Hi everybody, I live in Monterrey and had the chance to fly in Vivaaerobus. It is incredibly cheap and even cheaper if you catch a promotion . But the planes are pretty old, they wont lean back and if you want any snack you can buy it in there. I think it is good for short distance trips for the time and $$ saved. Still it made me a little nervous when landing and departing and im ussually not scared of airplane flights.

Im about to start the process and dont know if it is better to file both I130 and I129F forms together or just the I130.

That´s true, we need to find out how to make our files transferred to CSC, mine hasn´t been even touch since NOA1, hope it doesnt mean it will be delayed =( , it´s already on time to be approved according to the USCIS site.

Well as I always says, it ´s complicated.

There is a detail, Im am mexican by naturalization, but my kid is not Mexican, she´s Peruvian, she has a peruvian passport. But we have been living in Mexico for 5 years now and she has the mexican migration document FM3 so she can be legally and able to study here in Mexico. Her father gave me the permission to move here with her and he also agreed to let her move to the US when we have to, but there is no document about letting her move to the US from him. He lives now in Spain and we havent seen him in years. He has very few contact with my kid ( bday´s n xmas).

So i was hopping i dont have ask for a miracle to get any permission or custody document from him. The good thing is that in the Migration document FM·3 from mexico that my kid has says that she has the permission to be with her mother ( me) and live with me while she is in Mexico. i hope that can apply to the US too.

K-3 Spouse Visa Process & ProceduresMarried in Bulgaria, I-130 sent sept.2008, still no answer... is it normal?

Something similar happened to us, but we had been tracking our progress and since we didnt get any response we called the USCIS and they said they didnt get anything . Then called the delivery company and we found out that a worker there was keeping the envelope lost ( or hidden) because they already opened it trying to get the money but since the check was to USCIS they couldnt cash it. So they just left it hidden. We talk to many people from the delivery company so the envelope could be delivered.

WE finally got or NOA1 in August 08. After we got our NOA1 Chicago office lost some our papers so we had to send them back . We made several calls, called everybody we could and USCIS sent an apologize letter for all the problems and promise to make it faster. We got and RFE last August 09, we already sent the docs requested and also we talk to our senator to make sure everything goes well. Now a year after we are still waiting but getting closer.

So you definitelly have to keep tracking , keep calling anyone that can help and bother anyone you can to make this happen.

VJ site is a really good source of what and when you should expect to get any news about your file.

why it took year and 6 months? i thought it takes no more than 6-8months?

I dont know why it took so long. first USCIS lost our I129F we sent it back like 3 times. Then it didnt touch our case for almost a year although my hubby called then a 100 times. Finally we got tired and contact the representative and they helped us. USCIS sent an apologize letter and asked for 2 RFC. We sent them and finally got our NOA2 for I130.

Hello everybody, Im so hapy we got the email with the NOA2 for I130 APPROVED!!! finally after 1 year 6 months of waiting. Now we are just waiting for the mail with the printed letter and the instructions.

Im happy for this approval but i was expecting to get news for my I129F too. I was going on the K·3 because I have an 11 yo daughter i want to bring with me and thought that the K3 was easier for me and her. I also put her name in my I130 and I129F so she can get the same status im getting.

So now what should I do? I guess if they cancel my I129F I will have to file a new I130 for her? or since I mention her in my I130 it will be enough? If i file another I130 how long it will be hers to be approved?? ( i hope its not another 1.5 years of waiting)

Please any advice will be appreciate.

You will have to file another I130 for each stepchild and pay all the fees.

Mi situation was similar, i was going on the K3 and my husband filed one I 130 and I 129F where i could include my daugther in the same document.

But I had to file another Ia130 for my daughter since the new February 2010 news:

Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:

The nonimmigrant K visa will be administratively closed.
The application process explained below will not be applicable and cannot be used.
The NVC will contact the petitioner and you with instructions for processing your IR-1 (or CR-1) immigrant visa. For more information on the immigrant visa process review the Immigrant Visa for a Spouse webpage.
If the NVC does not receive your I-130 petition and I-129F at the same time, the NVC will process your I-129F petition. Then NVC will send the petition to the embassy or consulate in the country where the marriage took place. If your marriage took place in the U.S., the NVC will send the petition to the embassy or consulate that issues visas in your country of nationality. If your marriage took place in a country that does not have an American embassy, or the embassy does not issue visas, the NVC will send your petition to the embassy or consulate that normally processes visas for citizens of that country.


So for K3 the children listed in the beneficiary´s I130 have derivative status with the K4, but on the CR1/IR1, the children listed on the beneficiary´s I130 don´t have derivative status and you have to file another I130 for each children. check http://travel.state....types_2991.html

About the children´s fathers name on Birth Certificate better ask USCIS and NVC, but I think with a letter explainig everything will be ok.

We also file the I130 with married name, and so far we havent had any problems. I sent copies of my passprt and birth certificate with single name and the i 130 with married name and i ve never heard somebody having a problem about it.

I will say this again: K-1 applicants do not need to wait for an appointment. We did not have an appointment. We simply showed our paperwork to the guard outside, and he escorted us to the door. We walked in, in front of everyone.

