Any Public Notary will do. The Consulate wants to make sure you are the one who signed the statement and know what it contains. A Notary will verify that you signed the staement, and by signing your name, the Consulate will assume you know what the statement says. By notarizing, the Consulate makes the statement a legal document which could be used in Immigration Court.

Marc Ellis is a lawyer who has helped many VJs and others with their cases at HCMC Consulate. He lives in HCMC. If you do a search of his name you can find out more about him.

Your attorney is correct, get the supporting statement to your fiancee ASAP.

I'm assuming you mean the bank statements showed your checks that you used for your trip to Vietnam. Your checks are secondary evidence. The receipt (acknowledgement receipt) from the travel agency or online site where you purchased the tickets is what they want to support your bank statement, cancelled checks and boarding passes. That way everything is verified by a third party. IE, the travel agency, bank and airline of your trip to Vietnam. Did you submit your hotel bill or temporary residency book (if you stayed with the family or friends) with your I-129f? If not you should also have that evidence available as they may ask for it once you submit what they currently have asked for. As I said before, now is the time to prepare for anything else they may want you to submit.

Hopefully you can get this resolved quickly and get the pink.

The Consulate has your original statement but the problem is they don't know that because they don't bother to look at your I-129f from USCIS. The instructions for your interview says to have the originals of all requested documents. The Vietnamese woman at the window is just following her procedures. You should have included another original statement even if it was copied from the copy. Seeing a copy of any document that the Consulate requires will get you a blue slip.

It might be possible to get the Consulate to look at your I-129f but I think they will wait until you submit another one. Write one ASAP and sent it FEDEX, DHL or UPS to her. If that is the only thing wrong, then you will get your pink. However, it's government standard procedure to return/reject at the first error. Once the error is corrected, they then start over again. If there's another error or something the Consulate feels they need more info about (ie, birth certificates of parents), then they will hand out another blue. It seems silly but several people on VJ have that problem of submitting one piece of evidence only to be asked for more. Now would be a good time to look again at your evidence, docs etc to make sure you don't have another blue coming, send any additional evidence, etc asap to avoid waiting for months.

Another possible idea is to contact Marc Ellis, He might be able to resolve this quickly if you can afford to hire him.

I'm confused..... blink.gif You have the travel agency receipt? Hmmm. You have the cancelled check. I'm assumming you photo copied the front and back instead of giving the Consulate the cancelled check? unsure.gif Did you give them the actual bank statement or a photo copy? You gave them the actual boarding passes? Do you have pictures of you leaving and arriving at the airport showing the dates, ie a newspaper?

According to the Consulates instructions for the interview, all evidence has to be the originals, not photo copies.Then I would call the Consulate and ask them exactly what they want. I would if you haven't already, get the actual receipts, cancelled checks, bank statements, boarding passes for the Consulate. Also I would get the travel agency to write a notarized letter stating they sold you the tickets, etc. As well write one letter yourself and if you have pictures of you coming and going to the airport as well as the other members of the family in the pictures, ask them to write letters that they met you at the airport. Then I would submit everything the Consualte asked for and whatever else you have that proves you purchased the tickets and actually were in Vietnam.

I can understand the feeling of being considered guility and having to prove yourself innocent. When I was standing outside the HCMC Consulate waiting for Thi to finish her interview, I felt much the same. Had we done enough to prove we had a real relationship? Was there something we missed? Etc, Etc......Fortunately she came out with a pink slip.

The interview process is unfair in the fact that your case is decided on how the CO feels about your case and the evidence you provided. Most of that feeling is based on the I-129f and the evidence you provided with it. The rest is what you turned in at the interview and in talking/questioning your fiance(e) for a few short minutes. The Consulate doesn't have the time or resources to research each case so they decide based on a loose set of rules and their "gut".

If you read about the entire K 1 visa process in detail, you see the Consulate has the final say on getting the visa. They admit that the process may not seem fair, but they also say if you can show them that they are wrong with proper evidence, they will approve your visa. Couples who have a bonafide relationship will get approved, it's unfair that some have to take days, months or years extra to get aproved.

There's little reason for the Consulate to press charges because they didn't give you a visa based on their feeling it's not a bonafide relationship. They know most fraud based K1/3 visas will not be appealed, disputed or refiled. The people will simply give up because their fraud could be exposed by closer inspection which would happen if they appealed, disputed or refiled. At which time, they could find themselves facing charges. Those who do have bonafide relationships have nothing to hide and everything to gain by appealing, disputing or refiling.

