K-3 Spouse Visa Process & Procedures20 YR OLD MARRYING 17 YR OLD
ya know... as something to think about... these agencies find any excuse to reject an application. My advice is that she is almost 18. If you could wait it out a bit, it may save you many headaches. The entire process has taken 6 months for me. For others, it has taken longer. So waiting and having patience is part of this all. If you can wait it out till her 18th Birthday, it may be a smoother ride than if you go this route, but then again... it may be just fine. But you must comply with all US laws. Also, I would check her countries laws, because you said you will get married there. You do not want to end up in jail in a foreign country. I know most countries around the world have the legal age to marry set at 18, and if you are under that parental consent is required. If you are coming under a K1 visa remember that parental consent changes between states. Some states require both parties to have parental consent in the form of notarized copies of documents, court visitations, counselors, the list can go on. This might be a complicated case, and my advice would be to just wait a little. You are not guaranteed a visa. You make the case complicated, you are setting yourself up for delays and possible denile. You might want to look into the laws of the country where you wish to be married.

In a case like this, I would say that doing things by yourself would be quite risky. Most visa cases do not require the assistance of a law professional. But, I do think that professional legal advice would be your best bet if you decide to move on with this case unless you have a great understanding of the laws of your fiancee's country and the US.

Another thing to think about is this. I know that when a US citizen travels to another country, he is required to comply with all US laws.

The United States has laws that prohibit sex with minors in other countries and has greatly increased government efforts to combat this problem. Under the Protect Act of 2003, United States citizens or residents who engage in sexual activity abroad with a child under 18 can face 30 years in a U.S. prison. U.S. Immigration and Customs Enforcement is now actively investigating American sex tourists abroad and making arrests.

Remember that when you are going through your interview process as well. Just some things to think about. You do not want to find yourself not complying with the law and finding yourself in prison when what you really had was a legit relationship with a girl you love. Thats why I would suggest that you wait till she is 18 to begin this process.

US Embassy and Consulate DiscussionFaxing packet 3 before recieving it from warsaw embassy
I tried to e-mail the embassy about what the priority date was... so far no answer just an automated response.

If you know what to put for priority date, that would be great! I will have my fiancee send the WRW-1 via email.

Also, It is not required the DS-230 Part I so I am thinking to tell her NOT to email it with the WRW-1. Would you also say its safe to e-mail the WRW-1 when I know the NVC has sent the petition to Warsaw?

US Embassy and Consulate DiscussionRegarding I-134 income requirement

Correct though GUZ can and has requested the IRS returns to prove what is on the form. Consider that the interviewing officer is part of the immigrant visa unit, and tends to use the financial evidence requirements of the I-864 with the I-134.

The sad part is the most important key figure in the entire interview process... the interviewing officer has total discretion over the case. Because you were able to furnish 100% of the items in all the forms and whatever else they asked of you... they can still reject your case based on some other issue not having to do with the I-134, or just delay the entire process longer if you have a weak case and come up with some lame excuse why you did not get your visa.

Again... having more might be better, but sometimes having too much might throw some red flags, and difficult questions for you to answer.

US Embassy and Consulate DiscussionRegarding I-134 income requirement

Guangzhou has different standards with regard to evidence needed for I-134

Using the following url to the OF-167, http://guangzhou.usc...w/3._OF-167.pdf, I noticed that it is the same OF-167 (or should I say similar without the foreign letters) for my case with the Polish Embassy in Warsaw.

If you read it, again.. it clearly states under the AFFIDAVIT OF SUPPORT section that "(Sponsor) should use Form I-134, Affidavit of Support..." The next sentence explains your other option if you choose not to use the Form I-134... "Sponsors may also elect to furnish a statement in the form of an affidavit sworn to before a notary... bla bla". Then it goes on to explaining what the sponsors affidavit should include.

Finally, now to what you quoted:
"To substantiate the information regarding income and resources the sponsor should attach two or more of the following items to the affidavit: ... "

It all seems clear to me that these are items to be included in the case that you decided to take route two and make your own statement in the form of an affidavit. They were making clear instructions to what you should include in the case that you did go that route.

Any other takers on this one?

US Embassy and Consulate DiscussionRegarding I-134 income requirement
I would like to mention something...

I read the instructios on the I-134 and it is very clear what supporting evidence it is asking for. For one, it does not mention anything about tax papers unless you are self-employed. The only other two sections ( A and B ) clearly state the following:

"A. Statement from an officer of the bank..."

"B. Statement of your employer.."

