Our embassy will be the London location. I like having my paper work done way ahead of time for things, but I don't want to make these too soon & they end up expiring...! I was going to start gathering these documents up in August...should I wait until my fiance has an interview date?

If someone could give me a rough idea of how much time I need to get this stuff gathered, it would be much appreciated.

Thanks to all who give me nice replies! star_smile.gif

I believe a period of 1 yr is ok. You should be gathering information on this form. I did mine altogeter when I filed I-12F, in June and never has a problem on the interview. However, during the interview scheduling, the US Embassy will give you a checklist, eg, recent paystub, w-2 or income tax, company letter but they never ask for it. According to your timeline, your NOA2 was approved in June, so they give you 4 months to complete. You now have more than 3 months left to complete so I would say, go ahead and do it now.

One more thing, US Embassy never ask these because I did all these (I-134) when I filed my I-129F ... Some people wait until package3, but not necessary.

You could call the USEM to enquire but usually a month on from when the NVC despatches the petition and the USEM would contact you with the interview date. The best of luck!!! rose.gif

USE will contact your fiance(e) by phone, or letter or Email, etc.

US Embassy and Consulate DiscussionPossible Denial of K-1 Visa?
QUOTE (INCT @ Jul 29 2008, 07:14 AM) <{POST_SNAPBACK}>
Ok maybe now that I received my approval I am getting paranoid of what could go wrong - haha, I know real positive.

I am really nervous that the Embassy will deny us because of no common language.. He speaks spanish fluently and hardly any English. I speak English and not so good Spanish. We do speak for hours on the phone because the Spanish I do speak he understands (one of those odd couple things), and I can understand him if he speaks slow enough. We have spent 3 vacations together and between the Spanish I speak and the pocket dictionary I possess, the language was not a problem at all. I really wanted to go to the interview with him because the prevoius two times that he went for a tourist visa (after him and I met and had my name on the forms when he applied) he got denied, for the pure basis they did not think he would return to Chile.

Any thoughts on this?

As long as you can established a bonafide relationship between the two of you, and able to get married within 90 days, it shouldn't be a problem because Tourism visa is different from this K1 visa.

They may miss it. They may stick you on AR until you get it. May let it go if it's for a country like Dubai where you can only get a PC by appearing in person.
I wouldn't cancell. Just see what they come up with!

Don't cancel your appointment, the worse case scenario is, they will request to see it before your case can be approved or denied ... They may let it goes altogether. This document is very important and every person is required to have this done.

US Embassy and Consulate Discussiongreen card
My wife and I will have been married for 2 year this coming June, 2010 and just wondering if she would have problem getting green card if I filed AOS this late. I know she wouldn't, but just wanted to double check.

2ndly, if I wait after June 2010 to file, then will she be getting a permanent green card of 10 years or just the 2 years one regardless when you filed? Does anyone know the answer. I would appreciated any one shed a light on this.

Thank you.

Just wanted to add my 2 cent, Senator's help is great, but like other VJ said, if your case is more than 6 months, than you can request their help... Cuz, everyone goes through the same process!!! However, I did request my Senator's help and he responded. My case from start to finish, meaning the date I filed at USCIS and my fiancee enter the USA, in all, 9 months, and the interview was very friendly too!!!

CanadaI-129F questions
QUOTE (SapphireDreams @ Jun 26 2008, 08:03 PM) <{POST_SNAPBACK}>
We just wrote the story of how we met for the first time and how we visit eachother frequently. Then we attached some boarding passes, our receipts from the 3 cruises we went on together and photos. We also sent in phone records but we knew they weren't really necessary.

We have been dating long distance for 5 years and going back and forth for visits every 4-8 weeks so I just couldn't possible list every single visit. I mean I could've but I didn't save all my boarding passes so I figured a few of the ones I kept and a few other receipts was sufficient considering some people have only met once or twice and get through.