A large portion of the blue slips are given out because the required documents aren't submitted at the interview, proper evidence with the I-129f, lack of evidence for the interview or other instructions are not followed. When I was standing in line before Thi went into the Cosulate I was surprised how many of the women had no one with them and the lack of evidence they were carrying with them. Most of them had clear plastic folders that were less than an 1/2 inch thick. It looked like they had the required documents and little less. As near as I can could tell, most of them left with a blue slip. The few with thick folders or bags with evidence with them seemed to leave with pink slips. I'm not saying that having lots of evidence for the interview will mean a pink slip. My point is the preparation of the I-129f, documents for the interview and evidence is the most likely reason for the pink slip. Seeing women with lots of evidence at the interview leads me to believe, the rest of their documents. I-129f, etc are properly done.

The important thing to remember now is, you take the blue slip you got and submit the evidence they require. The most likely result is that they will give you a pink slip. While it's not the way you hoped it would be, the end result is still the one you want.

While going to HCMC Consulate in person now isn't ideal for you, I would suggest that calling and emailing now to the Consulate what they really want is the best next step. You need to make sure you tell to a Consulate Officer, not a Vietnamese employee. If you can talk to the CO who interviewed your fiancee. If you have given them evidence you mentioned in your post, there must be something in the evidence that has them thinking yours is not a real relationship.

Hiring a qualified lawyer is also a good idea but the Consulate seems to want to hear from you. I don't know why it happens some times but the Consulate will make it difficult for some couples. The good news is once the Consulate understands your relationship, they give you a plnk slip.

Well, she didn't get her pink again, yet she got another fing blue slip. This time saying that we don't have enough proof and need more evidence. Fair isn't the what the process is about. However, presistance and devotion to your relationship will resolve this in your favor. As I said in the other post you have about this, contacting the Consulate and talking to a CO maybe all that's needed. The Consulate knows most fraud cases aren't going to pursue thier cases. Somewhere in the posts here was a case where the Petitioner went to HCMC Consulate with the blue slip and waited until a CO would talk with him. He was there for the interview just in case this happened. It took hours but when he started to talk the CO, the CO looked over the case and handed him a pink slip on the spot.

Would anyone happen to know what the best way is of obtaining a visa to Vietnam? The last 2 times I went through the travel agency where I purchased the airline tickets but it took about 3 weeks to get. Also, where is the most cost efficient place to purchase airline tickets to Vietnam from NYC?

I got my visas from the SFO Vietnamese Consulate. It took about 3 business days. I sent it USPS Express and included a USPS Express paid envelope. I would assume the same turn around from the Vietnamese Embassy in Washington DC. You can download the instructions from their website

As to airline tickets, I searched the internet each time and found myself booking flights directly (thru my rewards program at Wells Fargo when I flew on United and China Airlines) and Expedia.com when I flew on EVA. It seems there isn't one cheap airline, the flight prices are constantly different.

If all the HCMC Consulate wants is the requested documents for a pink slip, you will get it anytime from the next day to 3 weeks. It depends on how busy the Consulate is and whether or not you request getting the visa sooner once you have the pink slip.

When Thi got her pink slip, her pick up date was a week later. Since I was there for the interview and had a return flight to the US on her pick up day, I called the Consulate the day of her interview and the next day before I got a CO who easily agreed to move up the date to the next day. That made it easy for us to return together to the US.

There's not a lot for you to do besides getting your I-134 in order. There's a lot for your fiancee to do. If you look at the guides, you'll get an idea of what she needs to do. The next event after the NOA2 is getting the Packet 3. Getting ready for that is up to your fiancee. In past posts are examples of what the Packet 3 contains. The sooner your fiancee returns the Packet 3, the sooner will be her interview. Once the Consulate has the Packet 3 from your fiancee, they will set an interview date and send out the Packet 4. The Consulate changes what is in the Packet 3 and Packet 4 so you should get in contact with those who have interviews before yours. They can help you with the "little" details that the Consulate changes that can delay your visa.

The better prepared and organized your papers and your fiancee is, the easier the interview and visa process usually is, but there's no guarantee of a smooth process.

Just remember you and your fiancee will be together no matter what.

No, neither is good. The green slip means that after the Consulate gets the requested evidence, they will take time to review what you have given them. A blue slip usually is a request for more evidence which when submitted could result in a pink slip. As long as the Consulate doesn't tell you that your case is going back to the US and the USCIS, you still have a pink slip possible.

