IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsFebruary 2013 I-130 Filers

For now, it's better because it goes fast but when we'll have to prove that my husband intends to re-establish domicile in USA... I think it's going to be harder... We only have a letter from his parents stating that we can stay at their place + his french visa expiring in march 2014... He has absolutely nothing on his name there, not even a bank account. We might get an RFE... We'll see :)

There are banks in the States that allow you to open an account online. I think that there are a few threads dealing with it. Enter your search terms in the search box and there should be some information that pops up. Also, does he have a drivers' license? And unexpired license can be included in your package. Good luck!

I got an email today saying it had been sent to NVC! When will you start calling them to see if they've received it? In like a week or so-ish?

It's recommended that you wait about a week and then start calling every day until you get your case number. Congrats on your approval!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsFebruary 2013 I-130 Filers

Thanks! I will definitely post all info. I didn't even know we would check our status online! How do we do that? After the NOA1? I'm kinda hopeless at this whole thing!

Once you receive your NOA1, it will include a case number. That case number will MOST LIKELY start with the letters MSC (since you are filing from abroad). Go to www.uscis.gov, and enter your case number on the home screen. Once you've entered your case number, you will be able to create an account (it's in the menu on the left of the screen) and sign up for text and/or email notifications on your case. I highly recommend doing so as soon as you've got that case number in hand. And don't worry if you can't see your case status...it doesn't mean that it's not being processed. And I know of at least one case here wherein a USC's spouse has now gone through Naturalization...and their case still reads Initial Review! :bonk:

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2013

DHL just delivered my IV and AOS Packages . When shall i start calling NVC to know if its in the system ? When do u think both packages will be reviewed ?
I miss calling NVC everyday ,lool

I'm in the same boat as you. Both packages will be there today. I was thinking to start calling Friday or Monday. Then maybe everyday after. But I don't know if that's to soon.....

It's been taking about a week to 10 days to get the packages reviewed. You probably won't hear anything until AT LEAST early next week, but I'd call every day until you get case complete. Good Luck! Posted Image

WOOHOOOO!!!! Sorry for yelling. Congressman Liasion had USCIS send a copied file. NVC acknowledges receiving it today just not in the system. After 2 months and 2 days, I'm back in the game. Stress level decreased enormously.

This made my heart sing! Congratulations! Posted ImagePosted Image

A little confused..when I called the NVC they said they have received my file and will contact me when a case number is there.. They don't have an email for me, should i ignore them and keep calling?

Ignore them. Call every day until you get your case number. It's taking a couple of weeks right now, but keep calling until you have the information you need. Posted Image

K-1 Fiance(e) Visa Case Filing and Progress ReportsJust over 7 months and have finally received our NOA2!!! Can somebody clarify for me what happens next!?

Congrats...it is such a long wait...a horrible wait...by the way, way to go Sineadx and Ryan and Amy!!!!!...Some on this website like to "Lord" over everything and condescend to anyone who just has a question. Everyone who gets approved are just excited and (speaking for myself), I find this website quite the task to navigate...not very user friendly in my eyes.

I have to say, I strongly disagree with both of these statements. Sure, maybe a poster isn't going to sugar-coat a response, but then again, I'm not looking for glad-handing. I want a usable answer. Every time I've had a legitimate question, I've had excellent responses and not felt condescended to at all. The guides that are in place are there so that the forums don't get choked up with people asking the same basic questions over and over, which in turn would make the site more difficult to navigate. The search bar allows for very specific terminology, allowing the user to weed out unnecessary threads. It's been an incredibly useful tool for navigating this process. I'm also very grateful to the "long-timers" who still pop in to the forums to share their hard-won experience. I certainly think it's made the process considerably smoother for my husband and I. I was able to research each step of the process extensively and am hoping that I'll have case closure at the end of the week.

OP: I, too, have a year-old baby. Well, 13 months, if you're going to get technical. They just get more and more fun, don't they?

IR-1 / CR-1 Spouse Visa Process & ProceduresHorribly Confused about DCF!
Hi, everyone!