I figure if they see that we've been dating for 5 years now long distance it better be real!!

Anyways, I don't think you need that much detail. I don't think it would hurt, but I wouldn't waste too much time on it.

To be very neat, I would suggest you do the followings Exhibit or table of content:

In I-129f package - some of the proof are: photoes of you together (at least one engagement photos is best), email, boarding pass/airplane ticket, phone bills, moneygram, westernunion, letter of intend, engagement document/letter, financial support evidences, email, etc. Put them in table of content, exhibit item, or label/item, title "proof of meeting", then list all those evidences on this section. On your cover letter, the content might be like,

A. I-129f package
B. G-325A (both)
C. Affidavit of support - form I-134 and all w-2, paystubs, mortgage, car, board, stockbond, checking &
saving if any of value to you (assess), etc
D. Engagement letter - engagement photo, ring receipt, letter of intend (both you and your fiance(e),
F. Proof of meeting in person - photoes, plane ticket, etc
G. On going relationship - Money gram, Westernuniton, phone bills, email, etc.

In this way, you'll be sure not to get RFE...

Also, you need not write long story because they'll ask you on the interview so you might forget what you wrote. Simple two lines (one sentence) to fit in that box only. That's how i did, and they asked this question on the interview. The CO asked me (interview me more) not my fiancee...
Hope this help a bit...

Removing Conditions on Residency General Discussionconditional card received - my husban is trying to deport me
QUOTE (Kathryn41 @ Jun 26 2008, 08:48 PM) <{POST_SNAPBACK}>
I am sorry that you are having problems and that the marriage didn't work out. First, you need to remember that USCIS is used to angry and disgruntled spouses complaining to them that their former partners need to be deported and they are not going to believe him without proof. He can address all of the letters to ICE that he wants but without evidence they won't carry much weight. If you have your conditional green card you are valid in the US until the expiry date on your green card. You can live here and you can work here until then.

You will need to remove the conditions on your green card and you will still have to prove that your marriage was a valid one. It will be more difficult if you have left and don't have access to things like joint bank account statements, etc. You can request copies of your tax receipts if you filed jointly and you may be able to get letters from banks to show that you were listed as a joint holder on the bank account, etc. You have some time to try and gather this evidence. Once you are divorced, You can file to remove conditions on your green card before the 2nd anniversary and you can request a 'waiver' from filing the application with your husband because of that divorce.

You would do well to try and talk to a family lawyer regarding the divorce and possibly an immigration lawyer to assist you in preparing the Removal of Conditions application when the time is right. Good luck, and again, I am sorry that your marriage didn't work out.

This happened far too often and many of my friends had the same problem (foreign wife left the husband after getting GC - so I'll give my two cents).

I am sorry to hear this story happened to any marriage, sadly it happened too many times in VJ forum, that after getting GC, many marriage fell apart. I wonder to myself, it is true love from the beginning or fraud intention from the beginning?

Well I have the same question, but as far as I can tell the DS-156 is required to be filled in online. The only format is to enter a Date, no free text in that field......So is it ok to leave this blank??????????

you can put any date. you are not required to arrive on the date you enter. same as with POE. you are not required to enter at the POE you have listed.

Print the form, and hand-written on it either , "when is visa is granted" or "N/A" ...

i hope this will not cause a big problem.. unsure.gif

This form MUST to be printed on one paper, meaning print back to back, in a single page. Enclosed the barcode with this paper. It is easier for the Embassy to find your information as I was told by Consular Officer when I talked to them. Two page is unacceptable because they don't know if the 2nd page is part of the first page, therefore, they need to be in one page. So total pages is 2 pages including the Barcode page. You will find this information on www.immhelp.com

Good luck..

I would suggest this:
Print the 1st page, or use print current page, and then flip over and put back into the printer. scroll down to page 2, use print currente page again or print from page 2, so you'll get 1 page back to back and the barcoding with in another page by itself.