The K1 visa process is two steps to get the visa.Then more steps once in the US to get permanent status. The USCIS approves the Petitioner's petition for sponsing the immigration of the Beneficary. That's usually simple, if you haven't filed for a K series visa before, aren't a crimminal or terrorist, etc, fill out the forms correctly and supply some info about how you met, you will be approved. The HCMC Consulate (or Embassy, depending on where your fiance(e) lives) decides whether or not the Visa should be given. The HCMC Consulate looks at the I-129f very closely. They can only deny a Visa if they find evidence not known to the USCIS that would caused the USCIS not to approve the petition or evidence of fraud on the part of the Petitioner or Beneficary. They don't accept the approval of the USCIS outright. An I-129f will little evidence about how you met and your ongoing relationship is a problem for HCMC.

There are many red flags that they are looking for. Not supplying a complete picture of your first meeting and proof of an ongoing relationship in your I-129f usually will result in a blue slip because the Consulate wants more information. Once given they then continue going thru the case starting from where they left off. That means they don't tell you with the first blue slip if that's the only problems they may have with your case. If they find other problems, they will issue another blue slip. Usually the second blue slip results in either a pink slip or green slip depending on the information requested. This is the normal mindset of the US government. One error and they stop processing. You then fix the error and they will continue to process untill either they are finished or find another error.

These blue/green slips are emotionally upsetting and delays getting the visa from a few days to months or in rare cases years. They can usually be avoided by starting with a solid I-129f with enough evidence to convince the Consulate that the interview is just a check to see if the beneficary is believable and the relationship appears real. The Consulate doesn't have the time or mindset to really check at the interview to see if all the ongoing relationship evidence is true or accurate. That's why many people at HCMC complain that the Consualte decided before the interview to hand out the blue slip. And why they only ask 5-10 questions at the interview.

They have already made up their minds based on the I-129f and supporting evidence given with it. A blue slip is usually because there isn't enough evidence to convince the Consulate about an issue, ie how did you meet, is this a real relationship or not? If you come to the interview without the required evidence in the proper form, ie originals not photo copies when required or only a couple of pictures and emails, you can turn your pink slip into a blue because they have to have the correct evidence and believe your relationship is real. Too many photos, emails, chats, etc aren't the problem, it's not enough evidence.

I can't say if this is true about other countries, but from what I've been thru, read and seen on VJ and other sites, this is the case at HCMC Consulate.

Sorry to hear that you didn't ge the pink. The Consulate is requesting what appears to be missing from your I-129f. Since HCMC is a high fraud Consulate, they are very suspious. A short letter like you wrote is ok for the USCIS but the Consulate wants a complete description of your relationship. That's the good news.

If you write a detailed letter about how you met answering the Consulate questions in the blue slip and follow that with a timeline with evidence showing the developement of your relationship, then you should get a pink.

The Consulaten looks at your I-129f before the interview and decides a lot about what they think about your case from it. So if you can think of anything now that could be a problem. For example, many Vietnamese Americans have to provide their parents and their fiance(e)s parent's birth certificate to show that they aren't related. When the Consulate asked for additional proof, they will usually want everything to be notarized.

For Thi's Interview, I was over there because I wanted to be there if anything happened, ie got a blue slip, only US citizens and residents can talk to the Consulate Officiers. If Thi had gotten a blue slip, I was planning on immediately addressing it and talking to the COs. I also had been emailing the Consulate about her interview and in the emails stated I would be at her interview, knowing of course I couldn't go inside. While I don't know if that had any effect, she did get her visa on her interview day.

As to getting the Packet 4 info in your email, I'm not sure about that. But our interview was Feb 2008 so things could have changed. However it is possible to pick it up at the Consulate. Knowing the Vietnamese mail system, that would be what I would suggest since the Packet 3 didn't arrive. If she's unable to get to the Consulate to pick them up and the Packet 4 info you got is complete and printable, I don't see why not. However I would contact the Consulate about that to be sure.

Here's what the USCIS website says:

"Customers who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving.

The law requires nearly all non-U.S. Citizens to report a change of address within 10 days of moving by completing a Form AR-11. Abiding by these legal requirements and completing the necessary forms does not update an address on any applications or petitions pending with USCIS. Non-citizens with pending cases must do both.

Most customers can now notify USCIS to change their address on a pending case online here on our website. Non-citizens can also now complete the Form AR-11 online here on our website.

If you choose to change your address online using our Online Change of Address Notification tool, you will need to have some information available. Please have the following information available before you begin:

* Your receipt notice or other notice we sent you showing your receipt number (if you have a pending case with USCIS).
* Your new address
* Your old address

An AR-11 Change of Address does not require a receipt number. You can submit your change of address for a Pending Case if you have not yet received a receipt number for your application.