I really think you can add all the additional evidence you want, but sometimes having what they ask for is enough. If you have a job making 50k a year... and a letter from your employer showing it... you are clearly well over the 125% povery requirement, and you are supplying the exact document stated in the affidavit instructions.

IF my fiancee gets to the interview and they look at the affidavit I supplied her with... and they claim that I did not supply enough evidence when I supplied then with my bank papers showing well over the 125% requirement sitting in a saving account, and my job which pays well over double the 125%... I don't think even the issue of being a new hire from 8 months ago will matter much. What do they expect if you just follow instructions?

By the way... good thing I read this post... I sent my originals of all the evidence to my fiancee... and now I will have to tell her to make two copies of everything because I overlooked the word "copies" and "in duplicate".

My question to the veterans around here is... what did they ask of you at the interview? Did they say, "Please show me your I-134 and evidence... wait, I need more than what it is asking for even though you meet the requirements." ?

US Embassy and Consulate DiscussionDS-230
My first guess... N/A would be more correct. Because it is just not applicable to you.

Answering NONE would be more appropriate in a question asking for an amount. Like... List the jobs you have had in the past 49 years: NONE. Another example... how many children do you have? NONE

Imagine none as if nothing.. and not applicable as it is just not capable of being applied.

If I did not confuse you any more than you were before, thats good :)

US Embassy and Consulate DiscussionFinancial situation - fears before interview
Update to the "Financial Fears" I had before the interview... I was worried that I had enough supporting documentation... Well... They didnt even ask my fiancee for the documents. They took the I-134 before the interview and said "keep the supporting documents"... 1 question into the interview she was told to pick up her visa the next morning. done. I have a feeling the US government had done their homework already prior to the interview.

US Embassy and Consulate DiscussionFinancial situation - fears before interview
Well... if the sponsor has a family of 3 (including themselves) and you and your fiance will make up another 2.. that makes 5. Your sponsor is responsible now for a family of 5. The chart shows that a family of 5 would require support of $30,163 to be 125% of the poverty line for a family that size. About the documents required. I submitted the exact documents the instructions asked for. The I-134, my employer letter stating the exact information they asked for, my bank statements, also bank statements showing when my accounts opened and what type of accounts they are, and I included a few pay stubs to show exactly how much I get paid and when. I added the last few things as an extra. I hear sometimes they dont even look at the supporting documentation. So having too much is ok, having too little is ok... having too little when they ask for too much might make having too much look good :) hehe I just played with my words.

US Embassy and Consulate DiscussionFinancial situation - fears before interview

We got ourselves a sponsor, with income well above guidelines (guidelines are $43,213 and sponsor's income is $72,000) and I am hoping it will be enough.

$43,213 is 125 % of the Poverty level for a family of 8. So I am guessing your sponsor has 6 other people including themself to support? Anyway, $72,000 is way beyond the $43,213 requirement for a family of 8. I do not see the concern about financial support? Fill out the right paperwork and you should be alright. The 2007 guidelines are listed here if you need to double check -> 2007 Poverty Guidelines

US Embassy and Consulate DiscussionVisa DENIED - Help!

No visa...

I hate to play devils advocate... but I believe they give that excuse when they have found other reasons for not giving approval for the visa. I would just follow the steps required to fix this doubt that the embassy might have had at the time of the interview promptly if you truely love him, and want to be together. Unfortunately, the interview is the last and only time the US is able to verify the legitimacy of the beneficiary. From what I read on this forum, and from personal experiences now... it does not seem so difficult to have an unsuccessful interview. If this is an honest request for further actions on your part by the embassy... just do it, and the visa process can move on.
iamjasonbunchMaleLatvia2007-06-29 20:23:00
CanadaWhich documents can I expect they will keep at the interview?
At my fiancee's interview yesterday... They kept the certified translation of her birth certificate. They also took the medical exam (original and sealed), original police certificate, and thats about all the original stuff they took. I tend to think that my case is more unusual because they took a copy of the I-134 without even copies of the supporting documents. Anyway... you should get certified copies of your birth certificate to take with you to even the states. They will be needed along the way.