I've been instructed to do so by Vice Consular Office for this Ds-156 once I found out that 3 pages are not acceptable per instruction on ***removed*** and per my fiancee's country USE. Other countries may do it differently... see link, http://immihelp.com/forms/ds-156.html

Form I-134 Affidavit of support needs to be notarized, your paystub, w-2 and company letter (mentioned how much you make) is all good to go if they're over the poverty line, else, visa will be denied. I saw many girls turn away during interview because of financial support is innsufficient. you don't need income tax returned if you make good money. I don't provide them, they never ask for it.
Along with this, an ongoing evidence of relationship is sufficient enough (all those that mentioned in the guidelines). Good luck!!!

If you want, you can bring income tax return during your interview, along with recent paystub, although they rarely ask for it, but on the Embassy form, a checklist of what to bring for interview, they mentioned you MUST bring income tax return, recent paystub, or w-2, etc.

Hello everyone. I'm just new here.

I have this concern, my fiance and I haven't met in two years (He left July, 2006). He wasn't able to come back in the Philippines since then because of his naturalization process. He just had his oath taking last July 11. He just sent the k1 and k2 application today for me and our son. BTW we have a son, before he left I was 3 months pregnant of our first born.

Is that considered as extreme hardship on meeting us ( me and our son) because of his naturalization process? sad.gif We've been together for eight years, since highschool.

I'm wondering if they will still approve the application. sad.gif I told them to seek advises from immigration lawyers but they still filed the applicaiton.

Please give advise about this concern. It would be great. Thanks.

There was a clause in this link, read section that said, "provide a detailed explanation that", http://immihelp.com/...a-petition.html

you'll have to give an explanation as to why you can not meet in person within 2 yrs timeframe, and since you already filed your application. I would suggest you wait and see if you get RFE, and then provide them with an explanation...

Think of a good reason, and write a letter to support it. waiting for naturalization will not be a good reason or hardship, but I'm not the one who decide it. Hope this help a bit...

I have a question for you: Marla and I met when she was a bar girl in Cebu. She said that she was doing it to help out her family. She stopped working in the bar a week ago because she felt our relationship was more important. If I want to bring her back to the US and marry her on a K1 visa will her being a bar girl affect the process? My friends say that it shouldn’t be a problem for me because most of the K1 petitions are for former bar girls. What do you think?

rofl.gif rofl.gif Was your friend referring to the Philippines? Let your friend make a stand on this, did he conduct any research on the statistics on K1 petitions and got into a conclusion as MOST K1 BENEFICIARIES ARE FORMER BAR GIRLS? laughing.gif OR he could refer us to a reliable source before he can let anyone believe about this information. innocent.gif whistling.gif

I don't think it will affect any process with your fiance' being a former bar girl as long as you could prove a "genuine relationship".

Good luck!

USEmbassy CO will more than likely deny your fiancee visa because of her former work history, period. Bar girl? This topic has emerged from one of VJ filer in Thailand (his fiancee) was denied a visa, on the denied paper, it said case 212(a), meaning she is likely to be discharge or do the same thing in the USA.

This is what I read, and past on to you. I do not know what BAR GIRL do/did, but we sometimes go beyond our imaginations and so US Consular Officer. Tell you nephew to find another girl. Military rule, don't ask don't tell policy might work for his fiancee.

Q2: Is it a good idea to be with your fiance during the interview appointment? Do US Consulate allows you to be with your fiance in the same room during the interview?

K-1 Fiance(e) Visa Case Filing and Progress ReportsWaiting for a NOA2 from VSC for your I-129F?

I've been looking for ways to to keep myself occupied while waiting for my petition to be processed, so I compiled this list of I-129F VSC filers with NOA1s waiting for NOA2s. The data is from the VJ.com timelines, and specifically from the reports available on the timelines. The number I have listed to the left of names is simply the sort order based on NOA1 date.

