I had a question concerning the medical exam. Those of you who have already done it, do they give you a date to have your examination or can you have everything done before your NOA2? Is the medical exam done around the same time as the interview, or is it on the check list you get when you receive the NOA2? Just trying to figure out what we can and can't do already. =]

It is not possible to do it before your NOA2, since you will need the paperwork that you get after that. When you receive your visa interview appointment letter, you will also receive instructions on how to schedule your medical appointment, which has to take place at least a week before the actual interview.

The international one is just fine. It lists your info plus your parents names, and that's all they need.

There is no original, or at least they will never give you one. They will either give you a legalized copy ("afschrift van de geboorte akte") of the orginal dutch one, or the international one. I was confused as well and went to the interview with both, but they told me the international one is sufficient for the visa process.

This is frustrating. I have to get official birth certificates and I am assuming I have to get those from the place I was born.
The visa instructions make a clear difference between originals and certified copies (last one is ok for my son)
But they don't give those different options on the website I ordered them from.

You need the afschrift van de geboorteakte, which you can only obtain from the city hall of the city you were born in. They can provide the original version and the international version. I can recommend to get both. You will need the international one for the visa interview. You may need the original one later on to renew your dutch passport at the consulate in the vs (to prove your dutch citizenship).
I could request mine through the city hall website (gemeente Heerlen), so I didn't have to go by in person.

Well I guess it all depends on how much evidence you already sent in.

Yeah it is very exciting. Actually we just decided today that we are going to postpone the actual wedding ceremony. We will just get married at city hall for now, and we will probably have the actual ceremony next year. That way we can save money, and I can fly out there sooner biggrin.gif

I did read the shortcut you gave us.
Well we first send out our petition to USCIS, they need to approve it and send it to NVC and than the rest of all the packages ;-)
So what we send to the USCIS like things which show our bonafide marriage do we need to send that too NVC too? Can you remember this stuff? See now i did print our skypecalls etc...maybe they never look at that but a lot of people send that in to USCIS (we didn't because i forgot and well my history was in my laptop in NL and Daniel has a Mac so kind a different) so i was just wondering if we can send that to NVC too and when?

The NVC doesn't look at any evidence, they just make sure that cases are prioritized correctly and then processed. The actual adjudication takes place at USCIS.

Yes, September 19. I already booked the flight a few months ago when I found an amazing deal.. so I just took the risk. We planned our wedding for October 30.. so we will still have to wait a while unfortunately.

Hi everyone! I haven't been posting much since everything has been extremely hectic, but I figured I should post a quick update since I just got home from my visa interview. All went well, and we're approved! biggrin.gif

Here's a bit of what happened (copied from our blog wink.gif):
After the thorough security check I continued to the reception where they once again checked my bag and passport. I was then told to go wait in line for counter number 5, where I waited for quite a while. I talked to a few of the other people there and it seemed like the majority was going to move to California as well.

When I got called to the counter the guy (he spoke Dutch!) checked my passport and took my fingerprints. He then went through the checklist (passport, photos, birth certificate, forms, evidence, stamps etc), and was very impressed that it all was complete and in duplicate. He put everything in a binder and gave me a big brown envelope which contained my x-ray and vaccination records. He explained that I would have to keep it with me on the plane along with all the other paperwork and evidence. He then told me to go to the waiting area until my name would be called.

After 10 minutes or so my name was called, and I was greeted by an American officer. He took another fingerprint, and proceeded to take his time to browse through all the paperwork. While he was concentrating on the forms, I glanced over and I could already see a big red ?Approved? stamp on the file, so instantly the nervousness was gone. He then asked me three simple questions: ?Who is petitioning for you??, ?Where does he live?? and ?What does he do??. After answering those questions I had to take an oath stating all the provided information was truthful, and I signed the remaining form. He then told me he would keep my passport and that they would put a visa in it and mail it to me, and that was it!

I had my interview yesterday at 10:35.. got called in at 12:30. Passed my test with no problems, but the IO wanted to see more recent proof of us living together, specifically bank statements. So he said he had to continue the process for the documents. Desperately I asked him if I could use his computer to log in to the bank and print statements, and he agreed and recommended me for approval! I got very lucky there.. so now I just have to wait for the oath ceremony :)

Hi Stormbringer, one more question!

Does my wife have to refile documents that she already filed as part of the K-Visa/AoS/RoC process or can she reference that they are already part of the record? In this regard, I am thinking about divorce decrees, annotated marriage documents from the Philippines, Land Titles, two of the three years of tax returns... et al. Most of what the N-400 asks for we already filed with the USCIS in the proceding steps. Are you refiling everything?

