Hi all,

I got my NOA on the 6th of Feb and still no word or "touch" on my file. just the "initial review". I am a soon to be lawyer so I made sure I was extra thorough in the application for my honey, yet, its still taking a while.

The anxiety is killing me.

I need a hug.


Touches don't mean anything with regards to having the petition adjudicated. Many don't see any "touches" on their petition between the first NOA and until it's adjudicated. It's only been about two months for you, so you still have some time to go. Spend the time prepping for the next steps in the journey. It's just beginning! :thumbs:

We wouldn't have started the K1 process, yet. She will be in Costa Rica for two months before I begin the process, giving her enough time to go back to Taiwan for the interview portion.

So, what you are saying is, the K1 could interfere with her getting a B1, but if she already has a B1, there should be no issue with the K1 process?

It shouldn't... although sometimes people who are engaged to USC's are denied visitor visas, unless they have very good proof that they have to return back to their home country. Otherwise the US government often thinks that the fiance(e) actually plans to stay in the US and won't allow another visa. 

 

That said, holding another type of visa shouldn't affect the K1 process at all.

I will admit I haven't read all of this topic, but didn't someone post that one of the only 2 times s/he'd seen a successful waiver of meeting in person it was exactly your situation?

 

IE: the petitioner (in your case, your fiance in Florida) was bedridden and unable to travel.

 

Seems like you could definitely apply for a waiver. Go for it and good luck!

 

I was also momentarily worried that you wouldn't be able to marry if Florida didn't allow first cousin marriage. But it turns out it does so you're ok there.

There have been stories on here that suggest that even a "non-legally binding" ceremony can make the Customs officials think you are married, and therefore not eligible for a K1. Much better not to do anything that even has a whiff of "getting married" until you have your K1 and can do it in the US.

 

With the evidence as you presented in your first post, it seems likely that all will go forward without problems, so it's just a question of how fast the USCIS, NVC and your embassy are processing K1 applications at the moment... and I have no idea what that timeline is, sorry.

 

I hope your paperwork goes through in time!

I'm so glad VJ nipped these ####### in the bud after their first season.   The production company was back sniffing around the forums for fresh meat immediately after season 1 aired and they greenlit season 2 but VJ politely asked them to leave (More politely than I would have).  The show was deliberately misleading and did nothing but stigmatize an already misunderstood Visa.   This show did nothing but make the K1 visa process look like a free ticket for scammers and misanthrope victims which couldn't be further from the truth.  

 

As for the individual Kzeilu who is so thoroughly down on this process... well I can't speak to your life or the life of others, but I love my wife, she loves me and God willing that won't change.   I'm sorry for your negativity.

I think you definitely need a statement of how you met and the time you've spent together in the last two years, and how you came to decide to marry - a summary of your relationship, if you will.  This can be one document - in fact it's probably easier for USCIS if it is just one document.  In some ways, this is the core document - everything else is the evidence that supports it. 

 

I would include a few photos of you guys doing normal things (at a friend's birthday party, at a local restaurant, etc), and maybe skype logs or email logs (not necessarily the content of the emails) - it can't hurt and shows that there is an ongoing relationship even when you're not together.  Sounds like you have more evidence than most couples going through this process, so I wouldn't worry too much!

Just a little advice about obtaining your police certificates!!

 

It is a lengthy process....so fill out your forms and send them off as soon as you get your text from the USCIS that your NOA2 has been approved, if not before because its coming up to a month and i still have not got them back.

 

Here is my journey to obtain one!!

 

18 April - Received NOA2 acceptance 

19 April - I downloaded the forms and filled them out

20 April - Went to get passport photographs done 

26 April - I received my Photograph Endorsement form and photograph back 

27 April - Sent package off to ACRO Portsmouth 

30 April - ACRO received my package

13 May - Received email saying   "It will now be dealt with in accordance with the published guidelines" 

 

So i guess they still have to do their checks and admin stuff and then send me it in the usual snail mail here in the UK, so another 5 days and it will be exactly one month till i finally get my police certificate, that's if it gets here in the 5 days!! I sent an email this morning asking what the turn a round time would be but still waiting for a reply!!