DH and I have just started our process, in that we haven't even sent off our I-130 yet (I'm getting everything together for mail-out next week). I've been reading posts on this site for the last day or so, and I have to say that it's all been helpful. I've been living in Co. Kildare for a little over a year now, legally, and we are hoping to be in the States sometime in the next 6 months to 1 year. Here's my question: do I start all of this by sending our packet to the Chicago lockbox or are we eligible for DCF? I looked around, but the different sites seem to be contradicting each other! Any and all help would be greatly appreciated!

Thanks, y'all. It seems to be a minefield, especially if you're not working. We got delivery notification today or our packet arriving in Chicago, so we're hoping to get this show on the road shortly. I'm sure I'll have a million more questions as we go through the process, so I'm so grateful to you all for being such an invaluable resource. I'll make sure to keep the timeline update, so fingers crossed, please!

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint Sponsor Question, Please Help!

I know what you mean by being self-employed, damned if you do and damned if you don’t. This is the damned if you do case, do not forget Government agencies share information with the IRS they may want to know where his assets came from.

Oh, his assets are all right and tight, stocks and accounts payable and whatnot, it's just that since he's the owner (and only employee) he files taxes for the company, and that shows negative income. Since he's got assets that will cover the requirement, I just want to know if he should submit only a personal financial statement or if he should include his tax transcripts as well with the packet. Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint Sponsor Question, Please Help!
Hello, All.

I am a USC residing overseas with my Irish husband. I haven't worked since I moved here in August of 2011 and have no plans to return anytime soon, since I stay home to take care of our daughter. My dad has agreed to be our joint sponsor and has sent the request for his (and my) tax transcrips. My question is this: my dad owns a residential construction company, so his taxes show him making a NEGATIVE amount of income. He has assets that are sufficient to cover the requirements, so should he submit a personal financial statement with his tax information, or can he just submit the PFS? I don't want any confusion over his suitability as a sponsor, but I don't want a RFE, either. What is the proper course to take? Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresExpatriate Filing with No DCF Available
Hi There!

We are also just starting our process (got delivery notification of our I-130 packet today), and I (the USC) live abroad with my husband in Ireland. We used our foreign mailing address, and only listed my parents' US address as the address where we intend to live once we're in the States. I've read somewhere on this forum that some of the packets filed from abroad are being expedited, so we crossed fingers and hoped that it would happen for us. Good luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresImmunisation Records: Currently MIA. Help!
Hello All,

I am the beneficiary of my wife's (MeredythB) petition. We live in Ireland. My mother cannot find any immunisation records for me. Obviously, I know when I was born, and at what hospital, but not what doctor I went to for injections. Does anyone know what steps I can take to find these records, or should I visit my GP and ask for a second battery of shots? Can I have a titre test done to determine what antibodies are in my blood, so that I might have a record that way? Any help would be appreciated.

Regards,

IR-1 / CR-1 Spouse Visa Process & ProceduresI130 payment options from Ireland
Hi!

We filed in November from Ireland, and I used my American bank account. I've seen other couples who have sent the package to a family member to have them include a check before sending it along to the Chicago lockbox. The check or money order must be drawn on an American bank, so check with whomever you bank with to see if they have any options for you. I think Western Union does some business here? I hope that helps.

Good luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS-Looking for Clarification
Happy 2013, Everybody!

So here's my question: I haven't made enough in the last two years to qualify to sponsor my husband on my own. However, I had some income based on a rental property, which I've recently accepted a sales contract on. The money I get at closing will not be enough to satisfy an assets-based sponsorship, either. I've also recently started a job, which WILL put me in the acceptable range. I'll be able to provide pay stubs starting on Friday. Since I'm now able to provide proof of income above and beyond the acceptable limits, will I need a sponsor because of my previous tax receipts showing totals under the requirements? Thanks for any assistance!

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling from abroad?

What do you mean by proof? As in a joint lease or something? I def did not submit anything like that as our accommodation is provided from my husband's company so nothing is in our name.

Not a bank account, utility bill, or anything? Did you have stamps in your passport or an immigration card showing that you were living legally in your foreign country? Possibly life insurance, a car loan, or credit card bill showing both names with a foreign address? That is what I am referring to.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1 visa. Petitioner allowed to attend interview?
There is a review from Dec. 20, 2012 that states that the petitioner accompanied his spouse to the embassy but was not allowed in for the interview. Looks like you'd just be sitting and waiting for him. I'd call the embassy to confirm this, though.

