Hi everyone,

I just received an email from the USCIS stating "On September 28, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E)." Can anyone tell me if this is this my NOA2?

I filed the I-129F ~Aug. 23 and my NOA-1 was issued on Aug. 25, so I was a little surprised by this email (seems early). The USCIS website has my case status as "Post Decision Activity" (it was in "Initial Review"). I'm a little worried that maybe I've just been denied or something, but both the website and the email state "approved" and I don't think there's a reason they would deny me. I haven't received anything in the mail yet (just got the email and text message tonight), so maybe it's just a glitch in their new website? I guess I'll cross my fingers for now.

The VSC has recently shifted a large number of its adjudicators to I-129fs to get "caught up"

Hopefully quite a few of us can ride this wave. Thanks for your thread.

Same here, just dropped off my I-129F in the post office downstairs. Can't wait!

We all needed a chuckle... This immigration process really stinks. I work at the place where laws are made, but I myself still have to go through this, a taste of my (our) own medicine maybe? Oh well, ya we needed this chuckle.

It's the same for us, we don't really email usually. We actually have been making an effort lately to write each other emails so we have a few to show (I dont think you need to bring 200 of them at the interview). I am also keeping emails exchanged between me and his mom or his brother.

I also send him cards oce in a while and he knows to keep them with the enveloppe...

Sorry, long day for me too. Thank you for the advice. I am going to start mailing her some Hallmark cards, once per week.

K-1 Fiance(e) Visa Process & ProceduresWell, we don't email each other
Hi everyone,

I have a question for you, me and my SO does not use email, we talk at least once a day (and we have phone record for it) and we primarily use MSN's video feature (I guess I can provide the chat log but there isn't much there). Would this be a problem to prove we have a real relationship?

Other than this, I think we are pretty good, I mean, both of us are native born Chinese (I am a neutralized USC), I have a 6-figure fed gov job, and we are similar in age, but this email record really bothers me, I mean, why write email while we can see each other at least 2 hours a day live and then talk for another hour? Please share you experience if you don't have a email record but get the visa regardless.

Thanks!

K-1 Fiance(e) Visa Process & ProceduresPetition filed by citizen by birth Vs. that of citizen by naturalization
Thank you for both of your quick responds, that eased me a bit. I read somewhere on this board (forgot which post) that a naturalized citizen's petition take more time because USCIS needs to pull the paperwork of the naturalization process from somewhere before continuing the petition.

Thanks again!

K-1 Fiance(e) Visa Process & ProceduresPetition filed by citizen by birth Vs. that of citizen by naturalization
Hello, I have a question for all of your seasoned VJers here: is there any difference, if any, in terms of processing time, between a petition filed by citizen by birth and a petition filed by a citizen by naturalization? I mean, is there additional steps for citizens by naturalization?

Beside the processing time, what else, if any, is different down the road?

Thank you very much for your insights and best wishes for all of us!

Depends on the clearance and where your other half is from. It has little affect on some . is an annoyance for others and causes you to lose others.

OK, thanks for the reply, but have you gone through this before, assuming you have a security clearance? I don't think I understand what you are trying to say, so let's use this example:

Petitioner has TS SSBI, and the other half is from China. Thanks again!

K-1 Fiance(e) Visa Process & ProceduresCase Specific Information Requests
QUOTE (Robert and Sun @ Nov 9 2009, 06:33 PM) <{POST_SNAPBACK}>
Okay, so I received my RFE letter today. The text and email claims it went out on the 3rd of Novemeber, but I'm just receiving it on the 9th. I guess even the mail moves more slowly when it's official government business. Alas. So back to the RFE. I feel really stupid. Apparently I forgot to answer Page 3 Part C. Other Information Question 2 of Form I-129F. All I had to do was indicate "no" and sign it. Wow. I checked my copy and sure enough - I didn't mark it. If they are able to end texts and emails I wish they'd sent me this letter as an attachment. I could've printed it out and mailed it the same day as opposed to having to wait a full week to get it in the mail. In other kick-myself-in-the-#### news, if I'd checked that box I would probably be receiving my NOA2 in the mail today instead of a freaking RFE. I did it to myself. I guess it's possible to be so caught up in the details that you actually miss one. At least it was an easy fix. I've updated my timeline to show that I mailed my RFE back today. The letter says I can expect to wait 14 days AFTER they receive it. Perhaps as long as 60 days. That doesn't seem to be the trend, but I am not known for my luck. ONWARD AND HOPEFULLY UPWARD!