 

I paid £45 fee for the standard service, which they state is 10 working day turnaround, not including dates of receipt or dispatch, but that's 2 weeks once they receive it, in my case i had to wait nearly 2 weeks before they even looked at it! with getting photo endorsed, sending and receiving it wont be short of a month. This is the only document i need before phoning for my medical and sending off the forms needed by the London Embassy!!

 

So my suggestion to everybody is you want the certificate sooner is pay the £80 for premier service and a 2 day turn around but that's only when they start processing it not for the whole process and i guess it also depends if you have a criminal record or not!!, which i dont smile.png

 

I will updateand let everyone know  when i actually get the certificate in my hands!!

I just got back from a visit to my fiance.  I went through US border control at Vancouver Airport.  I had copies of our NOA1, NOA2, i129 form, my current contract showing that I was contracted to work until October 2013, a copy of my mortgage statement, my travel insurance documentation covering only the period of my visit and of course a copy of my eTicket showing my return date.

 

The border control guard asked me the purpose of my visit, I said I was visiting my fiance for 2 weeks, and offered to get out my return ticket to show her.  She said "no, that's fine, just put your hand on the fingerprinter" and told me to have a good trip (which I did!).

 

(NB: suitcase photography is done at Vancouver - I only had a small bag in the hold, and a laptop bag and purse as carry on luggage)

 

I was actually a bit disappointed - I'd brought all this documentation and they didn't want to see it!

I'm not sure if this will be helpful, but I'd had one entry (before getting engaged) where the POE wasn't very pleasant. Thankfully I got let through and that was the trip my fiance had been planning on proposing as it turned out! Anyway, as I didn't want a repeat of it again I sent a few emails to the cbp and didn't get too much in the way of help, aside from one kind officer who sent me this scan of a letter and a checklist of things they like to see as ties to your home country. When I re-entered as a fiancee I printed it out and made sure I had one of most of the things on the list, or at least anything I could get hold of. As it turns out, I had all the evidence and got waved straight through, but I thought I'd upload it in case it helps anybody else! It's reassuring to see what they are looking for :)

Short answer: It varies. 

 

In my now-husband's case, he received the passport and "do not open" package back a week after the interview.

 

But, it depends on when the embassy completes their processing of the paperwork and actually issues the visa. If there's an extended "administrative processing" timeframe, then it could be a while. But, once it's released to DX for delivery, you can pay extra to have it delivered before noon, for example. However, there was a recent post in the UK forum where someone paid for early delivery and they were late, so YMMV.

We received our approval letter for our I-129F on May 9th. I called the NVC today and they have not received any information or documents from the CSC. The NVC instructed me to scan and send them my approval letter in an email. Is this common? Does this mean there could be a problem?

 

 

 

This happened to me as well. It seems our approved petition was sitting in the CSC mailroom waiting for enough to be accumulated before they mailed a package to NVC. It took about four weeks from approval of the petition to it being delivered to the NVC.

Hi,
I am filling out my I-134 for my fiancé for his interview coming up, and had a couple questions. My mom is being a co-sponsor so she is filling one out as well.
1. When it asks who is dependent on her for support, she will put me and my sister but will she put wholly or partially dependent if my dad gives her child support?
2. When it asks how much she has in savings in the bank, will this look bad if she puts $0? All of her money goes into her checking account and she uses a lot of it to pay bills and she likes to take cash out leaving her money in the bank low. Will they be suspicious of this?
3. I am currently unemployed but am also filling out an I-134, when it asks if you intend to make contributions to support the person, should I say something like I intend to support him when I am employed? Or I could say he can use my car or something? We will be living with my mom for the first few months until everything gets sorted and we can then both look for jobs, so I can't even put I can provide board for him.
His interview will be in London.