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting ready to start the process for CR-1
As long as you acknowledge the previous application, it shouldn't be a problem. It's when you try to hide previous applications that you really throw a wrench in the works. You could include a copy of the canceled stamp in her passport and the email from the embassy. Include the statement from the credit card, showing both names, pics, and the affidavits from your friends and family, attesting to your relationship, the stamp from your passport showing your visa to be in Brazil and your re-entry into the States (since it was an extended visit) along with your marriage certificate (a copy), and you have some good proof of a bona fide relationship. Honesty is key. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Certs: How many are needed?

Police in okinawa told my wife they need some form from the NVC to get her a police crime certificate, Yomitan village to be specific.... I told her to go in and get them to give them to here any way she could....I am not aware of any form that she would need to give them to "authorize" them to do a cert.

Anyone know or heard of this #######?

Follow this link and select her country from the drop-down list. It goes on to say where she can apply for her police certificate. NVC does not have a request form for police certs. She may have to go to a larger city in her district. Good luck to you.

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Certs: How many are needed?
I believe that it's members who are doing EP (electronic processing) and maybe(?) DCF (direct consular filing) that have to bring original police certs to their interview. Your wife should make two copies of everything sent to USCIS and NVC, so that she can provide the CO with copies of anything they request, but you should only need ONE set of original police certs, which will be sent in your IV package. Hope this helps.

Good Luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding Beneficiary Employment
Speedwell has hit the nail on the head. It's not necessary for the beneficiary to be employed in order to get a visa. The only financial requirements that the CO is concerned about are the PETITIONER'S requirements. If your wife is being harassed and it is not a hardship for her to be unemployed, there is no reason she should stay in her current situation. Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresINTERVIEW!!
Check with the embassy first to make certain that you are allowed to go to the interview. If they allow the USC spouse to attend, go if you think it will be in your interest. Some embassies allow you to attend (as in, sit in the waiting room), but not be present at the actual interview. You can call or email to find out what your embassy allows. In many circumstances, it doesn't HURT that you are there. I am planning on going to my husband's interview in Dublin when we get to that point.

I see in your timeline that you've just received your NOA1. Try and relax, as this process is a marathon, not a sprint. If you allow yourself to get this worked up so early in the process, you'll go crazy. :D

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864

I'm sorry but on the I-864 instruction (chapter 29) it says :
"the difference between your total household income and the current poverty guidelines for the household size. However, of you are a US citizen and you are sponsoring your spouse or minor child, the toal value of your assets must only be equal to at least three times the difference"

and here (I can't post link !!) on the USCIS website "Home > Green Card > Green Card Processes and Procedures > Affidavit of Support":
it says "The minimum cash value of assets must be three times the difference between the sponsor’s household income and 125% of the federal poverty guide line for the household."

There is a big difference !

Yes, you stated that your wife had US$0 income. So in order to qualify based on assets, since she is sponsoring you (her spouse), you will have to show assets in the amount of 3x 125% of the poverty guidelines for a family of 2. 125% of $15510 is $19387.50. You will need 3x that amount, or $58162.50. Truthfully, it would probably be better to have more than that, just to be on the safe side. Or, you can get a joint sponsor.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864

Hello guys,
My wife and I just got the NOA2 (I130 approuved) from the NBC very fast. We are now waiting for the package from the NVC.
According to the VJ guide, we need to fill an I-864. I read about it and it look very tricky to me...
Here is my plan :
My wife (the I-130 petitioner) will fill the I-864, we live together in France so we can't show US income. So we need to show sufficient assets.
We need to show "three times the difference between the poverty guideline and actual household income." which means :

100% poverty guideline (for 2 people) = $15,510 - US income (0$)
$15,510 x 3 : $46530

I do have it on a bank account.

So my wife will be my sponsor and I will use MY assets.
1)Is it a problem if she isn't residing in the US currently ?
2)Do I need to fill an I-864 or just evidence of my bank account ?

Thanks for your help.

You don't need to wait for a package from NVC. Go to the link below, as it has loads of useful information. It will help you get through this next stage. Oh, and you'll need 3 times 125% of the poverty level to use assets to qualify. I think it's around 19k for 2 people, so close to 60k total. Good luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresStupid questions about I-130 question, please forgive simple question.

