For someone who doesn’t seek assistance from a professional like yourself, what general advice would you give for someone applying for a visa to the US?

It is really simple. There’re a few American people who feel like they can do it themselves. Most American men when they start getting the information get overwhelmed by it, are confused by it and don’t know where to go. There are a few who want to attempt it themselves.

Personally, I think that that is a selfish approach because now they are expecting that their girlfriend who has to do most of the work because it is her visa is going to be able to function the same as an immigration attorney is going to function and file all the forms, all the documents, prepare for the embassy interview, know the questions that are going to be asked, how to apply for the interview and numerous other things. It is just not fair to put all of this on the girl whose English speaking, reading and writing ability is limited. So when a guy decides he wants to do it himself, he might be making a clear decision for himself, but he is not making a conscious decision about how his fiancée or wife is going to be able to handle everything that has to be done – and she is 80% of the equation. People hire us when they really want to take good care of their fiancée or wife.


What a load of nonsense. Just like Dan said, this guy didn't even take the bar (or maybe he did and failed it?) so I don't consider him a lawyer if he's not even eligible to sit before any court in the US as a lawyer!

Also, his comments about American men reading all the forms and then becoming confused are just plain ridiculous. US Government forms are pretty simple to understand generally speaking, and if not understood, the answers are easy to find.

Yes, it is a marketing ploy to say things like this but it's also demeaning to Thai women as if they're just obedient little women who will just sit back and be subservient all the time.

As you know, We never recieved packet 3. They accepted all our downloaded forms from the embassy site.

I believe our application was a special exception, asking her to come in person, to hand in her packet 3, instead of mailing it to the embassy. Due to the timing of her interview. But then again, this may be the new procedure. This gives them time to review, and us time to bring in any missing items before our interview.

We received packet 4 in the mail yesterday 03/06/2006. Today Jass has mailed out the 2 photos and a copy of her photo page of her passport per the packet 4 request.

I don't remember anyone mentioning before that we had to mail this stuff in to the Embassy in preparation for the interview. Is this a change of procedure?

Brent, did they give any reason that they called her in for a "qualification" pre-interview? We have our interview on the 20th of this month and haven't been requested to come in for anything. Are there special circumstances here? Have you had a K-1 visa application for someone else before or something else?

Does anybody know what documents they need for the SS card??? I assume the passport with visa and I-94, thai Drivers liscense, and birth certificate is enough. Did anybody mail it in or just go to the local office?? Thanks to all! :D

I know I sound like and idiot Yodrak but it seems like everytime I try to do something they say I need one more piece of paper. The instruction are meant for americans and I don't know how they will handle Thai documents. You know how government offices can be. Just wondering if anyone had any trouble that's all. :yes:

You have only two choices...
Either print out the updated forms, take them back to the hospital and ask the doctor to transfer the info to the new forms.
Or, submit the expired forms and take your chances.
I would probably do the the former.

I agree. You have plenty of time before the interview. Just have Jass go back to the hospital and ask them to transcribe the results onto the newer forms. Even if they are reluctant at first, I'm sure a couple of hundred baht (or more ;) ) might persaude someone to get it done! I feel bad that I was the one that found the Japan forms in the first place, and over looked the fact they were expired, but I certainly wouldn't take the risk and try turning them in. Better to get the new forms now, instead of after they turn Jass away at "Window 5"!

Yes I agree.
I wish i was there to do it with her...I am going to have to ask her to close her business again and fly to BKK. I do not care what the cost is....speaking of money the ATM card that I sent Jass is working beautifully. It really is the best way to get money to her and have it available for what ever she needs it for.

No reason to feel bad Robert...we are all trying to help each other obtain the same goal. Its a learning process for all of us.

My mistake was that i misunderstood the situation when Wi was sent away from the hospital the first time. I thought it was because she didn't have the second page of the three medical forms(DS3024, DS3025 and DS3026 ). I didn't realize it was because she didn't have the DS-2053.

I had actually already given the DS-2053 to Jass. I noticed early-on that the K1 and K3 packets were different and i included the DS-2053 from the K3 packet in the forms that i sent her because it was a medical form and I figured "Hey if the doctor doesn't need it.. then he won't fill it out. But better to have it and not need it than to need it and not have it."