For London, you'll only need the I-134 and supporting documentation from the co-sponsor. You don't have to submit one at all. If your mother's income is enough per the poverty guidelines (assuming it's mother, sister, your fiancé, then it's $24,412), she doesn't have to fill in the banking portion of the form at all. She'll just need to provide proof -- paystubs, tax transcript, etc. Your sister would be listed as wholly dependent. Good luck!

It's in the instructions for the I-129F petition...see page 2, section 5. The K-1 is for unmarried couples. By getting married, one is no longer eligible for the K-1 visa. It's one of the reasons you have to submit a letter of intent stating you're free to marry.

Im already in the country on the visa waiver. At the port of entry I had no intent to marry during this trip, I naively thought the visa would come through in time and that I would go back to the UK then re-enter on the K1. They questioned me at port of entry and were satisfied.

Does anyone actually know of anyone who has been denied the K1 on the grounds of already being married, when there has been no legally binding event or record to point to? In my mind I would just argue that I haven't had a marriage yet, and that I plan to when I enter the USA. Which would all be true.

Neither me or my fiance will be on FB during my interview. The only reason I'm asking is (and I'm sure it happens to many others) that many family and friends have already booked flights, booked time off work etc to make the ecclesiastical ceremony. It would cost a lot to postpone the wedding. When we filed, we had advice it would take 5/6 months, but it's more like 8/9 months.


You're right, it has happened to many others, which is why the VJ K-1 forum mantra is: Don't make plans until the visa is in your hands!

I'm not sure where you got the advice on how long it would take to get the actual visa, but 5-6 months is way off. It takes on average that long (and longer it seems from recent posts) to get the I-129F petition approved. Then, it's another 2 1/2-3 months to get an interview with London.

I would highly suggest contacting the vendors and seeing if they can postpone to a future date that's far in the future. Or, follow my other post upthread and ditch the K-1 path and go for the spousal visa.

Is it okay to have an ecclesiastical (Church) wedding ceremony in the USA on the VWP visitors visa before the K1 visa has been processed? What are the risks involved at the consulate interview? Will this cause problems when I go for AOS?


While going through London is one of the easier consulates/embassies, anything that resembles a wedding really should be avoided until you have the K-1 visa in hand and you're in the U.S. And the fact that you're calling it a wedding could lead to issues. There are more than a few cases of VJers who did a ceremony that was very wedding-like (or had relatives with public Facebook profiles calling it a wedding) and were denied visas because they couldn't prove they really weren't married.

Either dump the I-129F petition process, get really married, file the I-130 petition for a CR-1 visa and then go home and wait or skip the faux wedding altogether and continue on the path to a K-1 visa.

Oh god. What did I do? I just sent the I-129F packet yesterday, and now that im reading the K-1 timeline, I think I made a big mistake. On the Embassy&Consulate portion of the form, I used the Edinburgh consulate (My fiance lives in Scotland) and I think I should have put London?? Does anyone know which is correct? And if its wrong, how do I fix it? Im freaking out!

Originally we were going to decide on a date as soon as we got our NOA2 but after reading this im thinking I may wait until the interview is scheduled before we decide a date. Leaving it till Visa in Hand is way too late and wed rather run the risk of having to move it than have 99% of the the UK family not be able to come because its too late notice

 

In most cases, you have six months to enter the U.S. before the K-1 expires. Then, once you enter the U.S., you have 90 days to wed.

 

I get that most people want to hurry and enter the U.S. as soon as possible, but if having a big wedding is that important, then delay when you enter to make the plans rather than risk having to lose money if the visa doesn't arrive in time. You're dealing with the federal government and in most cases, they work on their own schedule.

Yes, the acceptance of co-sponsors and/or self-sponsors for the I-134 can vary by consulate. You should fill in your profile and choose Germany for your country so it gets the attention of those who have experience going through that consulate. Once the petition reaches the consulate stage, what's accepted -- or not -- can vary greatly. Good luck!