About loosing the passport.. I was a bit worried about my fiancee leaving her passport for even the few hours that she needed to the following day after the interview because she was in a different country than her own, and thats all shes got for ID. She was to report at the embassy in the morning at 7am and then went back a few hours later to pick up her passport with the visa inside. It seemed to work out just fine. I could imagine the fear of leaving your passport somewhere. I wouldnt worry about it so much in this situation, especially if you want a visa :) Well you seem to want them to put all their trust in you at the time of your interview, maybe you should put some trust into them to grant you a visa to their country. Reason I was worried is that the workers at the embassy where she left her passport were all polish, non-english speaking, non-us citizens. Gotta use your

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary Filers - Makin' It To The NVC

Did you guys see the article in today's paper that said the U.S. is increasing immigration fees? The increases will take effect at the end of July. Here's the incredible part: "the cost of bringing a foreign fiance will jump to $455 from $170" and "the price tag for a green card, or permanent resident visa, will rise to $930 from $325, and the cost of citizenship papers will increase to $675 from $330." Cha-ching! Ouch! Why not pay more, we get such outstanding service from the CSC.

So if my fiancee is coming the end of June... She should file for her AOS before the end of July to avoid the new fee charge from $325 to $930? Sounds like I might make it for at least one of them, correct?

I'm still wondering if my fiancee needs the hardcopy NOA2 at her interview or not? I decided to mail her NOA1 just in case..? I did not see anywhere in the documentation from the Warsaw site or any checklist that the original NOA2 is needed. More is better... or less is more?

Ah.. I guess having everything available at the interview in the case that the CO asks for something specific you have everything ready to be showed.

It was dated May 16, 2007... and the information I got on the phone earlier this week they told me that on May 15, 2007 my case was sent to the embassy in Poland. The letter is a form letter stating that "...within a week the petition wil be forwarded to the appropriate visa-issuing post where your visa interview will take place." Then some info about my case, new case number, bar code, then where it will be processed, then a short statement stating that my fiancee will get a packet soon with some instructions from the embassy. K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary Filers - Makin' It To The NVC

hey guys!! NVC got my approval yesterday!!! I was gonna wait 3 weeks to call them, in fact i was gonna stay 3 weeks away from VJ because my fiancee said i was getting obsessed, but today i just couldnt resist and i read the last posts on this thread and i saw some of you made it to the NVC so i decided to call them, when the lady asked me CUAL ES EL NOMBRE DEL BENEFICIARIO?? I started to jump, and then she told me my approval it wasnt there anymore, they sent it out yesterday!!! I am getting very stressed I thought i would have at least 3 more months to prepare everything for the interview. btw do you have any idea of how long it takes from this point until i get the package 1?? i know every embassay is different, im just trying to get an idea.

Yea!!! Congrats! I know, wasn't it THE BEST when they asked for the beneficiary's name! I got all full of butterflies! And yes, suddenly it's all "uh-oh, get on those documents!" in our world!

Hey ppl.. I've been reading the posts and keeping up... just been a bit forum shy. Anyway, I had to respond to this one because today I called the NVC about my petition that was sent from CSC. It was soo funny, talking about butterflies... I was talking to my fiancee on the telephone when I called and she heard the woman ask what the beneficiary's birth date was and I said the wrong number for the month! I was so excited I could not put Aug and 8 together... instead I said 9. The woman must have thought I was a horrible fiance. So after a bit of silence and stutter on her part, she then asked me for my birth date which I remembered because I was already thinking what an idiot I was for saying 9 instead of 8. This only happens to me :)

Anyway... she said they got the petition from CSC on May 11. I hope they sent it out today to Warsaw.

Something else I should mention is that I did not get my NOA2 hard copy... and I believe that you are supposed to send the original notice of action to your fiancee for the interview. Maybe I am wrong... but I have yet to get mine and my NOA2 email said it was mailed on May 3rd. From my experience packages take at least 3 weeks to get to my fiancee in Latvia. And she lives in the country.. so add a day or two. I'm a bit worried she wont have my package of papers for the interview. Anyone from May 3 with their hard copy of NOA2?

K-1 Fiance(e) Visa Case Filing and Progress ReportsSo where are our paper NOA2's?

Iamjasonbunch, try to call CSC and see what they say.

I will call first thing Monday morning. The loser on the phone that I spoke with last week told me they were going to investigate into this issue, and I should go to my post office to see if they have any answers. So, today I went to my post office and I got the most rediculous look from the workers after they asked me if this letter was certified, or if it had any tracking number on it? Of course I answered no... but I wanted to at least do this so I can tell the terds at USCIS I did it when they ask me again. Hah... I forgot to mention their reaction... "You tell the government we do not HOLD mail, we DELIVER it."

You have a link to that post on how to call and get the operator on the line? I called and I get to a point where I say I have an approved petition, then it asks for my case number, then it says to stay on the line to go to the next step. At that point it rings and an operator picks up. Is this the same operator to bring up this glitch to?