You will only need to file the documents asked for on the USCIS N-400 checklist: (link)

If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items:

Evidence that your spouse has been a U.S. citizen for the last 3 years:
- Birth certificate (if your spouse never lost citizenship since birth); or

- Certificate of Naturalization; or

- Certificate of Citizenship; or

- The inside of the front cover and signature page of your spouse's current U.S. passport; or

- Form FS-240, Report of Birth Abroad of a Citizen of the United States of America; and

Your current marriage certificate; and
Proof of termination of all prior marriages of your spouse (divorce decree(s), annulment(s), or death certificate(s)); and
Documents referring to you and your spouse:
- Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or

- Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years; or

- An IRS tax return transcript for the last 3 years.

If you were married before, send:

Proof that all earlier marriages ended (divorce decree(s), annulment(s), or death certificates(s)).


This is what I sent:

- copy of my gc
- copy of husband's passport
- copy of our marriage certificate
- IRS tax return transcripts for 2009, 2010 and 2011

I will however bring all supporting evidence to the interview, in case it is needed for some strange reason.

Hi Stormbringer!

You say, "So you have to meet both requirements" but we haven't until February AND NOWHERE do I see anything that tells me in USCIS pages that "you can file 90 days before the latest date."

Where do you see that?

You may file Form N-400 ninety (90) calendar days before you complete your permanent residence requirement if your eligibility for naturalization is based upon being a:

Permanent resident for at least 5 years; or
Permanent resident for at least 3 years if you are married to a US citizen.

adiiann thanks for the reply. I must admit I am still confused as that is not what the USCIS instructions authorize from that I have read.

The document says 3 (three) years after approval of your Adjustment of Status not 3 years after the marriage. Can you point me to a document that advises differently? For that is is worth I married my wife in September 2009 but we got the GC in February 2010. Some folks claim my wife can file in November, but the only thing I see inclines me to believe she must wait until February.

In general, you may qualify for naturalization under Section 319(a) of the Immigration and Nationality Act (INA) if you

-Have been a permanent resident (green card holder) for at least 3 years

-Have been living in marital union with the same U.S. citizen spouse during such time


So you have to meet both requirements, and you can file 90 days before the latest date.

For example: I got married July 2009, and got my GC October 2009. So I become eligible to file October 2012. Minus the 90 days that would make it early July, but I waited until August to file because of the 3 year marriage requirement, and I didn't want to cut it too close.

HELP and ADVICE please !!!!!!!!!!

Thank you, and I'm sorry you got an RFE as well.

I sent back everything I could find that had both our names on it, and could be used as evidence. I was pretty pissed off so I inundated them with a thick packet of evidence. This is what I sent:

- Complete tax returns and W2's of 2009, 2010 and 2011
- Complete phone bills of 2009 to 2012 that show we call and text each other constantly
- Car registration, insurance and car loan with both our names
- Bank statements from 2009 to 2012 that show both our salaries going into joint account, and all bills paid from that account (rent and utilities)
- Credit card statements from 2009 to 2012 that show all our daily spending from a joint account (groceries, gas)
- All leasing agreements we had since we started living together, with both our names and pet addendum which shows we have 2 'kids'
- Every single insurance policy we got from 2009 to 2012 with both our names on it (renters, car, etc)

Aside from that we also got our local congressman involved which sped things up after the RFE as well.

remember that the change of address process is not just online. you need to fill out the ar-11 (non-USC) AND the I-865 (USC) and mail them in. additionally, you can call USCIS to change/confirm the change. you probably know this already, but since it's sometimes overlooked by people, thought i'd mention it!


This is actually not the case. From https://egov.uscis.g...tion=coa.Terms:
"If you choose to use this online electronic change of address notification, please do not mail in a Form AR-11. On the other hand if you choose not to use this online tool and instead choose to mail in a paper Form AR-11 please understand that doing so will not update your address on any applications or petitions pending with USCIS."

We only filled out the online from after our AOS.. and just filed the I-751 with the new address. No need to complicate things.

Apparently the cases get there very fast, but don't get entered in their system until they are sent on to the consulate (that's when they get a case number attached). And it all depends on the consulate when that happens, there is a waitlist for it (I've seen that explained on some US government site but I can't remember where right now, I have to look it up).
We got our letter from the NVC days after I had already received packet 3 (which I received 8 days after the NOA2 date).