So if i had just sent Jass to the hospital with what she had.... they would have given her the medical with out a problem.

There is plenty of time to correct my mistake and it is better to realize it BEFORE the interview so i am not going to worry about it. If I wasn't completely out of vacation and sick time( I am planning to ask for a leave of absence to go over for the interview and bring her back with me) I would just fly over and take care of it with her. (Great excuse to see my honey)

I am not trying to put anyone in a panic. Just trying to help. Obviously the embassy has started a new process and we are the first applicants to go through it. There are some wrinkles in the new system that will be soon ironed out.

Wi did download the medical forms from the K1 first,,, and was denied seeing the doctor due to her missing some forms. So she downloaded the forms from the K3 section and went again,, where they did approve them. These are my statements

We did not recieve packet 3, we recieved only packet 4, which did not have the medical forms in them.

Now she has two meetings at the embassy. One to give the all required documents on March3rd and the final interview on March 13th.

These are facts. This is what we are going through now with the new process. Just thought you fellow Visajourney may want to know.

I apologize if I have created a panic to anyone who has read my posts.

I am the only person that is in a panic. I had the hospital fill out the forms from the Japan web site (DS3024, DS3025 and DS3026 ). I did not realize they are out of date and i am concerned (terrified!) that the CO will send us away because of it.

Any one have a suggestion on how to proceed?

Hello Visajourney friends,
Wi recieved a phone call from the Bangkok embassy today requesting to move her interview from March 17th to the 13th saying that they will not be giving interviews that day.

Also told her that they want to see her with all her papers and passport this Friday, The 3rd of March to review papers and to be ready to surrender her passport to them at that time until Visa is approved. This means she has two meetings. One for packet 4 and one for interview.

By the way, Wi downloaded all her medical forms from K3 list of forms from embassy site. The doctor had no problem using them.

This may be the new policy? Two meetings? I haven't heard of this being done yet. And am worried about surrendering her passport to them.

Any guesses about these requests from them?

I am concerned that Jass and I might have problems at our interview because we used the "out of date" forms from the Japan Embassy.

I was considering putting the "page 1's" from the BNK embassy together with the "page 2's" from the Japan embassy and going back to Bumrungrad and have them transfer the data to these forms instead of using the others. I just don't want to be rejected at the Embassy.
What do you think?

What kind of experiences have people had with out of date forms? Bye the way they are exactly the same forms except for the dates on them.

I also noticed that the bottom of the DS3025 it says" Give copy to applicant" which they did not do for Jass.

I got through to the NVC and they just told me that Jass has an appointment date of April 24th 8:00AM. I am absolutely thrilled!
Now I am hoping that they call Jass and offer to move the date up closer ( Never Satisfied!) I think i will wait a while before i make airplane reservations.

I was NEVER able to confirm receipt with the embassy. I couldn't even successfully track the DHL package from NH to BKK.

I received the case number from the NVC Portsmouth NH telephone number the day they "said " that they mailed it.
I waited for a while and then just had Jass send in the checklist and DS-230 P1. I was terified that they were going to throw it away because they didn't have the case yet.

You can not talk to the Embassy anymore (I've tried). Today I got through to the NVC hoping they would confirm that the Embassy had received the package and instead the very nice lady said " I see here that you were waiting for an Interview date. It was issued today. It is 4-24-06." I was delighted to see we actually had gotten an interview date. She said the package is in the mail...what package? Is this the Package 4? What is in it? I would like to get things filled out if possible in advance. Where can I get the forms?

My concern now is that the CO doesn't like the medical forms (from Japan Embassy website) that we used or the doctor didn't fill them out completely (hopefully Bumrungrad did a thorough job).

Thanks for the suggestion on shipping things, that was another question I was going to ask in the future. I want to make sure Jum can take all of the things that she wants. I would need a whole cargo ship to ship the things I would want to bring if I was moving to Thailand. :lol: Good thing too, my mom lives in Wilmington, NC, so the destination would be very convenient. I noticed in your time line that you interview date was changed. Did you request it or did it just happen? How common is this? I am concerned because we expect to get an interview date this week and I was intending to buy our airfare when I got it. But if they can just change the date that will cause me trouble!

