Our case is a little more complex.
The children were born in the UK, the Dad is British but we never got married.
The kids automatically took my nationality as we weren't married and I found out that I had the full custody of the children though his name was on their birth certificates.
Although they have his surname, he doesn't contact them, has never paid any child maintenance or anything.
When we separated we did not go through lawyers as we had nothing to share and he was happy with me keeping the children.
I ll write a letter explaining the full custody situation and another one explaining that my husband (the USC) will be and has been the sole financial provider since our marriage 2.5 years ago and get them notarized.
Hopefully it is not going to cause a problem!

Hello all,
Our family is in the process of applying for IR1 visas and a question just came to mind.
My husband is the USC, I'm French and have 2 children from a previous relationship ( I never married the kids' dad).
I separated from the children's Dad nearly 7 years ago now. As we werent married we agreed consently that I would have 100% of the children's care.
To complicate it all, the children were born in the UK but the Dad refused to give them British nationality so they took my French nationality.
Since then, the children are not in contact with their Dad (though his name appears on their birth certificates).
Being 100 % responsible for the children, would I need a letter from their biological father even though he hasn t been in contact for years?
We don t even know where he lives exactly.

I knew I as IR-1 but I thought that maybe IR-1s would be a little quicker as by living together for over 2 years without attempting to get a green card could prove that I did not get married 'just for the GC'.

I got married whilst on an ESTA in June 2010, and left within the 90 day limit.
I had no problems though the following time we visited the US, the customs asked me a lot of questions about my previous stay, hard to answer after travelling for 18 hrs :)
I wouldn't risk staying over the 90 day limit if I were you!

I know it's a little early but I feel that I need to get all the documentation ready for the NVC as I'm waiting for our NOA2.
I have a few questions: do the birth and police certificates need to be ni less than 3 months old?
Do they also need to be translated?
I read on VJ that there is no need to, however, I wouldn't want to be delayed if I were to omit such thing.
Also, with regards to the I864s, both my mother and father in laws are co-sponsors. Do I need original letters from their employment and pension, or will copies suffice?
Do we also need original payslips or will copies suffice?

Sure you can have a letter of employment in the US. Usually the HR of the company know what it is and can give you one quickly (my husband's one was called "verification of employment" letter). If the HR of your mother-in-law is not familiar with it, she can just explain to them simply that she needs a signed letter stating her position, current salary, if she's full-time or part-time.

No need to list all the assets on the I-864. If the income is well above the 125% mark, that's enough for the USCIS. They don't care of all the assets someone can have.

Good morning all!

I have a question regarding the I864s for our IR1 applications.
My husband is sponsoring myself and my 2 children, as well as my mither in law and my father in law (who are divorced).
I underhstand that all 3 of them need to provide the last 3 years W2s, howerver:
- whilst living with us in the UK, he earned under $19000 each year for 2011 and 2012 so wasn't required to file taxes for those years. He is planning to send a letter explaining the matter along with a copy of his payslips confirming the amount he earned. Would that be sufficient, bearing in mind that we were living in the UK? Would we need any other documentation?

He now has a job in the States which is just below the 125% required so his parents are acting as separate co-sponsors.

- my mother in law is a special needs teacher and earns well above the 125% mark. However, my husband keeps on re-iterating me that you can not get an employment letter in the States, can anyone help me with that? Has anyone ever been in the position where the company they worked for did NOT want to provide such letter?

- my father in law is pretired with a VERY comfortable pension, hence why he wants to act as a co- sponsor also. What kind of documentation would be required to support the amount of pension he gets? We have a letter confirming his UT State pension and another confirming his Federal pension, would that be enough?
Also, he is being reluctant at listing his assets on the I864, could this be a problem?

One of the problems with an expedite request is that the field offices don't seem to know what to do with them. I haven't seen anyone's expedite request go through at a field office since the change on August 15th. That isn't to say that it can't happen, but I'm unaware of any cases. I used the case of my USC daughter's mental health and mine and a variety of other reasons and while my expedite was not denied, it was also not looked at and bounced from NBC to Hartford to VSC and back to Hartford. We also had a senator on our side and still they seemed unable to even look at the expedite.

