I'm just asking other peoples experiences. Our petition has already been transferred from the NVC to Juarez on September 18th. Idk really what is next. My lawyer is out of town at the moment and I'm trying to make sure I have everything and I'm ready and prepared for whatever is next. I know I have to file a waiver, but Idk when. Do I have to file the waiver beige he can have an interview?

No I don't have anything yet. I know my lawyer sent off the waiver with the I-129f then he told me we have to resend it now. That's why I'm confused. It's already been over a year since we've seen each other and we have a two year old together. I don't want things to take that much longer.

He was here illegally before and returned to Mexico willingly. He was never deported or anything like that. But I was under the impression if he had been here illegally then we need to file the waiver

We just got our NOA2 notice at the end of September. The NVC gave me my case number and told me that they transferred it to the consulate in Juarez. And I'm not in Mexico with him. I'm trying to figure out when and where the waiver comes into play? I'm so confused.

My fiancé will be attending his interview next week on Wednesday. We will be needing to file a waiver. When they tell him that he needs to file a waiver will he be filing it right then if he has it, or do we have to wait? I'm just curious as to how this process works. We would like to file it right away because we will be prepared for it. And if we can file it right away should I bring a money order of the $585?? if anyone could please give me some information it would be greatly appreciated. I like to be overly prepared and kind of have an idea of what is coming.

one cannot file a waiver until interview the consulate denies

the visa but give U a paper to say U are approved to apply for

a waiver....its discretionary...no garantees.

Any criminal or prior immigration history, requires a good waiver

atty.all waivers requires atty. The atty has to argue the case in a

brief, many hardships shown and each waiver is $585.

Its taking 6-10 mths now for waiver decisions

 

He has been arrested before for domestic violence and all the charges were dropped and he attended all his classes. and he was also married before who had filed on his behalf and they never finished because they ended up getting divorced. We have a lawyer. but I'm still super worried about everything

It should not take that long to leave NVC... mine was received on Friday the 19th and left NVC to the consulate on Monday the 23rd... (the day yours arrived to NVC).... Please call NVC and get a case number just in case... find out on your embassy´s portal and see if they can give you that appt letter.... in my case, my fiance will get that letter from the window at the consulate.... I am not sure if it is the same in your case... Also, please check this site once you get that case number, it will give you updates on the case.... good luck!!!

1. What I have been using has been the first link you have.  the USC should have received the NOA2. Please call USCIS and ask them to send it that it was never received. YOu will need it later when adjusting status.

2. Yes it is.

K1 visas do not require vaccinations, but please be sure to have them handy with you as they will be needed when you are in the US for adjustment of status.  I am not sure about that kids' vaccines.

3. NO need.

4. No choice. Juarez is where these visas are processed. Please plan accordingly.  YOu need to have the medical done one or two days before the interview and remember you also need to have that famous letter that never arrived, which you can get from the consulate window that opens at 6:30am. The fingerprints can be done at another consulate. The system lets you choose the consulate where you want your fingerprints, but you do need to travel to Juarez for the interview. My fiancé and I are in the same situation. He lives in Puebla smile.png

5. The medical appt. is on a first come first served basis, if you completed your fingerprints in Guadalajara a week or two weeks before, you can go in the morning before the interview to get the letter from the window and the medical done and then next day the interview. I am not too familiar if these procedures vary because you are taking kids with you so maybe someone else can give you some more input but that's pretty much a general picture.  Good luck! The invitation letter gets you into the medical appointment which you have to do at least a day before your interview. The medical costs 190$. You will need the proof that you completed DS 160 for the ASC appointment. They will put a sticker on your DS160 to show that you completed ASC appointment. I needed 2 Passport sized photos, a copy of my last 2012 taxes, an original 134 Affidavit of support, an original Mexican birth certificate and obviously the passport. They asked her 4 questions. How long had she known me, did she have any tattoos, did she ever have any problems with the police, and when was the last time she was in USA. When you first get in the Embassy after the security check which they won't allow you the US citizen in they open the sealed medical paperwork which you brought which is sealed in black plastic. The person goes over it and then you go to the next station when they took the I 134 the DS160 and the tax return. They then sent her to the ASC center where she waited 20 minutes and they confirmed they had all the correct information. She then went back and was at another window and that's when they asked her to raise her hand and state she was going to tell the truth. The lady was African American and asked in Spanish if she wanted to speak Spanish or english. If he can have him do it in English she did and she thinks it went easier. They never asked for any proof of relationship or pictures or police certificate or check stubs or phone records, hotel receipts or any of that. The lady let her know it was approved and gave her a green slip of paper on how to get the DHL way bill number to track the visa. She was approved on the 23rd but as of today 11 days letter there is no way bill number yet I think because of the holiday. The embassy was 3 hours, her appointment was at 730 am, medical 2 hours, and the ASC appointment was about an hour.

Thank you so much! we are getting so nervous! he is flying into Juarez from mexico city sunday the 12th and I will be flying into el paso. I'm only going because I have done everything so I'm bringing everything and going to go over everything with him. I will also be paying everything. Monday I figured we would get up early and go get his medical. Tuesday he has his asc appointment then Wednesday the 15 is the interview. then Thursday go home. we know we will have to file a waiver. I'm just nervous about his medical because he has tattoos and I've heard some people give them a hard time.

I just had my appointment on December 23rd. I never received the invitation letter and neither did my fiancee in mexico. Just go to the window at the Juarez embassy to get the letter before you get your medical and ASC appointment. I got the letter in about 2 minutes. The line at the window is very short and either you or your fiancee can get the letter with your Jan 15 appointment confirmation printout.

 

 

The only thing that is mailed is the invitation letter stating they received your case and giving you the links to the instructions and websites you need. That is the letter that can be obtained from the information window at the consulate if you never receive it before you go to Juarez. Confirmation for filling out the DS-160, payment and interview appointment are to be printed out. Have him print out the email confirmation for the interview appointment.

Interesting news about your appointment.  Elizabeth was in Ciudad Juarez last August and they did not take appointments.  You had to get in line and wait your turn.  I talked to people who just recently were in Cuidad Juarez and the two authorized medical facilities were still not taking appointments...again you had to show up early and get in line.