Thanks for the update, though you have a RFE, but you are still much luckier than me, at least you heard something from them, I am still holding the dreaded NOA1 and cry myself to sleep every night. Keep us updated and wish all of us luck!

I didn't receive any texts or e-mails notifying me of the "touches"...

HOWEVER -

I did receive a text this morning telling me my case had been updated and it instructed me to get online for details. I was excited because I was certain it was NOA2 time. Guess what? IT WAS A FUGGIN' RFE!!! I packed that thing with everything they asked for and more. It makes no sense. Ugh. Now I have to wait for at least 3 to 4 days to get the notification in the mail so I can see what they mistakenly believe I'm missing. Fab. Oh well, even with the likely month-long delay this will cause I suppose I shouldn't complain. It seems to be going very fast. Neverthless, I call BUGGERY!!!

I am very sorry to hear about your RFE, but if I were you, when I receive a text message other than an "approval" message, I could draw a conclusion that it is nothing other than RFE, or anything that's not good. Again, sorry to hear about your RFE.

I filed in September and it looks like Igor's list is claiming that about 70% of us have been approved. Crazy. Me next, please?

Just curious as to how there is a touch on your petition-did you log on to the case status website and saw there is a "last update on the case date" (if so, you check your case status on a Sunday? good.gif I know I did.), or was it a SMS/email notification?

I'd love to know if they, (VSC) still have a ton of adjudicators working the K-1s trying to get caught up or if they've shifted back to other projects. Getting an NOA2 in 30 days would absolutely make my day. Actually, it's coming up on 30 days in another week, so we'll see.

As of Monday evening, yes. I do not know how long that will last. "Until they get caught up" I was told.

Hopefully USCIS will have the same numbers or more of adjudicators working on the K-1s, because, I don't know what do they really meant by "until they get caught up", does it mean reducing from the current 5-month to a 3-month, or 2-month, or 1-month, or virtually no waiting period, is considered "caught up"?

My NOA1 is 10/7, and I had seen other members got their NOA2 only 23 days from their NOA1, I wonder why. I refused to believe (naively) that VSC has drastically slowing down NOA2s (according to Igor's list, only 10 reported NOA2 this past week, compares to 37 a the week earlier), I am keeping the hope up.

IR-1 / CR-1 Spouse Visa Process & ProceduresStep son I-130?

Good morning. First of all, I am a US citizen by birth. My wife is in her home country and we are not adjusting status here in the US. My wife's CR-1 immigrant visa case is currently at the NVC stage, however we have decided to now start an I-130 for her son (my stepson) as well. Do we need to do this? Or can she simply utilize the follow to join benefits once she becomes a permanent resident? How does that application work? And would she be able to go back to her country and help her son (he is 8) at the embassy interview and then return to the US with him? I've done research on this but it's all so confusing to me. It just seems like a big time saver if we don't have to file another I-130 for him, if we can just wait a couple more months until she becomes a permanent resident. Thanks for all replies!

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp with embassy packets

I'm still learning all about the embassy part, and I don't see any guides like there were for the first 2 parts of the immigration process. Here is the situation: My wife is seeking a Cr-1 Visa in Panama. The case has just been expedited to the embassy and we are being told we will be contacted by them soon. What is packet 3 and 4? What will be needed for those? I read somewhere that packet 4 is used only for K-1, is that true? She already has most if not all the documents needed for the interview. She has original birth certificates from both of us, original marriage certificate, original police certificate, a passport, 2 color photos, the I-864, and DS-230 (our case was expedited so I know she will have to take these to the interview), and photos of us together. The only thing I can think of that she needs to get are her medical/immunization records for the medical appointment and pay for the IV packet at the embassy since we didn't pay for it at the NVC. Is there anything else that she will need? What will she need to do when she gets the Packet 3? I was under the assumption that she would bring all of these forms and certificates to the embassy on the day of the interview, not be mailed in prior. Obviously, since we have been expedited, I'm trying to be as prepared as possible so that when she gets packet 3 in the mail she can send it back within a day. Thanks for any reply!

You don't need deployment orders to get expedited. I was simply in my "window of deployment" and was granted an expedite due to the fact that if I do get orders it will be very short notice

Photos together that span from the beginning of the relationship to the present are good. I also included my life insurance policy on my wife, and the health insurance that I set up for her. I also used bank statements that showed I payed for trips together, and our wedding rings, etc. copies of letters/email traffic are good too. Affidavits are probably the weakest form of evidence, and I think others here will agree.