Thanks for your response. Silly me, I'm looking at the G-325A. The Bio. File Number and it has an A, so I'm guessing it's the Alien number like you're saying, and I don't have one of those..

Ok I will just note all previous residences I've lived before now and it will just be nothing as of Feb this year :) Hope that won't make me seem odd.

Thanks for your info.

As far as your previous residences are concerned, blank spots aren't great. My husband traveled some before he moved home for good (for about 3 months). Instead of leaving a blank spot, he put his parents' address in Ireland, since that's where his mail was going and his stuff was. That may be an option for you, if applicable.

IR-1 / CR-1 Spouse Visa Process & ProceduresStupid questions about I-130 question, please forgive simple question.

Top line, after DOB and nationality, 'File Number:'
What's this? Why would I have a file number? Is this filled in by admin people? Please help let me know if anyone is aware.

Also, I'll be in the US while we file my I-130 and will leave in a few weeks, but we're filing before I'm gone. Under residency for past 5 years, should I note down my current location, since on I-130 I will be declaring when I'm leaving the US.

Lastly, under List Past Employers, has anyone else come across the problem that there's not near enough room to write employers name AND address in full without running out of space? I want my form to be perfect so things like this make me anxious to have looking messy.

Thank you in advance. :crying:

Hope this helps.

1. Are you asking about the Alien number? You don't have one, so it would be "NONE" or "N/A". I'm looking at our I-130 and it doesn't have "file number" on it next to DOB.

2. They want to know your legal residences for the last 5 years. Official residences. Not where you visited.

3. Use up the lines that are available, then continue on a blank sheet. Put "CONTINUATION" at the top of the sheet, put the question number, and continue filling out the information.

Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresA certain co-sponsor requirement.

Ok, some of you may know I am an American living in Russia, me and my wife have been married for 2 years coming on March 3rd. But we have been trying to get a co-sponsor back home so we can finish this process, it is all that is really left.

But I need to know the requirement that the co-sponsor needs to make.

I know it is 125% above the poverty line, but I am getting $13,900 and the wife is getting like $18,000+ (estimate)

The thing is, is that we dont know which one is correct. We do not plan on living in the co-sponsors house or anything like that.

We have everything planned when we get home, we are just looking for someone to sign the papers who can meet the requirements and we will do the rest, but we need to know what that actual requirement $$$number is.

Any help is appreciated :)

Does your co-sponsor live alone? If so, he/she needs to make enough for 2 people ($19387.50).
If married, enough for 3 ($24412.50).

Basically, what your sponsor needs to clear is 125% of the minimum required for the number or people in his/her household PLUS your spouse. THAT is the number you are looking for.

Hope this helps.

Is your medical extortionate? I'm trying to figure out if it's a Europe thing, or an Irish phenomenon. IR-1 / CR-1 Spouse Visa Process & ProceduresEXPENSES

hi guys!

i would like to ask if you can help know how much it would cost to petition for a spouse IR/CR visa from the Philippines. From start to finish. estimate total. thank you so much.

:help:

The fees for the different applications/packages total $738, if you're only applying for your spouse. Then there is the new green card fee of $165, for a total of $903. That does not include fees for police certs, original documentation that you may have to apply for, your medical, shipping costs, copies, etc.

We are applying from Ireland. Our total, WITHOUT plane fare, will be around $1500.

Having US Citizen baby can effect the processing time somehow or no, Does anybody here got approved with USC kids and how long did it take, Same like other petitioners or much shorter?
any respond will be appreciated,

The only thing that having a baby that is a US citizen MAY help with is helping to prove that you have a bona fide relationship with your spouse/partner. It does NOT guarantee anything. However, if you and your USC partner have had a child, and have either done a CRBA or the child lives in the States, that child's birth certificate or CRBA certificate can be included as evidence of a relationship with the I-130 packet.

My husband and I have a little girl. We included her CRBA in our packet. We got approved in a little less than 7 weeks, but I'm not certain that having her CRBA included made much of a difference, as we had loads of other evidence as well.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed help with few sections of I-130 / G325A

Now what I'm missing here is the following information as I'm unsure of what I need to fill in those blanks...