I think you should try the expedite request, but just don't get your hopes up.

What kind of documentation did you have to provide for the expedite? I can get statements from his teacher, headteacher, doctor, paedopshychiatrist!

Of course there is- once she has NOA1 she (or rather, the USC husband should do it) can contact USCIS and request the expedite.
I have a son with moderate, non-verbal autism myself so In know how hard it is. That being said, I am not sure you qualify for expedite as it was your husband's choice to move back, plus the child is not a USC/ your husband's biological child. Still, you have little to loose. Get some letters from your son's therapists and teachers to support your claims, if you had to increase any meds he takes, show that etc.

I'm going to get his teachers and peadopsychiatrist to write statements about it. He isn't on medication but the fact that his teachers asked me to file for a teaching assistant for him and knowing full well that this would only make him more dependent on others really raised alarm bells.
His teachers really struggle to cope with him, he attends a small countryside school and all I hear from his teachers are 'we don't have enough time to focus on him'.
i know he has a lot of capacities (his cognitive skills are well above his fellow students as said by his teachers), it is simply the fact that he can not focus on one thing and has what they call 'temper tantrums'.
At home he's now become more introvert and hardle chats to anyone.

I just emailed our local US consular and I'm expecting him to contact me either today or tomorrow.

I don't know the exact details of the procedure of the US Embassy in France so I cannot advise you how to proceed. You can try checking on the US Embassy in France first to see if there is any saying like this. For example, this is for the US Embassy in Singapore, where my wife and I are staying:

So basically, after you contact the US Embassy in France and explain your situation in details, the US Embassy will contact USCIS and takes over from there. I am sure once this happens, your case will be much expedited compared to normal process. It can take less than 1 month depending on how bad the medical condition of your son is.

There is still some hope for you but it's better that you act fast, before the USCIS starts processing your application.

If you filed through Chicago Lockbox, there's no way to expedite your application. The best way is to contact the US Embassy in France and ask whether you can do a Direct Consular Filing. On the USCIS website, it says that the US Embassy will accept the I-130 in the case of medical emergency. I am sure that's your best hope.

Sorry to hear about your son. Hope that you can get somebody to help you at the US Embassy.

Good morning all,

I need some help with regards to requesting to expedite our applications. We are filing for my 2 children and myself, my husband is the USC and he went back to theUS the day we sent our applications so he could start working.
My son who is 8 has Asperger s Syndrome, which is a condition on the autistic spectrum. Unfortunately he is really struggling with the separation and his autism has worsened and the teachers at his school are really struggling with him now.
So I m thinking of requesting to expedite our applications.
1- Do you think our request would be accepted?
2- can anyone show me how to expedite it and what happens?

Our PD is 02/08, it has now been 40 days and we still haven t heard anything yet, not even accessing our cases online.

Did your husband use his foreign address on all the forms? It says that you applied at the Phoenix Lockbox, USC residing abroad apply at Chicago. They do deny the existence of the "auto-expedite" thing, but it does exist.

I think if you talk to a different ISO, that you will get different information for sure. Yes you could have adjusted status in 2010, but if you weren't intending on living in the US at the time why would you?


That s exactly my point! We would have filed for a fiancé visa had we wanted to stay in the States! I don t think we should have amended our status there and then as we immediately applied for a visa for my husband to live in the UK with us!
That s exactly what my husband will do Thursday: talk to a different ISO and hear a completely different story! :)