I downloaded the medical forms from the Japan Embassy site, and noticed they are expired about 2 years.
Not sure if that will be a problem at some point. Also, the second page for most of these forms is only the paperwork reduction act and privacy act legal stuff. Not sure how important that is for the hospital performing the exam.
The Bangkok Embassy website has the most recent medical forms, minus the second page legal disclaimers.

Thanks for pointing that out. I completely missed the dates. :oops: I'm normally quite ####### about those things... guess I was in too much of a hurry trying to find complete forms, and the fact that those pdf files looked so much better.

Sometimes the State Department accepts older forms, and sometimes they don't. I have had it happen to me when they changed to the new DS-156 forms! I had everything neatly filled out, ready to go for three different tourist visas. When I went to the window (Chiang Mai), the guy said they were complete, and looked so good... BUT... they were obsolete!!! :o I know he felt bad about not accepting them since they were so neat. I had to fill out all three applications again, by hand!!! :( I had writers cramp when I was done, and lost my place in line. Ended up being there the whole morning because of that!

Moral of the story... use the latest revision of the forms! I hope this doesn't cause anyone problems who used the forms from the Japan Embassy. :unsure:

I can tell you there wasn't any problem with the forms at Bumrungrad. Previously it was reported that they were refusing the medical when you presented them with the Bangkok version. I am hoping that they will be ok at the interview...I think if they could not be used.... then the Japan Embassy would not have them posted on there web site.

Just wanted to let everyone know what information you get for your money with the new Embassy web site.

Conditions:

Those who are engaged to a U.S. citizen and wish to marry in the U.S. and live there permanently must apply for a fiancé(e) visa.

MOST IMPORTANT: Begin this process well before the date of the wedding. Plan on a processing time of 5-8 months for your fiancé(e) visa from beginning to end.

Procedures:

1. The U.S. citizen must first file Form I-129F (Petition for Fiancé(e)) with one of the four regional service centers of U.S. Citizenship and Immigration Services (USCIS) in the US. (Information and forms are available at USCIS website: www.uscis.gov.)


2. Following approval, USCIS transfers approved petition to the Department of State’s National Visa Center (NVC) for preliminary processing. Upon completion of this processing, NVC forwards the petition to US Embassy Bangkok for visa processing. It usually takes approximately one month for the petition to arrive in Bangkok after its approval by DHS.

3. Upon receipt of the petition, US Embassy Bangkok mails the applicant an application instruction packet (Packet 3) with a request the completed Packet 3 checklist and form be returned to the Embassy as soon as the applicant has obtained all the necessary documents and is ready for his/her interview. (Note: mail only the checklist and DS-230 Part I form. Do not mail any documents. Documents are to be submitted in person on the day of the interview.)

4. When US Embassy Bangkok receives the complete response to Packet 3, a visa interview appointment will be scheduled and an appointment letter will be sent to the applicant.

5. The applicant attends the interview in Bangkok on the scheduled date. If s/he is found qualified, the visa will be ready for pick up the following working day.

6. Once the K-1 visa is issued, your fiancé(e) may travel to the US any time within the validity of the visa. (A K-1 visa is usually valid six months from the date of approval.) The K-1 visa recipient must marry the petitioner within 90 days of his/her arrival into the US with the K-1 visa. Following their marriage, the K-1 applicant must submit an application with DHS to have his/her status changed from nonimmigrant to immigrant. If your fiancé(e) decided not to marry you, s/he must depart the United States.

7. K-2: To qualify for K-2 issuance, an applicant must be the minor, unmarried child under 21 years of age of a qualified K-1 applicant. The U.S. citizen who files an I-129F petition for a fiancé9e) does not have to file a separate petition for a child of his or her fiancé(e). The children are to be listed on the I-129F petition of the fiancé(e).

ALTERNATIVE:

Instead of applying for a fiancé(e) visa, applicants might consider getting married in Thailand and have their U.S. citizen spouse file for an immigrant visa with USCIS in the U.S. after they are married. Please note, though, that the waiting period will be about the same, and the chances of being issued a nonimmigrant visa while the immigrant visa application is pending are extremely low. For information about petitions please contact: www.uscis.gov

If the couple is simply planning to get married in the United States and then return overseas to live and work, the fiancé(e) may enter on a visitor visa (or visa waiver if eligible); provided, the fiancé(e) is able to convince the USCIS officer at the U.S. border that he or she will return overseas after the wedding. All appointments for immigrant visas are scheduled by the embassy. If you have an application that is currently pending, you will be notified when your appointment is scheduled.

