i just got a text and check online and they just order the produce of my new green card!!!!!! so happy cant believe didn't take that long.......the date say august 9th......good luck everyone!!!!!

hello welcome to the forum, the waiting time is about six months. Some people from march I think got they aprovals but many other people from last year still waiting for an answer. Good luck!!!!

Hi! Joining the forum late in the game.. Filed for my husband April 2nd at VSC, did biometrics in May (can't remember exact date right now) and just waiting on them for now.. Any ideas on what the waiting time looks like for us?

You should have no problem. Dozens of VJ members travel abroad and back while their ROC is pending with their expired green card and the original extension letter + passport. I'm sure airline employees, especially in Mexico, see that every day. Just do a search on the forum and you'll see that the same question is being asked at least once every week.

Be sure to present the original extension letter and not a copy, as copies could give you trouble. The only time VJ members have had trouble boarding was when they presented a copy of the letter and not the original. And this whole time I've only read of one case who had trouble with the original letter because the airline employee was ignorant of the rules, but she "threatened" to hold him personally responsible if he didn't let her board, so that did the trick content.gif

Bottom line: it's unlikely that they won't let you board.

 

I'll be visiting my home country in mid August and will be returning in mid September. I don't expect any trouble, based on other VJ members' experience, but just to be 100% sure that no airline staff gives me hassle, I was also going to print out this page from the CPB website and bring with me in case I need to convince anyone that I am legally allowed to board the plane:

I suggest anyone feeling too nervous about their overseas travel does the same, just in case they are given hassle (which shouldn't happen in the first place).

Hello ! I'd like say thanks to everyone who shared their experience in this topic. I was a little bit nervous because I sent my i-751 package on April 22  to VSC (it was delivered on Apr 24) and I got no response so far (check is not cleared  and no NOA). It seems everyone who sent their package on the second half of april have to wait two or three weeks for their NOA.  I'll keep you updated of any change I'll have in my case.

Congrats on your NOA! Well, everyone gets a 1 year extension, so that's pretty standard. Based on current timelines, removal of conditions takes between 6 and 8 months for most cases, occasionally a bit longer. That's the timeline you should prepare for.

It assures me to know that I'm not an only one who is taking so long to receive NOA1. As of today, I still haven't received NOA1 yet, not to mention my check isn't cashed, either.
Sigh,,, well, hope we all receive it soon... Don't know why it's been taking so long.

Just updating. CSC received our packet on 4/22 and the check was just cashed today. (16 Days Later!). We still haven't received the NOA yet. 

I am in the same situation, I sent my package 4/15 and my check was cleared just on monday and no NOA yet, I guess we just have to wait.  Good luck :)



 

You make an InfoPass appointment, go to your local USCIS office and they put a stamp on your passport that grants you a 1 year extension of status. Same thing as the NOA.

If there's one thing you take away from this crazy process, it's that nothing is certain and everyone's case is different. All we do here is track one another and try to gain some semblance of a timeline while killing time together in the waiting room! No one has any idea or vague concept of what the government will do, particularly how fast they'll do it. You just have to sit back and wait, unfortunately....particularly if  you've filed at the California Service Center. They are notorious for being on their own clock.

 

Don't panic, I submitted our ROC packet on April 16th as well to the CSC and no cleared check or NOA1 here either. If you look at the timelines re-posted along the thread, you'll see many other people submitted their packets weeks before us without any luck, so we're still in line I'm afraid. My husband's GC expires at the end of June, but no need to worry. If you get to the point where you're a few days away from expiration just make an InfoPass appointment and you'll most likely get an extension stamp. Just read through the thread and all of your questions will be answered. Good luck!

Sorry that u got rfe,  they want to make sure you r together for real so to probe that is necessary that u both have financial bonds what I mean with this is for example my husband and I we have a joints acct that we use all the time for groceries, gas pay bills it's our daily basis acct so a full copy of that (each of our paychecks go in that acct) also I am his life ins beneficiary and 401k as well. We have wills on each other name. All that involve that trust each other with finances. Fake marriage don't have that kind of paper work. Hope this help and don't confuse you more.

 

Hello!  I just want to let you know that I am in the same boat as you.  I got mine last week and it hasn't been great the last few days.  I have already begun collecting documents so you will just have to be more creative.  I read somewhere that as long as you can prove from here on out that you are still together they may see that as a positive sign.  

