K-3 Spouse Visa Process & ProceduresK3 entry and AOS/interview abroad

thanks all for the information and response.

Is the AOS pretty much a guarentee with the successful entry for a K-3, so the issue is simply the length of time and paperwork until the green card is received? It seems that with another interview, there is in our case a small risk of denial at the interview... the personel seems to be such a ####### shoot, I would almost sacrifice time and manage risk for sure, but longer, bet.

Much appreciated

There is no guarentee with AOS as there is no guarentee with Embassy/Consulor interview!!

I also entered on a K3 & then returned to England for my CR1 interview!!..............much faster way of getting greencard!!

My intuition agrees, I think the risk of denial at the CR1 interview is small. I am glad that I posted otherwise I would have submitted the package to NVC and expected she could do a AOS....

thanks all for the info.... just weaving my way.... sigh.

K-3 Spouse Visa Process & ProceduresK3 entry and AOS/interview abroad
We anticipate my spouse will enter the US shortly under the K3. Meanwhile we’ve received our I-130 visa package and are preparing the docs to send in to the NVC NH

As I undertand it, after the I-130 package is received etc, it will forward to her home country US embassy ( frankfurt ) where an intervivew appt is set.

If my spouse enters under a K3, then we apply for an AOS after the I-130 is granted? Is there an interview is she is here? Does she have to return to her home country for the interview.... Sorry for the elementary inquiry. Any help is appreciated

Thanks

K-3 Spouse Visa Process & ProceduresNext Action? I797 received

1. Depends on the length of time the green card was vaild for (2 year/10 years).

2. Greencard replaces ead/ap.

Thank you for your reply and information. It's interesting that I dont have any notes about anything action I need to take, but I distinctly remember a 2 year anniversary. Might schedule an appointment just to check.

Again, thank you

K-3 Spouse Visa Process & ProceduresNext Action? I797 received
Two Questions

1) I am trying to verify whether any next action is required, my spouses I 485 was approved 10/15/07. She has received her green card (I-797). Based upon my check with the USCIS recording this the last information, and no other action is required until the renewal of her green card in (approximately) 2012. At the I485 interview, however, I thought I recalled there was some requirement for action on her part at or around the two year mark after approval. Does anyone have idea if anything is required?

2) Just checking to make sure that the green card replaces the EAC which was only valid for one year. My understanding was that the EAC was an interim right to work and the permanent green card replaced the EAC.

Thanks in advance for anyone's input.
Ron