Diplomats and International Exchange Organization Representatives

Procedures for Bangkok:

The Embassy will maintain a Diplomatic and Official Visa window for diplomats, national level government officials, and International Organization employees traveling to the U.S. on official business who qualify for A1, A2, G1, G2, G3, and G4, or C3 (diplomatic) visas. The window will be open on Monday and Wednesday afternoons from 13:30-15:00. Applicants should be directed to consult with their administrative offices that normally handle visa issues.

NOTE: Diplomats wishing to have their visas issued by Consulate General Chiang Mai should contact the Consulate General directly via diplomatic courier.

I'm glad to hear those forms worke for her. So did they actually use the DS-2053 form that isn't listed on the BNK Packet 3 documents? :unsure:

I already have an extra copy of the DS-3025 form, so that hopefully Chutima can get her own copy for later during the AOS process... if we EVER get there!!! :(

Two more days and it's off to Thailand!!! :dance: Will be delivering everything Chutima will need for the rest of the process, except the I-134 and supporting evidence, because it's too far out. Besides, once she gets an interview date, I will go back over to be with her, and take them at that time. :)

To be honest with you I am not sure if they used the DS-2053. All I know is that they gave her the medical with the forms she had. I am envious of your trip to Thailand in two days...ENJOY!

My thoughts exactly! I doubt the officer will make photo copies. Jass tried... but they just didn't cooperate at the hospital. I figure they probably forgot that she requested the copies and had already sealed the envelope and didn't want to re-open it.

She used the medical forms we got off the Japan US Embassy web site for her medical at Bumrungrad....NO PROBLEMS......She did however ask them for a copy of the completed medical forms (I believe we need some later?) But they did not give them to her...They said she can get a copy from the US Embassy at her interview...True/False?
She also paid her fee at the post office....She was exhausted tonight...it was a long day!

Tomorrow she applies for her Police Certificate.
She asked me if she could mail in her completed "packet 3 forms" that we got off the web site...I told her we shouldn't risk sending them in until we know the Embassy has the case in their system ( I heard they throw them away).

NVC said they sent them out on Feb 9th.....But i just cannot see the DHL shipment going to BKK when I search....Sure I see Portsmouth shipping every where else in the world BUT not BKK! I am thinking we should wait until the "real" packet 3 arrives in the mail. I wish I could just call the Embassy and verify they have it or have her stop in while she is in BKK but I believe they will not allow either????

Ton did her medical in Dec. and used only 3 forms which were from packet 3 that the consulate gave to her. She said even though it was only 3 forms, they total out to more than 3 pages. She doesn't remember exactly how many pages though.



I have to tell you this is really confusing. My fiance is closing her business and flying to BKK today to take care of the medical, post office fee and the police report. I feel like i may have given her bad advice and lead her down the wrong path IF she is denied her physical because of the forms that we printed off the web site. It would be a terrible waste.
This could all be avoided if the Embassy would let her pick up packet 3....will they still give it out on request?

That is exactly what i found. I called the NVC again today and they tell me that it was shipped out of there facility on 2/9/2006. Neither of those pakages could be mine they shipped earlier than that. I just find it hard to believe that DHL doesn't pick up everyday or why it would be delayed in the mail room for 3 days.

I know that one of the forms that we need to submit to BKK is an on-line form that has a bar code when it is printed out...but i can not find it on the BNK US Embassy web site. I noticed in your time line that the BKK Embassy confirmed with you that your case was in there system 8 days after it was shipped from the NVC. How were you able to confrim with them? Is this when they would answer the phone and will they still answer it?

I am thinking i will track the package on DHL and then wait 5 days after they receive it and then mail in our checklist, DS-230 Part1 and photos. I hope that will be the correct timeframe.

What is in packet 4? Can i get the forms now and begin filling them in?