 

I had an address change  (while the petition is being processed) as me and hubby recently purchased a home together so I am hoping to use that as strong evidence.

 

I know how you feel, I am totally bummed out too but I am hopeful as well since several that got RFEs have managed to get approvals within 3-4 weeks.

They don't receive as many petitions from Legal Residents as they do from U.S. citizens and that makes the line longer for U.S. citizens.  You would think that the $420 paid should be enough to cover the cost of the adjudication and that USCIS could allocate resources based on a prediction how many cases they are going to receive each month).  However, if you glance at processing volume data you'll see each month that while USCIS averages more and more I-130 petitions, completions have become fewer and fewer.

One more question.. am I considered IR1 beneficiary  ? Because from all I read, IR is an Immediate Relative of "US Citizen" not permanent resident.

I was just going through Processing Time Information of Vermont Service Center where my I-130 is being processed.
We can see difference between processing time for Relative of US Citizen and of Permanent Resident, which is shown below.

As shown in the table, current I-130's of Relative of US Citizen are at Feb 13 while of Permanent Residents can be around July or August. Is it true ?







If yes why so, that the Permanent Residents are given first preference ?

Although I am a Relative of Permanent Resident and its good for me, but I was just curious.

US Citizenship General DiscussionTook Oath but Citizenship denied

My wife was called for Oath, she took oath, but at time of taking Naturalization certificate, she was denied without reason.

 

I am submitting herewith my wife's history.

1) She came with me in 2003 under H-4 visa, dependent on her Father.
2) She got her green card as her dad's derivative, getting L-4 and green card.
3) She applied for citizenship (N-400)  in August 2011.
4) She got her interview on 11/10/2011 and passed the tests.
5) Was called for oath ceremony on January 27, 2012.
6) She took her oath on 01/27/2012 but at the last moment (at the time of issuing Naturalization certificate), they denied her the certificate.
7) She got a Motion to reopen an Approved Form N-400, Application for Naturalization on February 29, 2012.
8) Attorney filed a response to the application in March 2012.
9) She got a letter from USCIS stating that the application is still pending and they need 60 days to take a decision.
10) On USCIS website case status shows RFE, stating: "On February 27, 2013, we mailed a notice requesting initial evidence in this case." But strange part is we haven't received any requests by post, we inquired with InfoPass and via Telephone, but they say we have sent it already.
 
Her Father's History
1) Arrived in USA on April 20, 2003 under H-1B visa with family, consisting of wife, son and daughter (my wife).
2) The H-1B visa was filed by Attorney.
3) On February 2005 (An Employer) filed petition for Non-immigrant worker for change of status to L1A. This was done by Attorney.
4) Petition of The Employer approved and status of beneficiary allowed to be changed to L1A in February, 2005.
5) Granted status of Permanent Residence and issued Green Card on September 29,2005.
6) Employed with The Employer from March 2006 to Sep. 2006 and got W-2 from them.
7) Changed job and Employed with (Employer 2) from July 2005 to July 2012.
8) In February 2009 he was interrogated by Immigration officer at Atlanta airport (while he was coming back from India) and they enquired about (Employer 1) and Attorney, the attorney who did the L-1 and green card application. Employer 1 and Attorney did fraud with some other candidates and showed fake jobs in their profiles. But my father-in-law actually did job and got W2.
9) The Attorney  was arrested by Immigration department and he is in jail.
10) My father-in-law filed N-400 (Citizenship applicaiton) August 2011.
11) Called for interview and test on January 18, 2012. Passed the test of English and US history and government.
12) On February 29, 2012 I got notice of Decision stating that the application is denied. He was given 30 days time to appeal.
13) An appeal was filed by anther Attorney (N-336) on March 2012.
14) Hearing was scheduled on August 24, 2012. My father-in-law appeared alone for the hearing without any Attorney and explained the truth to the officer.
15) On August 27, 2012 I got the decision from Immigration department denying my appeal.
 
As a result of her dads denial, she is kept on halt. But actually she was minor at time of entry in the US and she was not liable for mistake of Employer and Attorney. Legally she must get Citizenship.
 
Can you please suggest how can we go forward with this case and get Citizenship for my wife and/or my father-in-law ?