After having been told by a USCIS officer last week that our case would be online by Monday, well it isn't! What a shock :)
My husband waited on the line for well over an hour to speak to a Tier 2 yesterday who told him that our case was being investigated by the National Visa Centre and that they were checking my criminal background (first red flag: how can the NVC check it when it's not even been approved)
Then the Tier 2 told him that by now our case should be in the Paris Embassy and he was just going to check it in his databse (second red flag: he hadn t even looked into our case to say that it was being investigated).
He then said that when he opened it 2 red flags came up: one he asked lots of questions to know why I had spent 14 years of my life in the UK, which seems to be a concern for them (well, we re in the EEC and free to live inany European nation!) so apparently there ll be some delay as they need to check my criminal records there too (I have all the documentation ready for the NVC).
Secondly, when we got married in 2010, I came to the States on a NWP visa as we stayed just under 3 months and fully intended to return to the UK where I was studying with my husband. The Tier 2 told him that we should have applied for an AOS for the foreign spouse of a US citizen with intent of residing abroad - has anyone heard of this status or is it a load of rubbish? 3 Embassies were notified of our marriage (French on in San Francisco and in London, and US one in London), and no one advised us of this AOS...
Finally, my husband mentioned the autoexpedite cases for the USCs living abroad to which he was replied that it did not exist and that they were in the queue like everyone else.

Consequences? Our case will apparently be delayed for 4 months because pf those red flags, despite our son s autism getting worse.
Next step? We are writing to our Senator (we have contacts) to see if he can do something and get clear info.

The USCIS line truly makes its nickname of "misinformation line" proud! My husband shall be calling again on Thursday to see if he gets the same information.

Good thing that we re going to visit him in 3 week s time, so at least we MAY be able to get somewhere.
We got our I797 from them, certain people people advised me to request for an expedite now due to the problems we are facing (my son has autism and his behaviour has dramatically changed since my husband's departure, to the point where the teachers are giving up on him). We can always try the expedite, I know its acceptance is not guaranteed but we ll see!

So I just called the 1 800 number to reach the USCIS and request an expedite for our applications on medical ground.
I am the beneficiary, my husband is the petitionner.
Whilst on the phone, I was advised that each time I ll call I will need to have the petitioner on the line with me, else they can not confirm anything to me (though I am in the file).
My husband is 5000 miles away and can not call during the day as he works.
How has anyone got round this? Any tips and advice?
Im calling the USCIS from a landline and can not make conference calls, how do you guys do?

I encountered no issues at POE when traveling with my husband (USC) to the USA. We filed I-130 and three weeks later had a trip planned to see family. Although my husband had a copy of his orders confirming residence in Germany, the Immigration Officer did not want to see it, nor did not ask any unusual questions other than the purpose of the trip and how long we were staying in the US.


I entered the US yesterday whilst our applications are going through.
The Immigration Officer found it strange that my husband had returned to live in the US without us (he couldn't get a job in France) so i explained that we had IR1s applications going through.
All he wanted to see was a copy of our return tickets which I showed him and off we went! :)

Yes you need a package of everything for each person. The only thing that will be single is the AOS bill. You will only have to pay that once. I'm unsure on the documents you need for each case but I'm sure there is someone who can help you with that since many families move together.

I am in the same case, also filing for my 8 and 10 year old children.
I am going to send an original birth certificate (long version) for both as well as 2 passport pictures each.
Because they are under 16 years old we do not need to provide a PCC.
I am going to complete an I-864 for each of us as well as a D230.
I will contact NVC tomorrow to find out whether I can sign on their behalf or whether they should.

Sending the ds3032 will not affect your AOS invoice but it will for your IV package.
I received my IINs last Monday, was able to log on Thursday, but only 2 cas out of 3 are linked. So I ve got to wait longer until all this is solved!

We're getting everything ready to send off for the DS-230 for my children (aged 8 and 10) and obviously want to avoid RFEs.

We're planning on sending the following for each child:

 

 

- Two (2) Passport Size Photographs of Beneficiary (NVC Case Number, beneficiary?s full name, and date of birth are written on back of both)
- DS-230 Part 1 completed and signed by the mother of the beneficiary (who is aged 10)
- DS-230 Part 2 completed by the mother of the beneficiary (who is aged 10) ? unsigned, as of yet, per instructions
- Photocopy of the Biographic Data Page(s) of Beneficiary?s Passport
- Photocopy of Marriage Certificate between the beneficiary?s mother and the petitioner
- Original Birth Certificate of beneficiary and a copy

Yes! Do it!
We paid on the Friday, I sent the IV package on the Monday, payment status changed to 'PAID' the day the package arrived. However, after 8 days, the NVC still hasn t reviewed it so it doesn't appear on their system yet. So you re good to go :)