Obviously, we have no idea what order VSC will process NOA2s (once they start processing them for us again) but its something to help pass the time.

Hi all!!
For those who have been thru K1 visa interiview, I wonder if the embassy will keep all those old letters, emails, photos, or such and such that you brought to the interview?

No, they don't keep anything, except your I-129f petition package... They just need to see them!!!

Has anyone encountered a problem when filing form I-485 without evidence of medical record in the package?

Per instruction on form I-485, it did ask for your medical record. I am not going to include this in the package since USCIS already has a copy in their file as recently as 7 to 8 months ago when my fiancee has her medical exam & entered the US. I heard somewhere in VJ discussion forum that we do not need to include this evidence (medical record) in this package. Is it true that we need not include? If this is the case, then I'll want to avoid it altogether. Any one shed a light on this subject.

No, but the lawyer seems hopeful that 2-4 weeks is realistic.

My case went to the NVC on June 6th shortly after being approved on June 2nd. The USCIS Website still shows as of yesterday that we are still waiting for approval. So, don't put complete trust in the USCIS Website being updated with current information. At least in my case it was not.

The simple answer to your question is, "NO" ... No more update online. Case go out to foreign US Embassy abroard for further processing!!!

QUOTE (Cecile and Bryan @ Jun 25 2008, 08:26 AM) <{POST_SNAPBACK}>
I see from your timeline that you are waiting for your NOA2. When USCIS will approve your case (and send you NOA2), they will forward your file to the NVC, which then send it to your local embassy.
The embassy will then send you some mail, called here "packet 3". Usually it contains a checklist of the things you will need at the interview, and some forms to fill out and send back. Once you send these back to them, they will send you something else, called "packet 4", which usually contains the date of your interview and the last things you have to do, such as having the medical exam done.
But this depends on which embassy/consulate you go through. Some don't issue anything and you have to call them.

You can find the information for your embassy here: Thailand

I don't know anything about what they ask in Thailand, so you should probably browse the Asia forum for more information.

My fiancee has her medical exam done in Thailand, including vaccine, twice though... 1st round and then 2nd round for shots. I believe Laos and Thai function the same routine, package3 & P4 as mentioned above here. Good luck.

Hey guys!!

Its been just over three months and we still have not recieved anything since our NOA1; yes, we have the CSS...

Firstly, *screams* this is so unbeliveably frustrating! whistling.gif crying.gif

Secondly, how long do we have to wait before we could get our US/Australian local members of Government involved?
I have heard things that if you waiting for more than 6 months then you can pressure them to get it expedited?
Fact or fiction???

Thirdly, my partner is coming out from the mighty USA to stay with my in Australia for the next few months (so excited!).
His family are going to keep a watchful eye on the post for possible REF's (hopefully not though) and NOA2's.
Anything else we should consider before he comes out??? We have everything signed and ready to go as soon as the NOA2 is issued.
Would they take into account (does it work in our favour) that my partner has had his Australian 1year VISA approved and he is going to be out in Australia??

Love and laughter!
smile.gif whistling.gif

waiting game is between a month to 6 months for NOA2 to arrive, or even getting RFE... you had another 3 months before seeking help. You can also check your status online, so you'll know it before your actual confirmation NOA2 (I-797) paper arrived in the mail.

USCIS has lost our first package, and we sent another one 3 weeks ago. The return recipt was signed by P Novac, so we know they got it. But again, we have not received
NOA1 yet. of course, they have not cashed our check either. What's going on with VSC? Could they possibly just throw out our packages twice????? Does it mean we have to hire a lawyer and file it for the third time??? crying.gif

It's hard to say what USCIS does, but NA1 should be issued within week of their receiving your package. Maybe they're trying to locate your first package before issue you NA1. This is just my view. Are you certainly sure your first package was lost?

Many June and July filers found that they didn't receieve their NOA1 for weeks, sometimes a month.

There you go, you're not alone on this journey...