So this question just came up because my fiancé and I were certain that we could. But I just read on other posts that joint sponsors are not accepted by every consulate (what exactly does that mean, or rather how do I find out which ones do?) and then others that say joint sponsors are only accepted in special cases(ok so what is that supposed to mean now) and at last that joint sponsors are pretty much never accepted.
People advise to just try to file the affidavit without the joint sponsor and just try to make it on our own, which is, I'm sorry but absolutely not helpful, because if we thought it goes through, well then we wouldn't need a joint sponsor in the first place. Or the advise to just get a better paid job, well that doesn't help me either.
It's not like my fiancé has no income, but his work is seasonal and well, he doesn't make a fortune. He is 20, so am I, therefore his assets are limite and I highly doubt his support form goes through.
His mom is our joint sponsor, she absolutely matches the requirements, but i'm just really really worried now. I'm a German citizen and would go the consulate in Frankfurt.
Can anyone help me at all? Give me any advise on this? Any experience, please, everything is appreciated : )

Didopage brings up some great points for you to consider. There are so many stories posted in the "Effects of Major Family Changes on Immigration Benefits" of couples rushing into a relationship only to have it turn sour because they don't know one another.

Again, not saying that any of those situations will happen to you, but both parties should be 100+% certain they want to marry one another and it sounds as if you're not there yet. Because she would be dependent upon you financially for a while until she's authorized to work in the U.S., be absolutely certain you're ready to take that on.

Hi everyone! A quick update. We are still figuring things out but it sounds like she doesn't want to go the k1 visa route. Her reasoning is because it'll be hard for her to find a job, a place to stay (her parents place is very small and doesn't seem like an option) and is a little worried of distance hurting our relationship. This all makes sense. I guess I didn't take into account of her situation back in the Ukraine as she doesn't have much saved up. A k1 is still on the table but as a last resort I guess. Her main thing is that she is already here and it seems more costly to go back to her country, then back again later. If she overstays, she wouldn't be able to work in the US or get a valid driver's license if I'm not mistaken correct?

My question is, is there another route we can take aside from getting married literally in less than a month, without her overstaying her j1 of course. My main issue is that i personally like to take my time and don't want to feel like we rushed into a marriage a year or two down the road because we were pressed for time, but at the same time I don't want to prolong her from actually having a life out here. It seems the faster we get married the better it is for her, so she can get a job etc. She made two good points that we can always have an official wedding with friends/family at the end of the year like i initially wanted, it's just the paperwork that is important. Also, she brought up the fact that she doesn't care how the USCIS views a "rushed marriage" so close to her j1 expiring, since it is real and believes there isn't nothing they can really do because they would not find anything to prove it was a sham, which is true (we have plenty of pics, some old restaurant and movie receipts etc.).

I guess it comes down to me wondering why there isn't a type of visa that allows you to remain in the US longer when something like a j1 expires and there are no other options. Like a k1 would be perfect for our situation I think if it didn't require her to go to the Ukraine and she could stay here during that process. At the end of the day, I just want the process smooth and unrushed; wanted to enjoy being engaged, having a bachelorette/bachelor party for each of us and all the joys leading up to an actual wedding like her showing off a ring and me introducing her to people that have never met her due to distance etc. It would be ideal if they allowed us to be fiances/engaged while she is already here and file for a future marriage in the year. I just want to get us a few more months for both of us to really make sure we are both ready for this type of commitment.

Unfortunately, no such option exists. If it did, many of us would have used such a path to have our loved ones remain in the country. Whatever you decide, it shouldn't involve your fiancée overstaying her visa. If you're not ready to get married before her visa expires, then it would be best for her to return home.