We waited for the forms to arrive, stayed in a Casa de Huespedes, and worked on our final details. We had questions, so I went to the Consulate, waited in the Information line for almost 4 hours, and once at the window, I asked my question. The man looked at me, and asked me if we had received our packet. I told him that we would wait for it in Juarez. He looked at me kind of funny "Why did you come so early, and without your packet?" So, I told him that while we would be waiting, we would just visit tourist areas, the Zoo and whatever. Have fun. He gave me an appointment card to come back the next day. After waiting in line, again, not knowing that with the appointment card that I could have just went to the front of the line, I waited for the same man to help me. He remembered me, and can you believe, he pulled our packet out of the packets that had beed there waitin to be sent. We filled out the information. Went to the bank and paid the Visa fees, went to the clinic, three days later, received the TB results, the computer disks and the physical results. Took all that to the Consulate. Interviewed that day, were approved, and received the Visas the very next day. We left one hour later, and on June 4th, we crossed the bridge into El Paso, Texas.

I do not know how everthing worked out like it did. Finally, I have a whole lot of information to share with anyone who needs it. So much more happened during this process, things that were frustrating, and otherwise. There were bitter moments, as well as sweet moments. We are marred now, and will file for their Resident Cards at the end of September. Thinks for reading.

Sheyla, and to everyone out there.

When our oldest son was born, because my wife did not want to declare who the father was, she simply gave him her two last names. However, with our second oldest, the father was still around, or at least promising to be there, but as soon as the baby was born, he took off, to return to his wife, if he ever left her at all. This here was our major problem. The father was absent, and to this day, I am the only father that our son knows. The paternal father, although during this entire process tried to get Abi back, was helpful, and we will appreciate his help forever. We hired a lawyer, and had documents drawn up giving my wife permission to travel, tend to his medical needs, tourism, and educational needs. There was no time limit placed on the document. But wait----when we fianlly went to get his passport in Hermosillo, we were told that the document was only good for 6 months. We returned, once again, and asked the paternal father for his help once again, and although it was difficult for him to leave work, he did so again. We signed new documents with the same lawyer. But wait----because we were treated poorly at the passport office in Hermosillo, we decided that when we got to Juarez, that we would take the risk of them telling us that we needed to obtain the passports in our hometown, and apply for the passports while we planned for our interview. We almost did not get the passport for our second son, because. lo and behold, the paternal father had renewed his identification, and the clerk who issued the new identification replace a Z with a S. We had to call again, the paternal father, have him go to Hermsosillo, fill out a OP-7, with his right name, and a second permission for our son to obtain his passport, and leave Mexico. We thought that we would never get it, but this was but one of our problems.

Abi, the kids and I had to travel by bus to Mexico City D. F. to obtain an origianl birth certificate. Not only did we arrive during a holiday, we were re-directed many times to different Registro Civiles (Civil Registry) each one a dead-end. We had left a copy of the origianal behind. This would have helped tremendously. We finally found the right Registro Civil, after 10 days of waiting, and were told that we would have to come back tomarrow. I gave the man $7 and Abi gave him 50 pesos, and he gave them to us right away. When we tried to get her pasport at the same time as the kids, we were told that Abi"s birth certificate was invalid because the man did not write in the year of her birth. They turned us away, after pleading with their supervisor. We went back home, and the "smart one" in the family just decided to write in the date, against my better judgement. He did it before I could stop him. The next day, Abi went back into the Passport office, and immediately they remembered us, and sent us away, knowing that the birth certificate had been doctored. However, since we decided to go to Juarez before receiving the welcoming packet, we did not have one problem, whatsoever.

Our third problem was that our youngest, who is also MY son, could not get his passport in Hermosillo, because I did not have a passport, and they informed me that I would be deported back to the United States, because, according to them, I was in Mexico, illegally. We had had problems obtaining a Consulate Birth Abroad certificate, and as of then, our youngest was still just considered to be Mexican. Once in Juarez, the passport office just sent me to El Paso to fill our a OP-7 giving her permission to obtain a passport for him, and afterwards, she had no problem.

We thought the nightmare would never end; we were stressed out to the max. We promised to pay our second oldest son's father the wages that he lost helping us, and also had help from Abi's brother driving the father to Hermosillo in our truck that we had left behind. (That's another story) One other note: because Abi did not have a high school diploma with her picture on it, she was only given a Passport for one year. Sssshhhhh

My girl from a previous marriage is from Peru but she has the FM3 migration documents in Mexico, because we both live in Mexico for some years now. Also last time i saw his father in a trip to Peru I make him gave me a Peruvian Notarized document allowing me to bring my girl back to Mexico and to the USA when ever we had to move. This was back in 2007. The Peruvian Notarized document does not say any expiration date.

In your experience, Do you think this document will help me as a custody document?

Im checking the list the of vaccines required for Ciudad Jaurez, but the list is pretty long.

Question: if i havent get any vaccines lately, do the medical in ciudad juarez make you get ALL the vaccines listed ???

I know i got in my country the mandatory government vaccines when i was a kid but i dont know where my kid´s vaccines records are now. Im pretty healthy but I know I will have to get some vaccines and I would like to go ahead and start getting the vaccines here so when i go to the medical check they wont make me get all the shots together ( ouch!)

Can anyone please share which vaccines the medical check in Ciudad Juarez usually make us get??
