everyone,
All of you have been very helpful in my journey relating to filling a Fiance visa. However I have a query relating to form I-134 Affidavit of Support form. During the event where I was filling and filed the I-129F petition for my Fiance, I was working and had a job. Now my situation has changed, I do not have a job, and I am in the process of looking for a job. Saying that my I-129F petition has been approved, I received NOA2 in the mail 2 days back.

I know that as part of filling out form I-134, I need to show proof that I was working, right now I am not. However I have been able to save good amount of money in the bank. Can I send my Fiance copies of my checking statements? Would that help?

Any suggestions would be helpful.

Thanks for your response. In that case, I will get a co-sponsor just not to run into any issues. Also relating to the 1040's, I have already taken copies of all the W2's, and the 1099's. Hope that would work. I will not bind those, as you mentioned.

Also Bobby+Umit when I have a co-sponsor, do I need their tax returns as well? If yes can I just show one year tax return or do I need past three years tax returns as well?

Do you have 5X the amount needed in savings or in assets you can easily convert? (also - how much do you owe on the house, and how much would you make if you sold it? - you can only use that last value, not the value of the house) (You would need 5x since the benificiary is not your spouse)

If you cannot make this level, you will need a co-sponsor, showing you had a job, and you have some money, will not be enough.

On your second question, yes - but I sent copies, not originals.

In terms of savings in the bank I have 25,000 dollars, and I still have $147,000 in mortgage that needs to be paid and would make $300,000 if I sold my house. Hope this helps.

Also Bobby, when putting the documents together is it ok if I bind all the documents. This to make sure that the documents dont get damaged if I send them loose.

Hello Everyone,

My question is relating to the I-134 Affidavit of Support form. During the process when I had filed the K-1 petition for my fiance, I was working. However things have changed at the present moment, I am no longer working and hence I cannot show proof of work or show pay stubs. I know that I can have a co-sponsor, however I dont have any one who could be a co-sponsor for me. However during the course of my work, I was able to save a good amount of money, and I can show that as proof by providing my fiance with a copies of my bank statements, as well as assets (home) that I own. I hoping that these would be ok in terms of filing out form I-134.

I am in the process of collecting all the documents to send to my fiance, In the "Step-by-Step Guide on Filing a K-1", the following "Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy." I have to send documentary proof in terms of the G-325A applications and proof of ongoing relationship. Am I right?

Can someone help me with answers.

My fiancee lives in Hyderabad, INDIA. We are at the point where she will have to get a Police Certificate? How can she get a police certificate? What forms does she need to show in order to get the certificate. Moreover does she have to go anywhere other than the local police station? She has been living in Hyderabad throughout her life (She has not moved anywhere since childhood).

I have gone ahead and sent her all the documents including I-134 affidavit of support and the entire packet containing I-129F documents (All the documents that I sent to USCIS when I filed the K-1 petition).

Any help will be very helpful.

Hi All,

This is with regards to the DS-156 form, I have gone ahead filled, and printed the document as I will be sending this over to my fiancee. However on page #1, there is a section at the bottom right to staple or glue photo (50 mm * 50mm). Has ur fiance or fiancee done that before taking the documents to the interview? or is it better to put a gem clip and attach the pictures behind the documents.

Hi All,

My fiance received all the documents and the K-1 Visa from the consulate on 04/29/2010. I have seen a few threads about the yellow envelope that is sent by the consulate, which my fiance is not supposed to open n which she did not. However I spoke to my fiance she mentioned there is a small opening on one of the edges. My fiance also mentioned it seems the consulate did this on purpose.

Have u come across something similar? Should I leave it alone? I hope she does not have to go back to the consulate!

I am looking for suggestions.

Hello Everyone,

I am in the process of putting all the documents together to send to USCIS California Center for removing conditions for my wife. However with regards to change of address, we moved to a different address during April of 2011 and I have not filled out a change of address online at USCIS.gov. I did read at USCIS.gov that a change of address should be done within ten days after the move, since I have passed the ten days how do I go about filing for a change of address at the moment? Do I simply go on-line and fill out the "Electronic AR-11" (Would this be faster!) Or has anyone else come across a situation similar to mine?

I will be sending all the documents for my wife during the 1st week of August.

I would appreciate any help with regards to updates or help.

File the AR-11 on-line and print the confirmation page. You are SUPPOSE to notify the USCIS of your address change within 10 days. Just like you are suppose to notify the DMV. Also the USC must file the I-865 form when they change address and have an I-864 in force. That is also supose to be done within 10 days of moving. I personally would file both change of addresses ASAP and then list the new address on the form with the old address as previous. This is one of those small details of this process that most people forget about or did not read about it.

I have the same situation as well. However in this case do you also fill out the "Electronic Form - AR-11" (Change of Address). I read on USCIS.gov that a change of address should be done within ten days of moving to a new address. I have not done that since I moved to the new address. Would it be sufficient for me just to include a separate sheet of paper listing all prior addresses?

The ROC form asks about prior addresses and, if needed, you will just submit a separate sheet of paper listing all prior addresses.

Hi All,

 

I just like everyone else is waiting to get the 10 year green card for my wife. I have one concern the expiration of the 60 days letter will approach by June 26th which is almost two weeks away. Do I still wait till the two weeks are over to make an appointment or can I make an appointment right now (Will that even help).

 

It's taking a while to get the green card and the USCIS site still says Initial Review even though my wife got her approval letter. 

 

Any updates regards this would be very helpful.

Hello All,

I have applied for removing conditions for my wife however on March 27th, 2013 we got an RFE. I did collect additional evidence (Listed below) and sent the packent on April 8th, 2013.

Bank Statements showing two years, additional utility bills, lease agreements showing both our names, marriage license, driver's license (Both my wife and mine), green card information includes my wife and me. I am hoping USCIS will not send any more RFE and wishing she gets her Green Card approved. Do you think I will have any issues (I am praying everything works out). I just checked the USCIS Status Website and when I entered in my wife case the site says "Intial Review" I am not sure if USCIS updated the case at this point as I still see the old comments? Any suggestions??

We will be moving to a new residence in less than three weeks if my wife does not get the green card by then and I perform a change of address does or will USCIS see that as an issue? Both my wife and I will be moving to the new location.

Any help or suggestions will be helpful.

Thanks for your post, the reason I want to apply for a K1 is the short wait time and yes I am not planning on including any pictures of our ceremony or wearing any rings as well. I am for certain to apply for a K1 - The thing the boggles my mind is the fact, that a U.S. Citizen cannot even bring his/her spouse immedieatly into the U.S.

Also whats the process after the 1-129F gets approved with regards to taking Medical Vaccination etc (Is this something directed by the consulate?).