Starting with Form G-325A:

1- The section on the top right hand corner of the paper "File Number A" do I leave this blank or do I fill in my old Alien Registration number?
2- Applicant's Residence last five years. List present Address first. (I been living at my parent house for 5 years and half, but I want this process to go through a P.O Box that I will be buying just in case I leave the house and rent an apartment for me and my wife, so how can I file that P.O Box as a return address, what should I write and where?
3- This form is submitted in connection with an application for: (what should I file here exactly? I read few examples that says *Others* Petition I-130* and some other examples say *Status as Permanent Residence*) so which one is more correct to choose?
4- Work name and address, do I need to file full address or just include city name? like "MB Development, Miami" or full address of the company I work with?

Now going for next part Form I-130:

1- Question #22 in the form, about the adjustment of status, I know Belarus and USA diplomatic relation is broken and they don't process visa or interview in Belarus, and closest embassy over there that does this work is located in Warsaw, Poland... So do I fill in Warsaw Poland, or do I keep it blank? (N/A)

And finally her son petition, I include almost identical information of passport copy, birth certificate, single mother, letter explaining parent situation, 2 photos of him, 2 photos of me, my passport copy, my birth certificate copy, money order of $420.

Thanks for your time and I hope I get a quick response so I can be done with this long mission and not waste anymore time!

1. If you are a citizen, you leave this blank. You are no longer an alien. Your wife and stepson would fill this space in with "none" or "n/a".
2. This question is for your residence, not your mailing address. Put your parents' address. A PO box is not a residence.
3. Other: I-130. You are asking that your wife and stepson be given a family-based visa.
4. We used full addresses. If you run out of space, use a blank sheet of paper, label it "Continuation", and give the question number.

I-130

1. Are your wife and stepson in the US? This question is directed to applicants whose spouses are already residing in the States. Put Warsaw if that is the closest consulate that processes visas, but it is not a guarantee that their applications will go there.

I don't pretend to get every answer correct, so I hope that you'll have additional members chiming in. However, I hope this helps. Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat should do after case completed at NVc
Normally, if you have your NOA2 or your interview letter, that suffices for medical. Check in your country's portal for information.

:time:

Hope this helps! And congrats on your complete!

IR-1 / CR-1 Spouse Visa Process & ProceduresAPPROVED FASTER BECAUSE OF LIVING ABROAD?!

Dont be calling me no troll..

Thats f'd up attacking me when i didnt say nothing about any of yall

The reason i said the richer get richer and poorer stay poorer is because its the same concept

If your overseas and living with your wife/husband and getting your visa processed faster .. Thats a Plus on top of another plus

IF you live in the USA and live far from your wife/husband and get your visa processed slower.. thats a Negative on top of another negative

Hence richer get richer poorer get poorer

And yea I do live in the US yea my typing and grammer is bad.. But you know what im talking about . You dont gotta attack sombodies handicap cause i didnt do well in english when i was in highschool.. I apologize i was one of those kids in school who got kicked out of class for joking around and thinking my popular status in school was more important than education. I regret that now but i cant go back in the past.

So i guess im the only one who agrees people living abroad and people living in the USA should have the same processing times as the others

You mean the entire thread you started (that is now locked) stating that American women are lazy, useless, grasping beasts that basically trade sex (I believe you called it "showing a t*t") in exchange for being supported by their husbands WASN'T supposed to be offensive to me, an American woman? Who, by the way, worked full-time, supported herself completely, bought her own house and car, and struggled with not having an income when I became a stay-at-home mom, something that my husband and I decided together, since child-care costs are prohibitively high here? Oh, I also cook him dinner every night, make sure his laundry is done, entertain his parents once a week, do the lion's share of the housework, and work in the family business to help meet our visa and moving costs. Sorry, must have misunderstood.

As I've said before in this thread, other applicants' progress does not come at the expense of yours. So this blaming attitude isn't helpful to anyone. We come to these threads for support, not to be vilified.

Are you F***ing kidding me?!? Who are you to say who should take longer to get processed? And how many times has it been mentioned that overseas filers make up a TINY percentage of immigration that it doesn't even affect the process for anyone else? Or are we just looking for a punching bag?

Also? Their, NOT "there"; theirs NOT "there's". Are you sure you live in the states?

You should really do some research and inform yourself. Ignorance of a situation doesn't improve either your outlook or the result.

Y'all, I have read some of this guy's other posts. Don't waste your breath. Troll.