Check: You can update your address using USCIS' Change of Address Online. This requires your receipt number. Look at the back of the cancelled check that was returned to you through your bank. On the back is the 13-digit USCIS receipt number which looks like this (but will have different letters and numbers) ABC 01 23456789 Use your 13-digit number when you are asked to input your receipt number in your change of address.

Money order: You can report your change of address by calling USCIS Customer Service toll-free at 1-800-375-5283, and a USCIS Customer Service agent will enter your new address for you."

That sounds to me like you should fill out the AR-11 now. Then call the USCIS to make sure they got the address update and about having to fill out I-865 (Sponsor's change of address for people who filed out I-864 affidavid of support). You may need to also fill that out.

As another poster has already pointed out, everyone should fill out their timelines. By doing so, others can see how long it takes to get from one stage of this process to the other. The software on this site then can give others a more accurate picture of how long things are taking now.

You can see from our case (timeline below and on the link to the timeline page) What happened and when. There's no cut and dry schedule as people who filed the same day can get approvals, interview dates, etc at different times. But you can get an idea from looking at ours and others.

Congratulations.

While there's not much you can do to ease her fears before the interview, being there will help her a lot if you can be there.

Now is the time to start preparing her for her interview. If she speaks English well, that's would be great, if not, she should try to learn as much as possible before the interview. There are many times when the translator screws up the interview and if she knows English well enough, then she can catch it. If she can answer the questions in English, even if she has to hear the questions in Vietnamese that would help avoid confusion. Thi did that in her interview partly because the translator woulldn't wait to see if she wanted a translation. The American CO was able to understand her just fine.

Also now would be a good time to start getting any and all evidence together for the interview.

Tell her she has everyone here ready to help and wishing the two of you success!

She has to sign the document even tho you have filled it out for her because she is the one immigrating to the US. The DS-230 . It is a legal document. Without her signature the US government will be unable allow her into the US. The Applicant (her) is responsible for the imformation contained in the DS-230. If fraud is discovered, her signature on the DS-230 will used in the case against her in US Courts as she has signed the DS-230 to immigrate and swore that all info in it is true and correct.

For most people it's just a signature to complete their journey so they can be with the one they love.

Parent's birth certificates are required only when there is an issue about you and your spouse being related. You are a Native born US citizen so there is no question about relatives. The HCMC Consulate is concerned that relatives may pay each other to bring relatives into the US so they are interested in how related you and your spouse are if you are Vietnamese American and she is Vietnamese. However they don't ask for them in every case, only when they suppect something.

The USCIS and HCMC Consulate don't state where go to get documents that must be translated. We had ours done in Vietnam because it was much cheaper than in the US. Thi went to KHA Translation Co where we got 7 documents translated for 330,000VND. They included their seal on all translations so I'm assuming it meant they were notarized. The USCIS accepted them and approved our petition without RFEs.

You should have records of changing your name. You need to find them in case the USCIS or Consulate asks for them.

You should call the HCMC Consulate. It's not the first time that HCMC Consulate has not mailed things out or the mail system in Vietnam is doing what it seems to do a lot, be really slow and able to "lose" mail. The medical exam only takes one day to get examed and one day or so for results. However if IR-1/CR-1 are like K visas, Cho Ray Hospital won't let you make an appointment without the letter.

For a K1/K3 visa, the HCMC Consulate uses IOM or the ChoRay Hospital for the medical exams and the Quarantine Service Of HCMC for the vaccinations. I think they use the same places for IR-1/CR-1. Also you should be getting an Instruction letter that details what you should do. Tyrobe also has an interview coming up so he might know for sure.

You should contact the HCMC Consulate to tell them about the change. I would suggest email since you have record of you asking about this and their answer. In a K1 visa, the Consulate is very fussy about income requirements and having the correct paperwork. They may be as fussy about paperwork in IR1/CR1 cases. With HCMC Consulate it's better to ahead of the game then behind so while you want for their answer, prepare the correct I-864.

You should get the required documents to the Consulate ASAP. Make sure they're complete and accurate so you don't get another blue slip. Once the Consulate has them, they will continue to process your case. That means if all they needed was the documents on the blue slip and they're satisfied with what you submitted, you wil get a pink slip. The pink slip could come on the day you submit the docs, they look at them and hand you a pink slip. Or they may want to review them for anywhere from a day to several months. Once you give them the documents, they will tell you.