In addition to the K-1 link I posted upthread, also read through the comparison chart on the options available. There's the K-1 fiancé or the IR-1/CR-1 for spouses. There are pros and cons, so you would need to decide which is the best option for the two of you, however, all involve some separation as she would need to return home for the medical exam and interview.

Thanks! Yeah sounds like you were in a similar situation. I'm not too concerned with being away for a short period of time (3 months or so would be my max I can tolerate). I can travel a lot due to a flexible job and a million travel miles, so I can always visit her once a month back in the Ukraine. I'm glad to here of another person's situation working out well. Ideally, I'd like to wait to the end of the year to get married, maybe around the holidays so we can have close family and friends attend rather than go to city hall or even Vegas haha. Do you have any knowledge if waiting a few months will hurt her chances to remain in the US? She officially expires in July, so it's either take a leap of faith and get married before then or wait 5 months and fill out papers right away soon after. This is the route I want to go personally but not at the risk of us losing each other. Good luck to you too, hope the marriage works out!


A head's up, the petition process for the K-1 visa takes a lot longer than three months. If you decide to go the K-1 route, first you would submit the I-129F petition. One thing, encouraging someone to stay beyond their visa is a huge risk that could lead to an even longer period of separation. If you're not ready to get married now and decide to go the K-1 route, then she will have to go home before her visa expires. Any plans for a holiday wedding, etc. would likely be off the table at this point as well.

Thanks a lot. Yes the wedding would be in Disney World. On that site, right under where it says both male and female must be 18, it says if a minor is 16 or 17 they can apply with parental consent. Does that still count as free to marry? I've read on I-129F instructions that if any person has age restrictions for marriage to provide required documents to show they are allowed to marry, so if I get my parents to both write notarized statements, would that be ok?

I live in Missouri, and the law to get married here is if you are under 18, you must have parental consent, which I do. Would I still have to go to a county clerk to get a letter? Also, I'm getting Married in Florida, does that make a difference?


If you're securing the marriage license in Florida, you would need to check with the county in which the wedding is taking place. I believe you said in another thread that you were getting married at Disney World, correct? On the age, it would likely depend on where you live as that would determine if you're free to marry. Check your state's marriage requirements to be sure.

It's hard to say. I hear that they prefer it if you're home for at least as long as you were in the US before trying to come back, but it seems to be a little hard to predict.  Because she doesn't have a job, or school, or a lease, it's hard to prove ties to home (and a pressing reason for her to return at the end of her visit) so she might be denied. Which shouldn't affect the K-1 but would affect your pocketbooks if she's already bought a ticket. 

I've been in and out of the US a couple of times since applying for our CR-1 visa (we're already married) and haven't had any troubles; we have a history of going for short visits to his parents or just on holidays (our honeymoon was in Arizona) and I've never been denied or overstayed what I told them or anything, so I'm sure that helps a bit. 

But you can never be sure. Just try to have as much evidence as possible that she plans to return, and that you're trying to do everything "properly" and hope for the best. 

It may be, eventually, that you will have to find the time to visit her, if they won't let her come to you.

As long as you have an up to date vaccination record they shouldn't make you do the shots again. It won't work if you just tell them, since you could be lying to avoid getting vaccinated.

 

I think if you have the list and you know what you're missing it shouldn't be a problem to get the shots before, and it'll most likely be cheaper. For instance, in Canada flu shots are free if you get them from your own doctor or clinic, but they'll charge you for it if you have to do it at the same time as the medical.

I make well over 125% of the poverty guideline for 1 or 2 persons, but only because I am a tipped employee. The problem is that my tips are not shown in my pay stubs but rather in a separate sheet that I need to report them myself. In order for the USCIS to consider income, assets - do those tips need to be reported and taxed for them to count them as income?

 

I would imagine that in order for your tips to be counted as income, they would have to be reported on your taxes. If you've been underreporting them (and believe me, I'm not judging) and not paying tax on them, now would be a pretty crappy time for the government to figure it out. Either report them and qualify on your own or get a joint sponsor, IMO.