Technically you're supposed to wait until you get a letter from the embassy with packet 3 and that's how you would know. Call NVC again and find out the day they ship it and then you can track it in DHL (using a reference number such as I-730) and see when it arrives in bangkok. Once they get it it'll take 3-5 business days to be in their "system" and then you can mail in your checklist and other forms. But since there's no tracking number you kindof have to guess if the package they received is yours or not using the DHL system.

The instructions that i read on the web site said do not sign the DS-230 Part 1. When you look at the form Part 1 doesn't look like the typical "must be witnessed" form. But Part 2 does.

Thanks for your reply. Since I have found no way to call and talk to a real person, I just decided to email the embassy. In the past, I've been able to call a regular Bangkok number (not an 800 number) and talk to an English speaking person to check on my case status or ask any kind of question. I wrote the number down somewhere but can't seem to find it anymore. Now it seems like they don't want any calls at all.

Sorry, I haven't updated my timeline yet. My husband has an interview date on March 9th but we want to reschedule it. This is why I need to get in touch with the embassy. I'm planning a trip to Thailand in April and if we can push the date a little further back to fit with my visit then I can attend the interview too. Hopefully, someone replies to my email.

As far as I know the Immigration Visa (IV) unit at the embassy will not take any phone calls. The operator will forward you to their voice message system which will tell you just that. You have to email them to get a response and sometimes that doesn't even work. If you are in bangkok, they will accept walk-in's from 1-3pm mon-fri except for the last friday of the month (learned that the hard way).

The pin system, as far as I understand and know, is only for NON-immigrant visas. K-1's are non-immigrant visas but are processed by the Immigrant Visa unit and are generally considered immigrant visas. I don't believe (but don't quote me) that paying for a pin and trying to access your case info will help for an immigrant visa case.

Email them if NVC has already sent your case to them, which according to your timeline they have. Their email is visasbkk@state.gov

Have they scheduled an interview for you? How have you been communicating with them in the past?

Don't waste your money on that automated system for a K1 visa. Like I said, I believe that's only for NON-immigrant visas (tourist, business, etc).


Has anyone tried contacting the embassy in Bangkok since they've set up the new visa system? I know they've got that 800 number but I've never gotten through. I called NVC and they gave me the case number. I tried the web site and paid the 400Baht...it got me no where. It said that a K1 fiance visa interview would be scheduled by the embassy......I wasted my money but perhaps everyone else can learn from it.
I have already down loaded all the packet 3 forms and they are all filled out. Jass is going to BKK on the 14th with her forms and get her medical, police report and pay the visa fee at the post office.

I was hoping that we could get an appointment as quickly as possible. Apparently the procedure is for her to MAIL in the checklist and Ds-230 part 1, unsigned, after receiving the packet 3 in the mail.

Is leaving the DS-230 Part 1 unsigned something new? Does it make sense to you people?

I would like to mail it in as soon as possible to get an appointment date....Question is when is the right time? Sure i could wait for the packet 3 to be sent in the mail but i am , of course, trying to shave off as much time as possible. I was hoping that i could call the embassy and when they told me they had the case we could mail in the checklist and Ds-230 part 1.

There is a way to cross the border without a passport if you are only driving. My husband has it. It basically a drivers license "plus" or something along those lines. Have her check the SAAQ website to check the details. It is only valid for US - Canada crossing. I don't know all the exact details but you should be able to find it on the website.

I think the OP's concern is that if she leaves Australia because of the 6 months limit, they wont be able to do the religious wedding in Australia.
What I would suggest is to go ahead with the process now. What should matter the most is being together. If you are "LUCKY" enough to get through this painfully straining process early (which is a problem i wouldnt mind having) you can apply for AP and then hope your luck continues and then go and have the wedding. Like previously mentioned, the process does not differentiate between those who file by themselves (with the help of many resourceful people here on VJ) and those who paid for the lawyers. Unless there is an "unusual" thing about yuor case then lawyers are not needed. Also, if you have to go the "lawyer route" do let any lawyer fool you into saying they specialize in a particular process center.....its a 50-50 chance in where you petition goes.

Like everyone else has mentioned. You can do a ceremony but not an official wedding , since part of the K1 process is agreeing to marry within 90 days of her entering the US. Since you are very early in the process , If you don't mind withdrawing your application (keep i mind that you loose the filing fee) and then file for a spousal visa after your wedding then thats up to you.