I still have no NOA2 hardcopy.

I called USCIS and they told me the general questions like have you moved? no. Have you gone to your local post office and asked them if they have it? uh, ur kidding right? Anyway... then the representative told me I have a couple options. I could request a copy which would cost whatever hundreds of dollars, and that he can put a ticket to investigate this issue. I told him about VJ and how many of us have not gotten our hardcopy of NOA2. I swear these letters just sit in their mail rooms and leave whenever the mail boy decides to stamp them. Anyone have suggestions on how their experience went, and just about how long it should take to get this NOA2? I will refuse to pay even 5 dollars let alone over 100 dollars for a duplicate of the original one they never sent. Sounds like a scam if thats the case.

Well I was kinda with you on that one... I will still send it when I get it. But, today I just broke down and went to the post office and submitted all the paperwork. I decided my best option was Express Mail. 3-5 days and she will have it at only $39 dollars. If I get the NOA-2... I'll just have to copy it and send the original later. The NOA2 is not required for the interview. You can go ahead and send her what she does need (I-134 and supporting documentation) while waiting for the NOA2.

Hey! Thanks so much. Reason I was quite worried is that I read you needed to have the original NOA2 at the interview. I'll get my I-134 notarized today and make doubles of everything and submit my nice BIG notebook today that has all the papers, photos, boarding passes... everything!

Well... already two weeks after I got the e-mail saying, "On May 3, 2007, we mailed you a notice that we have approved ...."

So where are they? :clock: I am really worried because I know that my fiancee will have her interview in a month or so based on how the timeline is going (things are going quickly) and it can take 3 weeks to mail it to her. I guess I could use the $250 dollar FedEx or UPS or DHL service if it gets too close. It is also crappy because she lives out in the country, and basically her father knows someone at the post office in the closest town and she calls him whenever I send her something. So I don't even know if FedEx or whatever is an option. I wanted to use Global Express from the USPS which they say a 3-5 day in a perfect world... comes out to like 1 1/2 weeks in real-time.

Anyway. I'm all ears for that first person to shout that they have their NOA2 in hand.

Don't be nervous people... if you know your fiance(e), you love them, your past is clean... they already pretty much know their decision before they interview you. Our visa journey is almost finished... and it was all too easy. My fiancee said the interview was the easiest thing ever. They asked her 1 questions, "How did you meet your fiance?", and then said congrats! Here is a paper for tomorrow morning that you will bring and pick up your visa." She even mentioned to them when they took her papers, and affidavit of support if they were going to take the required documents it asked for... they replied... no don't worry about it... oh wait just your birth certificate. Oh well, guess some cases are more straight forward than others.

One upsetting thing I do have to mention is about my fiancee's interview buddy that she met there who spoke only russian from belarus. My fiancee said nobody spoke english there. Anyway, this young woman asked my fiancee.. "do you love your fiance?" A bit shocked about the question, my fiancee answers "umm of course!" Her response was... "I don't think I love him... I'll go to the states... see how it goes if I like it there or not... if things dont work out with my husband.. whatever I'll stay there." a few min later she returns to my fiancee after her interview and says... "could you believe they asked me if my fiance was ever married and I said no because he never told me he has. They said I was wrong and that he was married before." and then she continued to say... "I got my visa."

Hmm

So anyway... Part two of the journey will come soon with the AOS. I wish everyone luck with their interviews. If you have a clean background, and if you speak english (people were asking my fiancee if she was american), and you have the required documents, you have NOTHING to worry about. So for the people out there that were in my same boat, have a clean-cut case... don't sweat it! Now, if you have a past... especially a shaddy past, I am sure things might be a bit more difficult. I do have to admit, my fiancee said the interviewer was quite happy she didnt have to talk through a translator again. She said the interviewer had a huge white smile on her face.

Good luck everyone!

They have not posted the dates yet on the Warsaw page for June... but I have this strong sensation that it will be in late June as we requested to the Embassy on a phone call after they received our fax.

I am super impressed how the US Embassy in Warsaw has treated us. They are SUPER nice to us so far. Both my Fiancee and I have called and they have been nice and helpfullll to the two of us. Guess I just have to wait for the memorial day weekend to end to find out anything! :)

Well.. believe it or not.. I wrote that quote off of the Warsaw page in the Embassy section of VJ. And... after reading the Warsaw US Embassy web site and calling them on the phone and reading the checklist... Warsaw does require it. This reminds me kinda of a common occurance on here where people end up making rules up, and false claims to what needs to be done and what doesn't. I also keep leaning towards this idea of just following directions. Even though the directions have not been totalllly clear at times, the process is still pretty basic and has not caused any headaches for me thus far.

She will e-mail the forms tomorrow if they tell her that she did not get the fax when she calls. She is also going to try and get a little info on maybe getting a push for the july interview date. If she speaks as well as I do.. who knows?!

hehe

ALMOST THERE!

BTW,

I'd fax and email the forms for the packet 3.

Thanks a 'Bunch' again. hehe. Hey, here is some interesting information to others out there that I found in the 'Embassy Info' section in VisaJourney, here. Interesting enough... "What forms should be send back to the Consulate? Only checklist", then it goes on to explain the following:

(DS-230 is NOT required, this is a common misunderstanding, since the checklist is issued for both K1, K2, K3 and other visas. DS-230 is required for immigrant visas. K1 visa is not an immigrant visa)

And based on that "Packet 3 Contains: 1. checklist, 2. form used to receive police certificate"... so just the checklist I guess. Anyway, too much being sent is not a bad thing. I'll stick with lucho on this one.

So the interview is creeping around the corner! I can't believe we are already so close to this step. It has been nine months now since I have seen my fiancee. The wait is almost over. Is it safe to say when you book the flight for the interview in Poland, that it is kinda safe to at least reserve/book the flight to Miami? I strongly believe the my case is pretty cut and dry. And more and more that a simple case where no children are involved, or if you have never been married before, you do not need a lawyer. Doing things on your own is not hard. I do have to admit that if you do not have good organization skills, patience, or your are a bit illiterate... a lawyer might be a good idea. But for the simple fact that I, a well educated person with a university degree, cannot understand clearly what is being said on the checklist for the items to be returned... a lawyer who does this day and night might have helped. But, again... interview is coming... I feel it!

I am so happy to be here with many other folks in similar situations and being able to share our experiences to get through all this. Many of us are doing this alone and it is all possible for us to communicate and help one another because of the internet... and VisaJourney.com.

Good luck at the interviews!!

I am thinking I could be at the packet 3 stage by now because my fiancee has all the documents ready. I had a few unanswered questions maybe you might have seen in your process. The packet 3 from warsaw has a IV/F04(WRW-1) which is the checklist. Example form here...

My question is first. On top it says "Priority Date". Is that something that needs to be filled out by my fiancee? I am the petitioner and I cannot remember seeing this anywhere.

2nd question. I think you are only supposed to send back the check-list... without attachments. Right? Like no DS-230 Part 1, or what is that form OF-167, Evidence Which May be Presented to Meet the Public Charge Provision of the Law??? It is an enclosure... but I cannot find an example anyone on the embassy site what that form looks like. Then later you read in the checklist to just send back the checklist.

Sooo.. my final thoughts are... I believe in packet 3 you JUST send back the checklist to the embassy via e-mail. And I assume that when you found out that your case got to the embassy you decided to submit packet 3 to put the wheels in motion quicker... right?

You are the first to write here on this new milestone for Jan CSC filers , and I am interested in hearing what ya did :)

YAY! I called just now with those instructions and the woman was sooo polite, and immediately said "You did not get your approval notice right? I will have one resubmitted right away." Then I went to say my friends were the ones that informed me of this issue and to call, and she then said "You tell all the rest of your friends to call back the same you did so they can get their notice sent."

What was funny was when she said our computer systems are REALLY old. I lauged and wished her a great day. Thanks for the instructions!

These are the prompts we used:
* 1 for English,
* 2 for main menu,
* 2 for reporting an issue,
* 4 for more evidence,
* then 2, 1,
* then entered our case number (with the WAC at the beginning, that is 922+10 digits).
* then it took us to a representative in the service center.

I followed the instructions from above and I was able to talk to a live person. I hope you have success!!!

I will cross my fingers and try it tomorrow. I hope they are quite understanding, and not annnoyed that too many people are calling and nagging them.

I'm trying to find that instruction on how to call? I got an operator to get on the phone without having to say I have an RFE... is this a different operator? Please link that post or something for me and everyone else wondering how to call, or just explain it.

I usually called and press the option for petition that has been approved, then another, and then it tells me my status after putting my case number in, then it says something like 'to continue to the next step please wait' and then eventually I get an operator on the line. It is Option 1, 2, 3 then 2, 1, then case number, then option 1, then option 3. Is this the same?
